| |purpose’ appears anywhere in the document and ‘lease’ appears within five words of ‘conversion’. If you want ‘lease’ to|
| |appear w/in 5 words of ‘conversion’ and w/in 5 words of ‘public purpose’, you must enter: lease w/5 conversion and |
| |lease w/5 public purpose . In other words, if you enter ‘and’ after a w/# connector, the connection ends at the ‘and’. |
| |Write a Specific Search: Use ‘Segments’ to restrict your search to specific sections of a document – e.g. if you want |
|Entering Search Terms: |to limit a search to cases from Hawai‘i, the Ninth Circuit or U.S. Supreme Ct., you should add the following to the |
|Terms & Connectors & |beginning of your search: court (hawaii or ninth or (united w/4 supreme)) and . This tells the system to look in the |
|Focus +: |section of the case where the court name is provided & to limit results to only those cases in which either the word |
|Segments |‘hawaii’, ‘ninth’ or ‘united w/4 supreme’ (U.S. Supreme Ct. cases) are part of the court name. |
| |Segments Listings: You can quickly review what segments (i.e. sections) of a document you can search by clicking on the|
| |‘Select a Segment’ drop-down menu |
| |Use the ‘Natural Language’ radio button to rank documents based on how frequently terms are used – e.g. if you select |
|Entering Search Terms: |‘Natural Language’ and enter lease conversion, the system will display documents that utilize ‘lease’ and/or |
|Natural Language |‘conversion’ most frequently. When using ‘Natural Language’, you must use quotations if you want the system to search |
| |for a phrase: e.g. you must enter “lease conversion” if you want to rank documents based on how frequently this phrase |
| |appears in documents. If your term is a verb, enter the verb’s singular & plural forms & all verb tenses: e.g. |
| |‘disclose’, ‘discloses’, ‘disclosed’, disclosing’. Mandatory Terms: Use the ‘Mandatory Terms’ feature to require that |
| |certain terms appear in a document. If you want to include synonyms in your Mandatory Terms search use parentheticals: |
| |e.g. if in the Mandatory Terms box, you enter: “public trust”, water (river, ocean, lake), Lexis will return only |
| |documents containing ‘public trust’, as well as ‘water’ or ‘river’ or ‘ocean’ or ‘lake’. |
|Retrieving Relevant Case Law |

|Search Advisor |located in the top left side of the Lexis page. Then, browse the folders to find a relevant topic or search for|
|Retrieve all headnotes related to a particular topic |a relevant topic using the “Find a Legal Topic” search engine. After selecting a topic, select a jurisdiction. |
| |Then, click the “Go” button to retrieve all headnotes related to the chosen topic. Review results or retrieve |
| |seminal cases for the chosen topic by clicking the “In-Depth Discussions” link. You may also use the “Focus” |
| |link to search for additional issues and/or facts within your answer set. |
|Finding Tool: | |
|Search Advisor |Follow the steps listed above to select a Search Advisor topic & case-law jurisdiction. Then, click the |
|Pull all Hawai‘i cases related to a particular topic |“Search” button, without entering any terms, to view all cases related to the chosen topic. Use the “Focus” |
| |link to pinpoint the most relevant cases. |
|H.R.S. & H.A.R. : Effective & Efficient Use |

| |Go to the ‘Hawaii’ folder/tab. Click the ‘HI – Hawaii Revised Statutes Annotated’ link or the “HI – Weil’s Code|
|H.R.S. & H.A.R. : |of Hawaii Rules” (H.A.R.) link. Click the “Table of Contents” radio button (under the search box). Enter the |
|Retrieving One Section or an Entire Chapter |Section # (e.g.: 482-1) or the Chapter # (e.g.: 482) or name (e.g.: trademark) & click “Search”. Click on the |
| |links to access sections. You may download, print or email sections by checking the boxes in front of the |
| |desired section(s)/chapter. |
| |Go to the ‘Hawaii’ folder/tab. Click on the ‘HI – Hawaii Revised Statutes Annotated’ link or the “HI – Weil’s |
|H.R.S. & H.A.R : |Code of Hawaii Rules” (H.A.R.) link. Browse the Table of Contents by clicking the [pic] symbols, or search the |
|Browsing H.R.S. |TOC by clicking the “Table of Contents” radio button and running a search. |
| |When viewing a section, you can easily jump to the Table of Contents by clicking on the “TOC” link located in |
|H.R.S. & H.A.R. : |the top left portion of the LexisNexis page. You may also link to a particular subsection (e.g.: a Chapter or |
|Accessing the Table of Contents when Viewing a |Division) by using the TOC hierarchy links located at the top of the document in the center of the page. Note |
|Section (§) |that if you move your cursor over the “. . .”, you will be given additional links to Titles, Sub-parts and |
