Look Before You Lock

With summer's heat and the inherent risk it brings, the National Highway Traffic Safety Administration wants you to take special precautions about leaving children or anyone alone in a parked car...even for a few minutes.

NHTSA has joined Safe Kids, North Carolina Department of Transportation officials and health professionals nationwide to discuss ways to prevent child deaths and injuries in hot cars and urge parents and caregivers to think "Where's baby? Look before you lock."

When outside temperatures are in the low 80s, the temperature inside a vehicle can reach deadly levels in only 10 minutes, even with a window rolled down two inches. Children's bodies in particular overheat easily, and infants and children under four years old are at the greatest risk for heat-related illness.

Shell, Exxon Pass Walmart on Fortune Global 500 List

NEW YORK -- Move over Walmart, there is a new top dog on Fortune magazine's Global 500 list.

Taking the top stop is Royal Dutch Shell with a 28.1-percent increase in revenue in 2011. All told, the Netherlands-based company saw more than $484 billion in revenues and $30.9 billion in profits a 53.6-percent increase from 2010.

That was enough to push Wal-Mart Stores out of the top stop after a two-year reign on the magazine's annual ranking of the world's 500 largest corporations. In fact, the Bentonville, Ark.-based retailer fell to third behind Exxon Mobil Corp. According to the rankings, Exxon Mobil recorded a 35-percent increase in profits to $41 billion in 2011 and had more than $452 billion in revenue. Wal-Mart Stores earned large profits overseas but struggled in the United States, with a 4.2-percent decline in profits, the report added. All total, the retailer tallied more than $446 billion in revenue and more than $15 billion in profits.

BP began to recover from the Deepwater Horizon oil spill in the Gulf of Mexico to land at the No. 4 spot on the Global 500 list. In 2011 BP oil company saw its revenue top $386 billion and profits reach above $25 billion.

Other companies with ties to the convenience store industry also landed on the list. They are: Chevron (No. 8), ConocoPhillips (No. 9), Valero Energy (No. 35), Statoil (No. 40), Lukoil (No. 49), Marathon Petroleum (No. 106), Sunoco (No. 217), Hess (No. 278), Murphy Oil (No. 352),

Vt. Senator Seeks Gasoline Price Investigation

Asks why several counties seeing "substantially higher" prices than other parts of state, region!!!

BURLINGTON, Vt. -- U.S. Senator Sen. Bernie Sanders (I-Vt.) has called for a federal investigation into unusually high gasoline prices in the Burlington, Vt., area.

He asked the U.S. Department of Justice and the Federal Trade Commission (FTC) to conduct a joint investigation to determine why gasoline prices in Chittenden, Grand Isle and Franklin counties are substantially higher than other parts of the state, New England and similar areas throughout the country.

Bernie SandersIn his letter to U.S. Attorney General Eric Holder and FTC chairman Jon Leibowitz, Sanders asked them to determine whether high prices in Chittenden County were related to the fact that the four largest gas station companies in the county control 67 of the 115 stations, or 58% of the total.

During one month, prices in greater Burlington fell 15 cents a gallon--from $3.84 to $3.69 for regular unleaded. That's the lowest price reduction in any of the 15 metro regions throughout New England, according to AAA's Daily Fuel Gauge Report data. The average price drop at these New England metro areas for a gallon of regular unleaded was 25.9 cents during the month examined.

Greater Burlington, as defined by AAA, includes Chittenden, Grand Isle and Franklin counties. The analysis conducted by Sanders' office used the AAA data for monthly gasoline price changes with the month ending June 25. During this same time period, prices fell as much as 34 cents per gallon in Manchester, N.H.

The average price of regular unleaded gasoline sold in Vermont has been selling for more than the national average since April 2012, while gasoline in New Hampshire has been selling for less than the U.S. average since May 2012.

In Middlebury 35 miles south of Burlington prices were as low as $3.35 a gallon on July 2 and most gas stations there sold fuel for no more than $3.40 a gallon, according to Meanwhile, on the same day, a gallon of regular unleaded in St. Albans cost at least $3.63 a gallon. At some Burlington stations, a gallon of gasoline was just under $3.70.

Senator Sanders should insist the investigation include ‘ZONE PRICING’ of the oil companies and their secret zone maps. ‘Zone Pricing’ is an oil company charging a higher gasoline price in one area of a state more than another due to ‘Zone Pricing’ maps designed by each oil company (Shell, Chevron, BP, ExxonMobil) to name a few. Every state has ‘Zone Pricing’with the same issues.

