1. This permit application is for furniture/retail in the R-10 Zone. Permit #2787-98-U was approved for furniture/retail. This site is now located in the TDO Zone of the New Carrollton Transit District Overlay Zone as of May 2010. Furniture/retail in the R-10 Zone is not listed therefore prohibited. Since this use legally existed per permit #2787-98-U prior to the New Carrollton ZMA, furniture/retail store is permitted with documentation of continuous operation from May 2010 to the present. Any documentation submitted can not exceed or lapse a period of 180-days. The documentation submitted must clearly demonstrate that this use has continually operated on this property. Documentation can consist of retail/invoice receipts, county and/or municipal business licenses, county or Health Department inspection records, taxes/accounting information and bills, old or new advertisements, old phone book listings, and customer invoices. Notarized statements from people that have knowledge that the use has been in continuous operation can be submitted to help supplement the documentation. Ideally the documentation should include letterhead that indicates the address of the property, and must clearly demonstrate that this use has operated on this property. 3/5/13 – Ok per adequate documentation of continuous operation from April 2010 through November 2012.

2. Per the applicability section of the New Carrollton Transit District Development Plan and TDOZ Map Amendment issuance of a use and occupancy permit for a change in ownership for any property with frontage along a public street shall require restoration or installation of landscape strips, buffering, and screening in accordance with Sections 4.2 (Requirements for Landscape Strips Along Streets) and 4.4 (Screening Requirements) of the Prince George’s County Landscape Manual. 5/31/13 – Per my conversation with Debbie Gallagher I can approve the subject permit per her conversation with Fern Piret. This site will not be subject to 4.2 requirements due to the l.s. strip would be required to be located below power lines and provided parking would need to be removed therefore a new DPLS would be required.

3. Landscape plans shall be prepared and sealed by a landscape architect registered in the State of Maryland. 5/31/13 - Per my conversation with Debbie Gallagher I can approve the subject permit per her conversation with Fern Piret. This site will not be subject to 4.2 requirements due to the l.s. strip would be required to be located below power lines and provided parking would need to be removed therefore a new DPLS would be required. Landscape plans not required.

3/1/13 – I emailed Debbie Gallagher who forwarded to Teri Bond of Community Planning confirming if the requirement in the applicability section of the TDO Zone of the New Carrollton Transit District Overlay Zone (comment #1) is going to be upheld or exempt.

3/4/13 – I follow-up with another email to Teri Bond but no response as of yet.

3/19/13 – Per Bill Washburn (community Planning) a DSP would be required to change requirements for New Carrollton Transit District Development Plan and TDOZ Map Amendment. Sent email to John Bassert, Paul Woodburn and John Lawall at Ben Dyer.

3/27/13 – Per Debbie she will contact John Bassert with Ben Dyer. Since this site has parking abutting right-of-way and if a 4.2 landscape strip is planted adjacent to the right-of-way on the property it would wipe out all parking and another Departure from Parking would be required. It was decided that this site will need State Hwy approval to plan 4.2 landscape strips within the right-of-way. If State Hwy denies we will approve without meeting the 4.2 requirement in the TDO Zone of the New Carrollton SMA applicability section.
