Prioritizing the Bill of Rights

Scenario: Many think that the most important amendments to the Constitution were the 10 devised in 1791 to appease the anti-federalists, just two years after ratification.

Directions: Your group’s task is to place these 10 amendments in order of importance, assigning the number 1 to the one you consider MOST important, and number 10 to the one you consider LEAST important.

Decisions should be reached by a majority vote. Summarize your reasons for the highest and lowest choices.

____. 1st Amendment: Freedom of Expression (religion, speech, the press to assemble + to petition)

____ 2nd Amendment: The Right to Bear Arms

____ 3rd Amendment: Protection against quartering (housing) soldiers

____ 4th Amendment: Protection against unreasonable search + seizure

____ 5th Amendment: The right to due process of law, including

protection against self-incrimination.

____ 6th Amendment: The rights granted to an accused, including a

speedy public trial w/ an impartial jury; the right of an accused to be informed of charges against him/her; the right to confront the accuser; the right to an attorney.

____ 7th Amendment: The right to a trial by jury.

____ 8th Amendment: Protection from excessive bail; Cruel + unusual punishment.

____ 9th Amendment: The guarantee of unenumerated (not listed)

rights retained by the people.

____ 10th Amendment: The guarantee that states or the people have all

the rights not delegated to the federal government or prohibited to the states.