QuikTrip Price-War Suit Set for Jury Trial

Resolution could be more than a year away

ST. LOUIS -- It could be a full year before a gasoline price-war lawsuit against QuikTrip is settled by a jury trial in Missouri, according to court documents filed this past week Daily News.

Following a court conference between representatives of defendant QuikTrip and plaintiff the Association of Independent Gas Station Owners (AIGO), U.S. District Judge Jean C. Hamilton signed a "case management order" designed to reduce courtroom delays and setting a 12-month schedule for proceedings to progress in the interim.

This action is set for a jury trial on Monday, July 1, 2013.

In the meantime, however, the document also sets aside Jan. 4 through March 4, 2013, to refer the case to "alternative dispute resolution" for a possible settlement before going to trial.

In the lawsuit filed in November, AIGO filed the complaint with the Eastern Division Court of Missouri claiming "QuikTrip's below-cost predatory pricing" has forced the plaintiffs "to set prices for gasoline below their costs in order to sustain their presence in the marketplace." "QuikTrip has engaged in this predatory price war of selling gasoline below its costs in order to dominate the marketplace in a manner that will allow it to recoup any losses it incurred as a result of its selling gasoline below its cost," stated the complaint.

Tulsa, Okla.-based QuikTrip denies selling gasoline below its cost and responded to the claims by stating that AIGO fails to meet legal definitions to warrant the lawsuit in several instances and requested the lawsuit be dismissed. That request was not granted, and the two sides were asked to meet to develop the timeline for the case to go to trial. A previous document suggesting a nonjury trial stated the case could take five days to try; there is no estimated timeframe for the jury trial.

AIGO, which is represented by West Moreland Service Inc. dba Go West Mart, George Minkevich and Edward Montgomery, requested in the original complaint that the court:

Enjoin QT's pricing practices.

Award the plaintiffs "in excess of $50 million," as well as court and attorney fees.

Impose penalties on QT.

Provide for additional relief as deemed appropriate.

More Than 200 Gas Stations in Danger of Closing This Fall

HARTFORD, Conn. -- Hundreds of Connecticut independent gasoline stations and convenience stores could be forced to go out of business this fall due to insurance issues, the Greenwich Time reported.

There are multiple sources of the problem. One is that Constitution State officials recently revised procedures used to clean up leaks around underground storage tanks (USTs), dealers have said.

Another problem is that retailers may find it very difficult to purchase insurance due to those policy changes. Insurance rates are now expected rise, the newspaper reported, forcing Connecticut retailers to raise their prices or go out of business after Oct. 1. C-store and gasoline station owners are required in the state to carry insurance on the underground tanks.

According to the news outlet, the insurance problem was exacerbated when Zurich American Insurance, a major insurer for the tanks, exited the business last week. "This is what we've been dreading," Larry Ancker, owner of the West Rocks Shell station in Norwalk, told the news source. "We're all being screwed by the legislature the DEEP (Department of Environmental Protection) because they cannot control their spending." However, DEEP spokesperson Dennis Schain told the Greenwich Time that Zurich's exit from tank insurance should not concern retailers.

"There is a competitive and robust market for UST coverage with several active players," he told the newspaper. "We have talked to several companies who provide this type of coverage and we are confident that station owners in Connecticut will be able to secure it."

House Minority Leader Lawrence Cafero, (R-Norwalk), opposed the legislation during a special session on June 12, foreseeing possible danger. "I appreciate the DEEP commissioner's optimism, but many independent gas stations can't fund remediation by themselves," he told the news outlet. "If the commissioner misses his hunch and other insurers don't come in, we're going to lose between 250 and 400 gasoline stations."

S.D. Supreme Court Overturns Fuel Dispute Ruling

Lower court excluded evidence of fraudulent contract

PIERRE, S.D. -- A split South Dakota Supreme Court has overturned a lower court ruling that ordered the owner of two North Sioux City, S.D., convenience stores to pay more than $925,000 in damages to a fuel supplier, said an Associated Press report.

The high court's 3-2 ruling said further proceedings are needed in circuit court to resolve disputed facts in the case.

