SUBJECT: Probable Cause Report for Arrest of Allen Warner (D.O.B.: 10/22/1970, 530 Union Street Rockland, Massachusetts)
1. This report is a summary of the investigation and was written for the limited purpose of establishing probable cause for the arrest and arraignment of Allen Warner (D.O.B.: 10/22/1970, 530 Union Street Rockland, Massachusetts) in violation of Massachusetts General Law Chapter 269 Section 1, Murder. It does not contain all the information known to investigators at this time.
2. Based on the following information hereinafter related as a result of my own investigative efforts and those of other investigators involved in this investigation, I believe that probable cause exists that the crime of Murder, a violation of Massachusetts General Laws, Chapter 265, Section 1, which was committed in the vicinity of Old Main Street Ext. and Main Street in the Town of Marshfield, with the victim being identified as Shana Warner (DOB: 11/26/1969), of 1717 Ocean Street Apt. 27D Marshfield, Massachusetts. This affidavit does not contain all information known to police investigators and is being submitted for the limited purpose of establishing probable cause for the arrest of Allen Warner (DOB: 10/22/70, of 530 Union Street Rockland, Massachusetts)
3. On Monday, September 24, 2018, at approximately 1858 hours, I was notified by Sergeant Donald Short (State Police Detective Unit) of a homicide in the town of Marshfield. The victim later identified by her Registry of Motor Vehicle photo as Shana Warner DOB: 11/26/1969 resided at 1717 Ocean Street Apt. 27D Marshfield. Sergeant Short advised me to report to Command Post located in the vicinity of 844 Main Street Marshfield. The following is a summation of the events. On Monday, September 24, 2018, at approximately 1751 hours, the Marshfield Police Department received a call from a female caller reporting suspicious activity on School Street in the town of Marshfield. The caller stated a male jumped into a vehicle and took off. On Monday, September 24, 2018 at approximately 1759 hours another caller stated that a grey cube vehicle drove off the road and a male fled on foot into the woods. At approximately 1800 hours the State dispatch transferred a 911 call from a female screaming in the silver Scion to the Marshfield police dispatcher. She stated her ex-husband jumped into the vehicle and she was very hurt. At approximately 1800 hours Officers from the Marshfield Police Department arrived on scene and requested fire for a female victim. At approximately 1809 hours the perimeter was set up, numerous agencies responded and Route 3A was closed off by police. At approximately 1946 hours a possible witness (Andrew Bergsten) saw a van type vehicle stopped on School Street near Old Main Extension, a description of a white male, approximately 5’10”, scruffy face, wearing dark gray hoodie, was standing outside of the driver side door. At approximately 2201 hours a caller (Richard Lombari) who heard a gun shot before police arrived. He also saw someone suspicious coming out of the woods around 1500 hours. The victim was pronounced deceased at approximately 1843 hours by Doctor Marcks. Sergeant Short contacted Massachusetts Crime Scene Services (CSSS), State Police Collision Analysis Reconstruction (CARS) and State Police Firearms Identifications Section.
4. Lieutenant William Sullivan from the Marshfield Police Department relayed the following: On Monday, September 24, 2018 at approximately 1751 hours officers were dispatched to the area of School Street for a report of a suspicious motor vehicle. While enroute, officers were re-directed to Main Street by Old Main Street Extension, Dispatch reported a suspicious incident involving a male and female as well as a vehicle off the road in that area.
5. Multiple units arrived on scene at almost the same time, including Officer Cooledge, Sergeant Morris, Sergeant Tingley, Officer Mulligan and Lieutenant Sullivan. There was a grey sedan off of the road facing southbound outside of the southbound lane that matched the description given by dispatch. Officers inspected the vehicle and found no one in the vehicle but the vehicle was running. Officer Cooledge then found a white female with dark hair lying flat on her back with her arms by her side approximately 2 or 3 feet from the vehicle. Her body was north to south with her head on the north side looking to the right and her feet were towards the south. She had obvious injuries with a large laceration on her chin, heavy bleeding in her chest and left shoulder. Officer Cooledge requested the fire department for medical assistance. The female seemed to be agonally breathing. The woman’s eyes were open, her pupils were constricted and she was unresponsive. Officer Mulligan and Cooledge checked for a pulse and found a faint pulse, stabilized her neck and monitored her breathing and pulse. Lieutenant Sullivan took the keys out of the vehicle’s ignition and put them on the seat. Sgt. Morris then took the keys and placed them in his pocket (later given to Trooper Paul Rego). While rendering aid, Officer Cooledge and Mulligan found what appeared to be a gunshot wound in the victim’s left shoulder where the heavy bleeding was. Marshfield Fire arrived on scene, took over first aid and transported the victim to South Shore Hospital.
6. On Monday, September 24, 2018, at approximately 2000 hours, Trooper Paul Rego was directed by Detective Lieutenant Lisa Buckley to secure the scene at the intersection of Main Street and Old Main Street Extension. The area was secured with yellow police tape.
7. When Trooper Rego arrived on scene he observed a gray, Toyota Scion bearing Massachusetts Registration 31KB84 approximately 30 feet off the roadway in the wood line near the intersection of Main Street and Old Main Street Extension facing away from the street. Trooper Rego noted there were tire marks leading from the roadway (Main St. Ext.) heading into the wood line where the vehicle was located. In the immediate area of the tire marks, Trooper Rego observed a black skecher shoe, size 7 was located in the wood line.
