FOREWORD

1. “Navy for Life and Beyond” was first published in 1989 and this is the fourth edition. It contains all the relevant information regarding pension, gratuity, DSOP fund, Encashment of annual leave, ECHS facilities and all allied issues that come up at the time of retirement. Important guidelines and application forms have been included for quick reference.

2. This would be a useful ready reckoner for retiring officers and their next of kin. The present edition takes into account all changes that have taken place since the last edition of 2000. While the information contained in the booklet is authentic;being a guideline document, it cannot be quoted as an authority on financial claims.

C H A P T E R – I

INTRODUCTION

0101. This publication is intended to be used as a rough guide to retired/retiring officers of the Indian Navy and their Next of Kin. The inputs for this publication has been provided by various agencies, directorates at Integrated Headquarters, Ministry of Defence (Navy).

0102. The book is divided into two parts. Part I contains important information for retired/retiring officers, whereas Part-II contains valuable information for the next of Kin.

0103. While all care has been taken to include up-to-date information, various policies are being changed continuously for the improvement and betterment of the service. The users are advised to refer the latest policy letters regarding these information.

0104. Useful information regarding pension, resettlement in civil life and benefits/concessions provided by the state/central Government etc. are also available at the following web-site:-

0105. Important documents. The following documents are required for availing any help from Kendriya Sainik Board/Rajya sainik Board and Zila Sainik Welfare Offices.

a) Record of service/service particulars, (release certificate in case of Short Service Officers which clearly indicates the date of Commission, date of release and reasons for release)used by IHQ MOD (Navy).

b) Pension Payment Order (PPO) and proof of release of gratuity in the case of Short Service Commissioned Officers.

c) Abstract of Gazette of India notification regarding grant of commission.

d) Proof of disability in case of disabled.

e) Abstract of Gazette of India Notification, award certificate and copy to citation in case of gallantry award winners. Gallantry Award Identity Card issued by Directorate of Personnel section, IHQ MOD (Navy)

f) Experience certificate issued by Officer Commanding of the last unit/competent authority as per rule.

g) Group Insurance documents.

h) Proof of transfer during last six years of service in case children of the officers who seeks admission in Kendriya Vidyalaya on priority.

i) Retired Officers Identity Card.

j) Ex-Servicemen Identity Card.

PRE-RETIREMENT FORMALITIES

0201. This chapter discusses the details of various pre-retirement formalities as listed in the check-off list given below in Para 0217. The timely completion of the formalities would help in expeditious settlement of post retirement dues.

0202. The details of the outstanding motor car/scooter/Govt. house building advance /NGIF housing loan and any other public and non-public dues are to be furnished to Commanding Officer eight months prior to the date of retirement for onward transmission to Naval Pay Office, Mumbai as per format given at Appendix ‘A’.

0203. All outstanding advances in respect of motor/car/scooter/Govt. house building advance/NGIF housing loan and pay etc., are required to be cleared prior to the actual date of retirement. In so far as Govt. loan/dues are concerned, repayment is to be made on Military Receivable Order (MRO) and the amount deposited in the Reserve Bank of India/Govt Treasury. Alternatively, a cross demand draft may be drawn for the entire balance including the interest due thereon in favour of the CDA(N) Mumbai and forwarded to him under intimation to Naval Pay Office, Mumbai. As regards, the NGIF housing loan, the amount is to be paid by a demand draft in favour of ‘The Secretary, Naval Group Insurance Fund’ payable at New Delhi.

0204. However, option for making adjustment of 90% of retirement gratuity due is also available but towards repayment of Govt. house building advance and NGIF housing loan only.

0205. Outstanding Claim for TA/DA/LTC. It is advisable that claims for the outstanding TA/DA and LTC advances are forwarded well in time so that these are satisfactorily settled to avoid correspondence after retirement and to ensure prompt issue of NDC by CDA(N).

0206. Return of Armed Forces Identity Card/Vigilance Clearance. The permanent Armed Forces Identity Card held must be returned to the Commanding Officer INS Kunjali through the Commanding Officer at least five months prior to the date of retirement. Late return of Identity Card will delay issue of vigilance clearance which is essential for sanction of pensionary benefits.

0207. Release Medical Board. To ensure prompt sanction for pensionary dues the following guidelines may be followed :-

(a) In case of low medical category, the Release Medical Board must be completed not earlier than 90 days prior to the date of retirement/release. The longevity certificate for pension must also be completed at the time of Release Medical Board.

(b) If in medical category S1A1, the pre-release medical examination may be completed within six months prior to the date of release/retirement.

(c) If it is planned to proceed on annual leave followed by retirement, the Release Medical Examination/Board should be completed one month prior to the date of proceeding on such leave.

(d) If there is a change in medical category consequent to RELEASE MEDICAL EXAMINATION/RELEASE MEDICAL BOARD, it may be worth confirming from ship/establishment that the change has been intimated to Administrative Authority, Integrated Headquarters, Ministry of Defence(Navy) , and Controller of Defence Accounts(Navy), Pension Cell, Mumbai.

0208. Anticipatory Pension and Retirement Gratuity. An application is required to be directly forwarded as per Appendix ‘B’ to Principal Controller of Defence Accounts (Navy), Pension Cell, Mumbai – 400 039 in duplicate endorsing a copy to Principal Director Pay & Allowances, Integrated Headquarters – Ministry of Defence (Navy), New Delhi – 110 011. The following documents are to accompany the application :-

(a) Declaration for grant of anticipatory/provisional pension (amount payable to be left blank).

(b) Passport size joint photograph with wife in duplicate (in civil clothes) duly attested on the reverse by a serving commissioned officer other than yourself endorsing attested photograph of rank, name and personnel number and his wife Smt. ……………

(c) Nomination Form ‘A’ as per Appendix ‘B1’ be forwarded to Principal Director Pay & Allowances, Integrated Headquarters – Ministry of Defence (Navy), New Delhi – 110 011 in triplicate. On receipt of a copy of service as well as family details of the retiring officer from the IHQ – MOD (N)/DOP, the same will countersigned by the concerned authority at IHQ – MOD (N)/DPA for onward transmission to PCDA (N), Pension Cell, Mumbai with a copy to the concerned retiring officer for his information.

0209. Commutation of pension. For commutation of pension, an application as per Appendix ‘C’ has to be forwarded directly to Principal Controller of Defence Accounts (Navy), Pension Cell, Mumbai – 400 039 in duplicate endorsing a copy to Principal Director Pay & Allowances, Integrated Headquarters – Ministry of Defence (Navy), New Delhi – 110 011. The application must have Release Medical Examination Report –AFMSF-18 containing the Longevity Certificate attached. In case of low medical category, the Release Medical Proceedings AFMSF- 16 will be forwarded to Principal Controller of Defence Accounts (Navy), Pension Cell, Mumbai – 400 039 by OC Hospital/Ship/Establishment through IHQ – MOD (N)/DGMS (N), New Delhi. If residing abroad, the Commutation Medical Board will be arranged by Indian Embassy/High Commission.

