I. Call to Order

Following the welcome, Pledge of Allegiance, and introductions, President David G. Perry called the meeting of the West Virginia Board of Education (WVBE) to order at 10:02 a.m. on August 8, 2018, in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia.

The following members were present: President Perry, Vice President Miller L. Hall, Thomas W. Campbell, F. Scott Rotruck, Debra K. Sullivan, Francis S. Vitale (via telephone), Joseph A. Wallace (via telephone), and James S. Wilson, and ex officios Steven L. Paine, State Superintendent of Schools, and Carolyn Long, Interim Chancellor, West Virginia Higher Education Policy Commission. Member absent was ex officio Sarah Armstrong Tucker, Chancellor, West Virginia Council for Community and Technical College Education.

II. Delegations

Mr. Fred Martin, resident of Mercer County, addressed the Board regarding the teaching of reading and bullying/harassment of students in Mercer County Schools. Mr. Charles Bryan Daugherty (provided remarks for attachment to the minutes), teacher, Ritchie County High School, addressed the Board regarding school counseling services. Mr. Randall Patterson, resident of Fayette County, thanked the Board and Department for the new direction and good work being experienced under the current Board and Department administration. III. Approval of Agenda

President Perry called for a motion to approve the agenda. Mr. Hall moved, and Mrs. Sullivan seconded, that the agenda be approved. Upon the call for the question the motion was carried unanimously.

IV. Remarks from Stakeholder Organizations

Ms. Christine Campbell, American Federation of Teachers-West Virginia, and Ms. Susan Collins, West Virginia Association of School Administrators, thanked the Board for offering the opportunity to stakeholders to speak at WVBE meetings; Ms. Janelle Sperry, West Virginia Parent Teacher Association, provided historical information regarding the Parent Teacher Association; and, Mr. David Gladkosky, West Virginia Professional Educators (WVPE), provided an overview of the WVPE and its membership.

V. Voices from the Field

Chancellor Long provided brief remarks stating that she looks forward to working with the Board and Department to improve the education of all students.

Mr. Jim Harris, Marshall University, presented information regarding Marshall University’s West Virginia Behavior/Mental Health Technical Assistance Center and Project AWARE. (PowerPoint attached to Official Minutes, Attachment R.)

VI. Consent Agenda

Mr. Hall moved, and Mr. Campbell seconded, that the Consent Agenda be approved. Mrs. Sullivan requested and received clarification regarding the waiver request. Upon the call for the question the Consent Agenda was unanimously approved. (Copies appended to Official Minutes, Attachments A through H.)

• Received West Virginia Department of Education (WVDE) personnel matters (Attachment B)

• Approved eleven requests for waivers of Policy 2445.40, Groupings for Early Childhood Education, Middle Childhood Education, and Adolescent Education: Cabell County - adoption Mathematics materials for grades K-5 published by Curriculum Associates; Calhoun County – adoption of Mathematics materials for grades K-5 published by Curriculum Associates; Jackson County – adoption of Mathematics materials for grades K-8 published by Curriculum Associates; Marion County adoption of Mathematics materials for Trig/PreCalculus published by McGraw-Hill: Pocahontas County (three waivers) – adoption of Mathematics materials for Math I, II, and III published by Mathematics Vision Project; Monongalia County – adoption of Mathematics materials for grades K-5 published by Curriculum Associates; Tyler County – adoption of Mathematics materials for grades K-5 published by Curriculum Associates; and Wood County (two waivers) – adoption of Mathematics materials for grades K-5 and 6-8 published by Curriculum Associates (Attachment C)

• Employment of Substitute Teachers in Areas of Critical Need and Shortage policies for Boone, Fayette, Gilmer, Lincoln, Logan, Mineral, Monongalia, Raleigh, Upshur, and Wetzel County Schools (Attachment D)

• Amendment/Facility Improvement - Calhoun County Board of Education Comprehensive Educational Facilities Plan (CEFP) to include “man traps” at Pleasant Hill Elementary School and Calhoun County Middle/High School, and a visitor management system for the county’s three schools (Attachment E)

• Amendment/Facility Improvement - Mineral County Board of Education CEFP to include the addition of modular classroom at Wiley Ford Primary School (Attachment F)

• Concord University’s Teacher-in-Residence program with Wyoming County Schools (Attachment G)

• Appointed Matthew Smith, high school teacher from career and technical education, Congressional District 1; Sarah Duncan, elementary school teacher, Congressional District 2; and, Stan Miller, layperson, to the West Virginia Commission for Professional Teaching Standards (Attachment H).