8. On the ground near the front passenger side tire, Trooper Rego observed a reddish/brown liquid. In the same area a gray flip phone was found, open, facing downward and had dry reddish/brown liquid on it, a rock was located near the rear passenger bumper also had reddish/brown liquid on it.
9. On the exterior of the vehicle, Trooper Rego observed two medical bags on the hood. There was a dry reddish/brown liquid on the hood and windshield. Trooper Rego also observed damage to the hood, more specifically on the front portion of the hood closer to the passenger side. Trooper Rego observed damage to the front bumper and a red stain on the lower front driver side of the bumper. The rear bumper sustained damage as well. Trooper Rego observed a red stain on the rear bumper on the passenger side and a red stain was located on the rear bumper on the driver side as well.
10. Looking inside the vehicle Trooper Rego observed a dry reddish/brown liquid on the front passenger side interior door panel.
11. The following State Police personnel responded and assisted in processing the scene. Sergeant William Tarbokas, Crime Scene Services Section (CSSS), Trooper Michael Lombard (CSSS), Trooper Peter Bengston (CSSS) Trooper Daniel Miller (CSSS), Trooper Brian Mahoney, Collision and Reconstruction Section (CARS), Trooper Nuno Medeiros, Firearm Identification Section (FIS) and Forensic Scientist Ruth Ragnaldsen.
12. On Tuesday, September 25, 2018, at approximately 0040 hours, Michael Miller (DOB: 05/24/81, Phone: 774-244-9093) from Lynch’s Towing arrived on scene and removed the vehicle from the wood line. Trooper Nuno Medeiros then followed Lynch’s Towing and the vehicle from the scene to the State Police Crime Lab, located at 30 Riverside Drive in the town of Lakeville. The vehicle was then secured inside the crime lab garage to be processed.
13. On Monday, September 24, 2018, at approximately 2025 hours. Sergeant Donald Short and Trooper Jason Abramoski conducted an interview with the biological father of victim; Thomas DeFilippo (Date of Birth: 06/05/1950). The interview was conducted in the kitchen of his primary residence, 454 School St. Marshfield and in the presence of his wife, Maureen DeFilippo (Date of Birth: 02/07/ 1958) Phone: 617-688-0114. The following interview is a summary of facts and is not to be interpreted as verbatim: Thomas stated that the victim had arrived at his house on this date, at approximately 1000 hours. He and the victim spent the day together as she frequently does and assisted him with his landscaping business. At approximately 1745 hours. The victim left the residence in her Toyota Scion and stated that she had dinner plans with her current boyfriend (John Tallent). Thomas explained that the victim and John had been dating since May 2018, and that they were very happy together. Thomas described John as a “good guy” and that the victim “finally found happiness in her life”. Thomas further explained that they were living together in an apartment located at 1717 Ocean St. Marshfield. Thomas did not observe anything out of the ordinary regarding the victim’s demeanor when she left and stated that she was “joking around” with him as she walked out the door.
14. Sergeant Short and Trooper Abramoski asked Thomas if he could explain the dynamic of her relationship with Allen Warner. Thomas explained that the victim was in the process of finalizing a divorce with Allen and that she had not spoken to him in months. The victim had blocked Allen’s number from her phone and to the best of Thomas’s knowledge, they did not communicate. Thomas explained that he worried that Allen may do something like this and described him as estranged, mentally ill and abusive. Thomas stated that the victim was in fear of Allen and once stated that “they don’t know him”. Thomas did not know where Allen resided and did not know his phone number. Thomas described Allen’s appearance as scruffy and “looks similar to Kid Rock”. At the conclusion of the interview, Thomas provided investigators with the victim’s phone number, (508) 562-2244.
15. On Monday, September 24, 2018 at approximately 1933 hours, Trooper Michael DiMarzio arrived at South Shore Hospital in Weymouth and was met by Trooper Michael Lombard of the Massachusetts State Police Crime Scene Services Section, Detective Gregory Davis and Detective Kimberly Jones of the Marshfield Police Department. Detective Davis stated that Doctor Brian Marcks tended to the victim and pronounced her deceased at 1843 hours. The victim was located in trauma room #1. Trooper DiMarzio observed that the victim was lying on a hospital bed and was covered by white and blue hospital blanket. Medical tubes and devices where affixed to the victim. Trooper DiMarzio observed that the victim had a large laceration across her chest, which Dr. Marcks later explained was created during life-saving measures. Trooper DiMarzio also observed that the victim appear to have a wound in the front portion of her neck. There was a deep laceration to the victims chin and Trooper DiMarzio observed several other cuts and bruises throughout the victim’s body. Upon rolling the victim, Trooper DiMarzio observed what appeared to be three wounds to the victims back. There was a large amount of reddish brown fluid on the hospital bed. Detective Davis then provided Trooper DiMarzio with a possible name of the victim as being Shana Warner, DOB: 11/26/69 along with an RMV photograph. The identity of the victim was confirmed to be Shana Warner. Trooper Lombard documented the victim using digital photography. Massachusetts State Police Chemist Ruth Ragnaldsen arrived at the hospital and took possession of the victims clothing that she was wearing when she arrived at the emergency room. Doctor Kathrine Lindstrom of the Office of the Chief Medical Examiner accepted jurisdiction.