0210. DSOP Fund Account. A format of application for closing of DSOP Fund account and payment of balance is at Appendix ‘D’. It is required to be completed and forwarded in triplicate to Naval Pay Office, Mumbai for finalisation of DSOP fund account. The DSOP fund account will be closed three months before retirement. The amount due will be calculated by Naval Pay Office and the claim forwarded to CDA(Navy) for pre-audit. On receipt of the audited claim, the Naval Pay Office will effect the payment directly to officers’ bankers.

0211. Income Tax Clearance. The officers must ensure that any income tax demand pending with the Income Tax Officer is cleared to facilitate the closing of pay accounts, as refunds/demands upto the date of retirement can be adjusted through pay accounts by Naval Pay Office.

0212. Insurance Cover – Naval Group Insurance Fund. The survival benefits under this scheme including those of Additional Scheme would be paid by the Secretary NGIF. The officers are to submit the pre-receipt as per Appendix E-I with full particulars and signatures except the amount part to the Secretary Naval Group Insurance Fund, IHQ MOD(Navy), New Delhi at least one month prior to retirement. NGIF would then remit the survival benefits payable to the officer though the officer’s Bankers as mentioned in the pre-receipt.

0213. Post Retirement Death Insurance Extension Scheme (PRDIES). Officers retiring with pensionable service (20 yrs) are to compulsorily subscribe for this scheme by submitting the application as per Appendix E-II, to the Secretary, Naval Group Insurance Fund, IHQ MOD(Navy), New Delhi.

This is a term insurance and a single non refundable premium would be deducted from the officer’s survival benefit. There is no saving element applicable under the scheme for those who exit the scheme through survival. Presently the premium is Rs.19,650/- with a sum Assured of Rs.3.6 lakh and the coverage period is of 25 yrs after retirement or 72 yrs of age which ever is later.

At the time of retirement the officers would be mailed an Insurance Certificate along with the samples of covering letter and other documents at the address given in application and are necessary for claiming insurance if the requirement comes up on death of the member. On death of the member, the nominee is to submit the application on the format given at Appendix ‘F’ duly enclosing the documents indicated thereon. On receipt of this application, a pre-receipt will be sent to the nominee. The amount of Insurance will be remitted to the nominee’s banker after the pre-receipt has been received by NGIF duly receipted.

0214. Encashment of Accumulated Annual Leave. The format of application for encashment of annual leave is as per Appendix ‘G’. Encashment of annual leave will be equal to the normal leave salary as admissible to the officer including dearness allowance. No compensatory allowance is admissible for the period of leave encashed.

0215. No Demand Certificate from Commanding Officer. The officer will be required to obtain a ‘No Demand Certificate’ from the Commanding Officer of ship/establishment where he was borne at the time of retirement and forward to Naval Pay Office, Mumbai.

0216. No Demand Certificate from MES. The officer will be required to obtain a ‘No Demand Certificate’ from the MES authorities as soon as he vacates married accommodation/settles all outstanding dues on account of Rent Bills and allied charges and forward it to Naval Pay Office, Mumbai.

0217. CHECK-OFF LIST The timely completion of the following activities is important in respect of officers retiring on superannuation. For Officers proceeding on premature retirement, these actions has to be completed between date of issue of orders and date of retirement.:-

(a) Clearance of all Outstanding Advances/Loans D-8 months

(b) Forwarding all Outstanding Claims for TA/DA/LTC D-6 months

(c) Return of Armed Forces Identity Card and applying for

Retired Officers Identity Cards. D-5 months

(d) Obtaining Vigilance Clearance from NHQ(DPS) D-5 months

(e) Application for ECHS Smart Card D-5 months

(f) Release Medical Exam (if Cat SIAI)

OR

Release Medical Board (if Low Medical Cat) D-3 months

(g) Application for Anticipatory Pension, Commutation D-4 months Of Pension and Retirement Gratuity

(h) Application for Closing DSOP Fund Account D-4 months

(j) Income Tax Clearance upto the Previous D-2 months

Assessment Year.

(k) Application for NGIF for Post-Retirement D-2 months

Insurance Cover.

(l) Application for Encashment of Accumulated Leave D-1 month

C H A P T E R – III

PENSIONARY BENEFITS

0301. Introduction. Based on the recommendations of the Vth Pay Commission, the Government has abolished the standard pension of the rank. The normal retiring pension is purely based on two factors i.e. ‘Qualifying Service’ and ‘Average Monthly Emoluments’.

0302. Type of Benefits. If the minimum qualifying service required has been completed officers are eligible for:-

(a) Retiring Pension

(b) Retirement Gratuity

0303. In case officers have not rendered the minimum qualifying service for pension, then they are entitled to:-

(a) Retiring Gratuity

(b) Retirement Gratuity

0304. Qualifying Service. It shall mean the actual qualifying service rendered plus a ‘weightage’ (in years) appropriate to the last rank held (as given subsequently below). The minimum qualifying service (without ‘weightage’) to be eligible for retiring pension is 20 years (15 years in case of a late entrant). The maximum qualifying service including ‘weightage’ reckonable for pensionary benefits is 33 years.

0305. Counting of Other Service. Full pre-commissioned service rendered under the Central Government whether in a Civil Department or in the Armed Forces shall be taken in account while working out the Qualifying service for pensionary benefits and determining the minimum Qualifying service for retiring pension.

0306. Calculation of Fraction of Year for Qualifying Service. To calculate the length of the Qualifying service, fraction of a year equal to 3 months and above but less than 6 months shall be treated as a completed one half year and reckoned as Qualifying service.

0307. Weightage. The object of the ‘weightage’ for calculating the Retiring Pension is to give the benefit of entitlement to Retiring pension as close as possible to 50% of reckonable emoluments which is the maximum admissible after 33 years of service. The weightage allowed is as follows :-

0308. Reckonable Emoluments. For the purpose of working out the Retiring Pension the term “Reckonable Emoluments” means the average of the Pay. Non-practising Allowance and the Rank pay and Stagnation Pay, if any, drawn during the 10 months immediately preceding the date of retirement.

0309. Quantum of Retiring Pension.

(a) The retiring pension is calculated at 50% of average emoluments. The amount so determined is the retiring pension for 33 years of reckonable qualifying service. For lesser period of reckonable qualifying service, this amount is proportionately reduced. The minimum pension shall not be less than Rs. 1,275/- per month wef 01 Jan 1996.

