Corson County Commission Proceedings



The Corson County Board of County Commissioners met in the Commissioner Room of the Courthouse on May 5, 2015. Chairman Stephen Keller called the meeting to order at 9:02 a.m. with Shawn Hinsz, Edward Schock, and Darren Bauer present. Donald Pazie was absent.

Approve Minutes

All voted in favor of a motion by Schock, seconded by Hinsz, to approve the minutes of the April 7, 2015 regular commission meeting and the April 14th Board of Equalization and special commission meeting.

State Reimbursement Rates

Due to state reimbursement rate increases, all voted in favor of a motion by Schock, seconded by Hinsz to increase mileage reimbursement to $0.42 per mile and meal reimbursement as follows: Breakfast-$6; Lunch-$11; and Dinner-$15 effective July 1, 2015.

Commissioner Arrived

Darren Bauer entered the meeting at 9:20 a.m.

Health Insurance

Kay Heimark representing Risty Benefits was present to discuss health insurance rate increases and renewal options. No action taken.

Highway Report

Benny Joe Schell, Highway Superintendent, briefed the commission on road conditions, culverts, pavement for parking lots, gravel, weight limit signs for bridges, and Keldron Road Project.

Discussion was held on purchasing some lots east of the highway shop in McIntosh from Edward Block. All voted in favor of a motion by Bauer, seconded by Schock to pursue the purchase of said lots from Edward Block.

Travel Authorization

Consensus of the board is to allow Highway Superintendent Schell to attend the summer workshop in Pierre on June 10-11.

Mosquito Control Grant

Loyson Carda and Benny Joe Schell were present to discuss the mosquito control grant application. Consensus was to pass the grant information on to the cities.

Wheel Tax Ordinance

Following the second reading of the imposition of wheel tax ordinance, Hinsz made a motion, seconded by Schock to adopt the following ordinance which will go into effect January 1, 2016 for Five Dollars ($5.00) per wheel with a maximum of Sixty Dollars ($60.00) per vehicle. This revenue will be used for the maintenance of roads and bridges. On roll call vote: Bauer, no; Schock, yes; Hinsz, yes; Keller, yes; Pazie, absent.

ORDINANCE 2015-1

AN ORDINANCE FOR THE IMPOSITION, COLLECTION, AND ENFORCEMENT OF A

WHEEL TAX IN CORSON COUNTY

WHEREAS, the South Dakota State Legislature enacted Senate Bill 1 during the 2015 Legislative Session.

WHEREAS, the South Dakota State Legislature created, through the enactment of Senate Bill 1, the Local Bridge Improvement Fund and any funds deposited into such Fund is continuously appropriated to the South Dakota Department of Transportation.

WHEREAS, the Department of Transportation may award grants from such Fund to any county which has adopted and annually updated its county highway and bridge improvement plan and has imposed a county wheel tax pursuant to SDCL 32-5A-1.

WHEREAS the Corson County Commission has determined that grants from the Local Bridge Improvement Fund and revenue from the adoption of a wheel tax is needed for highway and bridge maintenance and construction and the County needs more funding for such purposes.

BE IT ORDAINED BY THE CORSON COUNTY COMMISSION that a wheel tax pursuant to SDCL Chpt 32-5A, as amended, and consistent with legislative intent requiring Counties to impose and administer a wheel tax, is imposed in and for Corson County as set forth herein

Section 1: All motor vehicles as defined in SDCL 32-3-1, registered in the County shall have a wheel tax imposed upon each vehicle at a rate not to exceed Five Dollars ($ 5.00) per vehicle wheel.

Section 2: The wheel tax shall be collected and administered by the County. The per vehicle wheel rate shall be the same for all types of motor vehicles and the total vehicle tax may not exceed Sixty ($ 60.00) dollars per vehicle.

Section 3: The proceeds from the tax created by this chapter shall be retained by the county, deposited in a special highway fund and the revenue may be used only for highway and bridge maintenance and construction. The Board of County Commissioners shall, by resolution, establish a means of distributing the revenue generated by this chapter among the county and the municipalities and townships located within the county.

Section 4: Upon purchasing a vehicle from a dealer, the purchaser shall pay the appropriate tax at the time of title transfer. Nothing in this ordinance shall prevent an automobile dealer from licensing the vehicles on his lot without paying any taxes created by this ordinance.

Section 5: This ordinance shall cover and impose the wheel tax for all motor vehicles eligible for license registration or license renewal for January, 2016, and all subsequent months. This ordinance shall impose a wheel tax upon all motor vehicles, so described even though license registration or renewal takes place before January 1, 2016.

Section 6: Pursuant to SDCL 32-5A-7, if a motor vehicle is licensed for a period of time of less than twelve months, any wheel tax imposed on such motor vehicle pursuant to this ordinance shall be prorated on a monthly basis.

Section 7: If any provision of this ordinance shall be held invalid, it shall not affect any other provisions of this ordinance that can be given effect without the invalid provision, and for this purpose, the provisions of this ordinance are hereby declared to be severable.

This ordinance shall become effective 20 days after its completed publication unless suspended by option of a referendum. A referendum petition form, prepared by the county and ready for circulation, for such ordinance may be obtained from the office of the county auditor.

Travel Authorization

Consensus was to allow Benny Joe Schell to attend the Highway Superintendent Spring Meeting in Pierre on June 11th and 12th.

Emergency Management

Discussion was held on the amount of money the Emergency Manager can spend without commission approval in the case of a disaster/emergency. All voted in favor of a motion by Bauer, seconded by Hinsz to allow the Emergency Manager to spend up to $750 without commission approval in case of a disaster/emergency.

Register of Deeds

Diane Anderson informed the commission that she offered the Deputy Register of Deeds position to Sherry Ternes who will begin working in June. All voted in favor of a motion by Hinsz, seconded by Schock to approve hiring Sherry Ternes as part-time Deputy Register of Deeds at $12.00 per hour.
