The regular monthly meeting of the Board was called to order by the Chairman at 9:45 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

There being a quorum, the regular order of business began.

Mr. Danny Graham, Board member, led the members and audience in the Pledge of Allegiance, which was followed by an invocation given by Judge Darrell White, Hearing Officer then Judge White introduced himself and advised those present of his duties.

A MOTION was made by Mr. Lambert and seconded by Mr. Weston to accept the Minutes of the May 20, 2010 regular meeting, as typed. The Motion passed.

A MOTION was made by Mr. Dupuy and seconded by Mr. Clouatre that Residential Mold Remediation matters/cases will be heard by the Residential Building Committee then the Commercial Board would approve those decisions from the Residential Committee Meeting. The Motion passed.
Mrs. Lee Rainer, Mr. Jeff Crow and Mr. Richard Koubek, Dean with the LSU College of Engineering were all present. They came forward and presented Mr. Vic Weston, Commercial Board Member with the LSU Engineering Award.
Mrs. Rainer stated the CETF construction management program is a primary program with over four hundred (400) students in it. Students that go on to do some of the best representatives of this industry in our state and region and that would not be the case if we did not have the long standing support from the CETF. On behalf of the LSU Foundation she would like to present Mr. Vic Weston with the Larrette Society Plaque in recognizing CETF continued support and investment to make sure these are proper and well educated people in this industry in construction.

◙ Judgment Hearing(s):
Garrett-Laborde Construction, L.L.C. (CL#37032 & RL #84738)
Administrative Hearing – Consider an alleged violation by Garrett-Laborde Construction, L.L.C. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 18th Judicial District Court, No. 37,986, Division “C”, Parish of West Baton Rouge, State of Louisiana, on the 30th day of September, 2009, in which Garrett-Laborde Construction, LLC, holder of commercial contractor’s license number 37032 and residential contractor’s license number 84738, was ordered to pay in the full sum of FIFTY EIGHT THOUSAND EIGHT HUNDRED TWENTY FIVE DOLLARS AND 56/100 ($58,825.56), with legal interest from date of judicial demand, and attorney’s fees of 33 1/3%, which fees the Court finds reasonable under the circumstances, and all costs of the proceedings in favor of Johnson Rock Company, Inc.
Ms. Kris Fitch read the allegations against Garrett-Laborde Construction, L.L.C. then Judge White asked if a representative of Garrett-Laborde Construction, L.L.C. was present. There was no response.
Mr. Jerry Pepper, Attorney representing Johnson Rock Company, Inc. and Mr. Eric Johnson were both present.
Attorney Pepper and Mr. Johnson both came to the stand, Mr. Johnson was sworn in.
Ms. Fitch stated a certified letter was sent to the address on file, but no service was received on the Notice of Hearing and that staff was recommending the President who is a qualifying party for Garrett-Laborde Construction, LLC be removed.
Board Attorney, Trippe Hawthorne asked Attorney Pepper if this was a final judgment.
Attorney Pepper stated yes, but they haven’t been able to collect any monies.
Board Attorney, Trippe Hawthorne requested that commercial contractor’s license number 37032 and residential contractor’s license number 84738 held by for Garrett-Laborde Construction, LLC be revoked and the final judgment be entered into the record.
Judge White received the final judgment into the record.
A MOTION was made by Mr. Weston and seconded by Mr. Meredith to immediately revoke Commercial License Number 37043 and Residential License Number 84738 held by Garrett-Laborde Construction, L.L.C. The Motion passed.