(b) Further with effect from 01 Apr 2004, since 50% of Dearness Allowance converted into Dearness Pay is counted for retirement benefits, pension/family pension shall be calculated at 50% and 30% respectively of the pay plus Dearness Pay subject to minimum of Rs. 1,913/- and maximum of 50% and 30% respectively of the highest pay plus Dearness Pay in the Government. The highest pay in the Govt wef 01 Jan 96 is Rs. 30,000/-. The highest pension, as of now, comes to Rs. 22,500/- (i.e. basic pension Rs. 15,000/- + dearness pay Rs. 7,500/- = total pension Rs. 22,500/-).

0310. Protection of Retiring Pension. Retiring Pension in the rank of Cdr (TS), Commodore (Captain with 3 years and 10 months , or more service) and Rear Admiral shall in NO CASE be less than the pension admissible to the officer as a Lt Cdr, Captain (with less than 3 years and 10 months service) or as a Commodore, as the case may be, had the officer not been promoted to the higher rank.

0311. Retirement/Retiring Gratuity. Please see the details in Chapter IV on Gratuity.

0312. Pension Disbursing Authorites. The officers may claim the pension through Govt. Treasury/Pension Payment Masters/ Defence Pension Disbursing Officers. They may also draw the pension through Public Sector Banks, if they so desire.

0313. ILLUSTRATION. An illustration showing the procedure for calculation of Retiring Pension is given at Appendix ‘H’. For a near exact amount of pension and gratuity, officers are advised to browse the NPO website navpay.mil.in.

C H A P T E R – IV

GRATUITY

0401. In pursuance of the Government decisions on the recommendations of vth Pay Commission, the Death-cum-Retirement Gratuity has been re-defined as “Retirement Gratuity/Death Gratuity”.

0402. Retirement Gratuity. An individual , who has completed 5 years qualifying service and is eligible for retiring pension/ gratuity /invalid pension/gratuity, shall be granted retirement gratuity equal to one fourth of reckonable emoluments for each completed six monthly period of qualifying service, as defined below, subject to a maxim um of 16 ½ times the reckonable emoluments. However, in no case the amount of gratuity payable shall exceed Rs 3.5 lakhs.

0403. Reckonable Emoluments. These will comprise of pay plus Non- Practising Allowance, Rank Pay and Stagnation Pay, if any, last drawn by the officer.

0404. Qualifying Service. For the purpose of Retirement Gratuity the term ‘Qualifying Service’ means actual qualifying service plus a weightage of 5 years subject to the total qualifying service including weightage not exceeding 33 years.

0405. Death Gratuity. Please see Chapter XVII dealing with benefits to Next of Kin.

0406. Procedure for Payment of Retirement Gratuity. Those who are released/retired with Retiring Pension or Retiring Gratuity/Invalid Pension or Invalid Gratuity: The payment of retirement gratuity will be arranged by the Controller of Defence Accounts (Navy) Pension Cell, Mumbai along with retiring pension/gratuity or invalid pension/gratuity, as the case may be, through the authority from which the payment of pension or gratuity is desired by the officer.

0407. Nominations. If not already done, officers are advised to make nomination as given in Annexure I to NI 2/S/70, conferring on one or more persons the right to receive the Death Gratuity. One copy of the nomination is to be handed over to the nominee for safe custody.

0408. Recovery of Claim from Retirement Gratuity.

Any outstanding public or non public claim is recoverable from Retirement/Death Gratuity payable to the officer or his family.

0409. Retiring Gratuity (Non-Pensioners). The minimum period of qualifying service shall continue to be 10 years for earning Retiring Gratuity. It is worked on actual Qualifying Service rendered. No weightage is allowed.

0410. Qualifying Service. Actual qualifying service rendered, as per definition in Article 0304 and 0305 of Chapter III will count for working out Retiring Gratuity.

0411. Reckonable Emoluments. Pay plus Non-Practising Allowance Rank Pay and Stagnation Pay, if any, last drawn by the officer.

0412. Amount of Retiring Gratuity. The retiring gratuity shall be admissible at a uniform rate of half a month’s emoluments as given in para 0411 above, for each completed six monthly period of qualifying service. There shall be no deduction in the quantum of Retiring Gratuity so arrived at in respect of those who are permitted to retire or are discharged prematurely on Compassionate grounds/personal reasons.

0413. Life Time Arrears. These are such arrears which were due to the officer but could not be drawn by him prior to his death. NOKs are entitled for the same. The officers must nominate NOK at the earliest.

C H A P T E R – V

DISABILITY PENSION

0501 PENSIONARY BENEFITS ON DEATH/DISABILITY IN ATTRIBUTABLE/AGGRAVATED CASES. For determining the pensionary benefits for death or disability under different circumstances due to attributable/aggravated causes, the cases will be broadly categorized in terms of Min of Def letter No. 1(2)/97/D(Pen-C) dated 31 Jan 2001 :-

Category ‘A’

Death or disability due to natural causes neither attributable to nor aggravated by military service as determined by the competent medical authorities. Examples would be ailments of nature of constitutional disease as assessed by medical authorities, chronic ailments like heart and renal diseases, prolonged illness, accidents while not on duty.

Category ‘B’

Death or disability due to causes which are accepted as attributable to or aggravated by military service as determined by the competent medical authorities. Disease contracted because of continued exposure to a hostile work environment, subject to extreme weather conditions or occupational hazards resulting in death or disability would be examples.

Category ‘C’

Death or disability due to accidents in the performance of duties such as :-

(i) Accidents while traveling on duty in Govt vehicles or public/private transport.

(ii) Accidents during air journeys.

(iii) Mishaps at sea while on duty.

(iv) Electrocution while on duty, etc.

(v) Accidents during participation in organized sports events/adventure activities/expeditions/training.

Category ‘D’

Death or disability due to acts of violence/attack by terrorists, anti-social elements, etc whether on duty other than operational duty or even when not on duty. Bomb blasts in public places or transport, indiscriminate shooting incidents in public, etc would be covered under this category besides death/disability occurring while employed in the aid of civil power in dealing with natural calamities.

Category ‘E’

Death or disability arising as a result of :-

(i) Enemy action in international war.

(ii) Action during deployment with a peace keeping mission abroad.

(iii) Border skirmishes.

(iv) During laying or clearance of mines including enemy mines as also minesweeping operations.

(v) On account of accidental explosions of mines while laying operationally oriented mine-filed or lifting or negotiating mine-field laid by the enemy or own forces in operational areas near international borders or the line of control.

(vi) War like situations, including cases which are attributable to/aggravated by :-

(a) Extremists acts, exploring mines etc while on way to an operational area.

(b) Battle inoculation training exercises or demonstration with live ammunition.

(c) Kidnapping by extremists while on operational duty.

(vii) An act of violence/attack by extremists, anti-social elements etc while on operational duty.

(viii) Action against extremists, anti-social elements, etc death/disability while employed in the aid of civil power in quelling agitation, riots or revolt by demonstrators will be covered under this category.