16. On Monday, September 24, 2018, at approximately 2012 hours, Trooper Sean Finn conducted an interview of Robert A. Orsino (DOB: 02/13/1960). Robert Orsino was identified as a witness to the homicide of Shana Warner (DOB: 11/26/1969). The interview was conducted in the parking lot of ABC Equipment, located at 844 Main Street, in the town of Marshfield. The following is a summary of the facts obtained during the interview of Robert Orsino.
17. During the interview, Robert Orsino stated that he was traveling home from North Scituate, driving southbound on Main Street, in the area of ABC Equipment. While traveling southbound on Main Street, Robert observed a small Sport Utility Vehicle (SUV) off of the road, on the right side of the road, at the intersection of Old Main Street Extension. For the purpose of this affidavit, this vehicle will be referred to as Vehicle #1. Robert stated that he observed another vehicle in the same area of the vehicle which was off the road. For the purpose of this report, the other vehicle, which was described as a small silver sedan, will be referred to as Vehicle #2. Robert explained that Vehicle #2 was not off of the road, but was parked on the right shoulder, facing southbound on Main Street. Robert explained that he saw a male exit Vehicle #2 and approach Vehicle #1. Robert further explained that, he initially believed that the male he saw in the area of Vehicle #2 was a Good Samaritan who was checking on the operator of Vehicle #1, which was off of the road.
18. According to Robert, the male who was walking toward Vehicle #1 was carrying what appeared to be a “stick” in his hand. Robert explained that he was approximately twenty five (25) yards from the two vehicles when he made the above observations. Robert explained that he was driving slowly in the area, as he was “rubbernecking”. Robert explained that, as he continued to roll forward toward the vehicles, he saw the male approach Vehicle #1 and Robert heard a loud “bang”. Robert explained that he only heard one “bang”, which was immediately followed by a female screaming.
19. Robert explained that, due to the loud “bang” followed up by the screaming, he realized that the noise he heard was actually a gunshot. Robert believed the gunshot was from a shotgun or a high caliber firearm. Robert explained that he occasionally hunts and has a License to Carry a Firearm and is therefore familiar with the sound of gunshots.
20. Robert described the male he observed as thin, with medium or light skin tone, and average height (5’9”). Robert could not recall what the male was wearing for clothing.
21. Robert stated that, after he heard what he believed to be the gunshot, Robert slowed down and came to a stop approximately twenty (20) yards south of the scene. Robert stated that, as he was stopped beyond the scene, he observed the male get into the driver’s seat of Vehicle #2. Robert explained that Vehicle #2 then started to travel southbound on Main Street, and passed his stationary location. Robert stated that he decided to follow the vehicle, to see if he could identify it by Make/Model/License Plate.
22. Robert stated that he was able to make further observations of the vehicle and confirm that it was a silver sedan with an oval shaped insignia on the back (possibly a Ford). Robert stated that he was initially able to observe the first three (3) number/letters of the license plate, as the vehicle was traveling on Main Street. Robert stated that he was able to continue visual of the vehicle, although the vehicle began to travel at a high rate of speed and was passing vehicles on the wrong side of the road.
23. Robert continued to explain that, as Vehicle #2 approached the intersection of Furnace Street, Vehicle #2 went through the red light and turned right onto Furnace Street in a westerly direction. Robert stated that he continued to follow the vehicle and was eventually able to observe the License Plate in its entirety and identify the vehicle as Massachusetts Registration 4FSZ80. (Note: An inquiry into the CJIS Database revealed that the aforementioned registration (4FSZ80) came back to a gray 2013 Toyota Corolla, which was registered in the Massachusetts Registry of Motor Vehicles to Sandra Warner, of 73 Bickmill Street, Quincy, MA.)
24. Robert stated that he stopped following Vehicle #2 after he was able to identify the entire license plate. Robert stated that the last location he saw Vehicle #2 was in the area of Forest Street. Robert explained that, after being able to make identification of the license plate, he heard police sirens heading toward the area of the scene on Main Street. Robert stated that he then turned around and headed back to the scene. Upon his arrival back at the scene, Robert notified the first Police Officer he found of the above information.
25. On Monday, September 24, 2018, at approximately 2040 hours, Trooper Sean Finn conducted an interview of Michelle Smith (DOB: 08/16/1968). Michelle Smith was identified as a witness to the homicide of Shana Warner (DOB: 11/26/1969). The interview was conducted in the ABC Equipment parking lot, located at 844 Main Street, in the town of Marshfield. The following is a summary of the facts obtained during the interview of Michelle Smith.
26. During the interview, Michelle Smith stated that she was traveling in the area of Main Street and Old Main Street Extension, when her attention was brought to a vehicle on the side of the road. Michelle described the vehicle as a small silver Sport Utility Vehicle (SUV), which was “box shaped”.
27. Michelle explained that she saw a female near the vehicle yelling “help, help, help”. Michelle stated that the female was near the passenger door area of the silver SUV, when the female was yelling. Michelle stated that she believed that the female was either thrown out of the SUV, or jumped out of the SUV herself. Michelle explained that she observed the female on the ground, near the front passenger’s door.
