ADRIAN CITY COMMISSION

October 19, 2020 @ 7:00PM

The City Commission met for a pre-meeting study session on Monday, October 19, 2020 at 6:00 pm at the Adrian Armory at 230 W. Maumee Street, Adrian Michigan. The meeting was also streamed via Zoom.

The following items were discussed:

1. Cost of Living Adjustment for Non-Union Employees.

2. Location of Future Commission Meetings.

3. Marvin Farm Property Update.

On motion by Commissioner Heldt, seconded by Commissioner Strayer, the motion to adjourn the pre-meeting was approved by an all yes vote.

Meeting adjourned at 6:39 pm.

The Commission began the regularly scheduled meeting at the Adrian Armory at 7:00 pm.

On motion by Commissioner Watson, seconded by Commissioner Heldt, the minutes of the October 5, 2020 Regular Meeting of the Adrian City Commission were approved by a 7-0 vote.

On motion by Commissioner Roberts, seconded by Commissioner Strayer, the motion to approve the Vouchers was approved by a 7-0 vote.

Mayor Heath ask for a motion to amend the agenda to add resolution R20-195 from Administration to authorize a 2.5% cost of living pay increase to non-union employees retroactive to the start of the 2020-21 fiscal year.

On motion by Commissioner Roberts, and seconded by Commissioner Strayer, the motion to add resolution R20-195 from Administration to the agenda was approved by a 7-0 vote.

AN ORDINANCE TO AMEND THE CITY OF ADRIAN ZONING/DEVELOPMENT REGULATIONS.

The City of Adrian Ordains:

1. That Section 3.1 of Article III of the City of Adrian Zoning/Development Regulations, and the Zoning Map to which reference is therein made, is amended to the extent of deleting the following property hereinafter described from the B-2 Community Business District and RT Two-Family Residential District and including the same in the I-1 Light Industrial District and to include both properties in the Overlay Zone Marihuana 2 (West) (OZM) District.

RESOLUTIONS

R20-189 - COMMUNITY DEVELOPMENT – Approve PlaneWave Industrial Facilities Exemption Certificate for Real Property at 1375 N. Main Street, Adrian MI

RESOLUTION

WHEREAS, pursuant to PA 198 of 1974, as amended, after a duly noticed public hearing held on 18th day of March, 2019, this Commission by resolution established an Industrial Development District at 1375 N. Main Street, parcel # XAO-126-1375-00; and

WHEREAS, PlaneWave has filed an application for an Industrial Facilities Exemption Certificate with respect to improvements of Real Property at 1375 N. Main Street; and

WHEREAS, before acting on said application, the City of Adrian held a hearing on October 19, 2020, at 7pm, at which hearing the applicant, the Assessor and a representative of the affected taxing units were given written notice and were afforded an opportunity to be heard on said application; and

WHEREAS, improvements of Real Property at 1375 N. Main Street had not begun earlier than six (6) months before September 11, 2020, the date of acceptance of the application for the Industrial Facilities Exemption Certificate; and

WHEREAS, completion of the facility is calculated to and will, at the time of issuance of the certificate, generate new Real Property taxes in the City of Adrian; and

WHEREAS, the aggregate SEV of real and personal property exempt from ad valorem taxes within the City of Adrian, after granting this certificate, will not exceed 5% of an amount equal to the sum of the SEV of the unit, plus the SEV of personal and real property thus exempted.

NOW, THEREFORE, BE IT RESOLVED that:

1. The Adrian City Commission finds and determines that the granting of the Industrial Facilities Exemption Certificate considered together with the aggregate amount of certificates previously granted and currently in force under PA 198 of 1974, as amended and PA 225 of 1978, as amended shall not have the effect of substantially impeding the operation of City of Adrian, or impairing the financial soundness of a taxing unit which levies ad valorem property taxes in City of Adrian. 2. The application from PlaneWave for an Industrial Facilities Exemption Certificate, with respect to improved Real Property at the Industrial Development District at 1375 N. Main Street is hereby approved.

3. The Industrial Facilities Exemption Certificate, when issued, shall be and remain in force for a period of 12 years.

On motion by Commissioner Watson, seconded by Commissioner Strayer, this Resolution was approved by a 7-0 vote.

R20-190 - CITY CLERK – Acceptance of grant funds from the Center for Tech and Civic Life.