(ix) Operations specially notified by the Govt from time to time.

0502. Admissibility of Disability Pension on invalidment. Where an Officer is invalided out of service under the circumstances mentioned in Category ‘B’ and ‘C’ of Para 0501 which is accepted as attributable to or aggravated by military service, he/she shall be entitled to disability pension consisting of service element and disability element. The disability pension consists of the following two elements :-

(a) Service Element. The amount of Service Element shall be equal to the Retiring Pension. For this purpose the Reckonable Qualifying Service shall mean the actual service rendered plus the ‘weightage’ appropriate to the rank held at the time of invalidaton. In this case the requirement of minimum Qualifying Service for Retiring Pension has been waived off.

(b) Disability Element. The disability element for 100% disability for Commissioned Officers and Honorary commissioned Officers is Rs. 2600/- per month. Disability lower than 100% shall be reduced. Provided that where permanent disability is not less than 60% the disability pension (i.e. total service element plus disability element) shall not be less than 60% of the reckonable emoluments, last drawn. Where an Officer is invalided out under circumstances mentioned in Para 0501 above, the extent of disability or functional incapacity shall be determined in the following manner for the purpose of computing the disability element.

c) The extent of disability or functional incapacity is determined as under for the purpose of computing the disability element :-

For disabilities less than 100% but not less than 20% the rate of disability element shall be proportionately reduced. No disability element shall be payable for disabilities less than 20%.

0503. Admissibility of Disability Pension. The Disability Pension will be sanctioned only if the injury sustained or the disease on account of which the officer is being invalidated out or found to be suffering from at the time of his release/retirement; is attributable to or aggravated by Naval Service and the degree of disability is assessed at 20% or above. The disability pension consists of the following two elements:-

(a) Service Element. The amount of Service Element shall be equal to the Retiring Pension. For this purpose the Reckonable Qualifying Service shall mean the actual service rendered plus the ‘weightage’ appropriate to the rank held at the time of invalidaton. In this case the requirement of minimum Qualifying Service for Retiring Pension has been waived off.

(b) Disability Element. The disability element for 100% disability for Commissioned Officers and Honorary commissioned Officers is Rs. 2600/- per month. Disability lower than 100% shall be reduced. Provided that where permanent disability is not less than 60% the disability pension (i.e. total service element plus disability element) shall not be less than 60% of the reckonable emoluments, last drawn. Where an Officer is invalided out under circumstances mentioned in Para 0501 above, the extent of disability or functional incapacity shall be determined in the following manner for the purpose of computing the disability element.

(c) The extent of disability or functional incapacity is determined as under for the purpose of computing the disability element :-

For disabilities less than 100% but not less than 20% the rate of disability element shall be proportionately reduced. No disability element shall be payable for disabilities less than 20%.

0504. Date of Commencement of Pension. The Disability Pension is payable from the date following that of invalidation out of or retirement/release from service.

0505. Officers Retiring Voluntarily/Resigning Commission. In the event of voluntary retirement or resigning commission all claims to Disability Pension will be FORFEITED.

0506. Reduction in Disability /Pension. If the disability is wholly or partly due to serious negligence or misconduct on officer’s part, the amount of pension or gratuity otherwise admissible may be reduced at the discretion of the Government.

0507. Unreasonable Refusal to Undergo Medical Treatment. If , suffering from a disability, accepted as attributable to or aggravated by Naval Service, unreasonable refusal to undergo an operation or other medical treatment which, in the opinion of the Service medical authority, would cure or reduce the degree of disablement, the Disability Element of pension otherwise admissible (but not the Service Element) may be withheld or granted at a reduced rate at the discretion of the Government. The refusal is not regarded as unreasonable when in the opinion of the Service medical authority the treatment or operation is severe and dangerous to life.

0508. Manifestation of Disability after Retirement. If within a period of ten years from the date of retirement , the officer is found to be suffering from a disease which is accepted as attributable to the Service, he may be granted in addition to his Retiring Pension/Retiring Gratuity, a Disability Element of Pension at the appropriate rate.

0509. When Invalidation Disability is Less than 20% but Worsens Later. If disability at the time of invalidation is less than 20% but worsens later, the officer may claim to be brought before a Medical Board within a period of ten years from the date of his discharge. However the appearance before the Medical Board will be at his own expense.

0510. Period of Grant of Disability Pension. In case where the disability is loss of limb(s), sight, etc. and where the question of improvement/worsening of its physical condition does not arise, the awards may be sanctioned for life in the first instance itself.

0511. If the attributable disability is accepted as incapable of improvement. Disability Pension is granted for a period of ten years. During this period the reassessment can be claimed and if the pension is modified as a result of re-assessment, only once, it is again sanctioned for a period of ten years.

0512. When the percentage of disablement has remained unchanged for a period of ten years. officer will be brought before a Re-survey Medical Board and in the event of the disability still being accepted as incapable of improvement the award will be sanctioned for life. In this case travel is admissible at Government expense.

0513. Continuance of Service Element. Where an Officer is retained in service despite disability arising/sustained under the circumstances mentioned in Category ‘B’ and ‘C’ 0502 above and is subsequently retired/discharged on attaining the age of retirement or on completion of tenure, he/she shall be entitled to disability element for 100% disablement.

0514. Constant Attendant Allowance shall continue to be admissible under the conditions as hithertofore. However, it shall be admissible at a uniform rate of Rs. 600/- per month irrespective of the rank.

Re-survey Medical Board for Re-assessment of Disability.

0515. Re-assessment of Disability. There will be no periodical reviews by the Re-survey Medical Board for re-assessment of disabilities. In cases of disabilities adjudicated as being of a permanent nature, the decision once arrived at will be final and for life unless the individual himself requests for a review. In cases of disabilities which are not of a permanent nature, there will be only one review of the percentage by a Re-assessment Medical Board, to be carried out later, within a specified time frame. The percentage of disability assessed/recommended by the Re-assessment Medical Board will be final and for life unless the individual himself asks for a review. The review will be carried out by Review Medical Board constituted by DGAFMS. The percentage of disability assessed by the Review Medical Board will be final.

Travel Entitlement for Treatment of Disability and RSMB.

0516. Treatment of Disability Attributable /Aggravated by Service. In such a case officers are entitled free conveyance at temporary duty scale if required to proceed to an outstation Armed Forces Hospital for medical attendance/treatment.

0517. RSMB at Outstation Hospital. Officers are entitled for free conveyance to and from the outstation where RSMB is being held. If a specialist examination is considered essential by the RSMB, officers are also authorised free conveyance to the specialist’s station or back to their home station from there. These travel entitlements will be at temporary duty scale. However, no DA will be admissible for stay at station where RSMB is conducted.

0518. Authorisation of Escort. In case officers are too ill to travel and require an attendant to accompany, they are authorised reimbursement of actual to & fro fare for the attendant subject to maximum of their own entitlement, provided the RSMB certifies the necessity of the escort.

