I. Best Buy: The following provision applies to mandatory use contracts only. This contract is subject to RCW 43.19.190(2) & RCW 43.19.1905(7): which authorizes state agencies to purchase materials, supplies, services, and equipment of equal quantity and quality to those on state contract from non-contract suppliers. Provided that an agency subsequently notifies the Office of State Procurement (OSP) State Procurement Officer (SPO) that the pricing is less costly for such goods or services than the price from the state contractor.

If the non-contract supplier's pricing is less, the state contractor shall be given the opportunity by the state agency to at least meet the non-contractor's price. If the state contractor cannot meet the price, then the state agency may purchase the item(s) from the non-contract supplier, document the transactions on the appropriate form developed by OSP and forwarded to the SPO administering the state contract. If a lower price can be identified on a repeated basis, the state reserves the right to renegotiate the pricing structure of this agreement. In the event such negotiations fail, the state reserves the right to delete such item(s) from the contract.

III. Only authorized purchasers included in the State of Washington Purchasing Cooperative (WSPC) and State of Oregon Cooperative Purchasing Program (DASCPP/ORCPP) listings published and updated periodically by OSP and DAS may purchase from this contract. It is the contractor’s responsibility to verify membership of these organizations prior to processing orders received under this contract. IV. Contract Terms: This Document includes by reference all terms and conditions published in the original IFB, including Standard Terms and Conditions, and Definitions, included in the Competitive Procurement Standards published by OSP (as Amended).

Special Notes:

1. To extend contract for 12 months, effective October 31, 2010. This contract period will cover October 31, 2010 through October 30, 2011.

2. Applied Concepts is offering a $100.00 discount on the following products: DSR, DSR-I, DSR-IM, DSRM & DSRM-BMW for the 10-30-10 through 10-31-11 time period.

3. All other contract terms, conditions, specifications and pricing will remain unchanged.

Special Conditions:

This contract was not competitively bid. This contract was awarded under RCW 43.19.1906 Competitive Bids – Sealed =Bids, Exceptions, Paragraph (3) Purchases which are clearly and legitimately limited to a single source of supply and involving special facilities, services, or market conditions, in which instances the purchases be best established by direct negotiation.

SCOPE

The State of Washington, Office of State Procurement bid a convenience use contract, on a multiple award basis by manufacturers to support the current installation of Police Traffic Radar Equipment and Components that conform to the National Highway Traffic Safety Administration (NHTSA) “Model Performance Specification for Police Traffic Radar Devices.” This award was a negotiated sole source. All radar units are on the CPL (Consumer Products List), of the IACP and listed in the price sheets of this contract. Only bids meeting those specifications were considered for the award. The Office of State Procurements is working with the Washington State Patrol and the Washington State Traffic Safety Commission in awarding this contract. The Washington State Traffic Safety Commission issues grants for purchasing Police Radar Equipment to Washington State Local Police Agencies and Washington State Sheriff’s Offices. This contract is intended for the execution of additional purchases for the Washington State Patrol and additional purchases funded by the Washington State Traffic Safety Commission.

To support state and local law enforcement with Police Traffic Radar Equipment, Components, and to provide replacement equipment for the existing embedded devices, already owned and in operation by various departments located throughout the state.

SALES & SUBCONTRACTOR REPORTS

(IACP) TESTING PROGRAM

Radar/Lidar Testing Program: History

The first step on the road to establishing International Association of Chiefs of Police (IACP) testing laboratories was taken in 1976 with the passage of an IACP resolution calling for federal government concern and involvement in the development of health, safety and performance standards for speed-measuring devices, the testing of the devices and publication of the results.

In order to appreciate the significance of this resolution, one must consider the environment that existed 20 years ago. For about 35 years, radar had proven to be a beneficial tool in the enforcement of speed laws and development of evidence to support the prosecution of speeding violations. Over this span of time, technological advances led to the development of devices that were smaller, more mobile and capable of monitoring speeds in the moving mode. In addition, many units were equipped with special automated features intended to improve radar operator efficiency.

In August 1977, in response to law enforcement's needs, the National Highway Traffic Safety Administration (NHTSA) entered into an interagency agreement with the Law Enforcement Standards Laboratory (LESL) of the National Institute of Standards and Technology (NIST) — formerly the National Bureau of Standards — to perform a series of tasks relating to speed-measuring devices. Among the more important of these was the development of testing protocols and performance standards for police radar devices. In separate actions, NHTSA addressed the matters of police radar device operator training and the possible health hazards associated with radar use.

When developed, based on the recommendation of the IACP Technology Assessment Program Advisory Council (TAPAC), these specifications were adopted as IACP specifications for police radar devices.