James R. Brown, who farms near Gettysburg, S.D., bought two c-stores along Interstate 29 in North Sioux City in 2004, according to court documents cited by the news agency. Brown agreed to buy fuel from Stern Oil Co. Inc. of Freeman, S.D., but notified the fuel supplier in May 2007 that he would no longer buy its fuel because its prices were so high he could not make any profit when he set prices at the pump at levels competitive with other gas stations.

Stern Oil sued Brown for breach of contract. Brown filed a counterclaim alleging that Stern Oil fraudulently induced him to enter the contract by verbally guaranteeing he would make a profit of five cents a gallon on fuel sold.

Circuit Judge Bradley Zell of Sioux Falls, S.D., ruled in favor of Stern Oil on both claims, finding that Brown had breached his contract with the fuel supplier. The judge awarded Stern Oil more than $925,000 in damages for eight years of lost profits.

However, the Supreme Court said Zell had been wrong to exclude Brown's evidence that Stern Oil fraudulently induced him to agree to the contract by verbally guaranteeing him a five-cent-per-gallon profit. Stern Oil contends it did not make that guarantee. The high court's majority ruling said Zell decided the case too early because questions of fact remain to be determined on whether Brown signed the contract because he was relying on the alleged verbal guarantee that he would make a profit.

"This case is in large part a question of credibility: Brown says he signed the contract in reliance upon this representation and Stern Oil says he did not. Questions of credibility are also questions of fact for a jury," Chief Justice David Gilbertson wrote for the court majority. The high court's two dissenting justices agreed the circuit judge should have admitted evidence on Brown's allegations that he was fraudulently induced to sign the contract, but that Zell could rule in Stern Oil's favor because Brown failed to present sufficient evidence that he had relied on the alleged misrepresentation.

The majority opinion said questions of fact also remain to be resolved on whether a breach of contract occurred.

Brown argues that the contract was not enforceable because it did not set the price he would pay for fuel. The Supreme Court said more evidence is needed on whether Brown and Stern Oil intended to make an agreement that did not set prices.

Thirty-One Sites Hit Auction Block

NEW YORK -- Sheldon Good & Co. is leading an auction to sell a portfolio of 31 properties consisting of convenience stores with gas stations and development sites. The properties are located in New Jersey, Pennsylvania and Florida.

The sites, according to Sheldon Good, include profitable roadside businesses along highly trafficked routes and ready-to-build parcels of land. The assets can be purchased individually, in small groupings, or as a complete portfolio by submitting bids. The auction will conclude on Aug. 23.

The 31 properties are located in established retail corridors with major retailers and in secondary markets that are primed for development. Cities include Clearwater, Cape Coral and Ocala in Florida; Philadelphia, Phoenixville and Coatesville in Pennsylvania; and Lakewood, North Brunswick, Bayonne, Englewood, Jersey City, Paramus and others in New Jersey.

Nine of the available properties have long-term net-leases. A majority of the other commercial properties are vacant and all offer a range of redevelopment possibilities through flexible commercial zoning. The parcels range in size from 8,700 to 103,834 square feet and are ideal for a multi-tenant retail/office building, fast-food franchise or convenience store.

Washington Report: Bath Salts and Synthetic Marijuana Are Illegal

Legislation signed into law this week designates two chemicals commonly found in bath salts as FDA-controlled substances.

WASHINGTON –The Food and Drug Administration Safety and Innovation Act, which contains a provision that makes synthetic drugs like synthetic marijuana and bath salts controlled substance and therefore illegal to sell on store shelves.

Senator Rob Portman (R-OH), who authored the amendment that is now law, notes on his website the severe and horrific reactions people have had from taking these synthetic products: “In May, two Ohio men high on bath salts were shot by Columbus police as they tried to restrain their aggressive, violent behavior. In other recent cases of violence due to synthetic drug abuse, a man in Miami recently stripped himself of his clothes and tore into a helpless stranger’s face; a Baltimore man ate a fellow student’s heart and brain; a mother high on the drugs abused her young child in New York; and a Waco, Texas man ate his family dog.”

The National Conference of State Legislatures reports that at least 40 states have already banned synthetic marijuana products commonly known as "Spice or "K2," and 41 states have banned substitute cathinones, or bath salts, that can have similar effects as illegal drugs such as ecstasy and cocaine.

Oil Express issued an alert yesterday that McLean County has filed a forfeiture case against the owner of a BP

gasoline station in Naperville, Illinois, to seize his store because he used the property to sell synthetic drugs. Sheriff Mike Emery of McLean County, told the news source that local authorities want to “send a message to gasoline stations and convenience stores known to sell these drugs that the county is serious about getting the product off the shelves.”