| |Chapters. |
| |Go to relevant section of the Table of Contents. Either browse to the relevant portion of the TOC using the |
|H.R.S. & H.A.R. : |[pic] symbols, or jump to the TOC by pulling up a relevant section & clicking on the TOC link at the top of the |
|Printing and/or Downloading Multiple Sections |section. Once you are viewing the relevant portion of the TOC, click the white squares in front of any Sections|
| |or Chapter that you would like to print or download. To print the sections, click the ‘Print’ link or Fast |
| |Print button (choose ‘Full’ if you would like to print the full text of the selected documents or ‘Cite’ if you |
| |would like to print a listing of the titles of the documents). To download sections, select relevant sections &|
| |click the “Download” link (top, right side of page). Choose “Document View” “Full” or “Cite” depending on |
| |whether you would like to download the full text of each document or just the title of each document. Then, |
| |click “Download”. |
| |Annotations: Reviewing annotations is a great way to begin researching how a statute is interpreted. However, |
|H.R.S.: |annotations are often not published until a year or more after opinions cite the statute. You must Shepardize |
|Annotations & |statute to see recent cites. |
|Shepard’s Reports |Shepard’s: Shepard’s lists opinions that cite a statute w/in 48 hours of the opinion’s release. To view |
| |Shepard’s report, pull up the applicable H.R.S. section w/ the Lexis. Then, click the ‘Shepardize®’ link at the |
| |top of the page. |
|Shepard’s: Effective & Efficient Use |
|Feature |Description |
| |Using the ‘Custom’ link w/in Shepard’s is KEY to doing effective & efficient research (link located in the |
|Shepard’s ‘Custom’ link: |top/center of each Shepard’s report). The ‘Custom’ link enables you to quickly discard irrelevant citing |
|Discard Irrelevant References |references by limiting your Shepard’s report to relevant jurisdictions and relevant types of treatment. Click |
| |the link, check the boxes next to relevant types of treatment and jurisdictions, or to relevant secondary |
| |sources. Then, click the ‘Show Restrictions’ button. |
| |The ‘Focus’ link w/in Shepard’s is also critical to doing effective & efficient research (link located in the |
|Shepard’s ‘Focus’ link: |top/center of each Shepard’s report). The ‘Focus’ link enables you to search the full text of all citing |
|Limit Report to Relevant Issues &/or Facts |references in your Shepard’s report and thereby limit the report to references containing relevant issues &/or |
| |facts. Generally best to use the ‘Custom’ link first, and then use the ‘Focus’ link. Click the ‘Focus’ link & |
| |then, enter terms that cover your issues and/or facts. Note that ‘Focus’ uses the ‘Terms & Connectors’ search |
| |engine (so, you can search with connectors & segments, and the system automatically places quotes around any |
| |terms not separated by ‘and’ or ‘or’ (see page 1 of this guide for details)). |
| |You should Shepardize the following sources whenever you rely on them: |
|Shepard’s Sources: |1) Federal & State Statutes (e.g. H.R.S.), 2) Federal & State Court Rules (e.g. all HI Ct. Rules), 3) Federal & |
|Shepardize ~Everything |State Regulations (e.g. C.F.R.), 4) Law Review Articles, and 5) Case Law. Shepard’s updates all case citations |
| |w/in 48 hours of the release of opinions. Shepard’s is thus MUCH more current than annotations to statutes, |
| |regulations & court rules. Relying solely on annotations could result in malpractice. Shepardize any of the |
| |above sources by retrieving the relevant document with the LexisNexis Total Research System. Then, click the |
| |‘Shepard’s’ tab & the ‘Get’ button. Use the ‘Citation Formats’ link as needed. |
|Printing, Downloading & Emailing Documents |
|Feature |Description |
| |You can quickly print a document in single-column format by simply clicking on the “Print” icon located in the |
|Printing: |top row of your browser. The print job will be sent to whatever printer is attached to your computer. |
|Single-Column Printing | |
| |You can easily print selected text from a screen. Select the text you desire to print. Then, click the “File” |
|Printing: |menu located in the top left portion of the browser. Choose “Print” and then choose the “Selection” radio |
|Selected Text |button. Send the selection to the printer by clicking the “Print” button. |
| |To print a case in dual-column format, utilize the ‘Print’ link or red ‘Fast Print’ button. If you are viewing |
|Printing: |a Cite List (results list), Table of Contents, or Shepard’s report, you can print multiple documents at one time|
