Non-Exempt Timekeeping Policy

A. Introduction

Non-exempt employees are paid at an hourly rate for all authorized work time, including time and a half of their base rate for all hours worked in excess of forty hours in a workweek.

B. Time Keeping Procedures

ABC currently utilizes two methods of time recording for its non-exempt employees – Kronos (time clock) and manual time records. The method used is determined by location and/or position.

1. Kronos

a. Clock-In Procedures: To accommodate the number of individuals on each shift, non-exempt employees who maintain time records by an automated time clock may ‘clock-in’ up to 3 minutes prior to their scheduled shift or start time. The automated clock will record the employees’ start time as the pre-established schedule for that employee. Employees may not engage in any work activities prior to the start of their shift and should simply proceed to their work station or start-up meeting location and wait for instruction. Non-exempt employees may not clock in more than 3 minutes before their scheduled start time without express permission from their supervisor. If you perform any work activities prior to clocking in and/or prior to the start time of your shift please notify your supervisor immediately. These policies apply whether you are clocking in at the beginning of your scheduled shift or in connection with an unpaid meal period.

b. Clock-Out Procedures: Non-exempt employees who record their time using Kronos will be paid for all recorded time until they ‘clock-out’. Once an employee clocks out they may not perform any work activities. If you perform any work activities once you clock-out please notify your supervisor immediately. These policies apply whether you are clocking out after the end of your scheduled shift or in connection with an unpaid meal period.

2. Manual Time Card Records

Non-exempt employees who maintain time records by hand-written time cards or electronic time cards will be paid for all recorded time. It is the responsibility of the non-exempt employee to accurately record all time worked by logging the actual time they begin performing work activities and stop performing work activities, either at the beginning or end of their work day or in connection with an unpaid meal break. Actual time work is performed should be reflected on the time records as opposed to simply recording your scheduled shift. Employees should not perform work activities outside of normal work hours without the permission of their supervisor.

C. Work Performed Away from the Facility and/or Outside Normal Work Hours

No non-exempt employee should perform work outside of their normal schedule and/or while away from the facility without permission from their supervisor. In the event an employee does perform any work while away from the facility or outside normal business hours they must record this work time on their timesheet or, for employees who utilize the Kronos system, inform their manager immediately. Work covered by this provision could include business-related phone calls and emails.

D. Breaks

Non-exempt (hourly) employees are eligible to receive the following breaks and meal periods:

• 10-minute paid break after 2 hours of work (paid, do not clock-out)

• 30-minute unpaid meal break after 4 hours of work (unpaid, clock-out)

• 10-minute paid break after 6 hours of work (paid, do not clock-out)

During breaks or meal periods, employees should leave their workstation and not engage in any work activities. If a non-exempt employee performs work during their unpaid lunch break they must notify their supervisor immediately and (if applicable) reflect the work time on their time card.

E. Summary of Employee Obligations and Consequences

Non-exempt employees are responsible for proper timekeeping practices which include:

• Have knowledge of the location and content of this policy

• Clock in/clock out or record your work hours accurately

• Take all breaks and meal periods, holidays and vacations as scheduled

• Avoid unauthorized overtime and ‘off-the-clock’ work for yourself or coworkers

• Review and certify your time records on a regular basis and pursuant to ABC policies

• Report inaccuracies immediately

• Do not perform any principal work outside of your regularly scheduled hours of work unless authorized in advance by your supervisor or manager.

• Do not perform any overtime without the express, advance permission of your supervisor

An employee who violates this Policy is subject to discipline, up to and including, termination.

F. Mandatory Reporting Procedures:

In the event an employee believes they have not been paid for all hours worked, including at least time and a half for all hours worked over 40 in a work week, and the employee has been unable to resolve the dispute with their supervisor, the employee must report this issue using one of the following methods:

1. Contact the Human Resources Representative at your facility; or

2. File a complaint using [enter 1-800 number].

An employee should also utilize this reporting procedure in the event they believe any inappropriate deductions have been made to their pay.

G. Employee Acknowledgement:

I agree that I have read and understand the Policy. I agree to adhere to the provisions outlined in this Policy. I acknowledge that nothing in this Policy creates or shall be construed to create a contract for employment, either express or implied. I also acknowledge that should I violate this Policy, I can be disciplined, up to including termination of my employment.
