Licencing process

1.1 The licencing process for waste management activities is as per Environmental Impact Assessment Regulations R543 of 2010.

Where to submit applications

2.1 The Minister of Water and Environmental Affairs is the competent authority in respect of the following:

• All listed activities listed in both categories of Schedule 1 pertaining to hazardous waste;

• Where an applicant is a statutory body, excluding any municipality performing an exclusive competence of the national sphere of government (even if an activity is for a general waste management);

• Where an activity is for a general waste but is funded by the Provincial Department of Environmental Affairs;

• Where the applicant is a national Department;

• Where the applicant is a provincial department responsible for Environmental Affairs;

• Where the activity will affect more than one province or transverse international boundaries; and

• Where two or more activities are to be undertaken at the same facility and the Minister is the licencing authority for any one of those activities.

2.2 The application for a waste license in terms of section 45 of the National Environment Management Waste Act, 2008 (Act No. 59 of 2008) must be submitted by lodging an application with the National Department of Environmental Affairs. The application must be marked for the attention of:

Making an Application

3.1 The applicant must appoint terms of EIA Regs, 2010, R.543 (16) an Environmental Impact Assessment Practitioner (EAP) at their own cost to handle the application.

3.2 The applicant must fill in all relevant sections of the form. Incomplete applications will not be processed. The applicant will be notified of the missing information in the acknowledgement letter that will be sent within 14 days of receipt of the application. Sections in the form that do not apply to the applicant must be marked “not applicable”.

3.3 There is no prescribed fee at this stage; however, this may change in the future.

3.4 It is the responsibility of the Applicant/Environmental Assessment Practitioner (EAP) to ascertain whether subsequent versions of the form have been published or produced by the competent authority. It is the EAP or applicant’s responsibility to download the current version of the application form from the South African waste information centre website (.za) (click a link on the left of the screen - waste authorisation and then click a link on the right of the screen Licencing).

3.5 The application form must not be submitted electronically and only Two (2) hardcopy must be submitted to the Director: Authorizations and Waste Disposal Management. All application forms must be signed as stipulated. Applications that are not signed or completed accordingly will not be considered.

6. In case of an application for a waste management licence for a disposal facility or the remediation of contaminated land the EAP must submit four (4) copies of reports and/or any other documents required in terms of the NEMA, EIA 2010, Regulations. For any other waste management activities the EAP must submit only two copies of the reports.

Criteria for determining whether basic assessment or scoping is to be applied to applications

4.1 Basic assessment process must be fully complied with if the application is with respect of an activity/ies listed in Category A of the latest waste management activity list.

4.2 Scoping/full EIA process must be fully complied with if the application is with respect of an activity/ies listed in Category B of the latest waste management activity list.

4.3 It is the responsibility of the Applicant/Environmental Assessment Practitioner (EAP) to ascertain the latest waste management activity list gazetted by the Minister. The latest waste management activity list is available on .za (click a link on the left of the screen - waste authorisation and then click a link on the right of the screen Licencing).

5. APPLICATION FORMS

5.1 There are three types of application forms available on .za namely:

Application form for a new waste management licence;

Application form for waste management licence variation – this form must only be used in case of amendments of conditions, name change, and licence renewal; and

Application form for decommissioning of a waste management activity/ies.
