WEST VIRGINIA BOARD OF EDUCATION

I. Call to Order

Following the welcome, Pledge of Allegiance, and introductions, President Thomas W. Campbell called the meeting of the West Virginia Board of Education (WVBE) to order at 10:07 a.m. on May 9, 2018, in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia.

The following members were present: President Campbell, Vice President David G. Perry, Miller L. Hall (via telephone), F. Scott Rotruck, Debra K. Sullivan, Francis S. Vitale (via telephone), Joseph A. Wallace (via telephone), and James S. Wilson, and ex officio Steven L. Paine, State Superintendent of Schools. Members absent were ex officios Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission, and Sarah Armstrong Tucker, Chancellor, West Virginia Council for Community and Technical College Education.

II. Introduction of WVDE Division of Support and Accountability Staff

Superintendent Paine, assisted by Ms. Michele Blatt (distributed information), Assistant State Superintendent, Division of Support and Accountability, and senior staff in the West Virginia Department of Education (WVDE) Offices of Federal Programs, Child Nutrition, Leadership and Continuous Improvement, and Certification and Professional Preparation, provided an overview of office responsibilities and functions. Following the overview, staff members from the four offices were introduced. (Copy appended to Official Minutes, Attachment M.)

III. Delegations

Barbara Taylor, Sharon Glasscock, Denise Taylor (provided photographs for attachment to the minutes), Heather Glasko-Tully, Diana Meadows, Susan Johnson, Chris Drennen, and Robin Brown, residents of Nicholas County, addressed the Board regarding the Nicholas County Comprehensive Educational Facilities Plan. Mr. Wallace joined the meeting during delegations. (Copy appended to Official Minutes, Attachment Mc.)

IV. Approval of Agenda

President Campbell called for a motion to approve the agenda with the following adjustments: item X. Superintendent Report to be taken up following lunch, item VIII. Policy 6200, Handbook on Planning School Facilities, and Policy 6204, School Closings and Consolidations to be taken up following Superintendent Report, and New Business item A. WVBE Personnel Matters Inclusive of Update in Keller v. West Virginia Board of Education, et al., Potential Termination of Employment of an Employee at RESA 8, and Potential Action Regarding Continuation of Position of Board Attorney be taken up following item VI. Amendment - Nicholas County Comprehensive Educational Facilities Plan (CEFP) 2010-2020. Mr. Perry moved, and Dr. Wilson seconded, that the agenda be approved as adjusted. Upon the call for the question the motion was carried unanimously. Mr. Hall was absent for this vote.

V. Amendment - Nicholas County Comprehensive

Educational Facilities Plan (CEFP) 2010-2020

Mr. Terry Harless, Chief Financial Officer, WVDE Office of Finance and Administration, and Dr. Donna Burge-Tetrick (distributed information; PowerPoint presentation attached), Superintendent, Nicholas County Schools, presented an amendment to Nicholas County's 2010-2020 CEFP for the Board’s consideration. Mr. Hall joined the meeting and departed during questioning of Superintendent Burge-Tetrick.

Following discussion, Mr. Perry moved, and Dr. Wilson seconded, that the amendment be approved as presented. Upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment N.)

VI. WVBE Personnel Matters Inclusive of

Update in Keller v. West Virginia Board of Education, et al.,

Potential Termination of Employment of an Employee

at RESA 8, and Potential Action Regarding

Continuation of Position of Board Attorney Executive Session

Mr. Perry moved that the Board enter into Executive Session as provided in W. Va. Code §6-9A-4(b)(2)(A) [personnel exception] and/or §6-9A-4 [matters involving attorney-client privilege per Peters v. County Commission, 205 W. Va. 481 (1999)] to discuss personnel matters and to receive an update in Keller v. West Virginia Board of Education, et al. Mr. Rotruck seconded the motion and upon the call for the question the motion was carried unanimously. The Board moved into executive session at 12:09 p.m. Mr. Vitale departed the meeting prior to the return from executive session.

VII. Return from Executive Session

President Campbell announced that the Board had returned from executive session at 1:37 p.m. with no action taken and called for a motion to approve the Board's personnel attachment. Mr. Perry moved, and Dr. Wilson seconded, that the Board's personnel attachment be approved and that the employment of Elizabeth Loy at RESA 8, consistent with the recommendation of the RESA Council, be terminated effective at the close of business today (May 9, 2018). Upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment K.)

VIII. Policy 6200, Handbook on Planning School Facilities,

and Policy 6204, School Closings and Consolidations

President Campbell (distributed information) requested Mr. David Roach, Executive Director, Mr. Ben Ashley, Assistant Director of School Planning and Construction, School Building Authority (SBA) of West Virginia, and Mr. Mike Pickens, Executive Director, WVDE Office of School Facilities and Transportation, address the Board regarding Policy 6200 and the SBA policies and procedures handbook. Prior to discussion of member concerns with the policies, President Campbell stated that the Board would hold a special meeting to take up Policies 6200 and 6204. Following discussion, Superintendent Paine indicated that he, in consultation with Mr. Roach, would develop a draft agenda for the special meeting to address policy concerns issued by the Board. It was determined that the Board would meet in special session on May 23 at 9:00 a.m. (Copies appended to Official Minutes, Attachments A-1 and A-2 and addendum.)

