QUESTION PRESENTED

May a legislator accept season passes to football games of two public high schools provided by the local school board?

DISCUSSION

KRS 6.611(b)(8)(d) excludes from the definition of "anything of value" the cost of attendance at events sponsored or coordinated by a state or local government entity. Also, KRS 6.611(b)(12) excludes from the definition of "anything of value" the cost of attendance or participation provided by the sponsoring entity at events sponsored by a governmental organization.

Both of these provisions would apply to the situation above and the legislator can properly accept these football tickets to public school games.

OPINION

A legislator may accept season football passes to public school games because they are excluded from the definition of "anything of value" within the Legislative Ethics Code.
