I, James Brown, agree to abide by the following terms and conditions:

Insurance & Excess

? While one of our vehicles is loaned to you, you acknowledge that you acquire no rights of ownership in the vehicle which at all times remains the property of the trader.

? The vehicle is insured by An Insurance Company that will in some circumstances cover loss and/or damage to the vehicle (you agree to make your own inquiries as to the extent of cover and if required to arrange your own alternative insurance cover in respect of the vehicle).

? An excess of $500.00 will apply for each and every claim. ? You are responsible for paying the excess or for any damage to or replacement of the vehicle (including compensation for loss of use of the

vehicle) to the extent the policy of insurance does not provide and/or cover any driver of the vehicle or any loss and/or damage suffered. ? You agree to provide all assistance as required by the Trader and/or its insurers and to follow all lawful instructions given to you by the Trader

and/or the insurer. ? In the event of an accident you will:

1. Not admit liability under any circumstances. 2. Obtain name of third party. 3. Obtain address of third party. 4. Obtain registration plate and description of third party vehicle.

Loan vehicle conditions

? The vehicle shall not be driven by anyone other than the driver named on this form. ? The vehicle will not be driven under the influence of alcohol or drugs. ? The vehicle shall not be driven further than 200km's from the dealership. ? No smoking in the vehicle. ? No animals in the vehicle. ? I agree to accept responsibility for the full costs of repair and/or replacement of the vehicle except to the extent an insurer reimburses and /or

makes payment to the Trader in respect of such losses (which can include consequential and indirect losses such as for the loss of use of the vehicle). ? I acknowledge I am responsible for all fines and traffic offenses occurring whilst the loan vehicle is on loan to me. ? I agree to return the vehicle when requested to. ? I will return the vehicle in the same condition as it was when loaned to me. ? The vehicle must be parked and stored securely.

Declaration

? I agree to accept and observe all the conditions mentioned in this document. ? I confirm the above details are correct and I have given my permission for my drivers license details to be validated with LTNZ. ? Under the Privacy Act 1993 I give permission for any personal information about myself to be used, disclosed to third parties and /or stored for

the purposes of giving effect to this Agreement.

I confirm that to the best of my knowledge and certify that all material circumstances (such as accident and traffic history of myself and any driver authorised to use the vehicle) have been disclosed in writing to the Trader at the time of signing this Agreement such circumstances including those that ought to be disclosed to any insurer in determining whether to grant insurance cover.