As a result of the new law, sale and distribution of synthetic marijuana and bath salts is now classified by the federal government as the sale of controlled substances and is treated in a manner similar to the sale of cocaine, ecstasy and other illegal drugs.

Gas Stations Experience Sharp Decline in Sales

Retail sales are declining across the board, and gas stations receive the biggest blow.

Retail sales declined by 0.5% in June, following declines in May and April as more consumers cut spending on goods and services, the U.S. Department of Commerce reported.

The biggest decline in sales occurred at gas stations, which is a good thing for consumers, bad for the fueling industry. Sales in this category fell 1.8%. However spending fell sharply at most other stores, indicating that consumers have preferred to save money. The only retailers that reported high sales were clothing outlets, grocery stores, liquor stores and Internet sites such as Amazon, yet these increases were small.

The U.S. has not experienced a three-month decline in sales and spending since 2008, halfway through the Great Recession. Actual sales and spending failed to meet economists’ expectations, who had forecasted a 0.2% increase in sales.

“The soft patch in the U.S. economy looks just a bit softer after today’s news,” said economist Avery Shenfeld at CIBC World Markets.

Retail spending accounts for more than two-thirds of the nation’s economic growth. With weak retail sales, the U.S. economy is not likely to expand at a fast rate. The U.S. unemployment problem also won’t be resolved if consumer spending stays down.

Retail Gas Prices Expected to Decline in 2013

WASHINGTON, D.C. -- The Energy Information Administration (EIA) expects retail gasoline prices to drop below the July average by 2013 due to depressed consumer demand and continuing declines in crude oil prices, reports. . Drivers are likely to see prices below the current average of $3.41 per gallon by next year, stated the U.S. Energy Department.

Prices increased toward an average of $4 per gallon by April of this year, prompting some lawmakers to discuss tapping into strategic petroleum reserves. Since then prices have dropped; in June, the EIA lowered its predicted average price to $3.60 for the summer driving season.

In its short-term monthly outlook for July, the EIA projects that world oil demand will peak for the year during the third quarter of 2012.

Bonnie and Clyde Busted for Skimming

The couple installed six skimming devices at a single store with plans to target at least 100 more stores in the Minneapolis area.

MINNEAPOLIS – A California couple, Gohar Yesayan and Sarksis Mkhsyan, have been arrested for installing skimming devices on six fuel dispensers at a Shell station in New Hope, Minnesota.

When police arrested the couple, they uncovered a list of at least 100 gas stations the two were planning to target with skimming devices. This couple is also believed to be part of a more wide-spread criminal operation.

“In this case they were taking information from getting your credit card numbers and stealing your identity, and stealing all sorts of things," said Hennepin County Attorney Mike Freeman. "These are the kinds of white collar criminals that we have spent a lot of time on and will continue to. I'm hoping to put these folks in the big house for a chunk of time," he added.

Be vigilant and if you suspect something looks suspicious (a van or a trailer parked over your storage tanks), call police and copy the vehicles tag number. Florida has had many cases of stealing gasoline from gasoline stations while the station was open.

Weights and Measures Approves Reforms to Permit Fuel Discounts

The NCWM voted unanimously to revise regulations that enable retailers to comply with weights and measures regulations when offering fuel discounts

PORTLAND, Maine – The National Conference on Weights and Measures (NCWM) yesterday unanimously approved a proposal to revise Handbook 44 to remove restrictive language governing fuel price discounts and insert provisions that will provide retailers with the legal means to implement pro-consumer fuel marketing programs. The new provisions take effect on January 1, 2013.

"NACS has worked with NCWM and its retail price posting task group for more than a year to reform the code and allow retailers to implement creative marketing programs," explained NACS Vice President of Government Relations John Eichberger. "The current provisions essentially require every price at which a fuel product is offered for sale to be conspicuously posted on the dispenser and restrict the ability of retailers whose dispensers cannot automatically roll back the price from offering fuel discounts. We are pleased the conference adopted the task group’s recommended changes."

Eichberger explained that the goal of the task group was to facilitate the introduction of fuel price marketing programs while ensuring consumers are protected from deceptive practices. "We wanted to create rules that would provide retailers with the ultimate flexibility to benefit consumers, while ensuring that consumers and public officials could effectively audit a transaction and ensure that the price promised was actually the price charged."