Endeavor Construction, L.L.C. (CL#46405)
Administrative Hearing – Consider an alleged violation by Endeavor Construction, L.L.C. of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and consideration of applicable penalties therein. This hearing is being called to consider removing you as a member and qualifying party for reason that on information and belief you, Mr. Garrett, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by you of the above statutes. This violation is based on the fact that you, Mr. Garrett, as one of the Members and only qualifying party of Endeavor Construction, L.L.C., holder of commercial contractor’s license number 46405, have a judgment which was rendered by the 18th Judicial District Court, No. 37,986, Division “C”, Parish of West Baton Rouge, State of Louisiana, on the 30th day of September, 2009, in which Garrett-Laborde Construction, LLC, holder of commercial contractor’s license number 37032 and residential contractor’s license number 84738, with you also being the only Member and qualifying party of this company, was ordered to pay in the full sum of FIFTY EIGHT THOUSAND EIGHT HUNDRED TWENTY FIVE DOLLARS AND 56/100 ($58,825.56), with legal interest from date of judicial demand, and attorney’s fees of 33 1/3%, which fees the Court finds reasonable under the circumstances, and all costs of the proceedings in favor of Johnson Rock Company, Inc. Ms. Kris Fitch read the allegations against Endeavor Construction, L.L.C. then Judge White asked if a representative of Endeavor Construction, L.L.C. was present. Mr. Joseph Cotton was present.
Mr. Cotton came to the stand, was sworn in and gave his statement.
Ms. Fitch stated a certified letter was sent to the address on file, but no service was received on the Notice of Hearing and that staff was recommending the the President who is a qualifying party for Endeavor Construction, L.L.C. be removed.
Mr. Cotton responded.
Mr. Vic Weston, Board Vice Chairman requested that Mr. Garrett, Member for Endeavor be removed.
Board Attorney, Trippe Hawthorne suggested that the Board give them thirty (30) days to get Mr. Garrett removed.
A MOTION was made by Mr. Weston and seconded by Mr. Lambert to give Endeavor Construction, L.L.C. thirty (30) days to remove Joseph Garrett, Member. The Motion passed.
Yur Construction Company, Inc. (CL#43199 & RL #87289)
Administrative Hearing – Consider an alleged violation by Yur Construction Company, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, in particular Section 2158, Paragraph A (7), (8) and (9), and Section 115 of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you, Mr. Jones, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by you of the above statutes. This violation is based on the fact that you did not notify this Board that you filed a Chapter 11 bankruptcy on August 20, 2008 for Yur Construction Company, Inc. and it was then converted to a Chapter 7 bankruptcy on November 6, 2008 by the United States Trustee assigned to your case. The filing of both bankruptcies results in problems relating to the ability of the contractor(s), its qualifying party(ies), or any of its
principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience.
Ms. Kris Fitch read the allegations against Yur Construction Company, Inc. then Judge White asked if a representative of Yur Construction Company, Inc. was present. There was no response.
Board Attorney, Trippe Hawthorne stated that staff received a request from Mr. Jones with YUR Construction Company re an additional continuance regarding the outstanding judgment against his company.
Board Attorney, Trippe Hawthorne requested that the request from Mr. Jones and the outstanding judgment being entered into the record.
Judge White received the request from Mr. Jones and the outstanding judgment into the record.
A MOTION was made by Mr. Graham and seconded by Mr. Fenet to deny the request from Yur Construction Company, Inc. for A Continuance. The Motion passed
A MOTION was made by Mr. Weston and seconded by Mr. Fenet to immediately revoke Commercial License Number 343199 and Residential License Number 87289 held by Yur Construction Company, Inc. The Motion passed
◙ Continuances - Compliance Hearing(s):
Heiden Industries, Inc. (Unlicensed)
Continuance – Consider an alleged violation by Heiden Industries, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Heiden Industries, Inc., acted as a contractor to perform work on the Geaux Clean Express Car Wash project in Central City, Louisiana in the amount of $239,690.91 without possessing a Louisiana state contractor’s license.
Mrs. Bobbie Hughes read the allegations against Heiden Industries, Inc. then Judge White asked if a representative of Heiden Industries, Inc. was present. There was no response.
Mrs. Hughes then stated that Heiden has submitted a settlement offer of $500.00 plus $500.00 Administrative fees associated with these proceedings for a total of $1,000.00.
A MOTION was made by Mr. Lambert and seconded by Mr. Stuart to accept the Settlement Offer of $500.00 plus $500.00 Administrative fees associated with these proceedings for a total of $1,000.00 submitted by Heiden Industries, Inc. The Motion passed.