|Dual-Column Printing |by clicking the white squares in front of the documents that you desire. After selecting the documents, click |
| |the ‘Print’ link or ‘Fast Print’ button. Select ‘Full’ if you would like to print the full text of the |
| |documents or select ‘Cite’ if you would like to print a listing of the titles of the documents. |
| |To download or email documents, click the ‘Download’ or ‘Email’ link located in the top right portion of the |
|Downloading & Emailing: |Lexis page. If you are viewing a Cite List (results list), Table of Contents, or Shepard’s report, you can |
| |download or email multiple documents at one time by clicking the white squares in front of the documents that |
| |you desire. After selecting the documents, click the ‘Download’ or ‘Email’ link. Choose “Document View: Full” |
| |or “Cite” depending on whether you would like to download/email the full text of each document or just the title|
| |of each document. Then, click the “Download” or “Send” button. |
|Outstanding Research Tools |

| |LexisNexis automatically saves a link to every search that you run and stores this information for one month.|
|Archived History for |To rerun past searches, click the “History” link located in the top right portion of the Lexis page. |
|One Month |‘Archived Activity’ & ‘Today’s Results’ tabs: All of “Today’s” searches are listed under the ‘Today’s |
| |Results’ tab (located in the top/left of the History page). At ~8pm HST each night, ALL of ‘Today’s’ |
| |searches are moved to the ‘Archived Activity’ tab (located in the top/left of the History page) where they |
| |are stored for 29 days. So, one month of searches is always stored under either the ‘Today’s Results’ tab or|
| |the ‘Archived Activity’ tab. |
| |You may copy & paste a quote & citation, or just a citation into a Word document if you so desire. Use the |
|Copy with Cite |Research System to retrieve the document that you wish to copy. To copy a quote & citation, select the |
| |appropriate text. Then, click the “Copy w/ Cite” link located in the top middle portion of the Lexis page. |
| |If you want to copy only the citation, click the “Copy w/ Cite” link without selecting any text. Once, the |
| |“Copy w/ Cite” pop-up window appears, select whether you would like the link to be copied as a hyper-text |
| |link. Then, click “Copy to Clipboard.” Open the Word document of your choice & paste the citation into the |
| |document as desired (move the cursor to the appropriate location & click “Edit” and then “Paste”). |
| |Use the ECLIPSE feature to be automatically alerted to issues of interest. For example, ECLIPSE will notify |
|Automatic Daily, Weekly or Monthly Searches: |you whenever issues of interest are discussed in new: opinions, law review articles, etc. To set up an |
|ECLIPSE |ECLIPSE automatic search, select the source that you would like to have searched & select ‘Terms & |
| |Connectors’ search box. Enter the terms for which you would like the system to automatically search. Run |
| |the search and then click the “Save As ECLIPSE” link located in the top, middle portion of the Lexis page. |
| |Select daily, weekly or monthly as desired & your desired method of notification. Save the ECLIPSE. Contact|

|Find a Source Tab: |The ‘Find a Source’ tab enables you to search the titles of EVERY source in the LexisNexis Total Research |
| |System. Great way to quickly find quality sources. To use the tab, click on the ‘Search’ tab (top/left side|
| |of LexisNexis page – next to the ‘Research Tasks’ tab). Then, click the gray ‘Find a Source’ tab. Enter a |
| |word or two that you believe will be contained in the title of the source (database). The order does not |
| |matter (e.g. honolulu advertiser will return the same results as advertiser honolulu). Do not enter a |
| |detailed query b/c if you enter one word that is not contained in the title, you will not be shown that |
| |source. Often times, you will see the same title/source listed several times (e.g. you will see “The |
| |Honolulu Advertiser” listed three times). Each listing is the exact same database. Databases are placed in |
| |multiple folders to make it easier for people to find databases. |
| |Easily check the content and currency of a source by clicking on the “i” box to the right of each source – |
|Checking the Content & Currency of Sources: |e.g. if you would like to determine what jurisdictions are included in the source entitled, “HI Federal & |
|[pic] button |State Cases, incl. US Supreme Ct.”, click on the square with an “i” in it, located just to the right of the |
| |title of the source. |