VII. Introduction of WVDE Office of Finance and Administration Staff

Mr. Terry Harless, Chief Financial Officer, WVDE Office of Finance and Administration, introduced staff from the Office of School Finance, Office of School Facilities and Transportation, and Office of Internal Operations, and provided an overview of office responsibilities and functions.

VIII. West Virginia Secondary School Activities Commission (WVSSAC),

Series 1, Constitution, Series 2, Athletics, Provisions Governing Eligibility,

Series 3, Provisions Governing Contests, and Series 5, Band Activities

Mr. Bernie Dolan, Executive Director, WVSSAC, presented Series 1, Series 2, Series 3, and Series 5, for the Board’s consideration. Comments received during the comment period resulted in no change to the rules. The WVSSAC is planning to convene a group later this month to begin a thorough review of all WVSSAC rules.

Mr. Hall moved, and Dr. Wilson seconded, that WVSSAC Series 1, Constitution, Series 2, Athletics, Provisions Governing Eligibility, Series 3, Provisions Governing Contests, and Series 5, Band Activities be approved. Upon the call for the question the motion was carried unanimously. (Copies appended to Official Minutes, Attachment I.)

IX. Break

President Perry called for a break at 11:42 a.m.

X. Call to Order

President Perry called the meeting back to order at 11:54 a.m.

XI. Policy 3232, Establishment Procedures and Operating Policy

for Multi-County Career and Technical Education Centers

Dr. Kathy D’Antoni, Associate Superintendent, Division of Technical Education and Governor’s Economic Initiatives, presented Policy 3232 for the Board’s consideration. Policy 3232 is being amended to reflect current workforce trends and requirement and to more clearly define director and council roles.

Mr. Hall moved, and Mr. Vitale seconded, that Policy 3232 be placed on public comment for 30 days. Upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment J.)

XII. Policy 4334, West Virginia Policy and Manual for the

Minimum Requirements for Design and Equipment of School Buses

Mr. Harless presented Policy 4334 for the Board’s consideration. Policy 4334 is being amended to bring it into compliance with current industry standards for the safe transportation of students. Discussion ensued regarding a number of proposed amendments and the use of seat belts; it was requested that data be collected regarding school bus incidents. Superintendent Paine indicated that he would contact experts in the field to discuss concerns raised regarding Policy 4334.

Mr. Campbell moved, and Mrs. Sullivan seconded, that action regarding Policy 4334 be tabled until the September meeting. Mr. Vitale requested that an item regarding child safety (preventative and responsive) be placed on a future agenda. (Copy appended to Official Minutes, Attachment K.)

XIII. Policy 2520.8, West Virginia Driver Education Standards

Dr. Jan Barth, Assistant State Superintendent, Division of Teaching and Learning, presented Policy 2520.8 for the Board’s consideration. Policy 2520.8 has been reformatted to allow teachers and parents to better guide and monitor progress in driver's education and to address safety concerns for passengers and pedestrians as well as the driver.

Mr. Hall moved, and Dr. Wilson seconded, that Policy 2520.8 be placed on public comment for 30 days. Upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment L.)

XIV. Break

President Perry called for a break for lunch at 12:29 p.m. Chancellor Long departed the meeting.

XV. Call to Order

President Perry called the meeting back to order at 1:05 p.m.

XVI. Policy 5500, Professional Learning for West Virginia Educators

Dr. Barth presented Policy 5500 for the Board’s consideration. Policy 5500 has been revised due to the provisions set forth in 2018’s HB 4006, which resulted in revisions to W. Va. Code §18-2I-1, Professional development coordination and delivery; system goals; references to Regional Education Service Agencies (RESAs) were eliminated; and the addition of requirements set forth in W. Va. Code §18-9A-10(a)(4), which focuses on Step 7d of the Public School Support Plan.

Mr. Hall moved, and Mr. Wallace seconded, that Policy 5500 be placed on public comment for 30 days. Upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment M.)

XVII. Policy 4321.1, Standards for School Nutrition

Ms. Michele Blatt, Assistant State Superintendent, Division of Support and Accountability, presented Policy 4321.1 for the Board’s consideration. Policy 4321.1 is being amended to include the requirements of 2018’s HB 4478 (W. Va. Code §18-5D-5.) that the WVBE provide guidance to county boards on the management and distribution of excess school food consistent with local, state, and federal guidelines.