N.E. Construction, Ltd. (Unlicensed)
Continuance – Consider an alleged violation by N.E. Construction, Ltd. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, N.E. Construction, Ltd. acted as a contractor to perform work on the Sugar Mills Apts. project in Addis, Louisiana in the amount of $11,060,481.00 without possessing a Louisiana state contractor’s license and also Section 2158 (A,4), whereby, N.E. Construction, Ltd, entered into a contract with multiple unlicensed contractors to perform work on the Sugar Mills Apts. project in Addis, Louisiana in an amount in excess of $50,000.00.
Mrs. Bobbie Hughes read the allegations against NE CONSTRUCTION, LTD. then Judge White asked if a representative of NE CONSTRUCTION, LTD. was present. Mr. Gerald Asay, Attorney, Mr. Scott Frazier, Attorney and Mr. Charlie Moussa, all representing N.E. Construction, Ltd were all present.
Conflict COunselor, Stephanie Laborde talked about a proposed settlement offer and a probation request.
Mrs. Hughes gave a synopsis to the Board of previous actions last month relating to this company.
Attorney Laborde stated that the Board would accept the No Contest plea with respect to 2158 and would accept $3,500.00 penalty with respect to 2158, which is the maximum it is $1,000.00 for each of the three (3) violations plus $500.00.
The Board accept the No Contest plea with respect to 2160 and the Board would imposes the $1,500.00 is payable immediately, which would be the balance of the $5,000.00.
The Board would Suspend the remainder of the penalty imposed for the violation of 2160 for a period of six (6) months and that NE CONSTRUCTION, LTD. be on probation for a period of six (6) months and if there are no violations during that six (6) month period, the record would be closed without any imposition of any additional sanctions. The file would be closed, it would not be purged. The Motion passed.
A MOTION was made by Mr. Weston and seconded by Mr. Lambert to accept the Settlement Offer – Probation Guidelines as stated below:

American Hotel Furnishings (Unlicensed)
Continuance – Consider an alleged violation by American Hotel Furnishings of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, American Hotel Furnishings, acted as a contractor to perform work on the Laquinta Inn & Suites project in Baton Rouge, Louisiana in the amount of $504,524.32 without possessing a Louisiana state contractor’s license.
Mrs. Bobbie Hughes read the allegations against AMERICAN HOTEL FURNISHINGS then Judge White asked if a representative of AMERICAN HOTEL FURNISHINGS was present. There was no response.
Board Attorney, Trippe Hawthorne called Todd Brady, Compliance Investigator to the stand, he was sworn in. Board Attorney, Trippe Hawthorne reviewed Mr. Brady’s duties in the Compliance Section and what Mr. Brady found during his investigation into his matter. Board Attorney, Trippe Hawthorne reviewed the exhibit packet with Mr. Brady.
Judge White received the Exhibit Packet into the record.
A MOTION was made by Mr. Lambert and seconded by Mr. Weston to accept the no contest plea and the Settlement Offer of $5,000.00 plus $500.00 Administrative fees associated with these proceedings for a total of $5,500.00 submitted by AMERICAN HOTEL FURNISHINGS. The Motion passed.
Julio Federico Alvarez, Jr. (Unlicensed)
Continuance – Consider an alleged violation by Julio Federico Alvarez, Jr. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Julio Federico Alvarez, Jr., acted as a contractor to perform work on the Laquinta Inn & Suites project in Baton Rouge, Louisiana in the amount of $80,000.00 without possessing a Louisiana state contractor’s license.
Mrs. Bobbie Hughes read the allegations against Julio Federico Alvarez, Jr. then Judge White asked if a representative of Julio Federico Alvarez, Jr. was present. Mr. Julio Alvarez was present.
Mr. Alvarez came to the stand, was sworn in then pleaded not guilty to the allegations against Julio Federico Alvarez, Jr.
Mr. Alvarez stated he didn’t know he needed to have a license to give the contract and he didn’t know the sheetrock and finishing came under the same division and when they found out that he needed a state contract to be able to do the job, he never stepped foot on the job, he didn’t do the work, somebody else did it,
Mr. Gallo asked Mr. Alvarez what was the value of the work
Mr. Alvarez responded together the total amount would have been $80,000.00 but they didn’t know it was suppose to be under the same division.
