LIMITED WARRANTIES

Congratulations on the purchase of your new engine, transmission, or driveline component. We have taken many steps to ensure you of a quality product with quality core and component selection, precision machining, detailed assembly, and final inspection with 100% simulation testing. The term `manufacturer' in this document describes the manufacturer of the product whom warrants this product. This warranty supersedes any other verbal or written warranties provided by manufacturer OR reseller. Original warranty document including manufacturer details can be provided at request. This document covers the limited warranty supplied by the manufacturer to the original owner. Installation and use of the products described in this limited warranty constitutes agreement with and acceptance of all terms of the limited warranty. This limited warranty provides coverage for defects in materials and workmanship provided by the manufacturer. The manufacturer and seller reserves the unqualified right to refund the original purchase price paid in lieu of all claims made under this limited warranty. Any and all products repaired or replaced under this limited warranty will carry the remainder of the original product's term. This limited warranty is between the original purchaser/vehicle owner and manufacturer, but is transferable with the appropriate transfer forms and registration only. If you do not agree to the terms of this limited warranty manufacturer will refund the full purchase price for unused product returned within 30 days of purchase.

ENGINE, TRANSMISSION, & DRIVELINE COMPONANT LIMITED WARRANTY TERMS: Long block gasoline engines, automatic transmissions, manual transmissions, transfer cases, and differentials for private use passenger cars, light trucks, and vans under 1-ton are covered for a period of 3 years/unlimited mileage (Excludes Diesel applications). Labor on units installed at legitimate repair facilities shall be reimbursed at a rate of up to $50.00 per hour based upon the ALLDATA labor guide. Self-installed engines or transmissions have a parts only warranty, no labor will be covered. Diagnostic time will be reimbursed at up to 2 hours labor on authorized repairs. Parts authorized, but not supplied by manufacturer, shall be reimbursed at original acquisition cost. All warranty claims are pending return and analysis of the failed parts or assemblies.

SHORT BLOCK ENGINES & CYLINDER HEADS LIMITED WARRANTY TERMS: Short block gasoline engines and cylinder heads are covered for a period of 12 months or 12,000 miles. Labor for short blocks installed at legitimate repair facilities shall be reimbursed at a rate of up to $50.00 per hour and based upon the ALLDATA labor guide with a $500 maximum cap for short blocks and a $300 maximum cap for cylinder heads.

INDUSTRIAL/NON AUTOMOTIVE/RV USE & LP OR ALTERNATE FUEL USE LIMITED WARRANTY TERMS: Long block gasoline engines, transmissions, or driveline components sold for off road, industrial, non-automotive use, and Recreational Vehicles over 11,000 pounds Gross Vehicle Weight which includes Class A, Class B and Class C Motor Homes, Bus conversions, and any LP or Alternate Fuel vehicles are covered for a period of 90 days with a parts only warranty.

COMMERCIAL USE GAS ENGINE & DRIVELINE LIMITED WARRANTY TERMS: Long block gasoline engines, transfer cases, differentials, manual transmissions, and automatic transmissions for commercial use vehicles, including vehicles 1-ton and over, farm, taxis, police vehicles, tow trucks, buses, vehicles equipped with snow plows, and all driveline components in diesel powered applications are covered for a period of 18 months or 100,000 miles. Labor on units installed at legitimate repair facilities shall be reimbursed at a rate of up to $50.00 per hour and based upon the ALLDATA labor guide. Self-installed engines, transmissions, or other driveline components have a parts only warranty, no labor will be covered. Fluids and filters shall be reimbursed up to $25.00, or up to $50.00 for transmissions requiring synthetics. No diagnostic, towing, or rental car coverage applies to commercial vehicles. All warranty claims are pending return and analysis of the failed parts or assemblies.

MARINE ENGINES LIMITED WARRANTY TERMS: All marine premium and standard long block engines are covered for a period of 2 years/unlimited hours. High performance marine long blocks and complete performance marine engines shall be covered for a period of 12 months parts only with no labor reimbursement. Labor for engines installed at legitimate marine repair facilities shall be reimbursed at a rate of up to $75.00 per hour. Labor hours to be based on industry flat rate guides and shall under no circumstances exceed 18 hours. Self-installed marine engines have a parts only warranty, no labor will be covered. Fluids and filters shall be reimbursed at up to $25.00. Parts authorized, but not supplied by manufacturer, shall be reimbursed at original acquisition cost. All warranty claims are pending return and analysis of the failed parts or assemblies.

PERFORMANCE ENGINES & AUTOMATIC TRANSMISSIONS LIMITED WARRANTY TERMS: All high performance street use long block engines are warranted for a period 2 years. High performance short blocks and cylinder heads are warranted for 1 year. Coverage is for parts only, there is no provision for labor reimbursement either expressed or implied. There is no warranty on products used in any form of competition or racing. The addition of turbochargers, NOS systems, blowers, or any means of "boosting" the engine performance will void all warranties. IF YOUR ENGINE CAME EQUIPPED WITH AN INTAKE MANIFOLD, CARBURETOR, FUEL PUMP, DISTRIBUTOR, IGNITION WIRE SET, AND SPARK PLUGS, THOSE COMPONANTS ARE COVERED BY THEIR RESPECTIVE MANUFACTURERS WARRANTY AND NOT BY ENGINE MANUFACTURER. Manufacturer makes no claim that any performance engine meets current emission standards. It is the sole responsibility of the purchaser to verify that their vehicle conforms to current local, state, and federal emission standards. All warranty claims are pending return and analysis of the failed parts

or assemblies. All high performance transmissions are not warranted by this seller, those items carry the warranty of their respective manufacturer only. No warranty is expressed or implied from this seller or distributor, please refer to the transmission manufacturer's warranty document for information regarding warranty inquiries for transmissions.