28. Michelle explained that the female then started to walk away from the vehicle. According to Michelle, after the female walked away from the silver SUV, the female stopped walking. Michelle explained that, shortly thereafter, Michelle observed the silver SUV physically hit the female with the front end of the vehicle. Michelle further explained that, after being struck by the silver SUV, the female was dragged a short distance by the same vehicle. Michelle stated that, based on her observations, she could tell that the impact of the vehicle was clearly intentional and the vehicle made no attempt to avoid the female.
29. According to Michelle, after the vehicle impacted the female, Michelle observed a male get out of the silver SUV and run away from the vehicle. Michelle explained that she only saw the profile of the male, and based on her positioning, she was unable to see the entire body of the male. Michelle described the male as “scruffy looking”, with dirty blonde hair, possibly wearing a hat.
30. Michelle explained that, after making the above observations, she continued to drive beyond the scene and returned to the scene when she observed police arrive. Michelle stated that, upon arrival of first responders, she informed the first Police Officer she saw of what transpired.
31. At the conclusion of the interview a photo array was shown to Michelle Smith. Trooper Finn utilized a photo array comprised by the State Police Fusion Center which included an image of Allen Warner DOB 10/22/1970. Michelle Smith stated that she was unable to make a determination if it was the male described above and that she only saw the profile of his face.
32. On Monday, September 24, 2018, at approximately 2112 hours. Trooper Jason Abramoski conducted an interview with Kathleen McClarey (Date of Birth: 9/13/1968). The interview was conducted in the parking lot of 844 Main St. Marshfield, MA. The following interview is a summary of facts and is not to be interpreted as verbatim: At approximately 1725 hours. McClarey was returning home to her residence for her son’s birthday dinner. During that time, McClarey was driving north bound on Main St. at School St. when she observed a male walking southbound on Old Main St. toward Route 3A. McClarey’s attention was drawn to the male because of his odd demeanor, clothing and the fact that she had never seen him in the area before. McClarey further described the individual as a white male, approximately 6 feet in height, 40-50 years old, scruffy light colored hair, and wearing dark jeans with a black hooded sweatshirt that was pulled over his head. McClarey thought the male was “just odd” and she observed no other vehicles in the area.
33. At approximately 1749 hours. McClarey and her family were traveling south on Old Main St. with Kathleen driving. As McClarey approached the intersection of Old Main St. and Main St. (Route 3A), McClarey observed a gray vehicle that was stationary in the middle of roadway. As McClarey drove closer to the vehicle, she observed the same white male as described above, leaning into the opened driver’s side door of the stationary gray vehicle. McClarey described the white males demeanor as nervous, agitated, and looking around as McClarey’s vehicle passed his location. McClarey could not see the operator of the gray vehicle. As McClarey continued passed the gray vehicle, she observed the white male climb into the driver side of the vehicle and the car began to drive forward. At that time, McClarey believed a “car jacking” may have taken place and she immediately called 911 to report her observations.
34. At the conclusion of the interview a photo array was shown to Kathleen McClarey. Trooper Finn showed an image of Allen Warner DOB 10/22/1970. Kathleen McClarey stated that she was unable to make a determination if it was the male described because the man was wearing a hoodie which partially blocked his face.
35. Kathleen McClarey’s son, James McClarey who was also in the vehicle with her was also shown a photo array. Trooper Finn utilized a photo array comprised by the State Police Fusion Center which included an image of Allen Warner DOB 10/22/1970. James McClarey stated that she was unable to make a determination if it was the male described above because nothing stood out to him, and he noted the suspect seemed younger than the individuals photographed.
36. On Monday, September 24, 2018, at approximately 2139 hours, Trooper Rabbitt conducted an interview of John Tallent (DOB: 8/11/65, 1717 Ocean Street #27D, Marshfield) at 454 School Street, Marshfield. John Tallent was identified as the current boyfriend of the victim and had last seen the victim on the morning of September 24, 2018.
37. John Tallent stated that the victim, Shanna Wanger, has been his girlfriend for approximately five months and they currently live together at 1717 Ocean Street #27D, Marshfield. John Tallent stated that the victim currently worked as a landscaper with her father a “D’s” landscaping and worked at the Home Depot in Rockland in the winter. John Tallent stated that he is currently retired from the Massachusetts Bay Transit Authority.
38. John Tallent stated that he last saw the victim on Monday, September 24, 2018, at approximately 0930-0945 hours at their home when she left for work. John Tallent stated that the victim was dressed in jeans and a black hoodie when she left for work and was driving a Scion color silver. John Tallent described the Scion as being “Boxy” in style. John Tallent stated that he texted the victim approximately halfway through the day telling her he bought her cigarettes and to tell her that he loved her. John Tallent stated that the victim responded to his text by saying “Oh good thank you” and “I’m going to start cooking soon” at approximately 1706 hours, the same date. John Tallent stated that he texted the victim back at approximately 1927 hours, the same date, asking her if she was okay. John Tallent stated that he texts the victim every day to tell her he loves her and often times texts her “BBBB” which means “I love you” between the two of them. John Tallent stated that he and the victim had not been in a fight recently or ever.
39. John Tallent stated that the victim has a “Crazy Ex-husband” from Rockland. John Tallent stated that in order just to drive to his mother’s house in Abington with the victim she would have him drive around Rockland to avoid it. John Tallent stated that he has never seen the victim’s ex-husband. John Tallent stated that shortly after they began dating, the victim received “Weird calls and texts” from “508 and 808 numbers”. John Tallent stated that he could never recall the victim telling him that her ex-husband ever showed up at her home or work. John Tallent stated that the victim last received a telephone call from her ex-husband approximately one month ago, however she did not answer. John Tallent stated that he believes the victim’s ex-husband to be Allen Warner, who drives a Toyota Corolla and lives on Market or Union Street in Rockland.
