|ORDER REGARDING MANDATORY ELECTRONIC FILING FOR |

|DOMESTIC RELATIONS CASES |

Effective February 1, 2009, attorneys will be required to electronically file all new cases and pleadings in Domestic Relations (DR) cases. Sealed cases and cases with a DU case number shall be exempt from the mandatory filing requirement for Domestic Relations cases as they are not available for e-filing. Suppressed Cases are available for e-filing to parties of record and the Court only.

All counsel shall electronically file and serve, in accordance with C.R.C.P. 121, section 1-26, all pleadings, motions, affidavits, exhibits, and all other documents using LexisNexis File & Serve service. Pleadings with electronic signatures and s/ signatures must indicate which attorney signature appears on the original document kept on file at the law office. Printed copies of electronically filed documents shall not be filed with the Court.

All documents requiring verification of the signature of both parties and/or counsel per C.R.C.P. 121 1-26 (8) shall be electronically filed with scanned signatures and seals. The statement “original signature on file” or s/ are not acceptable in these instances.

❖ Decrees do NOT require verification or approval signatures of counsel or the parties. Decrees are Proposed Orders and shall be submitted in editable format.

❖ Although the QDRO is a Proposed Order, it DOES require the signature of the parties. Therefore, Local Rules require the QDRO to be submitted in PDF format with scanned signatures.

❖ Protection Orders shall be filed in electronic format, but no action will be taken by the Court until counsel appears in person before the Court.

❖ Rule 70 Orders, once approved by the court, will require counsel to submit in paper format the original Negotiable Instrument needed for signature by the Clerk of Court.

❖ Foreign Decrees will require counsel to submit the Original Exemplified Copy of the Foreign Decree in paper format to the Clerk’s Office immediately upon e-filing the new case. The Clerk will not issue the Notice of Filing until receipt of the original exemplified copy.

Per Chief Justice Directive 05-01 RE: Public Access to Records, the following documents shall be filed “sealed-electronically”: Separation Agreement; Parenting Plan; Permanent Orders; Sworn Financial Statements; and the Case Information Sheet. Other pleadings and exhibits which contain confidential financial information such as social security numbers, credit card numbers, or bank account numbers shall also be filed as “sealed-electronically.” It is the responsibility of the Attorney to protect the client’s private information. Therefore, DO NOT submit unlabeled exhibits with social security numbers, bank account numbers or credit card numbers buried in the middle of 20 pages of exhibits. The Document Title of the Exhibit shall indicate which confidential protected information is contained in the exhibit. e.g. “Exhibit 1 – Misc Financial Documents containing confidential personal information.”

Special Advocate Reports, Parenting Evaluations, Custody Evaluations, Drug Screens, Paternity test results, and all medical diagnosis or psychological or psychiatric evaluations MUST be sealed electronically. Other documents or pleadings that the parties would like to be sealed, but are not addressed specifically in Chief Justice Directive 05-01 or the rules of civil procedure, shall be filed in paper format along with a specific Motion and Order requesting that the documents be accepted under seal in paper format.

Motions to Intervene require the attorney to contact the clerk prior to filing so the parties and attorney can be added to the case.

Notice of Attorney’s Lien and pleadings filed by former counsel of record shall be filed in paper format. An Attorney who has withdrawn from the case is no longer granted unlimited access to the file.

For Cases commenced in paper format: after February 1, 2009, the effective date for mandatory e-filing, the clerk will return all paper filed pleadings along with a copy of this Order to the filing attorney. Attorneys who insist upon filing in paper format will be assessed a scanning fee of $50.00 per document.

All documents relating to a single pleading or paper should be filed electronically as separate documents` within a single transaction. For example: a motion shall be filed as a main document, while exhibits and other related documents shall be filed as supporting documents. All proposed orders shall be submitted in Word or Word Perfect format (not scanned). All returns of service shall be filed electronically with the Court.

Parties who are not represented by an attorney shall continue to file documents in paper format. The clerk shall scan and upload those documents into LexisNexis File & Serve. No additional fees will be charged to pro se litigants for scanning and uploading, because pro se litigants do not have access to LexisNexis. Counsel shall transmit documents to unrepresented parties or personally serve such parties as required by the Colorado Rules of Civil Procedure.

A Guardian Ad Litem/Special Advocate who is a licensed attorney is considered an attorney of record and is subject to mandatory electronic filing. CFI’s (Child and Family Investigators) and mediators shall electronically file documents “sealed-electronically” if they are licensed attorneys.

All judicial rulings, opinions, orders and other communications from the court to parties shall be electronically filed to counsel and LexisNexis File & Serve will mail these communications to unrepresented parties.

Access to electronic cases may be obtained from court staff during regular court business hours. Copies of electronic documents may be purchased from the court staff at twenty-five cents (¢25) per page.