INCLUDED PARTS

This limited warranty covers defects and workmanship with castings including: engine block, transmission case, differential housing, cylinder head, crankshaft, gears, connecting rods, pistons, rings, bearings, timing components, rocker assemblies, valves, valve springs, push rods, lifters, oil pump, water pump, freeze and oil galley plugs, clutch packs, synchronizers, shift forks, valve bodies, torque converters, solenoids, seals and gaskets installed by manufacturer. WATER PUMPS AND TIMING BELTS SUPPLIED AS PART OF THE ASSEMBLED PRODUCT ARE COVERED FOR THE FIRST YEAR OF THE WARRANTY ONLY. Installation Kit components are covered under specific part manufacturers' warranty terms.

EXCLUSIONS & LIMITATIONS THIS LIMITED WARRANTY DOES NOT COVER DAMAGE FROM: OVERHEATING (all engines are equipped with temperature sensors), DETONATION, PREIGNITION, OVER FUELING, EMISSION SYSTEM FAILURE, CRANKSHAFT THRUST BEARING FAILURE, LACK OF PROPER MAINTENANCE, IMPROPER INSTALLATION, CONTAMINATION OF FLUIDS, use of fluids not specified by manufacturer, overloading, abuse, or misapplication. This limited warranty does not cover components, or failure caused by components, that were not installed by manufacturer as a part of the assembled product. This includes but is not limited to all ignition system components, fuel system components, cooling system components, emission system components, manual clutch components, computer systems and sensors, steering, brake, and suspension components. Any and all vehicle modifications from Original Equipment configuration will void any and all warranty coverage including but not limited to: electronic programmers, cold air intakes, reduction pulleys, aftermarket exhaust, aftermarket intake manifolds, and shift improvement kits. Products used in any form of competitive racing are not covered. VEHICLE OWNER MUST BEAR THE COST OF ANY PARTS AND/OR REPAIRS NOT COVERED, OR LABOR ABOVE THE MAXIMUM LIMITS ALLOWABLE UNDER THIS LIMITED WARRANTY. THE MAXIMUM TOTAL OF ALL BENEFITS OR REMEDIES UNDER THIS LIMITED WARRANTY SHALL NOT EXCEED THE PURCHASE PRICE ON THE ORIGINAL MANUFACTURER INVOICE. NO BENEFITS OR REMEDIES ARE AVAILIBLE UNDER THIS LIMITED WARRANTY WHILE THE INVOICE FOR THE UNIT OR RELATED PRODUCT REMAINS OUTSTANDING AND/OR UNPAID. Manufacturer's liability is excluded from loss or damage caused by latent or hidden product defects of original designer or manufacturer. Manufacturer will not be liable for death or injury to person or property, or any incidental or consequential damages resulting from the use of its products. Such damages include but are not limited to: damage to engine, transmission, and/or driveline components not supplied by manufacturer, loss of capital, telephone charges, freight charges, or any other customer claims of damages. Manufacturer's maximum liability is the aggregate limit of its commercial insurance policy. SOME STATES DO NOT ALLOW EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. This warranty gives you specific legal rights. You may also have other rights which may vary from state to state and country to country.

CUSTOMER/INSTALLER RESPONSIBILITIES (WARRANTY VOID IF NOT FOLLOWED)

Manufacturer's installation guidelines must be strictly followed. Failure to follow proper installation procedures can and will void the warranty. Engine must be pre-lubricated prior to startup. A new thermostat must be installed and proper operation of cooling system verified. Engine oil coolers (when so equipped) must be replaced. Transmission oil coolers must be flushed or replaced as required per application. Ignition, fuel, emission systems, and adjustments must be verified and functioning properly. Exhaust back pressure must be checked and recorded on the warranty certificate. ENGINE OIL AND FILTER MUST BE CHANGED AT LEAST EVERY 3,000 MILES OR 3 MONTHS AND RECEIPTS PROVIDED OR ENGINE WARRANTY WILL BE VOID. Warranty registration form must be returned to manufacturer within 10 days of installation. Manufacturer must have a fully completed warranty registration form on file to validate any claim.

CLAIMS PROCEDURE In the unlikely event your vehicle needs repair, first contact manufacturer warranty claim line at (855) 459-1650. Have all warranty information available, along with current vehicle mileage. BEFORE REPAIRS ARE MADE YOU MUST OBTAIN PROPER AUTHORIZATION FROM MANUFACTURER OR YOUR WARRANTY CLAIM WILL BE DENIED. Parts authorized, but not supplied by manufacturer, shall be reimbursed at original acquisition cost. Parts receipts must be provided. All warranty parts including complete assemblies must be returned to manufacturer for inspection before any claim is paid.

APPLICABLE LAW AND VENUE FOR LEGAL ACTION This limited warranty allocates the risks of product failure between the manufacturer and the original owner as authorized by uniform commercial code and other applicable laws. If any portion or provision of this limited warranty is found or determined to be illegal, invalid, or otherwise unenforceable, the remainder of this limited warranty shall still apply in its entirety. In event of any legal action to enforce the terms of the limited warranty, the customer agrees that the laws of the state of Wisconsin shall govern such action, that the courts of the state of Wisconsin shall have exclusive jurisdiction for such action, and that the venue shall be St. Croix County, Wisconsin.