40. John Tallent stated that after the victim left for work today he stayed home, cleaned their residence, watched television, took the trash out and covered his motorcycle. John Tallent stated that he left his residence at approximately 1500 hours, the same date, and went to “Smoke and Ashes” on Route 139 to buy cigarettes and returned to his residence. John Tallent stated that he learned about the shooting of the victim when the victim’s daughter, Victoria, call him and told him that the victim had been shot.
41. On Monday, September 24, 2018 at approximately 2200 hours, Sgt. Jay Farley along with Tpr. Jerome MacDonald of the State Police Detective Unit interviewed Sandra Warner (DOB 7-21-40, 73 Bicknell Street, #125, Quincy, Ma) at her residence. Bicknell agreed to speak with us after she had consented to a search of her residence for her son Allen Warner (along with Quincy Police Sgt. Garrett Greenwood and his tactical team). The officers found no one else present in her apartment. Mrs. Warner asked if her friend James Morgan (DOB 07-16-50 73 Bicknell Street, Quincy) could also be present for the interview. The interview was electronically recorded. This is a summary of the recorded interview.
42. Upon opening her apartment door, before the recorded interview, the first statement that Warner said to the officers (unprovoked) was that “he” wasn’t there. Sgt Farley asked her who she was referring to and she stated that her son, Allen was not there. She stated that she knew of the situation in Marshfield and that she heard that her son had been involved in a shooting incident involving his estranged wife, Shana. Warner said that she had not spoken with her son since the incident earlier in the day on this date. Warner said that the last time that she spoke with her son was on Wednesday, September 19, 2018. She said that her son advised that he had a prepaid phone and that he was running low on minutes but that he would call her when he put more time onto his prepaid cellular phone. Warner said that she believed that her son Allen had run out of minutes on his phone because of his previous statement that he was low on minutes and that she had tried calling him earlier on this date and that the phone rang and went direct to voicemail. Warner provided us with a number of 339-309-9061 for Allen. Warner stated that Allen lived at 530 Union Street in Rockland. She said that Allen Warner lived with Joe Burton (781-351-0810) along with Burton’s 8 year old son. Warner said that Allen lived there and was supposed to be there and “not supposed to be in Marshfield shooting his friggin wife.” She stated that he is getting a divorce and that he should be nowhere near her. Warner said that Allen’s wife had previously been married for 20 years to Al’s friend, Raymond Taylor.
43. Warner said that her son was estranged from his wife, Shana, and that the two of them had a strained relationship. Warner said that Allen Warner had previously “beat up” Shana approximately 15 years ago. Warner said that the police were not contacted in response to that previous domestic incident.
44. Warner said that she hoped that Allen didn’t shoot himself. She said that he had never stated that he wanted to hurt himself but that Shana was driving him up a wall and that Shana was just “turning the knife”. Warner stated that she didn’t know if Allen owned a firearm and that he could get access to anything.
45. Warner stated that Allen had her car, and that she heard Allen shot Shana in the car. Warner stated that the car was a 2013 Toyota Corolla. Warner said that she didn’t have a license and that Allen was the only one who used the Corolla. Warner said, “I’m sure Allen did it. I’m sure he did it. She just drives him up the wall.” Warner said that she hoped he didn’t hurt himself.
46. Warner stated once again that she was afraid that Allen was going to shoot himself. Warner said that Allen was not a fighter and that everybody loves him. Warner said that Allen and Shana lived together for 9 years and that they were constantly fighting. Warner said that Allen can’t drink alcohol anymore because he had been in a bad crash while drinking.
47. Warner said that Allen is the only person who should have the car and that he has the car. Warner was asked the location of the car and that she said that she heard that Allen had smashed the car in Marshfield.
48. On Monday, September 24, 2018, at approximately 2210 hours, Trooper Sean Finn conducted an interview of Rick Lombardi (DOB: 01/23/1959). Rick Lombardi was identified as a person who contacted the Marshfield Police Department, stating that he had information regarding the homicide investigation. The interview was conducted inside the ABC Equipment store, located at 844 Main Street, in the town of Marshfield. The following is a summary of the facts obtained during the interview of Rick Lombardi.
49. During the interview, Rick explained that, on Monday, September 24, 2018, at approximately 1500 hours, he left his residence on Main Street and began traveling southbound on Main Street, in the area of Old Main Street Extension. While traveling on Main Street, Rick observed a male walking out of a parking area, south of Old Main Street Extension, and began crossing the street toward the Furnace Brook.
50. Rick explained that the parking lot was a common parking area, which had access to hiking trails. Rick further explained that he would often see vehicles parked in that lot; however, Rick stated that the vehicle that he saw parked in the lot at this specific time was parked abnormally. Rick explained that vehicles usually park straight on, facing toward the hiking trails. According to Rick, the vehicle which he observed parked in the lot was facing south, close to the entrance, which was abnormal. Rick stated that the vehicle he observed was a light gray or possibly white sedan, possibly a Ford.