RESOLUTION

WHEREAS, the Center of Tech and Civic Life offered municipalities the opportunity to apply for grant funds available for the purpose of operationalizing safe and secure election administration for the 2020 Elections;

WHEREAS, the City Clerk’s office applied for such grant funds and based on the information provided in the application submitted by the City was awarded the amount of $15,157.25.

WHEREAS, the City Clerk recommends the acceptance of the grant funds from the Center for Tech and Civic Life to offset the costs of supplies, training and staff to conduct the November 3, 2020 Election and other expenses associated with the August 4, 2020 Election;

NOW, THEREFORE BE IT RESOLVED that the Adrian City Commission, by this resolution, hereby authorizes the acceptance of the grant funds from the Center for Tech and Civic Life for operating and staffing the November 3, 2020 Election without reducing the budget of the Municipal Clerk for the grant project period of June 15, 2020 through December 31, 2020.

On motion by Commissioner Gauss, seconded by Commissioner Roberts, this Resolution was approved by a 7-0 vote.

R20-191 - CITY CLERK – Approval of a new Medical Marihuana Facility Permit for WPL Industries, LLC.

RESOLUTION

WHEREAS, the Adrian City Commission has adopted a Commercial Medical Marihuana Facilities and Adult Use Establishments Ordinance, Medical Marihuana Zoning Ordinances, and Medical Marihuana Zoning Ordinance Overlays; and

WHEREAS, WPL Industries, LLC has properly submitted a 2020-2021 new application (#MM20-012) for a new Medical Marihuana Facility Permit for an additional Class C Grow for 1201/1209 E. Beecher Street, Adrian, Michigan; and

WHEREAS, the City Clerk has reviewed the new application, confirms that the required inspections have been conducted or the required waiver of inspections have been submitted, and that the new application meets the requirements of the adopted Commercial Medical Marihuana Facilities and Adult Use Establishments Ordinance, and recommends approval of a new permit for an additional Class C Grow to WPL Industries, LLC for 1201/1209 E. Beecher Street;

NOW, THEREFORE BE IT RESOLVED, that the Adrian City Commission by this resolution, hereby approves a new Medical Marihuana Permit for an additional Class C Grow for WPL Industries, LLC for 1201/1209 E. Beecher Street, Adrian, Michigan.

On motion by Commissioner Strayer, seconded by Commissioner Heldt, this Resolution was approved by a 7-0 vote.

R20-192 - PARKS & ENGINEERING SERVICES DEPARTMENT – Authorization to Allow Adrian College to place concrete within the Right of Way

RESOLUTION

WHEREAS, the roundabout located at Adrian College Boulevard, Charles St, and Michigan Ave was completed in 2018; and

WHEREAS, Adrian College would now like to fill the center island with colored concrete with their “AC” symbol; and

WHEREAS, this is similar to placing a permanent sign within the City Right of Way, it was determined this shall be approved by the City Commission; and

NOW, THEREFORE, BE IT RESOLVED, that the Adrian City Commission by this resolution hereby authorizes Adrian College to place and maintain the concrete in the island of the aforementioned roundabout with the Adrian College “AC” Symbol.

On motion by Commissioner Watson, seconded by Commissioner Heldt, this Resolution was approved by a 7-0 vote.

R20-193 - PARKS & ENGINEERING SERVICES – Yard Waste and Compost Site Fee Schedule

RESOLUTION

WHEREAS, in order to maintain a clean City, the following fee shall be applied for items placed in the Right of Way illegally or before or after dedicated dates and times:

$65 pick-up fee

; and

WHEREAS, in an effort to offset the operations costs and to assist with volume management of yard waste at the City’s Compost Site, it is proposed that an expanded fee schedule be approved as follows:

City Resident

• Top soil and mulch pick up at no cost when loading by hand

• $20 per cubic yard of material (top soil, mulch, unsifted millings) loaded by City staff

• $35 per cubic yard – two yard minimum (top soil, mulch, and unsifted millings) delivered within city limits

Businesses (Excluding Lawn Care Services) and Non-Residents

• Businesses (excluding lawn care services) and non-residents of the City can purchase a compost site tag for $100 per year

• Top soil and mulch pick up at no cost when loading by hand

• $25 per cubic yard of material (top soil, mulch, unsifted millings) loaded by City staff (Must call ahead)

• $50 per cubic yard – two yard minimum (top soil, mulch, and unsifted millings) delivered within five miles of city limits

Commercial Lawn Care Businesses

• Commercial lawn care businesses can purchase a compost site tag for $100 per year. $20 per each site entry. Punch card system billed in June and December.

