1. Call to Order

Meeting started at 10:00 AM. 2. Approval of Minutes (June 23rd, 2016).

Motion to approve, (someone); Second Portia Sanders, Los Angeles; passed unanimously.

3. Legislative Advocate Update

Legislature is on recess. June 30th they took off to their home district. The deadline to pass any policy committee was July 1st. Critical meetings took place. Legislature returns August 1st. When they come back, they only have the ability to hold fiscal meetings and 4 sessions until August 31st. On the 31st, that is the deadline for all 2 year bills to be passed.

They could also waive their own rules, if they have a 2/3rds majority vote in each house, which is easy to do so. They could gut and amend an entire bill, that doesn’t even exist right now. The brand new piece of legislation can be heard in the policy committee, then in appropriations, and move it to the floor all in 1 day. Sometimes these bills are about current topics in the news media, which most likely will not affect us. This is just to be aware of what could happen.

We don’t have anything on the Governor’s desk. What we have are still moving along.

Assembly Bill 2882 (Committee on Judiciary) Family Code/Marriage Cleanup

Still moving along.

Assembly Bill 2128 (Achadjian) “Conflict or War” Deletion

Burden of proof onto the person getting married, not onto the County or State anymore. Strong support from military groups. Almost to Governor’s office.

Senate Bill 974: Expansion of Certified Mail Requirement for Notaries / ID Requirement /

First part is to use other forms of mailing other than Certified Mail, as long as it provides tracking and a receipt. Everyone likes that.

Second is to present ID to the clerk, which they currently do not have to provide. Notaries didn’t argue with this.

Third part is County Clerk code cleanup, which will help with references.

Assembly Bill 1546 (Olsen) Vital Records/Intaglio Print

New options provided now. Still moving along.

Assembly Bill 2761 (Low) Marriage

This bill wants elected and previously elected officials be able to solemnize a marriage. Recently amended to “prohibit any of the elected persons from accepting compensation for solemnizing a marriage and prohibits those individuals from solemnizing a marriage if they have been removed from office due to committing an offense or have been convicted of a crime that involves moral turpitude, dishonesty, or fraud.”

Senate Bill 875 (Gaines) Marriage

This is specific for the elected County Sheriff, not for the staff or deputies. This bill is unnecessary, because this is included in AB 2761. Once these bills move into the Governor’s office, there will probably be debate on how to handle these bills.

• AB 2566 – Notaries public: acceptance of identification. - Not specific to County Clerk, but we do look at IDs. No effect to Clerks.

• AB 2761 – Marriage. – Nothing to do with us.

• SB 1255 – Dissolution of marriage: date of separation. - Watch bill. Does not impact the County Clerk.

San Francisco’s Bills:

• SB 1008 – California Environmental Quality Act. Los Angeles Regional Interoperable Communications System: exemption.

• SB 1473 – Fish and Game Commission: procedures. - Going to cause major revisions.

Santa Clara’s Bills:

• AB 2882 – Judiciary omnibus: family law.

• SB 1005 – Marriage. – 7/1/16 - Chaptered by Secretary of State. Chapter 50, Statutes of 2016.

Sonoma’s Bills:

• AB 2070 – Political Reform Act of 1974: local enforcement. Urgency.

Ventura’s Bills:

• AB 1546 – Vital Records – Moving along.

• SB 710 – Real estate licensees: fictitious business names: team names.

• SB 974 – Local government: omnibus. Does not impact the County Clerk.

No new proposals have been submitted for the upcoming year. Proposal form is online, if you would like to submit a proposal.