51. Rick explained that the male he observed looked “out of place” as the male did not look like he was ready to hike. Rick specifically noted that the male was holding in his hand what appeared to be a large hot coffee, from Dunkin Donuts. Rick described the male as a white male (pale complexion), approximately 5’9” tall, with a “slighter build”, reddish-blondish hair, with facial hair (beard) which was pointed at the chin. Rick stated that the male was wearing a blue hooded sweatshirt, which had a full zip in the front, with a white shirt under it, blue jeans, and a backwards baseball hat, which Rick believed to be beige or white. Rick explained that, after hearing about the homicide on the news, he realized how important his above observations were and realized that he needed to report the information. Rick stated that he made no additional observations of the male.
52. Rick explained that, on the same date, at approximately 1540 hours, he returned home. Rick explained that he was grilling food in his back yard when he heard a single gunshot. Rick stated that he was not sure of the exact time of the gunshot; however, he believed it was a minute or two prior to the first arriving Police Officer at the crime scene. Rick explained that he knew the sound was a gunshot because he has heard gunshots before. According to Rick, after he heard the gunshots Rick walked south on Main Street and talked to first responders at the scene. Rick stated that, after the gunshot was fired, he did not see anyone on foot traveling northbound on Main Street.
53. On Monday, September 24, 2018 at approximately 2315 hours, Trooper Michael DiMarzio, Trooper Jason Abramoski and Hanson Police Detective Paul O’Brien conducted the following three interviews at the Hanson Police Station.
54. On Monday September 24, 2018 at approximately 2320 hours, the victim’s daughter, Victoria Taylor, DOB: 10/18/91, stated that she last spoke with the victim three days ago on the telephone and nothing appeared unusual. Ms. Taylor stated that her mother’s ex-husband was Allan Warner and stated his telephone number is 339-309-9061. Victoria also advised that her mother was married to her father, Raymond Taylor, DOB: 01/21/70 but divorced in 2007. Ms. Taylor stated she called Allen Warner’s phone twice at 2106 hours and the phone rang a few times and then went to voicemail. Ms. Taylor stated she called Allen Warner because she figured he knew what happened to her mother. Ms. Taylor stated she would not think of anyone beside Allen Warner who would have done this to her mother. Ms. Taylor stated that her mother first started dating Allen Warner in 2007 and then they married in 2008. Ms. Taylor stated that Allen Warner has mental health issues and abuses opioids. Ms. Taylor advised that the victim and Allen Warner had an off and on relationship for years but her mother finally filed for divorce in April of 2018. Ms. Taylor stated that her mother was nervous after filing for divorce and was also concerned that Allen Warner would commit suicide. The victim had not talked to Allen Warner since filing for divorce. Ms. Taylor has not seen Allen Warner in nearly two years. Ms. Taylor advised that that she is not sure where Allen Warner could be found but stated that he once stayed with a friend, Ryan Pagnani, DOB: 10/17/91 on Beech Street in Rockland. Ms. Taylor stated that she never observed any abuse but stated that the victim told her that Allen Warner was verbally abusive to the victim. Ms. Taylor stated that Allen Warner knew a lot about guns and was “obsessed” with war.
55. On Monday, September 24, 2018 at approximately 2342 hours, the victim’s son, David Taylor, DOB: 07/26/94, stated that he last spoke with the victim five days ago and nothing seemed unusual. David stated that Allen Warner is a “shit show” and has something mental going on. He advised that one time Allen Warner grabbed his mother’s throat approximately three years ago. He has not seen Allen Warner in over a year.
56. On Monday, September 24, 2018 at approximately 2355 hours, the victim’s son, Thomas DeFillippo, DOB: 12/15/86, stated he last saw Allen Warner one year ago. He advised that he never liked Mr. Allen and suspected that he “smoked cracked” because he just gave him that “vibe”. When asked if he was aware of any violence between the victim or Allen Warner, Thomas stated Allen Warner did something to his mother one time and he thinks his mother may have then struck Allen Warner with a frying pan.
57. On Monday, September 24, 2018 at approximately 2350 hours I, Trooper McNamara listened to the 911 call from the State Dispatch Center in Framingham, MA. The following is a summary of the 911 call and is not meant to be a verbatim account of the actual call. The victim was completely and utterly in distress. At one point the caller/victim in Marshfield talking to the dispatcher breathing heavy and seemingly acting frantic. The caller stated her ex-husband jumped into her car. She was confused of her location. She then stated that she cannot drive right now and her ex-husband was no longer in the vehicle. The caller states she is very hurt. As the State dispatcher is talking to Marshfield dispatch you can hear the caller begin screaming frantically.
58. On Tuesday, September 25, 2018 at approximately 0030 hours, Trooper Sean Finn conducted an interview of Joseph Burton (DOB: 02/03/1965). Through investigatory efforts, Joseph was identified as the roommate of Allen Warner. The interview was conducted at 530 Union Street, in the town of Rockland. The following is a summary of the facts obtained during the interview of Joseph Burton.
59. During the interview, Joseph stated that he has known Allen for about five (5) or six (6) years. Joseph explained that Allen has been staying with Joseph for the past year. Joseph stated that he last saw Allen on Monday, September 24, 2018, at approximately 1030 hours. Joseph explained that, during the early morning hours of Monday, Allen helped Joseph with yard work. Joseph stated that Allen left around 10:30 am on Monday morning. Joseph stated that Allen left in his newer model, (2015-2016) 4-door silver Toyota. Joseph stated that he knew the Toyota was registered in Allen’s mother’s name. Joseph stated that, when Allen left the residence, Allen was wearing a blue hoodie, jeans, hiking boots and a yellow hat that Allen always wears.