• Top soil and mulch pick up at no cost when loading by hand

• $25 per cubic yard of material (top soil, mulch, unsifted millings) loaded by City staff (Must call ahead)

• $50 per cubic yard – two yard minimum (top soil, mulch, and unsifted millings) delivered within five miles of city limits

• Call ahead for drop off appointment. Anything after 3:30 PM will need to be dropped off next business day.

*Appointments must be made in advance by calling Public Works at 517-264-4888

**Bulk Pricing (10+ Cubic Yards): $20 per cubic yard for pick up (loaded by City staff), $40 per cubic yard for delivery

***Weekend or after hour rates available for additional $100 per load

NOW, THEREFORE BE IT RESOLVED, that the Adrian City Commission by this resolution, hereby approves the yard waste fee schedule as submitted here.

On motion by Commissioner Roberts, seconded by Commissioner Gauss, this Resolution was approved by a 7-0 vote.

R20-194 - ENGINEERING DEPARTMENT – Acquisition and Maintenance of Alley Bordered by Butler, Croswell, Maple, and Elm Streets, to Create a Public Right-of-Way

RESOLUTION

WHEREAS, in October 2012, the City of Adrian notified property owners, along an alley bordered by Butler, Croswell, Maple and Elm Streets, that the alley was considered private property and would no longer be maintained by the City; and

WHEREAS, after notification, several property owners contacted the City Administrator to express their preference to relinquish their ownership of the alley to the City in order to create a public right-of-way; and

WHEREAS, the Administrator and the Director of Parks & Engineering Services, recommend the acceptance of acquisition of the alley property, as described above, to create a public right-of-way; and

WHEREAS, the acquisition is contingent upon verification of clear and marketable title of each affected parcel; and

WHEREAS, the Finance Director indicates that there are sufficient funds in the FY2020-2021 budget from the Local Street Maintenance Account (203-451.00-801.000); and

NOW, THEREFORE BE IT RESOLVED, that the Adrian City Commission, by this resolution, hereby authorizes the acceptance of ownership of this alley property to create and maintain a public right-of-way.

On motion by Commissioner Strayer, seconded by Commissioner Roberts, this Resolution was approved by a 7-0 vote.

R20-195 - ADMINISTRATION – Authorization of a 2.5% cost-of-living pay increase to non-union employees, retroactive to the start of the 2020-21 fiscal year.

RESOLUTION

WHEREAS, the union contracts of the City of Adrian provide for a cost of living adjustment for the current year, which was implemented at the start of this fiscal year; and

WHEREAS, the City of Adrian typically provides a cost of living increase to non-union employees in a like manner to employees in collective bargaining units; and

WHEREAS, due to the COVID-19 pandemic, a “hold steady” budget was put in place at the start of the 2020-21 fiscal year which did not include a cost of living adjustment for non-union employees; and

WHEREAS, a portion of the City’s fund balance ($75,000.00) has been designated for payroll adjustments, which is the amount needed to give non-union employees a 2.5% increase.

NOW, THEREFORE, BE IT HEREBY RESOLVED that based on the recommendation of the City Administrator, a 2.5% cost-of-living adjustment is hereby authorized for the non-union employees of the City of Adrian, retroactive to the start of the 2020-21 fiscal year.

On motion by Commissioner Heldt, seconded by Commissioners Strayer & Castleberry, this Resolution was approved by a 7-0 vote.

Commented about the chicken issue and that he finds it odd that a select few people are using their position in the community to set the narrative on this issue. The real issue with the city is building the tax base. We do not have an expense problem we have a revenue problem. All the nuisances around the city affect property sales. Allow the citizens to vote, let the people speak.

Commented about the DARA lines and asked why they are in the middle of the sidewalk. Doesn’t think it looks particularly good.

COMMISSIONER COMMENTS

Commissioner Roberts thanked Matt Tomaszewski for taking the vision she had and making it a reality. Also thanked Drake Lolley and the Murray’s for the use of the equipment and the facility. Thanked Eric from PlaneWave for continuing to support the city and the development. Also mentioned that the issue of the amendment to the ordinance regarding chickens could be addressed with the Planning Commission.

Commissioner Strayer thought the blue lines around the DARA District was a good idea. Signage you may not see and are limited to where you can put them. Felt other cities would follow our lead moving forward.

Commissioner Heldt welcomed Commissioner Castleberry to her first meeting and felt she would fit right in.

The next regular meeting of the Adrian City Commission will be held at 7:00 pm on Monday, November 3, 2020.