0519. Compensation in lieu of Disability Element. In case a person belonging to the Armed Forces is found to have a disability which is sustained under the circumstances mentioned in Category ‘B’ and ‘C’ at Para 0501 above which is assessed at 20% or more for life but the individual is retained in service despite such disability, he/she shall be paid a compensation in lump sum (in lieu of disability element) equal to the capitalized value of disability element on the basis of disability actually assessed. The rates of disability element shall be proportionately reduced for lesser percentage of disability. The age next birthday will be reckoned with reference to the date of onset of disability with loading of age, if any, recommended by the Disability Compensation Medical Board. Once a compensation has been paid in lieu of disability element there shall be no further entitlement to the disability element for the same disability. Such disability shall also not qualify for the grant of any pensionary benefits or relief subsequently.

0520. War Injury Pension. Where an Armed Forces personnel is invalided out of service on account of disabilities sustained under the circumstances mentioned in Category ‘E’ at Para 0501 above, he/she shall be entitled to War Injury Pension consisting of Service Element and War Injury Element as follows :-

(a) Service Element. Equal to retiring/service pension to which he/she would have been entitled on the basis of his/her pay on the date of invalidment but counting service upto the date on which he/she would have retired in that rank in normal course including weightage as admissible. There shall be no condition of minimum qualifying service for earning this element.

(b) War Injury Element. Equal to reckonable emoluments last drawn for 100% disablement. However, in no case the aggregate of Service Element and War Injury Element should exceed last pay drawn. For lower percentage of disablement, War Injury Element shall be proportionately reduced.

Provisions contained in Para 0502 and 0503 above shall equally apply to individuals invalided out under the circumstances mentioned in Category ‘D’ and ‘E’ at Para 0501 above for calculating War Injury Element of War Injury Pension.

Retirement Gratuity admissible on invalidment due to War Injury shall be calculated on the basis of reckonable emoluments on the date of invalidment but counting service upto the date on which he/she would have normally retired in that rank plus weightage as applicable (total not exceeding 33 years).

0521. (a) War Injury Pension on Retention in Service. Armed Forces personnel who are retained in service despite the disability due to War Injury sustained under the circumstances mentioned in Category ‘E’ of Para 0501 above and retire subsequently will have an option as follows to be exercised with in period as prescribed by the Govt from time to time :-

(i) To draw lump sum compensation in lieu of War Injury Element, foregoing War Injury Element at the time of subsequent retirement/discharge; or

(ii) To draw War Injury Element at the time of retirement in addition to retiring/service pension admissible on retirement/discharge foregoing lump sum compensation.

(b) War Injury Element on subsequent retirement. Where an Armed Forces personnel is retained in service despite injury/disability sustained under the circumstances mentioned in Category ‘E’ of Para 0501 above and does not opt for lump sum compensation in lieu of War Injury, he/she shall be entitled to the payment of War Injury Element on a monthly basis at the rates prescribed under Para 0502 and 0503 above on subsequent retirement/discharge or on completion of the term of engagement.

0523. Lumpsum Compensation in lieu of War Injury Pension. In case an Armed Forces personnel is found to have a disability which is sustained under the circumstances mentioned in Category ‘E’ of Para 0501 above which is assessed at 20% or more for life but the individual is retained in service despite such disability and opts for lump sum compensation, he shall be paid the lump sum compensation in lieu of War Injury Element. The rate of calculation of lump sum compensation in lieu of War Injury Element for 100% disability for life for Commissioned Officers and Hony Commissioned Officers is Rs. 5,200/-.

Liberalised Disability Pension. Armed Forces personnel sustaining disability under the circumstances mentioned in Category ‘D’ of Para 0501 above shall be entitled to same pensionary benefits as admissible to war injury cases on invalidment/retirement/discharge including lumpsum compensation in lieu of disability mentioned in 0520 and 0521 above. However, on invalidment they shall be entitled to Disability Element instead of War Injury Element in addition to Service Element. The Service Element will be equal to Retiring/Service Pension to which he/she would have been entitled on the basis of his/her pay on the date of invalidment but counting service upto the date on which he would have retired in that rank in the normal course including wieghtage as admissible. There shall be no condition of minimum qualifying service for earning this element. For lower percentage of disablement, this amount shall be proportionately reduced. However, in no case aggregate of service element and disability element shall be less than 80% of reckonable emoluments last drawn.

Armed Forces personnel sustained disability under the circumstances mentioned in Category ‘D’ of Para 0501 above shall not be treated as War Disabled. Hence they will not be entitled to any special concession/dispensation otherwise available to war disabled.

0523. For disabilities due to war injury less than 100% but more than 20% the rates shall be proportionately reduced. Also, once the compensation in lieu of war injury pension due to disability for life have been paid there shall be no further pensionary entitlement on account of such a disability at the time of retirement/discharge.

0524. The one time compensation in lump sum in lieu of war injury pension will be equal to the capitalised value of war injury pension for the actual percentage of disability at the appropriate rate mentioned in para 0519. For this purpose the rank shall be the rank held at the time of injury sustained by the individual due to war. Age next birthday will be reckoned with reference to the date of the onset of disability with loading of age if any recommended by the competent medical board.

0525. Any subsequent increase in the amount of war injury pension as a result of grant of subsequent revision will not be applicable. Also, since this is a one time payment no restoration will be permitted.

0526. The above provisions shall apply to cases arising on or after 01 January 1996.

Retiring/Service Pension or Retiring/Service Gratuity.

0527. Retiring/Service Pension or Retiring/Service Gratuity as admissible shall be payable in addition to War Injury Element from the date of retirement/discharge.

Illustration.

0528. A constant Attendant Allowance at the uniform rate of Rs 600/- per month for battle and non-battle casualties is payable if the Disability Pension is granted for 100% disablement provided that :-

(a) The Invalidation Medical Board certified that the service of a constant attendant are required.

(b) There is no relative look after the pensioner properly.

(c) An attendant is actually employed to look after.

Note : The payment of the Constant Attendance is on condition of a declaration being rendered by the officer in the prescribed form at Appendix ‘J’.

0529. Illustrations to show calculation of Disability and War Injury Pension are at Appendices ‘K’ and ‘L’.

C H A P T E R – VI

INVALID PENSION/GRATUITY

Invalid Pension

0601. Eligibility. If an officer is being invalidated out of service with a disability which is neither attributable to nor aggravated by the service, he will be entitled to Invalid Pension, if the service actually rendered by him is 10 years or more.

0602. Rate of Invalid Pension. It is equal to the Service Element of Disability Pension that would have been admissible in case the causes were attributable to or aggravated by the service.

