Supervisor Tendy opened the meeting at 7:00 p.m.

AMENDMENTS TO THE AGENDA

RESOLUTION #R 14-327

RESOLVED that the Town Board amend the agenda to add the following:

#3a Certificates of Appreciation-William Zutt, Sam Oliverio and Ed McCarthy

#7a Discuss Letter from Visiting Veterinary Practice of Westchester

#7b Authorize Leave of Absence-P. Rau

#7c- Authorize Water Testing Expenditure-Putnam Valley Museum

SUPERVISOR’S OPENING COMMENTS

Supervisor Tendy directed his trivia questions to Town Counsel Zutt who will be leaving his position with the Town of Putnam Valley effective 12-31-14.

COUNTY LEGISLATOR’S REPORT

County Legislator Oliverio noted that this is his last legislator report, as his term will expire as of 12-31-14. He introduced the new County Legislator who was elected to take his place, Bill Gouldman. In his closing statement, he noted that the work on Peekskill Hollow Road between Adams Corners and Oregon Corners has been approved by New York State. The Peekskill Hollow Bridge will be replaced, as well as drainage and a turning lane at the high school will be added. If there is any money left, the slant on Lovers Lane will also be repaired. Also, Putnam County is getting ready to close on the gas station property at Oregon Corners. He thanked the Town Board for their support over the years.

CERTIFICATE OF APPRECIATION-WILLIAM ZUTT, SAM OLIVERIO AND ED MCCARTHY

Councilman Luongo presented Putnam Valley Volunteer Fire Chief, Ed McCarthy with a Certificate of Appreciation for his years of serving as the chief. Supervisor Tendy added that Mr. McCarthy has volunteered for 40 years as a member of the fire department, the town is lucky to have someone like Mr. McCarthy, whose dedication goes above and beyond.

Supervisor Tendy presented County Legislator Oliverio with a Certificate of Appreciation for his twenty years of public service. He noted that County Legislator Oliverio is an excellent example of what an elected official should be.

Supervisor Tendy presented Town Counsel Zutt with a Certificate of Appreciation for his years of service to our town. He is a great town attorney who has a wealth of experience and his shoes will be hard to fill.

Town Counsel Zutt thanked the Town Board for a wonderful experience and noted that the residents of Putnam Valley are blessed to have such hard working Town Boards.

APPROVAL OF TOWN BOARD MINUTES

RESOLUTION # R 14-328

RESOLVED, that the Town Board approve the Town Board Minutes of November 5th, November 12th, and November 19th.

SCHOOL DISTRICT REPORT

Putnam Valley School Board approved Veterans Exemption for residents who served.

AUTHORIZATION BAN RENEWAL –RBL VALVE REPLACEMENT-DAM

RESOLUTION #R14-329

RESOLVED, that the Town Board authorize a Bond Anticipation Note Issuance Renewal in the amount of $80,000 for Roaring Brook Lake Improvement District Valve Replacement. This amount represents the current balance of a 2013 note. The rate is 1.5% and the note will be held by Putnam County Savings Bank.

Seconded by Councilman Mackay, unanimously carried.

DISCUSSION OF CIVIL PENALTY- TM# 62.17-3-4

Building Zoning Inspector Quagietta explained that the he received a complaint on October 17, 2014 and issued a violation. The homeowner did not clean up the property so the town had it cleaned up for the cost of $100 and under the Civil Penalty Law, he will also be liable for a $500 Civil Penalty. If the homeowner chooses not to pay the $600, under the law it will be added to his property tax bill.

Town Counsel Zutt told the Town Board that the Civil Penalty must be imposed by resolution. A letter was sent to the homeowner giving them notification of a Civil Penalty and asking them to acknowledge receipt of letter, which they did not. Homeowners have also been given the opportunity to appear before the Town Board tonight, but did not come.

