Rest and Meal Period Chart

Employers are subject to huge penalties for failing to provide employees with rest periods or meal periods required by law. Accordingly, it is essential that supervisors know the required number of rest and meal periods to provide employees.

To aid FELS subscribers in this endeavor, here is a chart stating the required number of rest and meal periods for a given number of hours worked in a workday.

Footnotes: 1 Net hours worked excluding unpaid periods such as meal periods.

2 Meal period may be waived by mutual consent of employer and employee if a work period of not more than six hours will complete the day's work. A meal period must be provided for each work period of not more than five hours. The five-hour period starts when the employee begins the work or when workday resumes following an unpaid meal period.