Invalid Gratuity

0603. Eligibility. In case the officer is being invalidated out of service with a disability which is neither attributable to nor aggravated by service and the service rendered by him is less than 10 years, he will be entitled to Invalid Gratuity and not Invalid Pension.

0604. Rate of Invalid Gratuity. At half a month’s emoluments as defined in article 0605 below for each six monthly period of service.

0605. Reckonable Emoluments for Calculation of Invalid Gratuity. Pay, Non-Practising Allowance (NPA), Rank Pay and Stagnation Pay if any, last drawn by the officer.

C H A P T E R – VII

COMMUTATION OF PENSION

0701. Extent of Commutation. Officers are entitled to commute their Retiring/Invalid/Disability pension where sanctioned for life upto an upper limit of 43%.

0702. Retiring pension may be commuted at any time after retirement/ invalidation. The officer can also commute more than once provided the overall commuted pension is within the maximum limits as in article 0701 above.

0703. Reckoning Age of Commutation. The age is reckoned as on officer’s next birthday following the date of retirement. In case if he decides to apply for commutation after one year of retirement, the age will be reckoned as on the birthday falling after the date of Medical Board signing the medical examination papers.

0704. Procedure for Commutation. Please refer to article 0207 and 0209 of Chapter II.

0705. Withdrawal of Application for Commutation. The officer may withdraw his application for commutation at his discretion if he is not satisfied with the Medical Board's recommendation of loading of years to his actual age. Withdrawal of applications is to be made by written notice despatched within 14 days of the date of medical examination.

0706. Revision of Rejected Application. In case application to commute a portion of pension has been rejected on the recommendations of a Medical Board or officer has declined to accept commutation on the basis of loading of years to his actual age recommended by a Medical Board , he may appeal for revision of the original finding. He will be permitted to appear for re-examination by a Medical Board, provided that a period of at least one year has elapsed after the date on which he was examined by the first Medical Board.

0707. When Commutation Becomes Absolute. The title to the commuted portion of the Retiring Pension becomes absolute on the date the officer is placed on the retired list or the date on which the Commutation Medical Board signs the medical certificate, whichever is later. In the unfortunate event of demise on or after the date the commutation becomes absolute, but before the commutation amount is paid, the amount will be paid to the officer’s Next of Kin.

0708. Commutation Value. The table for commutation value is given at Appendix ‘N’. However it is subject to change from time to time. Illustration showing calculation of commuted value of pension is at Appendix ‘P’.

0709. Restoration of Commuted Portion of Pension. The officer will be eligible for restoration of commuted portion on completion of 15 years from the date of retirement/date of payment of commuted amount, whichever is later. To claim restoration he is required to apply on the proforma given at Appendix ‘Q’ to his Pension Disbursing Authority who will restore the commuted portion of pension.

C H A P T E R – VIII

ENCASHMENT OF ACCUMULATED ANNUAL LEAVE

0801. Retiring on Superannuation /After Completion of 20 Years Service.

Naval Officers may accumulate and encash the annual leave at the time of retirement on superannuation as per the ceilings given below:-

(a) 22 years and above -upto 300 days

(b) 17 years and above but below 22 years -upto 265 days

(c) 15 years and above but below 17 years -upto 240 days

0802. Permitted to Proceed on Retirement/ Discharge at own Request. Officer who are permitted to proceed on retirement/discharge at their own request, may accumulate and encase the annual leave as per ceiling given below:-

(a) 22 years and above - 300 days

(b) 20 years and above but less

than 22 years - 265 days

(c) 17 years and above but less

than 20 years - 132 days

(d) Less than 17 years - 113 days

0803. Accumulation of Annual Leave of Year of Retirement. Not more than 30 days annual leave is allowed to be accumulated in a calendar year. Annual leave of the year of retirement can be encashed as follows:-

(a) Those retiring on 31 Jan of the year - 15 days

(b) Those retiring in Feb and thereafter - 30 days

0804. The total number of days of leave encashed including leave of the year of retirement shall not exceed 300 days.

0805. In Case of Death Whilst in Service. Encashment of accumulated leave to the credit of an officer will be paid to his Next of Kin. Naval Pay Office, Mumbai will initiate action for payment based on the information received from the Commanding Officer of the last Ship/Establishment.

C H A P T E R – IX

TRAVEL ENTITLEMENTS AND MONETARY ALLOWANCE

0901. Entitlements. Subject to restrictions as given below, officers are entitled to conveyance for self, family (including dependent parents, brothers, and sisters), baggage and car/scooter on the same line as their entitlement on permanent transfer whilst in the service. The restrictions are:-

(a) Journey by air is not permissible.

(b) All moves are on cash payment. Warrants are not issuable for move of self, family or baggage.

0902. Lien Periods for Moves on Retirement. The moves can take place during Annual Leave preceeding retirement.

0903. Lien period from the date of retirement is upto 1 year extendable to 18 months in special cases by the competent authority viz., COP/IHQ MOD(Navy).

0904. Members of family and baggage may precede the officer by not more than one month or follow him within six months, these periods being counted from the date on which the officer himself moves. These periods are extendable in special cases by competent authority.

0905. In case the officers are re-employed under Central Government within six months of retirement, travel concessions under rule 200 TR are allowed to be availed of within one year of the expiry of the period of their current re-employment.

0906. Advance of Travelling Allowance (TA). With abolition of Leave Pending Retirement, payment of advance of TA/DA on retirement is NOT admissible. The officers are to prefer a claim for the same on completion of the move and forward the same to CDA(N), TA Section, Mumbai, through their last ship/establishment for settlement.

0907. Procedure for Claiming TA. The travelling allowance claims are to be preferred in the same manner as in the case of permanent duty moves.

0908. Concession by the Indian Airlines and Indian Railways. The Indian Airlines allows 50% concession to recipients of Level I & II Gallantry Awards:-

a) Param Vir Chakra b) Ashok Chakra

c) Maha Vir Chakra d) Kirti Chakra

e) VIR Chakra f) Shaurya Chakra

0909. Indian Railways offer 50% concession in Ist & IInd class recipients/widows of posthumous Winner of Chakra Series Gallantry Awards.

0910. Concerned officers are advised to contact Directorate of Personal Services, Integrated Headquarters, Ministry of Defence(Navy) for obtaining the required identity cards/certificates.

0911. Monetary Allowance Attached to Gallantry Awards. The revised Monetary allowance for gallantry awards, with effect from 01 Feb 99 are :-

0912. Monetary Allowance for Nausena Medal. Min of Def vide their letters No. 3(8)/98/D(Ceremonials) dated 18.3. 99 and 12 Oct 2000 have intimated that the monetary allowance of Rs 250/- per month to the Nao Sena Medal Awardees (Gallantry) will also be payable to all the existing awardees.

