Acting Secretary of State Robert Torres announced that 98 disciplinary actions have been taken by the Bureau of Professional and Occupational Affairs' 29 professional licensing boards, the Bureau of Charitable Organizations and the Division of Legislation and Notaries of the Bureau of Commission, Elections, and Legislation:

PA Board of Accountancy

Allegheny County Deborah Luteran Iwanyshyn, certificate and license no. CA014069L, of Allison Park, Allegheny County, had a public reprimand placed on her permanent disciplinary record with the Board, was ordered to cease and desist, and paid costs of investigation of $526.32, because she failed to meet the conditions which would allow her to use the "CPA" designation without a current license to practice public accounting solely as a mark of achievement. Merrill John Druggs, certificate and license no. CA010455L, of Gibsonia, Allegheny County, permanently and voluntarily surrendered his license, because he pled guilty to a felony; plead guilty to a crime, an element of which is dishonesty or fraud; and was convicted of a felony. (9/19/17)

Bucks County Jeanne E. Swain, certificate and license no. CA015584L, of Yardley, Bucks County, permanently and voluntarily surrendered her license, because she pled guilty to a felony under Pennsylvania law, an element of which was dishonesty and was convicted of a felony offense in Pennsylvania. PA Architects Licensure Board

Montgomery County James S. Borchard, registration no. RA014570B, of Narberth, Montgomery County, was ordered to pay a civil penalty of $3,000, because he engaged in the practice, or offered to engage in the practice of architecture in this State, or used the title of architect or used any sign, card or device implied that such Respondent is an architect, or is competent to engage in the practice of architecture, without holding a currently valid certificate pursuant to this act. Allegheny County Independent Settlement Services LLC, registration no. AMC000096, of Pittsburgh, Allegheny County, was publicly reprimanded and ordered to pay a civil penalty of $2,500, because it was subject to a disciplinary action by an agency of another jurisdiction responsible for regulating appraisers, mortgage brokers, real estate salesperson or real estate brokers, and failed to notify the Board in writing within thirty days after its occurrence. Lackawanna County Anthony John Cherundolo, certificate no. GA001115L, of Old Forge, Lackawanna County, was ordered to pay a civil penalty of $4,000, pay the costs of investigation in the amount of $1,000, and successfully complete at least twenty-nine (29) hours of remedial education, because he failed to complete an appraisal assignment within the requirements of the USPAP, failed or refused to exercise reasonable diligence in developing an appraisal, preparing an appraisal report, or communicating an appraisal, and negligently or incompetently developed an appraisal, prepared an appraisal report, or communicated an appraisal. Edna Friedberg, certificate no. RL139350, of Clarks Summit, Lackawanna County, paid a civil penalty of $2500 and costs of investigation of $1250 and shall attend and successfully complete at least twenty-nine total hours of remedial education because she failed to complete an appraisal assignment within the requirements of the USPAP. Philadelphia County Harry J. Dougherty, certificate no. RL000597L, of Philadelphia, Philadelphia County, was ordered to pay a civil penalty of $3,000, to pay the costs of investigation of $1,000, and to attend and successfully complete at least twenty-nine (29) total hours of remedial education, because he failed to complete an appraisal assignment within the requirements of the USPAP, failed or refused to exercise reasonable diligence in developing an appraisal, preparing an appraisal report, or communicating and appraisal, and negligently or incompetently developed an appraisal, prepared an appraisal report, or communicated an appraisal. Out of State Larry M. McDaniel, certificate no. GA001335R, of Parkersburg, West Virginia, permanently and voluntarily surrendered his license, because he was convicted of or pleaded guilty to a crime which is substantially related to the qualifications, functions, and duties of a person developing real property appraisals and communicating real property appraisals to others, and has been convicted of a felony. RL002011R, of Laurel Springs, New Jersey, was suspended for a period of 3 years; after 6 months of active suspension he may petition the Board to reinstate his certificate to probationary status; was ordered to pay a civil penalty of $3000, costs of investigation of $1000 and to complete remedial education because he failed to complete an appraisal assignment within the requirements of USPAP; failed or refused to exercise reasonable diligence in developing an appraisal, preparing an appraisal report, or communicating an appraisal; and negligently or incompetently developed an appraisal, prepared an appraisal report or communicated an appraisal report. PA Board of Cosmetology

