UPDATE YOUR PROFILE

The Board’s regulations require that all MDs, DOs, DPMs, Residents and University Limited licensees submit information for inclusion on the Board’s Practitioner Information System, also known as profiles. The regulations also require that within 30 days of any changes to your required information, that you provide those changes to the Board, either online or by paper.

The 1-2% random audit routinely picks up practitioners that have failed to submit changes to their profile when their required information changes. Deficiencies in profile data have consequences that range from courtesy letters to significant monetary penalties. Help the system work better by keeping your information up to date.

To provide a reminder and to help licensees with required profile compliance, the Board will endeavor to incorporate updating of one’s profile into the online license renewal process beginning in November. Paper renewals will also receive a reminder. (

MIXING, DILUTING AND RECONSTITUTING

The Board promulgated emergency regulations regarding compounding activities in physicians’ practices, but those have expired. Final regulations, to replace the emergency regulations, were approved by the Board at its June 2007 meeting.

Until recently, compounding has been part of pharmacy practice, and as such, any activity that fell under the definition of compounding, was under the purview of the Board of Pharmacy. That has changed. To distinguish compounding, governed by the Board of Pharmacy, from such activities that occur in physicians’ practices, law was passed and regulations promulgated regarding mixing, diluting and reconstituting of drugs for administration.

The law requires that all physicians that perform mixing, diluting or reconstituting in their practices report that fact to the Board. The law also requires inspections of physicians’ practices to ensure compliance with the law and regulations. The Board will incorporate reporting regarding mixing, diluting or reconstituting into the license renewal process this fall. The data collection will go on throughout 2008, and inspections will most likely begin in 2009.

The following final regulations have been approved by the Governor, and will become effective on September 19, 2007.

Mixing, Diluting or Reconstituting of Drugs for Administration

18VAC85-20-400. Requirements for immediate-use sterile mixing, diluting or reconstituting.

A. For the purposes of this chapter, the mixing, diluting, or reconstituting of sterile manufactured drug products, when there is no direct contact contamination and administration begins within ten hours of the completion time of preparation shall be considered immediate-use. If manufacturers’ instructions or any other accepted standard specifies or indicates an appropriate time between preparation and administration of less than ten hours, the mixing, diluting or reconstituting shall be in accordance with the lesser time. No direct contact contamination means that there is no contamination from touch, gloves, bare skin or secretions from the mouth or nose. Emergency drugs used in the practice of anesthesiology and administration of allergens may exceed ten hours after completion of the preparation, provided administration does not exceed the specified expiration date of a multiple use vial and there is compliance with all other requirements of this section.

B. Doctors of medicine or osteopathic medicine who engage in immediate-use mixing, diluting or reconstituting shall:

1. Utilize the practices and principles of disinfection techniques, aseptic manipulations and solution compatibility in immediate-use mixing, diluting or reconstituting; and

2. Ensure that all personnel under their supervision who are involved in immediate-use mixing, diluting or reconstituting are appropriately and properly trained in and utilize the practices and principles of disinfection techniques, aseptic manipulations and solution compatibility.

3. Establish and implement procedures for verification of the accuracy of the product that has been mixed, diluted, or reconstituted to include a second check performed by a doctor of medicine or osteopathic medicine or a pharmacist, or by a physician assistant or a registered nurse who has been specifically trained pursuant to subdivision B 2 of this subsection in immediate-use mixing, diluting or reconstituting. Mixing, diluting or reconstituting that is performed by a doctor of medicine or osteopathic medicine, a pharmacist, or by a specifically trained physician assistant or registered nurse does not require a second check.

4. Provide a designated, sanitary work space and equipment appropriate for aseptic manipulations.

5. Document or ensure that personnel under his supervision documents in the patient record or other readily-retrievable record that identifies the patient, the names of drugs mixed, diluted or reconstituted and the date of administration.

6. Develop and maintain written policies and procedures to be followed in mixing, diluting or reconstituting of sterile products and for the training of personnel.