Board Attorney, Trippe Hawthorne called Todd Brady, Compliance Investigator to the stand, he was sworn in then Board Attorney, Trippe Hawthorne reviewed what Mr. Brady found during his investigation into this matter.
A MOTION was made by Mr. Lambert and seconded by Mr. Gallo to dismiss the allegations against Julio Federico Alvarez, Jr. The Motion passed
Shree Laxmi, LLC (Unlicensed)
Continuance – Consider an alleged violation by Shree Laxmi, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Shree Laxmi, LLC, acted as a contractor to perform work on the Laquinta Inn and Suites project in Baton Rouge, Louisiana in the amount of $4,189,912.00 without possessing a Louisiana state contractor’s license.
Mrs. Bobbie Hughes read the allegations against SHREE LAXMI, LLC then Judge White asked if a representative of SHREE LAXMI, LLC was present. Mr. Raj Patel was present.
Mr. Patel came to the stand, was sworn in then pleaded not guilty to the allegations against Shree Laxmi, LLC.
Mr. Patel stated he provided Mr. Brady the American Home Furnishings contract. That American Home Furnishing was only providing the furnishing that was $22,000.00 for the installation that was too high so they decided they would hire Able Body laborers at an hourly rate and install the stuff themselves.
Mr. Patel stated he wanted to introduce the contract into the record. Judge asked Trippe Hawthorne if he had any objections to that. Mr. Hawthorne stated he did not. The only things American Home Furnishing provided was the furniture, fixtures and the equipment, consisting of beds, bedspreads, sheets, soaps, furniture, television and didn’t know he needed a license to order supplies for his hotel.
Mr. Hawthorne stated to Mr. Patel that he doesn’t have to be licensed to order these supplies for his hotel, but he does need to be licensed to install them. Who did you hire as laborers to install those furnishings and stuff? Who installed the washers and dryers.
Mr. Patel responded they hired hourly laborers from Able Body Labor and they were putting furniture into the rooms themselves. Jim Walsh provided washers and dryers for the hotel and CNS Communications provided the Security System as far as camera system, the DVR, the phone systems they also installed their wireless high speed internet.
Mr. Talbot asked Mr. Patel who framed the building, who did the drywall.
Mr. Patel stated that was part of S & R Development. Basically all the contracts were for either materials washer or dryers, a camera system or high speed wireless internet, routers access points and other stuff like that. He didn’t know he needed a license to order that all these items for his hotel
Mr. Hawthorne asked Mr. Patel all that work was done in conjunction with this one single renovations project.
Mr. Patel responded correct.
Mr. Brady responded it was new construction.
Mr. Patel stated it was new construction, not a renovation.
Mr. Meredith asked Mr. Patel to explain to him if he contracted with S & R to build him a building and they completed it then left. Did the furnishing and installing of the wiring of the high speed internet happen during the construction of the building or did it happen after the building was completed.
Mr. Patel responded no it happened while the building was being constructed. The stuff from American Home furnishings that started going in after the hotel was built to keep it from getting damaged.
Mr. Meredith stated if you contract with a general contractor to build a building. he completes the contract and leaves. Then you come in after the building is completed and you buy furniture and you put it in that building that is not a problem. The problem comes in if he contracted work that is an integral part of building that building as far as wiring the internet or camera or anything that was put in during the construction of that building and that was contracted separately from the general contractor building the building and it is a part of that building then you have a problem. The problem comes in with your providing integral parts of that building that should have been under his contract.
Mr. Lambert wanted to know if Mr. Patel have a license with this Board and who built this building for him and if they have a license with this Board.
Mr. Patel responded no sir he didn’t have a license and that S & R Development built the building and yes they have a license with this Board.
Board Attorney, Trippe Hawthorne called Todd Brady, Compliance Investigator to the stand, he was sworn in. Board Attorney, Trippe Hawthorne reviewed Mr. Brady’s duties in the Compliance Section and what Mr. Brady found during his investigation into his matter. Board Attorney, Trippe Hawthorne reviewed the exhibit packet with Mr. Brady. Then Board Attorney, Trippe Hawthorne offered all three (3) exhibits packets for Julio Federico Alvarez, Jr., Shree Laxmi, Inc. and S & R Development, Inc. of Mississippi into the record.
