This investigator is responsible for gathering information and documenting evidence collected in response to a violation of the mandated selection and employment standards and forwarding the information via the chain of command to the Executive Director and Commission for final action. These investigations could result in an applicant’s permanent denial into the licensing process, or the imposition of license sanctions by the Commission up to and including permanent license revocation. These investigations may also be the basis for referral for criminal charges if violations of the law are found. Other statutory responsibilities include investigation of violations of the funding and reporting requirements established by Public Act 302 of 1982, reviewing and determining the eligibility for licensing of applicants for a Private Security Police Agency license per Public Act 330 of 1968, and investigating violations of the mandates of other statutes and administrative laws falling under the Commission’s purview. Duty 2General Summary of Duty 2: 10 % of TimeServes as the claims investigator for the Public Safety Officer Benefits (PSOB) program conducting detailed investigations to determine an applicant’s eligibility for an award. These groups are subject to the standards and reporting requirements mandated by numerous statutes including Public Act 203 of 1965, and the administrative rules promulgated by the Commission.All law enforcement agencies as well as state and local human resource departments are impacted during: the hiring process, the mandated annual reporting process, mandated inspections and the separation of officers or the revocation of officer licensure.Affected populations include:Applicants for enrollment into basic training and the Recognition of Prior Basic Training and Experience program,Candidates for law enforcement licensing, and Law enforcement agencies in the process of hiring and licensing candidates.This investigator is the recognized resource in Michigan performing these tasks and the Commission has sole responsibility for these mandates.17.Describe the types of decisions that require your supervisor’s review.Supervisory review includes any issue of a sensitive nature relating to pending or current litigation or where the issue is the subject of Commission initiated review for possible legislative or policy change. Cases are reviewed by the executive leadership when completed. The final revocation/denial decisions are governed by the statute and administrative rules with Executive and Commission oversight.18.What kind of physical effort do you use in your position? What environmental conditions are you physically exposed to in your position? Indicate the amount of time and intensity of each activity and condition. Refer to instructions on page 2.Most of the time (approx. 90-95%) the effort necessary involves review and research of databases, public records, Internet and media resources, and law enforcement agency investigative records, document preparation and production, and the creation of official reports.Other efforts in support of the position include state-wide travel (5-10%) to interview witnesses and law enforcement officials, and to gather court records. The comprehensive and complex investigations conducted by this investigator are the basis for these decisions and they provide the evidentiary support for the final decisions issued by the Executive Director and Commission. 23.What are the essential duties of this position?This position is responsible for the investigation and enforcement of legislatively mandated selection, employment, training, licensing, and license revocation standards for all licensed law enforcement officers per Public Act 203 of 1965, as amended. This investigator has the responsibility of investigating standards violations for review by the Executive Director and Commission.This position is also responsible for conducting in-depth investigations of law enforcement agencies for violations of the funding and annual registration reporting requirements established by Public Act 203 of 1965, and Public Act 302 of 1982, as well as investigating violations of the mandates of all other statutes and administrative law falling into the purview of the Commission.24.Indicate specifically how the position’s duties and responsibilities have changed since the position was last reviewed.In 2016 Public Act 203 of 1965 was amended adding additional revocation requirements to the Commission’s existing revocation authority. The Commission now has the authority to revoke a license and deny access to the licensing process for selected misdemeanor crimes. This has increased the volume and complexity of investigations. At the same time the enactment of Public Act 128 of 2017 also added the responsibility for the review of an officer’s separation from a previous law enforcement employer in certain circumstances prior to licensing or admission to training.There were also changes in requirements made by the US Department of Justice which required the Commission to switch to the use of the Michigan Criminal History Records Internet Subscription Service (CHRISS) for the purposes of obtaining statutorily mandated fingerprint information. This system has a complicated access and dissemination process and requires an internal administrator. This position is the assigned administrator for both the law enforcement training and private security police functions.Finally, Executive Directive 2019-11 requires additional scrutiny to ensure the proper processing of documents for the purposes of transparency. This new responsibility also falls to this position.25.What is the function of the work area and how does this position fit into that function?The function of the Standards Compliance Section is to ensure that candidates for law enforcement licensing comply with all the statutorily mandated selection, training employment, licensing and license maintenance requirements. The section works with all components of the criminal justice system to ensure compliance with mandated standards.The function of the investigator is to investigate all allegations of failure to comply with the licensing mandates and standards, any case where there is a suspicion of fraud or failure to disclose information in obtaining licensure, and issues related to proper fiscal reporting of state restricted training funds. This position conducts the investigations necessary to gather evidence to support the decisions that need to be made by the Executive Director and Commission relative to statutes and administrative rules26.In your opinion, what are the minimum education and experience qualifications needed to perform the essential functions of this position?EDUCATION:Possession of a bachelor’s degree in business administration, criminal justice, criminology, law enforcement, police administration, security and loss prevention or a related field.Special investigative training (background investigator coursework) is desired.EXPERIENCE:Three years of professional experience, providing regulation and investigative services equivalent to a Regulation Agent, including one year equivalent to a Regulation Agent P11.A minimum of 5 years of experience as a sworn detective at a law enforcement agency may be substituted for the education and experience requirements.KNOWLEDGE, SKILLS, AND ABILITIES:Knowledge of various statutory mandates, administrative rules and policies; knowledge of the Administrative Procedures Act; knowledge of law enforcement agency administrative operations, including Human Resources; and a detailed knowledge of the Freedom of Information Act, the Public Safety Officers Benefit Act, and the Police and Firefighter Survivor Tuition Act. Excellent writing and verbal communication skills are critical. Knowledge and skill in the use of investigative resources and techniques and the ability to conduct comprehensive, complex and detailed administrative investigations is also essential.