Mr. Hall moved, and Mrs. Sullivan seconded, that Policy 4321.1 be placed on public comment for 30 days. Upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment Mc.)

XVIII. Annual Appointment of WVBE Statutory Units/Liaisons

President Perry called for a motion to reappoint Debra K. Sullivan to the Educational Broadcasting Authority.

Mr. Vitale moved, and Mr. Wallace seconded, that Debra K. Sullivan be reappointed to the Educational Broadcasting Authority. Upon the call for the question the motion was carried unanimously.

President Perry called for a motion to reappoint James S. Wilson to the West Virginia Secondary School Activities Commission Board of Directors.

Mr. Vitale moved, and Mr. Hall seconded, that James S. Wilson be reappointed to the West Virginia Secondary School Activities Commission Board of Directors. Upon the call for the question the motion was carried unanimously.

President Perry requested that New Business item H. WVBE Personnel Matters Inclusive of Evaluation of WVBE Secretary be taken up following item XI. Math for Life.

XIX. Superintendent Report

Superintendent Paine, assisted by Ms. Blatt, provided an update regarding the impact on children as a result of the opioid crisis and indicated that a tool kit of intervention strategies will be presented at the September meeting; assisted by Mr. Clayton Burch (distributed information), Associate State Superintendent of Schools, provided an update regarding the transition of programs from the Department of Education and the Arts (eliminated June 30, 2018) to the WVDE (it was requested by members that the Governor’s schools and student leadership academies be promoted); and, assisted by Dr. Barth, provided information regarding the recently completed education summits. Mrs. Sullivan departed the meeting during this report. (Copy appended to Official Minutes, Attachment S.)

XX. Math for Life

Dr. Barth (distributed information) presented for the Board’s information the West Virginia Math for Life Campaign: Pre-K-Grade12. This collaborative initiative was developed to close the mathematics achievement gap. It was requested by Mr. Vitale, where possible, that the campaign be aligned to the overall strategic plan. XXI. WVBE Personnel Matters Inclusive of Evaluation of WVBE Secretary

President Perry called for a motion to enter into executive session for personnel matters. Mr. Hall moved that the Board enter into Executive Session as provided in W. Va. Code §6-9A-4(b)(2)(A) [personnel exception] and/or §6-9A-4 [matters involving attorney-client privilege per Peters v. County Commission, 205 W. Va. 481 (1999)]. Mr. Vitale seconded the motion and upon the call for the question the motion was carried unanimously. The Board moved into executive session at 2:37 p.m.

XXII. Return from Executive Session

President Perry announced that the Board had returned from executive session at 3:32 p.m. with no action taken. Mr. Wallace departed the meeting,

President Perry called for a motion to approve the Board’s personnel attachment. Mr. Hall moved, and Mr. Campbell seconded, that the Board’s personnel attachment be approved. Upon the call for the question to motion was carried unanimously. (Copy appended to Official Minutes, Attachment N.)

XXIII. WVBE Member Updates

Dr. Wilson requested an item be placed on agendas that celebrates students (either in person, via electronic means, or a visual presentation – limited to 20 minutes) at the beginning of each meeting. Mr. Vitale recognized the Department for the work that went into making the education summits a success, and stated that he has spoken at a number of county board retreats and suggested inviting local boards to present at WVBE meetings. Mr. Campbell spoke to his service as President and thanked everyone for their assistance during his tenure. Mr. Rotruck spoke regarding his service on the Board’s School Finance and Funding Committee. Superintendent Paine reported that the mediation agreement with Nicholas County is on track.

XXIV. Items for Future Meetings

President Perry drew members’ attention to a schedule of WVDE events provided to members earlier in the meeting. (Copy appended to Official Minutes, Attachment T.)

XXV. Future Meetings

President Perry called for a motion to approve the Board’s meeting schedule for September 2018 through August 2019.

Mr. Campbell moved, and Mr. Hall seconded, that the Board’s meeting schedule for September 2018 through August 2019 be approved. Upon the call for the question to motion was carried unanimously. (Copy appended to Official Minutes, Attachment P.)

President Perry announced that the next regular meeting of the WVBE would be held September 12, 2018, at 10:00 a.m. in Charleston, West Virginia. The meeting will continue on September 13, 2018, if the agenda is not completed on September 12, 2018.

XXVI. Adjourn

President Perry called for a motion to adjourn. Mr. Vitale moved, and Mr. Rotruck seconded, that the meeting be adjourned. Upon the call for the question the motion was carried unanimously and the meeting was adjourned at 3:43 p.m.