0913. Priority Telephone Facility to Gallantry Award Winners. Earlier, War Widows, disabled soldiers and Gallantry award winners were entitled to full concession in telephone instalation in charges and 50% concession in normal rental charges. Now, these categories of persons are also entitled to full exemption from payment of Registration Charges. (Authority : Min of Communications, Deptt of Telecom Service Circular 7/2000 issued vide letter No. 2-47/92 PHA dt 13 Jun 2000)

Chapter - X

Financial Assistance – Naval Non Public Funds

1001. Post Retirement Benefits. On retirement officers are entitled to benefits, grants or assistance from the following Naval Non Public Funds :

a) Naval Group Insurance Fund (NGIF)

b) Indian Naval Benevolent Association (INBA)

1002. Naval Group Insurance Fund. The survival benefits accrued to the officer in form of saving element, bonus as applicable etc are paid to the officers on retirement being terminal benefits. In this connection para 0212 refers.

1003. Post Retirement Death Insurance Extension Scheme. The membership of the above scheme is compulsory for all officers retiring with pensionable service. Brief information of the scheme is given at para 0213.

1004. Disability Benefits. In case of any officer medically invalidated out with disability of 20% or more, prior to his superannuation, NGIF pays disability benefits at the rate of 50% of sum assured under General Group Insurance and Additional Group Insurance (if Eligible member) for 100% disability. For lesser disability up to 20%, the amount on pro rata basis would be payable. The disability payments would be paid by the Secretary, Naval Group Insurance Fund, on receipt of relevant documents from PDOP/DGMS(Navy), along with the survival benefits. In such cases also, the officer has to forward the pre-receipt as per Appendix E-I and the application for PRDIES if eligible ( if boarded out with pensionable service).

1005 Scholarship Scheme. Officer’s children are considered for award of scholarship for pursuing post 10+2 education with a view to encourage them to compete for better future prospects. Children in receipt of any other stipend/scholarship are awarded the difference of INBA rates and the amount of such stipend/scholarship. The main criteria for award and the rates of scholarship are as follows :-

(a) Marks obtained by the children in their 10+2/Graduation examination form the basis of initial award of scholarship for pursuing Graduation/Post Graduation studies respectively.

(b) At present, the annual rates of scholarship are :-

(i) Day Scholars - Rs. 6,000/-

(ii) Boarders - Rs.10,000/-

1006. Special Scholarship Scheme. Scholarship is awarded to wards of naval personnel who die/died in harness, for reimbursement of actual expenditure on education subject to the laid down monetary ceiling.

1007. Scholarship for Handicapped Children. The following amount is paid for handicapped children :-

a) Reimbursement of Tuition Fee :

(i) Day Scholars - Rs.100/- p.m

(ii) Boarders - Rs.200/- p.m

(b) Purchase of Special Equipment - Rs.3000/-

1008. Marriage Grant. A grant of Rs.20,000/- is paid to the NOK of deceased officer for daughter’s marriage.

1009. Death Grant. In the event of unfortunate death of an officer, Rs.15,000/- is paid to NOK.

C H A P T E R – XI

ECHS

1101. The Ex-Servicemen Contributory Health Scheme (ECHS) was approved by the Government on 30 Dec 2002 and commenced from 01 Apr 2003 with the aim to provide quality medical care to ESM and their dependents.

1102. The ECHS Provides the Following Facilities:-

(a) Quality Medical Care covering all diseases including Cardiac, Renal, Joint replacement, Cancer etc.

(b) Quality hospitals/ nursing homes and diagnostics centres will be

empanelled nation wide.

(c) Accessibility of Health care in all states in the country including non-military stations.

d) Treatment easily accessible in Emergencies.

1103. Eligibility for Echs Medicare. The following categories are covered:

a) Ex-Servicemen drawing pension/disability pension.

b) Widows drawing family pension.

c) Spouse of pensioner.

d) Unemployed sons below 25 Years and unemployed and/or unmarried daughters.

e) Mentally/ Physically challenged children for life.

1104. Membership. All service personnel retiring on or after 01 Apr 2003 are compulsory members. The one time contribution is being deducted by PCDA(Navy) from the terminal benefits and the same is reflected in the PPO. However submission of ECHS application form is mandatory for obtaining ECHS Smart Cards. Ex-Servicemen already retired can become members by remitting a one-time subscription rates as approved by the Govt on a sliding scale as given below.

1105. Echs Smart Cards. A ‘Smart Card’ with built in security features are issued to all members of the ECHS. The Smart Card contains the details of the Ex-Servicemen and dependents including their medical history in physical as well as in electronic form. The Smart Card possession is necessary for availing entitled medicare.

1106. Facilities. The following facilities will be established: -

a) Medical facilities provided through a network of 227 Polyclinics spread across the country.

(b) Referral will be made from ECHS Polyclinic to Armed Forces Medical Services Hospitals, Empanelled Pvt Hospitals/ Nursing Homes and Diagnostic Centres. These referrals can only made by authorized staff of the Polyclinics.

(c) Only in case of emergencies of life threatening nature, members are allowed to report to any hospital and the expenditure will be reimbursed as per approved rates.

1107. Smart Card. With immediate effect Retiring officers (compulsory members) can submit ECHS applications without PPO copy to DOP, five months prior to date of retirement for obtaining smart cards.

Smart cards will be issued to officers by DOP/ECHS cell fifteen days prior to proceeding on retirement on submission of PPO copy.

1108. Application Form. Copy of the application is placed at Appendix ‘R’. Officers are required to fill up and submit to NHQ/ DOP, five months prior to date of retirement to facilitate obtaining of Smart Cards prior to proceeding on retirement. The revised application is also hosted on IRFC website.

C H A P T E R – XII

ACCOMMODATION, RATION,

CANTEEN FACILITIES & NAVY FOUNDATION

1201. Retention of Accommodation. Officers are entitled to retain accommodation whether Government, hired or requisitioned for a period of three months after retirement/invalidation/superannuation from service. This concession is not admissible to those officers who on the date of retirement/invalidation/ superannuation are living in their own houses and are claiming rent reimbursement.

1202. If an officer fails to vacate Government accommodation on retirement after the permissible period, he is liable to be evicted under the provisions of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971.

1203. Ration and POL from ASC Sources/BVO/RIS. If an officer is a pensioner, he is permitted to purchase for himself and his family (including servants) provisions from the ASC Supply Points/RIS, subject to restrictions on the total monetary values as notified from time to time. In addition, he is also entitled to purchase POL from ASC/BVO/Establishments.

1204. In areas where civil rationing arrangements are introduced. purchases from the ASC Supply Points/BVO/RIS of such commodities as are rationed for the civil population will be restricted to the civil scale laid down in those areas for the families and servants of Service Officers.

1205. To avail this concession, an officer should apply to the Naval Station Commander of Army/Air Force Commander of the place of their residence who will publish a Station Order authorising him to draw his requirements from the Supply point as near to his residence as possible. In case he decides to settle down at a place away from a military station he may also avail of these facilities from the nearest military station where such facilities exist.