60. Joseph stated that, prior to Allen leaving, Allen told Joseph that he (Allen) had to run errands to run. According to Joseph, Allen also revealed that he might have to stop by and see his ex. Joseph explained that he was surprised by Allen going to see his ex, because Allen hadn’t talked about her in a long time. Joseph stated that after Allen left Rockland, Joseph never heard from Allen again.
61. Joseph stated that Allen sometimes leaves the house for an hour and sometimes Allen leaves for days. Joseph stated that Allen sometimes goes to the hospital because he thinks Allen has issues; Joseph specifically noted that Allen often thinks that he had bugs on him.
62. Joseph stated that Allen informed Joseph that Allen was in Marshfield on Friday/Saturday looking for scrap. Allen told Joseph that someone called the cops on him (Allen). Joseph explained that, based on his knowledge of Allen’s ex, and her family, he was aware that the location Allen was “looking for scrap” at was the same area that Allen’s ex’s father lives.
63. According to Joseph, over this past weekend (September 22 or 23), Allen was complaining about his ex to Joseph. Specifically, Joseph noted that Allen said that his ex was being a “douche bag”. Joseph also stated that Allen was frustrated during the morning hours of Monday, September 24, 2018, and stated “She is really getting me heated”. Joseph stated that the statement was made by Allen, prior to Allen leaving the house on Monday.
64. Based on Joseph’s knowledge of Allen Warner, Joseph believes that Allen likely fled to either New Hampshire or Virginia. Joseph explained that Allen’s sister (Marsha Dunstan) and her husband own a house in New Hampshire, which Allen likes to visit to “clear his head”. Joseph also explained that Allen’s older brother owns a house in Virginia and he could see Allen going there to hide.
65. On Tuesday, September 25, 2018 at approximately 0538 hours I, Trooper McNamara viewed Marshfield Police Department’s log and noted that Allen Warner (DOB 10/22/1970) was called in as a suspicious person on Thursday, September 20, 2018 in the vicinity of 465 Forest Street Marshfield, Massachusetts. The caller reported a male possibly picking cans from trash but not sure. The caller stated they would like someone to check on him.
66. On Tuesday, September 25, 2018, at approximately 0821 hours, I spoke with Timothy Hughes, (DOB: 3/13/66) who told me that yesterday, (Monday, September 24th) at approximately 1745 hours, he was driving home from work. While traveling on north on Main Street and turned left onto Old Main Street Extension, he noticed a vehicle in the woods with a white male standing on the hood of the vehicle with a cellular telephone up to his ear. Hughes further described the male as 180-200 lbs with a beard and motion that the male’s hair was long in the back and flaired out by his shoulders, wearing a brownish flannel.
67. Based on all the information ascertained, and corroborated, during the investigation, it is my opinion, as well as, the opinion of other investigators assisting in this investigation, that there is probable cause to believe that Allen Warner (DOB: 10/22/1970) shot Shana Warner (DOB: 11/26/1969) with a firearm, stabbed and struck her with a vehicle, resulting in her death. This opinion is based on the above investigation and the following:
• Account of the events, prior to the victim being shot by a firearm, stabbed and struck with a vehicle: The victim was recorded on a 911 call, specifically, the victim frantically noting that she was very hurt and her ex-husband jumped into her vehicle.
• Witness interviews which revealed that a gray SUV intentionally struck the victim, in the area of Main Street and Old Main Street Extension. Witnesses then observed a white male exit the small SUV and flee from the immediate area on foot.
• Witness interview which revealed that a male was observed exiting a gray sedan and walking over to the gray SUV, now located off of the roadway into the wood line, with a “stick” like object in his hand. Moments later, the witness heard a single gunshot, followed up by screaming from a female, in the area of the gray SUV. The male was then observed running away from the gray SUV and went into to the driver’s seat of the gray sedan. The suspect vehicle (gray sedan) was then observed by a witness fleeing the scene southbound on Main Street, toward Furnace Street. The witness, continued following the suspect vehicle, and is able to identify the suspect vehicle as Massachusetts Registration 4FSZ80.
• The records of the Registry of Motor Vehicles revealed that the vehicle bearing Massachusetts Registration 4FSZ80 is a 2013, Toyota Corolla, color gray listed to Sandra Warner, of 73 Bicknell Street, Quincy. Sandra Warner was later identified as the mother of Allen Warner (DOB: 10/22/1970).
• Witness interviews revealed that Allen Warner is the primary operator of Massachusetts Registration 4FSZ80. Furthermore, Allen Warner was observed leaving 530 Union Street, in the town of Rockland, operating that vehicle on September 24, 2018.
• Witness interview revealed a male wearing a blue hooded sweatshirt, which had a full zip in the front, with a white shirt under it, blue jeans, and a backwards baseball hat, believed to be beige or white. This is the description of the physical features of the Allen Warner confirmed by photograph on MA Driver’s License and known/documented physical stature. The description of the clothing of the suspect is consistent with the clothing description given by Allen Warner’s roommate who saw the Warner leave from 530 Union Street, Rockland on September 24, 2018 in that clothing.
