Russell Shea Scott Keyser (Major MSP)James Laughland Mark UrbanikRachel RosenbergMinutesThe minutes from the June 12, 2019 meeting were approved unanimously.AnnouncementsAny firearm approved at this meeting will be published in the Maryland Register on October 11, 2019 and, barring no objections, will be included on the Maryland State Police website on November 11, 2019 as a handgun, model and caliber legal for sale in the State of Maryland.Additional DiscussionsIMSDPublic Safety Article 5-132 on handgun safety devices and Attorney General J. Joseph Curran Jr.'s opinion referencing the requirements of integrated mechanical safety devices were disseminated. The discussion covered the definition and laws of an integrated mechanical safety device and the need for an updated definition and list of devices. The idea of creating petitions specific to IMSD’s was presented but not voted upon. The Administrator will take the initiative on checking the availability of the current devices on the list and whether they are built into the firearm. It was noted that the list includes cable locks, which are universally accepted and commonly sold by dealers with the purchase of a firearm but external to the firearm and may violate state law. At this point the Board chose not to take action on this matter.N/AThe dual meaning of “N/A” being entered as a model number on the handgun roster was discussed. The Board was made aware that the entering on “N/A” means both “not applicable” and “all”. They were made aware that there are thousands of entries on the handgun roster as “N/A” and more SKU numbers entered than model numbers. For Licensing Division purposes, the “N/A’s” represent all model numbers are approved. If a manufacturer adds in a variation later, there would be no way for it to be to distinguish as all future modification would already be covered under “N/A” designation.At the hearing, the Board was asked to consider a group of 24 petitions, submitted by a single petitioner, that were meant to encourage the elimination of model numbers. In response, the Board chose to table any petitions in which “All” appeared as the model number and request that specific model numbers or identification numbers be provided. Also, the Board chose to approve only the information submitted on the petitions and as listed on the agenda and for the Administrator to seek clarification from the petitioner and/or manufacturer regarding model numbers. Petitions with “N/A” for the model number were changed to, and will appear of the roster as, “NMN” (no model number). The Board requested that future petitions to include a model number or alternatively, a SKU, part, item, or manufacturer number, etc. It was suggested “N/A” would only be indicated in place of a model number, if it is a true “not applicable.” Criteria for Sample TestingThe draft letter from Board member Mathias’ to manufacturers was presented for discussion. As the letter, in-part, conflicts with the approved criteria for sample testing (established at the December 2018 meeting) a determination needs to be made as to whether the letter is ready for dissemination and/or if the testing criteria needs to be modified. The Board decided to table this matter as asked that the letter, as well as the criteria, be resubmitted to all members for further consideration and comment.In a related matter, the current requirement for FATMU to fire a full magazine when testing firearms (established in the SOP between P&R and FSD) came into question. The Board brought up concerns about the cost of shooting more than 10 rounds and the fact that a magazine with more than 10 rounds cannot be sold in the state. This matter did not come up for vote. No action taken at this time. PetitionsThere was a suggestion that manufacturers should be required to provide the specifications and photos with the submitted petitions. In addition, the idea that any groupings of petitions should be treated as one and approved or disapproved all together as such. This matter did not come up for vote. No action taken at this time.