RESOLUTION # R14- 330

RESOLVED that under our Town Code, Section 165-95.2, the Town Board imposes a Civil Penalty on TM# 62.17-3-4, 29 Starview Avenue, Mr. Yousef and Mr. Atrash, a $500 Civil Penalty plus $100 which was the cost to clean up the property. If this goes unpaid for ten days, it will then be sent to Putnam County to be added to the 2016 Town/County tax bill.

DISCUSS LETTER FROM VISITING VETERINARY PRACTICE OF WESTCHESTER

Supervisor Tendy told the residents that the Town Board has received a letter from the doctors of the Visiting Veterinary Practice of Westchester. They are considering locating to the Town of Putnam Valley, possibly at 17 Peekskill Hollow Road. Our code presently does not allow veterinary hospitals. Dr. Slavin does house calls and would only use the office space to perform surgeries.

Town Counsel Zutt noted that there are some minor modifications to the code that can be done to allow this type of set up as they would not board animals. It would be difficult to get them into the building without the help of the Town Board.

AUTHORIZE LEAVE OF ABSENCE-P. RAU

RESOLUTION #R14-331

RESOLVED, that the Town Board authorize a leave of absence for Patricia Rau effective June 1, 2015 through July 31, 2015 in accordance with Article VIII of the CSEA contract.

AUTHORIZE WATER TESTING EXPENDITURE TOWN MUSEUM

RESOLUTION #R14-332

RESOLVED, that the Town Board authorizes the expenditure to Hydro Environmental Solutions in the amount of $811.50 for water testing and reporting done at the Putnam Valley Town Museum located at 301 Peekskill Hollow Road. This testing is required by the NYS DEC as part of the protocol for removal of the underground heating oil tank. This expense is not budgeted so funding will need to be provided from the general fund.

RELEASE WETLANDS & EROSION & SEDIMENT CONTROL BONDS-TM#73.-2-21

RESOLUTION # R14-336

RESOLVED that the Town Board release the cash bonds as the applicant, Dino Deriggi is no longer interested in building on that piece of land and the site plan has expired.. The Wetland Bond is $4450.00, Erosion & Sediment Control bond is $15,525.00 and remaining escrow is $3,114.50.

LAKE PEEKSKILL DISTRICT REPORT

Supervisor Tendy announced that last Saturday was “Meet Santa” at the Lake Peekskill Community Center, kids had a great time and it was a lot of fun.

Councilwoman Annabi announced that on January 24th there will be a Lake Peekskill District Meeting at 10 a.m., rain/snow date is January 31, 2014. She also read off the recycling guidelines for the residents of Lake Peekskill.

AUTHORIZE C-SLAP EXPENDITURE-LAKE PEEKSKILL

RESOLUTION # R14-337

RESOLVED that the Town Board authorize the expenditure of $410.00 for the volunteers in Lake Peekskill to participate in the New York Federation of Lakes C-Slap program for 2015.

The C-Slap participation fee is $360.00 and the membership fee in NYSFOLA is $50.00.

ACCEPT MILL PONDS END OF YEAR REVENUE REPORT

RESOLVED that the Town Board accept the 2014 year end Mill Pond Water District Revenue Report:

PUBLIC COMMENT

Library Board member Priscilla Keresey announced that the library is now open. It is still not in tiptop shape, but they are working on it. The Community Room is not ready to be rented, but computers are available for use. The pedestrian bridge is closed but vehicular bridge is open for pedestrian traffic only. Not sure if they will repair pedestrian bridge or do away with it, as the new vehicular bridge will be wide enough for a pedestrian walkway.

Councilwoman Annabi announced that Santa will be visiting different areas on Saturday, December 20th beginning at 8:45 a.m. and will be at the firehouse at 1:00 p.m..

County Legislator Oliverio told Town Counsel Zutt that it has been an honor to work with him over the years.

Building/Zoning Inspector Quaglietta thanked Town Counsel Zutt, and noted that it has been a pleasure working with him.