Bradford County Urban Connection, license no. CB120194, of Athens, Bradford County, was ordered to cease and desist from operating as a cosmetology salon in Pennsylvania unless or until the required license(s) are current and valid; and was ordered to pay a civil penalty in the amount of $500, because it violated the law by using or maintaining any place for the practice of cosmetology without a current and active license. Monroe County Waterlilly Spa, license no. CB125551, of Bartonsville, Monroe County, was ordered to pay a civil penalty of $8,000 and must cease and desist from possessing and using metal credo tools in the practice of nail technology and or cosmetology because it operated as a cosmetology salon in a grossly incompetent, dishonest, and unethical manner through the possession of and use of metal credo tools, with each tool found representing a separate count. Bucks County Harvey Jay Goldberger, license no. DS021138L, of Newtown, Bucks County, had a public reprimand placed on his permanent disciplinary record with the Board, was ordered to pay a civil penalty of $5,000 and a fine of $668 to cover the costs of investigation and ordered to immediately cease and desist from the use of White Bright or any similar product as a prophylaxis or any other off-label use, because he committed unprofessional conduct by using a whitening agent as a prophylaxis paste on minor children without informed consent. Chester County Ronald J. Briglia, license no. DS024039L, of Chester Springs, Chester County, had a public reprimand placed on his permanent disciplinary record with the Board, and was ordered to pay a civil penalty of $1,500 and a fine of $654 to cover the costs of investigation because he committed unprofessional conduct by failing to provide a patient with her treatment records despite her written request. Out of State Karen F. Wright, license no. DH071250, of Ridgewood, New Jersey, permanently and voluntarily surrendered her license, because she had her license to practice as a dental hygienist disciplined by the proper licensing authority of another state. (9/15/17)

Joytilak Majumdar, license no. DS036304, of West Windsor, New Jersey, had a public reprimand placed on his permanent disciplinary record with the Board and ordered to pay a civil penalty of $2,500 because he had his license to practice dentistry disciplined by the proper licensing authority of another state. DS037612, of East Brunswick, New Jersey, had a public reprimand placed on his permanent disciplinary record with the Board and ordered to pay a civil penalty of $5,000 because he had his license to practice dentistry disciplined by the proper licensing authority of another state. PA Board of Professional Engineers, Land Surveyors and Geologists

Out of State Ross Alan Stevens, license and registration no. PE037040R, of New London, New Hampshire, paid a civil penalty of $2,500 and had a public reprimand placed on his permanent disciplinary record with the Board because he practiced the profession of engineering without holding a license and a current registration in the Commonwealth. PA Board of Massage Therapy

Chester County Ocean Spa, an unlicensed massage parlor of Downingtown, Chester County, was ordered to cease and desist from hiring or employing any individual to perform or offering to perform any activity requiring a license to practice as a massage therapist in the Commonwealth of Pennsylvania who does not have a license issued by the Board unless and until the Board issues such individual the appropriate authorization to practice the profession, pay a civil penalty of $3,000.00, and pay costs of investigation of $1,156.95, because the massage parlor, through its Responsible officer, employed two individuals to provide massage therapy/bodywork services even though the aforementioned individuals were not licensed by the Board. Out of State Jamie Lynn Hughson, license no. MSG001017, of Jeffersonville, New York, permanently and voluntarily surrendered her license, because she failed to complete twenty-four (24) hours of acceptable continuing education during the renewal period of February 1, 2011 to January 31, 2013, submitted a false or deceptive biennial registration to the Board, and failed to complete twenty-four (24) hours of acceptable continuing education during the renewal period of February 1, 2013 to January 31, 2015. Allegheny County Martha M Kachmaryk, license no. MD446985, of West Mifflin, Allegheny County, permanently and voluntarily surrendered her license, because she had a license or other authorization to practice the profession suspended, revoked, refused or otherwise disciplined by the proper licensing authority of another state, territory, possession or country, or a branch of the Federal Government and because she is unable to practice medicine with reasonable skill and safety to patients by reason of psychiatric illness. MD054184L, of Churchville, Bucks County, was ordered to pay a civil penalty of $525 and ordered to complete the necessary continuing education, because he failed to complete at least one hundred (100) hours of continuing medical education in the 2013-2014 biennial reporting period, of which at least twenty (20) credit hours consisted of AMA PRA Category 1 activities; at least twelve (12) hours consisted of activities related to patient safety or risk management in either Category 1 or 2 and with the remaining credit hours completed in either Category 1 or Category 2 approved activities. MD044041E, of Media, Delaware County, was ordered to pay a civil penalty of $650 and to attend and complete the missing hours of continuing education, because he failed to complete at least one hundred (100) hours of continuing medical education in the 2013-2014 biennial reporting period, of which at least twenty (20) credit hours consisted of AMA PRA Category 1 activities; at least twelve (12) hours consisted of activities related to patient safety or risk management in either Category 1 or 2 and with the remaining credit hours completed in either Category 1 or Category 2 approved activities.