• Allen Warner specifically noting, prior to leaving 530 Union Street, to his roommate that he (Allen) might have to stop by and see his ex (Shana) and that “she is really getting me heated.”
• Allen Warner’s previous encounter with Marshfield PD, on September 20, 2018, where Allen Warner was observed in the area of Forest Street and School Street wearing camouflage walking around, apparently collecting cans. This area is known by Allen Warner as the location/area which the victim’s father lives.
• Known/recent animosity between Allen Warner and Shana Warner, as Allen told a witness that Shana was being a “douche bag” and Shana was “really getting (him) heated.”
• Allen Warner’s own mother believes Allen probably killed Shana Warner and stated “I’m sure Allen did it. I’m sure he did it. She just drives him up the wall.”
68. On Tuesday, September 25, 2018 at approximately 1000 hours, Trooper Jerome MacDonald, met Trooper Heather Sullivan assigned to the Crime Scene Services Section (CSSS) at the Office of the Chief Medical Examiner (OCME), 720 Albany Street Boston, Massachusetts. Trooper Sullivan and Trooper MacDonald were at the (OCME) to attend and witness the autopsy of Shana Warner, DOB: 11/26/1969, 1717 Ocean Street, Marshfield.
69. Doctor Andrew Elin conducted the autopsy at approximately 1000 hours on the same date. The victim and autopsy process were documented using digital photography by Trooper Sullivan (CSSS).
70. While performing the autopsy Doctor Andrew Elin noted the following: No defensive wounds on the right hand such as cuts or slices. No cuts or slices on the left hand. The top of the left hand was bruised. Bruising and scrapes to the left and right thighs. The right knee had bruising on the back and an abrasion on the inside the knee. The left knee had a small abrasion on the front of the knee. Bruising on the outer part of the left ankle. Scratches on the stomach. Abrasion on the left side of the stomach. Bruising to the left eye.
71. The following and lacerations were documented:
A. An exit wound from a bullet located on the front left chest under the neck.
B. Entrance wound top left shoulder, small fragments of bullets in the left shoulder of the victim.
C. Stab wound on the left shoulder area.
D. Stab wound to the spine area.
E. Stab wound under the right shoulder.
F. Stab wound to the chin, a half circle round the chin almost cutting the chin off.
G. Stab wound to the top of the skull.
H. Stab wound top back of the head. (Both stab wounds were approximately 2-2/12 inches apart.)
72. Dr. Elin advised the Left Lung had damage from the bullet and possibly one of the stab wounds and heavy damage to the left shoulder. Doctor Elin concluded the autopsy on Tuesday, September 13, 2018 at approximately at 1500 hours. He stated the Cause and Manner of the death are pending at this time.
73. On Tuesday, September 25, 2018 at approximately 1232 hours Officer Mark Poirier from the Whitman Police Department was dispatched to the Dunkin Donuts at 26 South Avenue Whitman, Massachusetts 02382 for a report of a past hit and run in their drive through parking lot. The witness stated the truck involved was a ramp style truck and they believe it was a T & K Asphalt Paving truck. Officer Poirier was brought to the Dunkin Donuts Office to view the video. While observing the video, Officer Poirier noted that truck looked like a black Peter Built ramp truck and stated it looked like the T & K on the driver’s side door. Officer Poirier observed the truck try to pull through the drive thru but was blocked by 3 large flower pots. The truck made several attempts but ended up destroying two of the flower pots then continued through the drive thru without making a purchase. Officer Poirier then responded to and spoke with the facilities manager Chris Duffy on the road in front of the building at 7 Industrial Way in the Town of Whitman. As the Officer was speaking with Mr. Duffy, Mr. Duffy stated no one should be in the truck but they could find out because the truck had GPS on them. Officer Poirier identified the truck as it approached them on Industrial Avenue. Officer Poirier got into his patrol car, activated his emergency light and attempted to stop the flat bed. As he approached the vehicle he noticed the vehicle begin to back up so Officer Poirier activated his siren and pulled to the right side of the truck. Officer Poirier yelled to the operator to stop the truck and immediately identified the operator to be Allen Warner from the earlier BOLO. The Officer immediately exited his vehicle and as the operator’s door opened, Officer Poirier asked “are you Al?” The operator replied with “yes.” Officer Poirier then handcuffed the operator and asked “are you Allen Warner?” The operator then replied “yes.” Officer Stokinger transported him back to the Whitman Police Department and then to the Marshfield Police Department, where he was booked, photographed and given the opportunity to use the phone. Allen was held pending court.
74. Based on the foregoing reliable information and upon my personal knowledge and belief, as well as the opinion of other investigators assisting in this investigation, I believe that there is probable cause to believe that Allen Warner (DOB: 10/22/1970), did shoot Shana Warner (DOB: 11/26/1969) with a firearm and stabbed her, causing her death. It is the opinion of this officer, as well as others involved in this investigation, that Allen Warner (DOB: 10/22/1970), of 530 Union Street Marshfield, Massachusetts, committed the crime of Murder, a violation of Massachusetts General Laws Chapter 269, Section 1, with the victim of this crime being identified as Shana Warner (DOB: 03/10/1992). Further, that this crime occurred at the vicinity of Old Main Street Ext. and Main Street, in the Town of Marshfield, Massachusetts, on Monday, September 24, 2018.