C. Any mixing, diluting or reconstituting of drug products that are hazardous to personnel shall be performed consistent with requirements of all applicable federal and state laws and regulations for safety and air quality, to include but not be limited to those of the Occupational Safety and Health Administration (OSHA). For the purposes of this chapter, Appendix A of the National Institute for Occupational Safety and Health publication (NIOSH Publication No. 2004-165), Preventing Occupational Exposure to Antineoplastic and Other Hazardous Drugs in Health Care Settings is incorporated by reference for the list of hazardous drug products and can be found at niosh/docs/2004-165.

18VAC85-20-410. Requirements for low, medium- or high-risk sterile mixing, diluting or reconstituting.

A. Any mixing, diluting or reconstituting of sterile products that does not meet the criteria for immediate-use as set forth in 18VAC85-20-400 (A) shall be defined as low-, medium-, or high-risk compounding under the definitions of Chapter 797 of the U. S. Pharmacopeia (USP).

B. Until July 1, 2007, all low-, medium-, or high-risk mixing, diluting or reconstituting of sterile products shall comply with the standards for immediate-use mixing, diluting or reconstituting as specified in 18VAC85-20-400. Beginning July 1, 2007, doctors of medicine or osteopathic medicine who engage in low-, medium-, or high-risk mixing, diluting or reconstituting of sterile products shall comply with all applicable requirements of USP Chapter 797. Subsequent changes to the USP Chapter 797 shall apply within one year of the official announcement by USP.

C. A current copy, in any published format, of USP Chapter 797 shall be maintained at the location where low-, medium- or high-risk mixing, diluting or reconstituting of sterile products is performed.

18VAC85-20-420. Responsibilities of doctors who mix, dilute or reconstitute drugs in their practices.

A. Doctors of medicine or osteopathic medicine who delegate the mixing, diluting or reconstituting of sterile drug products for administration retain responsibility for patient care and shall monitor and document any adverse responses to the drugs.

B. Doctors who engage in the mixing, diluting or reconstituting of sterile drug products in their practices shall disclose this information to the board in a manner prescribed by the board, and are subject to unannounced inspections by the board or its agents. (

PAIN MANAGEMENT REGULATIONS

For approximately 10 years, the Board has had a guidance document addressing the use of opioids for chronic nonmalignant pain. Over the last decade, the use of opioids for chronic nonmalignant pain has increased and so have the opportunities for diagnostic and treatment errors by physicians, as well as the opportunities for abuse and diversion by patients. The Board believes that greater clarity regarding the Board’s expectations for the use of opioids is necessary. Over the last year, an ad hoc committee has looked at the issue of writing controlled substances for pain and has made its recommendations in the form of draft regulations. The regulations, essentially a distillation of the guidance document, were approved by the Board at its June 2007 meeting. The regulations will include definitions of acute and chronic pain, as well as requirements for assessing each type. The requirements for the management of chronic pain will be more detailed in regards to evaluation of the patient, development of a treatment plan, informed consent, agreement for treatment, periodic review, consultation and requirements for medical records. The medical record will be expected to contain an H & P, PMH, records from previous providers, labs and other diagnostic studies, consultations, treatment goals, discussion of risks and benefits, informed consent, agreement for treatment, treatments, medications, instructions, agreements and progress notes. There will be an opportunity for comment at some time in the future, most likely in the fall. Check Virginia Regulatory Townhall () to stay abreast of developing regulations. The periods of comment will be listed there. Comment that is received outside a formal comment period cannot be used in the process of refining proposed regulations. The Board hopes that you will comment during the window of opportunity. (

INJECTIONS BY TRAINED INDIVIDUALS NOW ALLOWED

A much misunderstood subject for many years has been clarified as to whom a physician may delegate the giving of medication, especially by injection. This year the General Assembly passed law that authorizes delegation to properly trained individuals, beyond the previously listed professionals. The new law reads as follows:

§54.1-3408. Professional use by practitioners.

