Corson County Commission Proceedings



The Corson County Board of County Commissioners met in the Commissioner Room of the Courthouse on April 7, 2020. Chairman Stephen Keller called the meeting to order at 9:05 a.m. with Shawn Hinsz, Edward Schock, and Jacob Nehl present. Darren Bauer was absent. Also present was States Attorney Cheryl Bogue.

Approve Minutes

All voted in favor of a motion by Schock, seconded by Nehl, to amend the minutes of the March 3, 2020 meeting as follows: SD Department of Transportation Stockpile Lease

Superintendent Schell presented the SD Department of Transportation Stockpile Lease Agreement. Following discussion, all voted in favor of a motion by Hinsz, seconded by Bauer authorizing Chairman Keller to sign the State Stockpile Lease for use of the McLaughlin yard from March 1, 2020 through February 29, 2024.

Approve Minutes

All voted in favor of a motion by Nehl, seconded by Schock to approve the minutes of the March 19, 2020 Special Emergency Procedures meeting.

Approve Agenda

All voted in favor of a motion by Hinsz, seconded by Nehl, to approve the agenda with the following additions: Sheriff’s Office Resignation and Travel Authorization.

Highway Report

Benny Joe Schell, Highway Superintendent, briefed the commission on road conditions and blade repairs. No action taken.

Superintendent Schell presented quotes for a new commercial lawn mower. Following discussion, all voted in favor of a motion by Hinsz, seconded by Schock to purchase a Grasshopper mower from Premier Equipment in the amount of $7950.

Utility Permit

Discussion was held on the Utility Permit received from West River Telecommunications Cooperative. Following discussion, all voted in favor of a motion by Hinsz, seconded by Nehl authorizing Chairman Keller to sign the West River Telecommunications Cooperative Utility Permit.

Sheriff’s Office

Sheriff Keith Gall introduced the new Deputy Sheriff Charles Bortz. All voted in favor of a motion by Hinsz, seconded by Nehl to approve annual salary for Charles Bortz of $39,500. Charles began work on April 1, 2020.

Malt Beverage License Transfer Hearing

No one appeared for the Malt Beverage License Transfer Hearing. Following discussion, all voted in favor of a motion by Nehl, seconded by Hinsz to approve the following malt beverage license transfer:

Cash Balance

Pursuant to SDCL 7-21-18.1, the total unreserved, undesignated fund balance of the general fund of the county as of March 31, 2020 is $1,130,077.29 which is 52.65% of the total general fund appropriations.

Equalization Meeting

Assessor Amy Schriock informed the commission that the Board of Equalization and Consolidated Board of Equalization meeting will be held on April 15th at 1:00 p.m. MT.

Flamme Quiet Title Action

States Attorney Bogue briefed the commission on the Flamme Quiet Title Action we received. Following discussion, all voted in favor of a motion by Schock, seconded by Hinsz authorizing Chairman Keller to sign the Admissions of Service of Summons and Complaint for the Flamme Quiet Title Action.

COVID-19 Emergency Procedures

Discussion was held on emergency procedures to aid in reducing the spread of COVID-19 for all county property. Following discussion all voted in favor of a motion by Schock, seconded by Nehl to keep the Corson County Courthouse closed to the general public through May 5, 2020. This will be re-evaluated at the May 5, 2020 regular Commission meeting.

All voted in favor of a motion by Schock, seconded by Nehl authorizing Auditor Bertolotto to implement a mandatory limited staffing plan to go into effect on Tuesday, April 14, 2020 as a precaution to COVID-19. Limited staff will be available during regular business hours via phone, email, and fax only. However, the Courthouse will still be open for court services via appointment only.

Combine Election Precincts

All voted in favor of a motion by Nehl, seconded by Hinsz to adopt the following resolution to combine voting precincts:

CORSON COUNTY RESOLUTION 20-2

RESOLUTION COMBINING PRECINCTS FOR 2020 PRIMARY ELECTION

WHEREAS, as per SDCL Chapter 12-14 provides that the Board of County Commissioners shall by resolution provide for primary and general election precincts through out its county and shall designate polling places within such precincts; and

WHEREAS, in the interests of providing more convenient, efficient and orderly elections for voters and in the interests of eliminating duplication of facilities, efforts and expenses, SDCL Chapter 12-14 provides the Board may change the boundaries of election precincts already established; it is

NOW THEREFORE RESOLVED that the precinct boundaries below listed be changed to the following:

1. McIntosh and South McIntosh Precincts to form McIntosh Precinct

2. Lincoln and Oak Creek Precincts to form Lincoln/Oak Creek Precinct,

as shown according to the maps thereof on file in the office of the Corson County Auditor. Any discrepancies shall be resolved by reference to the maps on file.

IT IS FURTHER RESOLVED that this Resolution shall be in effect each year for all elections held unless repealed or modified by duly enacted resolution.

Courthouse Heating/Cooling Repairs

Emily Zimba presented quotes from River City Heating & Air to replace the circulator pump in the amount of $686 and replace the heating unit in the amount of $5285. Following discussion, all voted in favor of a motion by Nehl, seconded by Schock to accept the quotes from River City Heating & Air to replace the circulator pump and heating unit.

Weed & Pest Supervisor

All voted in favor of a motion by Schock, seconded by Nehl to approve the hiring of Christen Schneider as full time Weed & Pest Supervisor at an annual salary of $37,500.
