This report is produced in accordance with Federal Acquisition Regulation (FAR) Parts 10, Market Research; 11, Describing Agency Needs; and FAR Part12, Acquisition of Commercial Items (as applicable), which describes the policies and procedures for conducting market research in order to determine the most suitable approach to acquiring, distributing, and supporting supplies and services. The extent of market research will vary, depending on such factors as urgency, estimated dollar value, complexity, and past experience. Market research involves obtaining information specific to the item being acquired.

NOTE: All red & italicized verbiage is guidance intended to help you complete this report. Please remove as you complete each section.

1. SERVICE OR PRODUCT DESCRIPTION

Enter a full description of your contractual requirement to include:

a. Description of Supply/Service: Identify and list all unique/salient characteristics, specialized standards, expertise and or experience requirements that are important in the determination of a contractor’s capability to provide the products or services (example: software, licenses, training, contractor travel, industry standards, licenses and certifications, highly specialized subject matter expert labor categories).

b. Critical Performance Standards: What are the critical performance standards the service or product must meet? These performance standards will be used to assess contractor capabilities.

c. Other Direct Costs: Identify ALL other direct costs (ODCs) associated with this requirement that the contractor will be responsible to deliver (example: contractor travel, industry seminars, software license maintenance, and hardware/software needed to support the requirement) and discuss how they relate to the requirement.

In 1998, Congress amended the Rehabilitation Act of 1973 to require Federal agencies to make their electronic and information technology (EIT) accessible to people with disabilities. The law (29 U.S.C § 794 (d)) applies to all Federal agencies when they develop, procure, maintain, or use electronic and information technology. Under Section 508, agencies must give disabled employees and members of the public access to information comparable to the access available to others. Reference for more information.

2. ACQUISITION BACKGROUND & HISTORY

NOTE: This section should provide the acquisition background of your contractual requirement, not the history of your office/component.

a. Background:

• Explain how the requirement evolved and its importance to the program office it supports.

• Provide any National Defense Authorization Act (NDAA) language or statutes of the program.

• Discuss if there is any organizational conflict of interest.

• If this is a follow-on contract, if at all possible, discus the previous acquisition strategy, the number of offers received, and if there were any protests.

• Identify any changes that are required for your new contract. This includes changes in the technical requirement, place of performance, and significant increases or decreases in estimated costs from previous contracts.

• Discuss if you are consolidating or bundling any requirements for this new procurement. Federal Acquisition Regulation (FAR) 2.101 includes a definition of “consolidation” and “bundling” as follows:

o “Consolidation or consolidated requirement”-- (1) Means a solicitation for a single contract, a multiple-award contract, a task order, or a delivery order to satisfy-- (i) Two or more requirements of the Federal agency for supplies or services that have been provided to or performed for the Federal agency under two or more separate contracts, each of which was lower in cost than the total cost of the contract for which offers are solicited; or (ii) Requirements of the Federal agency for construction projects to be performed at two or more discrete sites. (2) Separate contract as used in this definition, means a contract that has been performed by any business, including small and other than small business concerns.

o “Bundling” -- (1) Means a subset of consolidation that combines two or more requirements for supplies or services, previously provided or performed under separate smaller contracts (see paragraph (2) of this definition), into a solicitation for a single contract, a multiple-award contract, or a task or delivery order that is likely to be unsuitable for award to a small business concern (even if it is suitable for award to a small business with a Small Business Teaming Arrangement) due to-- (i) The diversity, size, or specialized nature of the elements of the performance specified; (ii) The aggregate dollar value of the anticipated award; (iii) The geographical dispersion of the contract performance sites; or (iv) Any combination of the factors described in paragraphs (1)(i), (ii), and (iii) of this definition. (2) “Separate smaller contract” as used in this definition, means a contract that has been performed by one or more small business concerns or that was suitable for award to one or more small business concerns.
