GARNISHMENT HANDBOOK SUMMARY

The Center is committed to following all the provisions of Title III of the Consumer Credit Protection Act (CCPA) and of Chapter 2716 of the Ohio Revised Code in regards to wage garnishments.

A wage garnishment is a court to the employer to withhold wages from an employee’s paycheck to satisfy an unpaid debt for which the debtor has been given a court judgment. A tax levy can also be issued to withhold wages for unpaid federal, state, and local taxes. Child support can also be withheld from an employee’s pay.

The law limits the amount that can be withheld during any one pay period.

Garnishment: No more than 25% of an employee’s disposable earnings can be withheld

Child support: No more than 50% if supporting another child or current spouse or up to 60% if no other dependents are supported. An additional 5% can be added if the employee is more than 12 weeks in arrears.

Tax levy: How often you are paid and how many exemptions are on your W-4 are factors used in determining the amount withheld from your pay.

Disposable earning are all earnings after legally required deductions such as federal, state, and local taxes; Social Security contributions, and state employee retirement contributions. They do not include health insurance premiums, union dues, or 410k contributions.

Legally an employee can not be discharged for one (1) garnishment within a twelve (12) month period but can be for subsequent garnishments within the one (1) year period. However, it is the intent of the Center to keep employees with their jobs. If you receive two (2) separate garnishments within and eighteen (18) month period, you will be required to attend credit counseling through the Center’s Employee Assistance Program.

A $3 processing fee is withheld from the employee’s pay each pay period there is an amount garnished.

If the Center received notice that wages are to withheld, you will be notified by the Human Resources Manager no later than the pay date the wages are withheld from.

Garnishment begins the next full pay period after receipt of the court order.
