Warrensburg-Latham School District Drug Testing Policy

Policy Statement:

The Warrensburg-Latham School District believes that the use of prohibited substances or illegal drugs by students will present a hazard to the health, safety, and welfare of all students. Therefore, those who participate in Extracurricular Activities, Student Drivers, and/or students enrolled in classes that may include use of power equipment will be subjected to random drug testing. The school district encourages all students to participate in extra-curricular activities and elective courses but views these as privileges and not rights. In order for a student to be eligible to sign up or participate in an extracurricular activity or enroll in specific courses, student and student’s parent/guardian must sign and return the consent form authorizing the Warrensburg Latham School District or its designee to place the students name into the testing pool.

Purpose:

1. To provide for the safety and health of all students.

2. To undermine the effects of peer pressure by providing a legitimate reason for students to refuse to use illegal drugs.

3. To encourage students who use drugs to participate in drug treatment programs.

4. To help enforce a drug-free educational environment.

Definitions:

A. Extracurricular Activities

School sponsored activities outside of the regular school day, where participation is voluntary and no academic grade or credit is given. Including clubs and/or teams.

B. Student Drivers

Any student who is granted a parking permit to or from school and anyone enrolled in driver’s education class.

C. Power Equipment class students

Any student who is enrolled in a class that requires the use of power equipment .

D. Prohibited Substances

Testing, by means of urinalysis, will be conducted to detect the presence of the following:

1) Amphetamines 4) Opiates

2) Cocaine 5) Phencyclidine (PCP)

3) Marijuana

Detection levels requiring a determination of a positive result will be in conformance with the guidelines adopted by the National Institute on Drug Abuse, now known as the Substance Abuse and Mental Health Services Administration (SAMHSA).

Testing, by means of urinalysis, may be conducted to detect the presence of the following:

1) Bath Salts

2) Synthetic Marijuana

Detection levels are reported as “Detected or “Not Detected” and not subject to a Medical Review Officer (MRO) review or SAMSHA guidelines. A Detected result will be treated as a violation of the Warrensburg Latham School District Drug Testing Policy and subject to the Consequences of Violation.

E. Testing Frequency

Students will be subject to random (unannounced, suspicion less) drug testing. Selections will be made at the rate of approximately 2% or more of those subject to testing. The time of the test will be determined by the Warrensburg Latham School District.

F. Testing Facility/Procedure

The testing facility shall be certified by SAMHSA. When using Quick plates, the collection site is the testing facility, which will be selected by the Warrensburg Latham School District.

The Testing Facility shall retain a Medical Review Officer (MRO) to evaluate positive results for tests. The MRO's determination shall be final and binding on all students.

If a student is required to submit to a urine drug test, due regard will be provided for the tested student’s privacy while, at the same time, testing personnel will use measures designed to ensure that the sample is not substituted, tampered with, or otherwise contaminated.

G. Random Sample

The school will use an independent facility for the computerized random selection program.

H. Prohibited Acts/Conduct:

1) Refusing or failing to sign and return the Warrensburg Latham School District Drug Testing Policy Consent Form.

2) Failure to provide an adequate urine sample in the time allotted.

3) Failure to cooperate in the testing process, including tampering with urine sample.

4) Submitting urine which is not with appropriate temperature range.

These acts/conduct shall constitute a violation of the Warrensburg-Latham School District Drug Testing Policy and therefore be considered a positive test and therefore subject to the Consequences of Violation.

I. Test Events

Students will be tested on 2 occasions:

1. Random

2. As a follow-up to violations of the Warrensburg-Latham School District Drug Testing Policy.

Consent form

To try out for or participate for any school sponsored activity, to enroll as a student driver, and/or to enroll in a class that will be operating power equipment, the student must read the Warrensburg Latham Drug Testing Policy and sign a consent form by which the student authorizes their name to be placed into the testing pool. The consent form must be signed also by the student’s parent/guardian.

Notification of Participant Selection/Absence

If a selected student is absent from school, during testing, the student will be tested before becoming eligible to participate in practice, competition, organization, and class membership and/or retain driving privileges. The test will be done in a timely manner with administrative discretion. Pre-Arranged excused absences will be at the administrator’s discretion as to whether the student is eligible to participate in practice, competition, etc and will set a time line for when the test will be administered. After the testing, a participator’s name is re-entered into the testing population and subject to re-selection during the next testing cycle while participating in any of the activities listed in the Policy Statement.

Negative Results

The parents/guardians of any random tested student who tests negative will be notified by mail, as soon as practical, of the district’s receipt of the information.

Non-Negative Quick Test Result

If a student tests non-negative on a quick test, they will be treated in a manner that protects their innocence until confirmed positive by the MRO or has a result of detected. If confirmed positive or result of detected, the student will be in violation of the Warrensburg-Latham School District Drug Testing Policy and be subject to the Consequences of Violation.

Consequences of Violation

If a student is involved in more than one categories below, they will result a consequence for each pertaining category. (i.e. An in season athlete who has a parking permit, would be ineligible for that season and unable to maintain their parking permit if they tested positive on the drug test.)

Extra Curricular

Students would be out the remainder of the season and at least five counseling sessions must be finished before the next desired season begins, in order to participate. Club members would be removed for the remainder of the year due to participation being a year long. Second offense will result in the loss of eligibility from one calendar year from the date of the offense. Third offense will result in the loss of eligibility for the rest of the student’s scholastic career in the district.

-Counseling A student would need to attend five counseling sessions. These sessions would be paid for by the student or student’s family, if outside counseling is needed.

Student Drivers

Students will lose the privilege of their parking permit for the remainder of the year.

Power Equipment class member

Student will, at a minimum, be removed from the class for the semester.

Warrensburg Latham Drug Testing Policy Consent form

I agree to submit to a urine drug test as required by the Warrensburg Latham Drug Testing Policy.

I understand that if a drug test is performed, its purpose will be to determine whether there is: 1) A prohibited level of the following drugs or their metabolites in the urine I provide: marijuana, cocaine, amphetamines, phencyclidine (PCP) and opiates. 2) A detected level of the following drugs or their metabolites in the urine I provide: bath salts and synthetic marijuana.

I consent to the disclosure of the test results and test-related information by and between the testing facility, Warrensburg Latham School District designated representative and its Superintendent, Administrators, Head Coach and Teacher on a “need to know” basis my parent/guardian, and the designated medical review officer (“MRO”) to ensure there is a careful and accurate review and reporting of the test results.

I consent to the disclosure of the test results and test-related information by and between Warrensburg Latham School District, the MRO and treatment provider if the test results are verified and confirmed as positive or detected and if I am referred for evaluation, treatment or rehabilitation. For the same reasons, I agree that if I am referred to a treatment provider, that provider may disclose to Warrensburg Latham School District any follow-up tests that may be performed as part of the evaluation, treatment or rehabilitation process.

I also agree that Warrensburg Latham School District may use and release information related to any drug tests to which I may submit under the Warrensburg Latham School District Drug Testing Policy for the purposes and to the extent authorized by statute or other legal authority.

I agree to indemnify, defend and hold Warrensburg Latham School District #11’s Board of Education, its officers, administrators, directors, and employees harmless from and against any and all claims, suits, causes of action, liability, damages, judgments or expenses for personal injury and/or damages suffered by the student arising out of any of the Warrensburg Latham Drug Testing Policy.

I acknowledge that I have read this form before signing it and that this consent is knowing and voluntary.

I further acknowledge that this consent form shall remain in effect until revoked in writing by me and may parent/guardian or the end of the school year as outlined in the school calendar.