T. Pursuant to a specific order for a patient and under his direct and immediate supervision, a prescriber may authorize the administration of controlled substances by personnel who have been properly trained to assist a doctor of medicine or osteopathic medicine, provided the method does not include intravenous, intrathecal, or epidural administration and the prescriber remains responsible for such administration. (

REMOVAL OF DISMISSALS AND EXONERATIONS FROM THE WEBSITE

HB2157, which passed in this session of the General Assembly, requires that the Board not post on the Internet the Notices and Orders in instances in which the practitioner is exonerated or has the charges in the Notice dismissed. The Notices and Orders will still be public documents, available to the public upon request; they just won’t be posted on the website. Similarly, licensees who previously had charges dismissed or were exonerated can request in writing to have the Notice and Order removed from the website. A form has been developed by the Board of Medicine for such requests and is available on the Board website at . (

DEA AND WRITING SCHEDULE II CONTROLLED SUBSTANCES

In 2005, the DEA issued a statement indicating that it was unlawful to issue more than one prescription for the same Schedule II drug to an individual on the same day. Since then, the practice of writing three separate scripts, each for a month, with the instructions “do not fill until…” to get the patient to an appointment three months out, has not been allowed. The DEA has been studying this matter and issued a statement last fall that indicates the resolution may be that multiple scripts can be issued on the same day for the same Schedule II drug, but that the total amount of drugs may not exceed 90 days. The regulations in this matter have not yet been finalized, so the 2005 interpretation prevails until the regulations are final. The final ruling is expected by the end of this year. (

TAMPER-RESISTANT PRESCRIPTION PADS

A recent Congressional Bill includes a provision that requires tamper-resistant prescriptions for Medicaid patients effective October 1, 2007. Pharmacists will not be reimbursed for filling a prescription that is not on tamper-resistant paper. If you do not use tamper-resistant pads, pharmacies may call you to convert the prescription to an oral one as their only other options are to refuse to fill the script or fill it and not be reimbursed. (

QUALIFIED TO PRACTICE ACUPUNCTURE

All doctors qualified to practice acupuncture should be aware of the following law and be sure to comply with it in advertising.

54.1-2956.9. Unlawful to practice acupuncture without license; unlawful designation as acupuncturist; Board to regulate acupuncturists.

It shall be unlawful for a person to practice or to hold himself out as practicing as an acupuncturist unless he holds a license as such issued by the Board. (

FAST-TRACK ADVERTISING REGULATIONS

The Board of Medicine is developing a regulation that will bring efficiency to its processing of advertising complaints. Currently licensees are prohibited from using any form of advertising that contains false, fraudulent, misleading or deceptive information. Further, licensees cannot make a claim of superiority. The licensee is currently deemed responsible for the validity and truthfulness of his/her advertising. The amended regulation will more clearly place the burden for proof of an advertising claim on the licensee, rather than on the Board. The new proposed language reads as follows:

F. Documentation, scientific and otherwise, supporting claims made in an advertisement shall be maintained and available for the board’s review for at least two years.

Although not in effect until signed by the Governor, it is anticipated this regulation will be in force by the end of the year. (

Acupuncture

All licensed acupuncturists should be aware of and comply with the following regulation:

18VAC85-110-110. Limitation of titles.

A person practicing as a licensed acupuncturist is restricted to the use of the titles "Lic.Ac." or "L.Ac." and shall not use the terms "physician" or "doctor" in his name or practice unless he simultaneously uses a clarifying title, initials, abbreviation or designation or language.

Athletic Training

Athletic trainers that supervise provisionally-licensed athletic trainers will soon have more stringent parameters for supervision. At its June 2007 meeting, the Board of Medicine adopted final proposed regulations that will require daily, on-site review and evaluation of services being provided by provisional licensees. The amendment requires the final approval of the Governor, but the new requirement is expected to be in force by the end of the year.

Physician Assistants

As of July 1, 2007, physician assistants are authorized to prescribe Schedule II controlled substances. The PA must obtain a letter from the Board of Medicine that he/she can forward to the DEA in application for the prescribing of Schedule II’s. Midwifery

Two new guidance documents of help to Certified Professional Midwives are available on the Board of Medicine’s website. One provides the listing of laws and regulations outside Chapter 29 of Title 54.1 the Code of Virginia that impact midwifery. The other addresses midwives’ role in newborn hearing screening, documentation and reporting.