Getty Realty Puts 66 Sites Up for Sale

CHICAGO -- Getty Realty Corp. has tapped NRC Realty & Capital Advisors to lead its divesture of 66 retail and commercial properties. The sites are spread through six markets in the Northeast and Mid-Atlantic regions.

Broken out by state, , 11 properties are in New York, 21 in New Jersey, 24 in Pennsylvania, six in Massachusetts, one in Connecticut and three in Delaware. All are fee-owned properties and the sale includes the improvements on the underlying real estate. There are no underground storage tanks at any of the locations, according to NRC.

Thirty-nine of the properties are closed, 25 locations have occupants in place under month-to-month license agreements, and two consist of vacant land. Original asking prices range from $75,000 to $1,000,000, and the properties are being offered at minimum bids of 50 to 60 percent of current asking prices, the advisory company added.

"These sites are very attractive for a variety of retail and commercial uses," said Dennis Ruben, NRC's executive managing director. "The majority are located on high-traffic corners in mature neighborhoods and in small towns. Investors will also be interested in bidding on many of the locations under licenses with operators."

The properties will be sold using NRC's well-known "buy one, some or all" sealed bid sale process. Property Specific Packages (due diligence packages) are expected to be available in late August, with a bid deadline of Oct. 2, NRC added. In addition, NRC will be coordinating property viewings on sites without tenants on Aug. 22, Aug. 28 and Sept. 12. Sites with tenants are open during normal business hours, and prospective bidders can view these sites as long as they do not disturb the users. Broker cooperation is encouraged, and a 3-percent broker co-op commission is being offered.

Northwest Motorists Disagree on Self-Serve Laws

A PEMCO Insurance poll suggests that nearly two-thirds of drivers in Oregon and Washington prefer their state’s respective full or self-service laws.

SEATTLE – Motorists from two neighboring states have significantly different views on full and self-service at the pump.

Recent poll results from PEMCO Insurance found that nearly two-thirds of drivers in Oregon and Washington prefer their state's full- and self-service gas-pumping laws, which dictate who's allowed to pump fuel at gas stations.

In Oregon, where it's illegal to pump your own gas, nearly two out of three drivers (63%) support the state's ban on self-service gas stations. In Washington, where drivers can choose between both full- and self-service stations, just one-third of that state's drivers favor the notion of mandated full-service gas, with 60% opposing laws that prevent them from pumping their own gas.

"It seems that drivers in both states prefer what they're most familiar with," said PEMCO spokesperson Jon Osterberg. "In casual conversations, I've heard many Washington residents voice frustration at Oregon's mandatory full-service law, and we suspected Oregonians might share that sentiment. But our poll shows that's not the case."

Oregon is one of just two states that ban self-service gas stations, with New Jersey requiring a similar full-service experience.

The Oregon State Legislature passed the self-service ban in 1951 (although self-service didn't become popular nationwide until the early 1970s) on the basis that self-service gas stations are less safe, increasing the risk of accidental fires. The Oregon Revised Statutes also defend today's law on economic grounds, citing that "self-service dispensing at retail locations contributes to unemployment, particularly among young people."

According to the PEMCO poll, Washington residents are unconvinced of the economic benefits of gas-pumping laws. The poll presented drivers with a proposed scenario suggesting that a shift from Washington's self-service model to the full-service law would result in an increased cost of about five cents per gallon and create new jobs for Washington residents. Despite the prospect of new jobs, nearly two-thirds of Washington drivers said they would oppose costlier gasoline.

Oregon drivers, however, are more motivated by economic factors about half (49%) said they would consider favoring a change in the self-service ban if it meant saving as little as five cents per gallon.

The poll also looked at who, among drivers, is most likely to support full-service gas requirements. In Oregon, about seven out of 10 women support full-service gas stations, while only about half of men feel the same way. In Washington, both males and females generally oppose full-service stations. Also in Washington, those with incomes above $50,000 are much more likely to oppose changing the law than are those with incomes below $50,000.

FinCEN Announces Launch of FinCEN Updates E-mail Subscription News Service

The Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free

e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.

FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security. Users can opt to have FinCEN Updates sent immediately, daily, weekly, or monthly to their e-mail accounts or directly to a wireless device.

FinCEN selected the GovDelivery® E-Mail Subscription Management service to monitor designated website content and to send an e-mail to alert subscribers when there is new information posted on FinCEN’s public websites. Subscribers will receive e-mails from the