Publication of the Model Minimum Performance Specifications prompted an IACP proposal to test police speed-measuring radar devices to determine compliance with the model specifications and to prepare a Consumer Products List (CPL), similar to those prepared for the other types of police equipment being tested by the IACP as part of the National Institute of Justice Technology Assessment Program. After review and agreement by NHTSA, the unsolicited proposal was accepted and, in October 1982, the IACP entered into a cooperative agreement with NIST/LESL to accomplish the testing of radar devices and publish the test results.

During the period following the specifications development and up to the period of radar testing, the manufacturers of radar devices made several modifications to their products directed toward achieving compliance with the model performance specifications.

All known radar manufacturers were contacted and given an opportunity to submit devices for inclusion in this test program. The testing resulted in the original CPL, which was published in April 1984. Since that time, there have been updates in the CPL, which are reflected in the new CPL. This list designates those devices that are recognized by the IACP as being in full compliance with the CPL requirements.

Approved Equipment and suppliers shall be listed on the CPL (Consumer Products List), of the IACP at:

Bidder must be regularly engaged in the supply of Police Radar Equipment, shall be products listed on the CPL (Consumer Products List), of the IACP and listed in the price sheets of this.

Bidder must be an authorized reseller (in good standing) for the products and manufacturers bid. The state reserves the right to request the apparent successful bidder(s) to provide proof of authorization. Acceptable proof of authorization may include (but is not limited to) the submission of a letter from the manufacturer indicating that the bidder is an authorized to sell the manufacturer’s wares or a recent manufacturers invoice (within 12 months of bid opening date) that supports claims that the bidder is an authorized supplier.

SERVICE EXPECTATIONS:

Upon award, the state expects to be designated as a Preferred Customer as a result of this contract and consequently the successful bidder(s) will:

• Review the impact of this award and take the necessary steps to ensure adequate coverage and contract compliance.

• Promote and market the use of this contract to all eligible contract purchasers.

• Provide electronic notification to the procurement officer of upcoming manufacturer sponsored events related to new technology, product introductions, training seminars, mobile product demonstrations etc.

• Take necessary action to ensure that authorized purchasers will automatically receive contract pricing.

• Ensure that those who endeavor to utilize this contract are authorized State Purchasing Cooperative (SPC) members.

• Provide price verification to contract users upon request.

FULFILLMENT REQUIREMENTS:

Contract purchasers may place orders against this contract either in person, electronically, fax or by phone. Once an order is issued, the following shall apply:

• All product purchased against this contract shall be FOB destination with cost of freight included in the bid price. No COD deliveries will be accepted.

• Standard products shall be delivered within ten (10) business days. Non-standard or custom product orders shall be delivered within twenty (20) business days; if delivery is not possible because of specialized materials or product specifications then Contractor shall provide a mutually acceptable firm delivery date.

• It is understood that the contractor(s) will make every effort to ensure the expeditious delivery of all contract orders. Failure to fulfill quoted delivery schedules may subject the contractor to non-delivery assessment charges as appropriate. Furthermore, a pattern of prolonged delivery delays may be cause for contract termination.

• The contractor(s) shall provide a “Customer Service Call Center” who will be responsible for resolving contract performance issues (examples might include but are not limited to order fulfillment delays, receipt of damaged goods, product returns, etc.) If the customer service center is unable to resolve the problem within two business days of the inquiry, the call center is to send an electronic notification to the procurement officer that documents the problem, and includes customer contact information as well as a plan for resolution. The call center will continue to provide on-going updates to the procurement officer until the issue(s) have been successful resolved.

• Unless special delivery requirements have been pre-arranged, deliveries will be made during the normal work hours (Monday through Friday from 8 AM to 5 PM). The contractor is responsible for coordinating with customers and carrier(s) the delivery schedule, shipping instructions and location delivery details. The state reserves the right to refuse shipment when delivered after normal working hours.

• If it is determined that order fulfillment could potentially exceed the typical order fulfillment lead time, the contractor shall advise the purchaser within 24 hours of receipt of the order. In such cases, the state reserves the right to purchase elsewhere (without being liable for cancellation/restocking fees) should the anticipated delivery lead-time adversely effect project scheduling.

• Product damaged as a result of contractor negligence will either be replaced (and expedited at contractor’s expense) or if the customer prefers, be noted on the receiving report and deducted from final payment.

• Contractor is responsible for shipping costs and arranging for pick-up of any defective returns, and arranging for a Call Tag to insure freight is charged to Contractor for defective returns, within ten (10) business days.

• Should an order include a specialty item(s), the contractor’s or manufacturer’s restocking fees concerning the specialty item(s) shall be communicated and approved by customer upon receipt of the purchase order.

• All costs for containers shall be borne by the contractor. All products shall conform to the provisions set forth in the federal, county, state and city laws for their product, handling, processing and labeling. Packages shall be so constructed to ensure safe transportation to point of delivery.

• The Contractor is responsible to verify delivery conditions/requirements prior to the delivery.
