Section 1.2.25 Fair Housing Policy: Multiple Listing Services are important tools for furthering fair housing because they facilitate the widespread distribution of accurate property information to all consumers. To that end, MLSs must implement a process for identifying potential violations of fair housing laws, advising participants and subscribers to remove or correct potential violations.

If the Association receives a report of an alleged Fair Housing violation, it will be sent to Director of Professional Standards or CEO. If it is found to be a possible violation, then the Director of Professional Standards will contact the listing agent and cooperating broker and request the language be eliminated and educate them as to why it was a violation. If the possible violation is still not corrected, then the violation will be forwarded to the Fair Housing Center.

Section 1.2.10 Marketing Remarks: The Marketing Remarks field in the MLS system is to be used for information pertinent to the subject property only. Violations will be subject to a fine per the fine schedule. The Marketing Remarks section of your listings may NOT include:

a. Email Addresses b. Personal Branding c. Seller or Agent name d. Seller or Agent phone number e. Phone numbers to recorded messages about the subject property f. Text numbers (Amended 08/14) g. Information about other listings not related to the subject property h. Information about other services (e.g. mortgages) i. Any information that is not specifically about the listed property j. Information related to lease offerings on Residential and Multi-Family, 2-4 unit listings unless entered into the MLS as a Residential Lease Listing (Amended 03/11) k. Statements that shift or attempt to shift responsibility for data accuracy to the buyer's agent (Amended 06/19) l. URL linking to additional information on the subject property (Amended 08/14) The primary content on the URL for Virtual Media must contain video, audio or images relating primarily to the subject property. m. Statements that violate Fair Housing laws (e.g. schools, neighborhood, race, color, ancestry, religion, national origin, age, gender, marital status, familial status, source of income, sexual orientation or disability) The exceptions to this rule are: a. Listings of REO properties may contain information required by the seller, provided such requirements are given to MLS Staff (Amended 05/11)

Section 1.2.11 Advertising Remarks: The Advertising Remarks are intended to be included in listing displays on third-party websites and are considered public remarks which will be disseminated to third-party sites through an approved RETS feed. Participants and Subscribers may only include the physical characteristics of the property and or neighborhood, listing agent contact information, including phone numbers, email addresses, website information, and open house information. Advertising remarks are prohibited from including additional self-promotion. Participants and Subscribers may not use the Advertising Remarks for purposes of conveying information about other offices, disparaging other real estate agents, the transaction or the subject property, or statements that violate fair housing laws. Participants and Subscribers may not include information considered confidential.