IX. Superintendent Report

Superintendent Paine provided information regarding: a meeting he had with secondary students from across the state; assisted by Ms. Melanie Purkey (distributed information), Senior Administrator, Office of Federal Programs, provided an update regarding the child nutrition operations manual; assisted by Mr. Mark Gandolfi (via telephone), Superintendent of Administration and Chief Financial Officer, West Virginia Schools for the Deaf and the Blind (WVSDB), provided an update regarding renovations at the WVSDB and specifically Memoranda of Understanding and an Agreement that the Board has authorized Superintendent Paine to sign on the Board’s behalf; and, assisted by Dr. Kathy D’Antoni (distributed information), Associate Superintendent, Division of Technical Education and Governor’s Economic Initiatives, provided an update regarding the CTE option pathway. Superintendent Paine provided information regarding state comparisons and the NAEP assessment and stated that when poverty rates become a part of the formula rankings are much different; and, indicated that the WVDE is looking carefully at all facets and patterns influencing mathematics achievement. X. Consent Agenda

Mr. Perry moved, and Mrs. Sullivan seconded, that the Consent Agenda be approved. Upon the call for the question the Consent Agenda was unanimously approved. (Copies appended to Official Minutes, Attachments B through J.)

• Approved April 11, 2018 minutes (Attachment B)

• Received WVDE personnel matters (Attachment C)

• Approved five requests for waivers of Policy 2510: 1) Jackson County Schools, Section 5.4. Adolescent Education Programming related to high school credit in The Arts; 2) Cabell County Schools, Section 5.4. Adolescent Education Programming related to high school social studies credit); 3) Wyoming County Schools, Section 5.4. Adolescent Education Programming related to high school mathematics credit; 4) Jefferson County Schools, Section 7.5.c.8.A related to required training for teachers of Advanced Placement (AP) courses; and, 5) Kanawha County Schools, Section 7.5.c.8.A related to required training for teachers of Advanced Placement (AP) courses (Attachment D)

• Approved an amended Employment of Substitute Teachers in Areas of Critical Need and Shortage policy for Wirt County Schools (Attachment E)

• Received notice of Employment of Substitute Teachers in Areas of Critical Need and Shortage Affidavits from Boone, Jackson, Kanawha, Lincoln, Mercer, Mingo, Taylor, Wirt, and Wood County Schools, Roane-Jackson Technical Center, and the WVDE Office of Diversion and Transition Programs

• Approved the Wirt County Board of Education’s request for an amendment to its 2010-2020 CEFP to make upgrades to the front entrance/bathrooms at Wirt County High School (Attachment F)

• Approved WVU's WVUteach Mathematics 5-Adult program of study leading to educator licensure (Attachment G)

• Appointed Ms. Kathryn Davis, a middle school teacher from Putnam County, to the Alternative Certification Educator Preparation Program Review Board (Attachment H)

• Appointed Mr. Lee Jones, elementary school principal from Fayette County, Mr. Pat Gray, county board member from Fayette, and Ms. Stephanie Hyre, a layperson, to a three-year term on the West Virginia Commission for Professional Teaching Standards (Attachment I)

• Approved the West Virginia Schools for the Deaf and the Blind 2018-2019 school calendar (Attachment J).

XI. Policy 3233, Establishment and Operation of Regional Education Service Agencies

Superintendent Paine presented the repeal of Policy 3233 for the Board’s consideration. W. Va. Code §18-2-26(a) - "The regional education service agencies previously established by this section and W. Va. 126CSR72, filed October 15, 2015, and effective November 16, 2015, shall remain and may continue to operate in accordance with the provisions of this section prior to its amendment and reenactment at the Regular Session of the Legislature, 2017, and with said rule, unless and until modified by a cooperative agreement entered into by county boards within the agency boundaries or dissolved by said county boards: Provided, That on July 1, 2018, the regional education service agencies as provided under prior provisions of this section are dissolved."

Following discussion, Mr. Perry moved, and Mr. Wallace seconded, Policy 3233 be repealed effective July 1, 2018. Upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment L.)

XII. WVBE Updates

Mr. Perry reminded members to RSVP to an invitation from Park Middle School event by May 17.

XIII. Items for Future Meetings

Superintendent Paine provided an update regarding the passage of excess levies and bonds. Information was requested regarding the accountability plan and use of locally selected assessments.

XIV. Future Meetings

The Board will meet in special session on May 23, 2018, at 9:00 a.m. in Charleston, West Virginia. The next regular meeting of the WVBE will be held June 13, 2018, in Charleston, West Virginia. The meeting will continue on June 14, 2018, if the agenda is not completed on June 13, 2018.

XV. Adjourn

President Campbell called for a motion to adjourn. Prior to the motion, Superintendent Paine introduced the new Executive Director, West Virginia Association of School Administrators, Ms. Susan Collins. Mr. Perry moved, and Mr. Rotruck seconded, that the meeting be adjourned. Upon the call for the question the motion was unanimously carried; the meeting was adjourned at 3:00 p.m.