Respiratory Care

Earlier this year, a letter was sent to all respiratory care programs in Virginia addressing compliance with the Code Section on the student exemption to the practice of respiratory care. Programs that wish to support students in mentorships can do so by complying with the provisions of Section 54.1-2956.01 of the Code of Virginia. A copy of this letter may be requested by calling the Board.

Occupational Therapy

The Advisory Board on Occupational Therapy voted to handle the very small number of licensees identified as not complying with the Board’s continuing education requirements by issuing a Confidential Consent Agreement.

Radiologic Technology

A letter has been sent to all rad tech-limiteds reminding them of the requirements for continuing education. To renew a license, a rad tech-limited must attest to having obtained at least 12 Category A hours in topics covering the anatomical areas in which he/she practices. (

THE VIRGINIA PRESCRIPTION MONITORING PROGRAM

It’s available to you; start using it today…….

The Virginia Department of Health Professions Prescription Monitoring Program can help you help your patients. By accessing the information in the program’s databanks, you will be better able to identify patients in your practice that may need help with substance abuse intervention and treatment. You will also be better able to identify and prevent attempts at diversion of controlled substances from your practice.

How it works………

The Prescription Monitoring Program collects data from Virginia pharmacies and non-resident pharmacies on all prescriptions filled for Schedule II, III and IV drugs. The information is maintained by the Department of Health Professions in accordance with strict security and confidentiality measures. Only those persons authorized by law can access information from the database, and the list of authorized persons is very limited. Prescribers may query the database to assist in determining treatment history and to rule out the possibility that a patient is "doctor shopping" or "scamming" in order to obtain controlled substances. A prescriber must obtain written consent from the patient before submitting an inquiry.

You may request a report online or by faxing a request form to the Program. You can usually get the requested data within 30 minutes during working hours.

Jennifer Deschenes, JD has succeeded Karen Perrine, JD as the Deputy Executive Director for Discipline. Ms. Deschenes joined the Board from the private practice of healthcare law. She also brings considerable experience with medical education programs at the undergraduate and graduate level.

Sandra Whitley Ryals, RN, MSN has succeeded Robert A. Nebiker as Director of the Department of Health Professions. Ms. Ryals has extensive nursing and administrative experience, as well as a regulatory background with the Department of Professional and Occupational Regulation.

Emily Wingfield, JD stepped into the position vacated by Ms. Ryals, that of Deputy Director of the Department of Health Professions. Ms. Wingfield is eminently qualified by experience for her position, having served as an adjudication specialist in the Department’s Administrative Proceedings Division, as a prosecutor in the Office of the Attorney General, and as previous counsel to the Board of Medicine.

Amy Marschean, JD has succeeded Emily Wingfield as counsel to the Board of Medicine. Ms. Marschean spent nine years with the Division of Legislative Services working for the General Assembly, drafting legislation related to health professions, as well as other areas of health and human services. Ms. Marschean also has prior local government legal experience, having worked for Hanover County and the City of Alexandria.

What you need to know……

All medical malpractice payments (paid claims) must be reported to the Board regardless of whether they are settlements or judgments, and no matter what the amount, within thirty days of payment.

Medical malpractice payments (paid claims) of $10,000 or less are not reportable on your profile unless you have had a medical malpractice payment (of any amount) in the preceding 12 months – then both claims must be reported.

Effective July 1, 2005, any doctor with three medical malpractice payments (paid claims) of any amount in the most recent ten year period (with the third claim payable on or after July 1, 2005) was subject to a competency assessment.

For purposes of consideration of a competency assessment for three medical malpractice payments (paid claims) with the third claim payable on or after July 1 2007, the Board will not use a medical malpractice payment (paid claim) of $10,000 or less when considering competency assessments. All three paid claims (with the most recent occurring on or after July 1, 2007) must be over $10,000 for the doctor to be considered a candidate for a competency assessment.
