Exercises – Cost Effective Lexis and Westlaw and Lexis and Westlaw Alternatives

Research Certificate Seminar – March 10, 2011

1. Using Casemaker, do a multibook search of Case Law and Unreported Appellate Cases in Ohio in order to answer the following question:

Whether a car considered a deadly weapon for purposes of the Ohio felonious assault statute when a police officer is pinned between the driver’s side door and the defendant’s vehicle, and the defendant accelerates at a high rate of speed.

The case is in the Twelfth appellate district.

a. What was your search statement?:

~car “deadly weapon” “felonious assault” pinned

b. Did you find any cases with similar facts from the 12th district?

State v. Upham (May 12, 1997), Butler App. No. CA96-08-157

2. Using Google Scholar, can you find the case you found to answer 1(b)? If not, why?

No, because unreported cases do not go back that far on Google Scholar.

3. On Casemaker, sign up for the free trial of Casecheck Plus.

Pull up the case Scott-Pontzer v. Liberty Mut. Fire Ins. Co., 1999-Ohio-292, 85 Ohio St.3d 660, 710 N.E.2d 1116

Can you tell if the case is still good law? How does Casecheck Plus compare to Shepards or Keycite?

I don’t have CaseCheck Plus anymore.

With regular CaseCheck, it is hard to tell. Better off do a search such as w/5 scott-pontzer reversed

Try pulling up the case on Google Scholar. How can you tell whether the case is still good law?

Just gives a list of cases, but at least Westfield v. Galatis is the first case. Westfield technically limited Scott-Pontzer, but in my mind overruled it, until it was superseded by statute.

4. On Google Scholar, search for Ohio cases concerning whether it was proper to grant a motion for summary judgment in case involving fraud or misrepresentations made by the seller of a home.

What was your search statement?

"summary judgment" sale home ~fraud OR ~misrepresentation

Give the citation for a case on point:

Jacobs v. Racevskis  (1995), 105 Ohio App. 3d 1, 663 NE 2d 653

5. Using CCH, find a discussion of whether age can be a bona fide occupational qualification for establishing firefighter retirement age

What was your search?

age bona fide occupational qualification

Give the citation for one such discussion

Spencer's Benefits Reports: Discrimination,401.04.-1,Mandatory Retirement Allowed If Age Is Bona Fide Occupational Qualification; Two-Part Test Required