Judge White received the Exhibit Packets into the record.
A MOTION was made by Mr. Lambert and no one seconded Mr. Lambert’s motion to dismiss the allegations against SHREE LAXMI, LLC. The Motion didn’t passed
A SUBSTITUTE MOTION was made by Mr. Meredith and seconded by Mr. Lambert to find SHREE LAXMI, LLC guilty and to assess them a fine of $1,500.00 plus $500.00 Administrative fees associated with these proceedings for a total of $2,000.00. The Motion passed, but not unanimously.
S & R Development, Inc. of Mississippi (CL#51400)
Continuance – Consider an alleged violation by S & R Development, Inc. of Mississippi of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, S & R Development, Inc. of Mississippi, entered into multiple contracts with multiple unlicensed contractors to perform work on the Laquinta Inn & Suites project in Baton Rouge, Louisiana in an amount in excess of $50,000.00.
Mrs. Bobbie Hughes read the allegations against S & R Development, Inc. of Mississippi then Judge White asked if a representative of S & R Development, Inc. of Mississippi was present. Mr. Hiren Patel was present.
Mr. Patel came to the stand, was sworn in then pleaded not guilty to the allegations against S & R Development, Inc. of Mississippi.
Mr. Patel stated he was the general contractor on the job. That American Hotel they supplied the furniture they had nothing to do with the construction of the hotel. Then he contracted with Julio Alvarez, who is their sheet rock contractor in Mississippi. This was his first hotel here the subcontractors, were still in the framing and doing stucco and roofing at that time, they haven’t ran any wire or any kind of electrical before the sheetrock to start. He didn’t notice that Mr. Alvarez’s contact was for $40,000 for the hanging and finishing. He immediately responded by a letter dated January 11 stating that they will no longer use him and they terminate his contract. Then they hire LaBarron Brothers Drywall which has a Louisiana license.
Mr. Meredith wanted to know if Mr. Patel had a signed contract with Mr. Alvarez
Mr. Patel responded yes he did, he sent it to Mr. Brady and Mr. Templet then he realized he couldn’t do that while they were under construction.
Mr. Meredith stated the fact is you did have a signed contract with Mr. Alvarez even though later when you found out about the violation you terminated him and you found someone else
Mr. Patel responded correct, he didn’t realize that Mr. Alvarez didn’t have a Louisiana license.
Mr. Meredith asked Mr. Patel but you do acknowledge that he did have a signed contract with Mr. Alvarez.
Mr. Patel responded yes sir he does – correct
Mr. Talbot asked Mr. Brady if there was anything else he wanted to offer.
Mr. Brady responded Mr. Patel was correct, they were cooperative with him, they were just unknowledgeable of the laws that they should have been aware of, but once they were made aware of the violation they replaced them with a license sheetrock contractor .
Mr. Graham asked Mr. Brady did he ever start the job
Mr. Brady asked the sheetrock contractor, no sir he didn’t. The American Hotel Registry was more than just furniture, they installed things that would have required a license, but obviously we’re not in the furniture moving - licensing business.
Mr. Talbot asked Mr. Brady like what
Mr. Brady responded carpet, draperies, blinds, those were all areas that this Board licenses.
Mr. Fenet asked Mr. Brady if American Hotel Furnishing furnished the items and did they install the carpet
Mr. Brady responded the information he had was that they were in contract to furnish and install and that is in the contact he has. He doesn’t know if he had this contract which is were they were just gonna furnish and then Shree was gonna install, however, that would be more barring on American Hotel Registry hearing and they’ve settled.
Mr. Talbot asked Mr. Patel who installed the carpet and draperies
Mr. Patel responded the carpet was installed by Carpet Kingdom located on Airline Hwy. in Baton Rouge.
Mr. Fenet asked if American Hotel Furnishings only furnished stuff, they did not do any installing.
Mr. Patel responded no sir
Mr. Brady stated that is not the information that he has.