1206. Canteen Facilities. Officers in receipt of pension from Defence Service Estimates are permitted to purchase the following types of canteen stores from Service Canteens:-

(a) Indigenous canteen stores less specially allocated/short supply items

(b) Indigenous liquor in accordance with the scales approved from time to time and subject to excise restrictions.

1207. In addition, officers are also authorised to purchase Refrigerator/Motor Cycles and Mopeds.

1208. Officers who have put in 5 years of service and have been either released at their own request or by the Government on administrative grounds, are also entitled to avail canteen facilities.

1209. All entitled personnel/widows who are desirous of availing of canteen facilities are required to get themselves registered with the Military/Naval Station Commander or the local Army/Air Force Commander concerned.

1210. Navy Foundation. The Navy Foundation an association of retired naval officers is an All India body with headquarters at New Delhi. Regional charters have been established at Bangalore, Mumbai, Kolkata, Chandigarh, Kochi, Coimbatore/Nilgiris, Delhi, Goa, Pune, Hyderabad, Madras, Vishakhapatnam and Bhubaneswar. CNS is the President of the All India body which has a governing council to oversee the matters at the national level. The governing council includes, Director Ex-Servicemen Affairs, Director Non-Public Funds and JAG as the Secretary, treasurer and legal member respectively.

1211. Aims and Objectives. The cardinal objectives of the Foundation are as follows:

(a) To promote interest in Defence Studies, particularly on maritime interest and to propagate thereby a revival of maritime interest and consequently generate awareness of the Indian Navy and its role in national affairs.

(b) To further strengthen and continue the existing bonds between members of the naval fraternity, both retired and serving by ensuring that the sense of belonging and comraderie is retained amongst the retired personnel.

(c) To provide assistance to the needy naval ex-servicemen and help them in their post retired life.

(d) To assist them in their venture for charitable, social and philanthropic causes.

1212. Membership. The membership of the Navy Foundation is open to all retired naval officers who have served in the Indian Navy or the erstwhile Royal Indian Navy. Widows of such officers are also eligible for honorary membership;. Any retired naval officer can become a member of the Navy Foundation by paying one time subscription of Rs.500 only. An application form for membership is placed at Appendix ‘S’.. A retired naval officer desirous of becoming member may complete the membership form and forward it to the Secretary Navy Foundation of the regional charter with the membership fees applicable for the charter. where he desires to take membership. A separate card showing present names and addresses of office bearers of the charters is placed in this pamphlet. These are subject to change. Officers residing at places where regional charters have not been established may forward their membership forms to Navy Foundation, B-28, South Block. Integrated Headquarters, Ministry of Defence(Navy) New Delhi-110011 and make the cheque in favour of ‘Navy Foundation’.

C H A P T E R – XIII

RESETTLEMENT IN CIVIL LIFE

1301. There are certain avenues available through the Service resources which could be of assistance for officers in resettlement. These avenues are discussed in this Chapter.

1302. The Avenues. These are as follows:-

a) Re-employment in the Navy

b) Employment in PSUs

c) Self - Employment through Director General Resettlement (DGR)

1303. Re-employment in the Navy. Officers are eligible for re-employment in the Navy. The rules regarding re-employment are laid down in Navy Instructions 5/S/58 as amended from time to time. Officers of the rank of Commander and below having a good record of service and who are in medical category not lower than S2A2 are re-employed on their retirement/release from service for a period not exceeding three years at a time upto the age of 56 years at the discretion of the CNS. Officers in the rank of Commander are granted re-employment against appointment tenable in one rank below. Cases of officers who are in lower medical category require the approval of the Government.

1304. Employment in PSUs. Officers can register themselves for employment in PSUs by filling up the proforma at Appendix ‘T’. It is essential that application is routed through NHQ (DESA). These applications (Appendix ‘T’) will be forwarded to Public Enterprises Selection Board, for their Data Bank. The selection to the posts like the Chairman, Managing Director, Members of the Board of Directors & Executive/Functional Director are made by the Central Government. Whereas for other lower posts, it is the individual Board Management of the concerned PSU that makes the selection. For further details you may contract:

1305. Assistance through the Director General Resettlement. The Director General Resettlement under the Ministry of Defence is the nodal agency for resettlement and rehabilitation of all ex-servicemen in the country. They have the following schemes:-

(a) Resettlement Course. Short courses in different disciplines viz, industrial security, personnel management, export management, EDP, dairy development and entrepreneurship development programmes etc are sponsored by DGR to promote an awareness and understanding of the complexities of the prevailing business environment and modern management techniques. Some of these courses are free of cost, whereas for others only a nominal fee is charged. If the duration of the course does not exceed 3 months, it is treated as on duty; however, officers will NOT be entitled for free passage and TA/DA. The detailed programme of these courses is promulgated every year and are available with Command HQrs/Units.

(b) Sponsorship for Employment. The DGR maintains a panel for employment in Central/State Governments and private undertakings. Applications on the prescribed form as at Appendix ‘U’ may be forwarded through NHQ(DESA). Officers may also apply directly to DGR prior to retirement.

(c) Self-Employment. State Governments have reserved industrial plots/sheds for ex-servicemen. Officers may apply for these through Rajya Sainik Board/Zilla Sainik Board. Officers may also establish ex-servicemen transport companies/agencies and co-operative societies in collaboration with other ex-servicemen. The following schemes formulated by DGR are available for self-employment ventures:-

(i) SEMFEX-I. Officers can obtain soft loan from Industrial Development Bank of India (IDBI)/Mumbai Mercantile Co-0oerative Bank for small scale industries, transports etc. Details and application forms are available with Rajya Sainik Board/Zila Sainik Board.

(ii) SEMFEX-II. Officers can obtain soft loan for setting up village and cottage industries in rural areas. Details and application forms are available with RSB/ZSB. The application is to be submitted through RSB/ZSB.

1306. Employment under Foreign Govts/Missions/Agencies Controlled by Them. Irrespective of the type of Commission held by an officer, if he has been granted any pension, gratuity or other benefits in respect of his Naval service he is required to obtain permission of the Government before accepting an employment under a Govt. outside India at any time after his naval service has ceased. For this purpose employment under a Govt. outside India’ includes employment under a local authority or corporation or any other institution or organisation which functions under the supervision or control of a Govt. outside India. Permission is not normally granted for acceptance of employment under a foreign Mission in India before the expiry of at least 3 years from the date officer ceases to be in naval service.

1307. Employment under Indian Private/Govt. Posts. If rank held by an officer on retirement was Captain or above, whether substantive or not, he is required to obtain the permission of the Government prior to accepting employment before the expiry of 2 years from the date his naval service ceases, in the following cases:-

(a) Commercial Employment in Private Undertakings. For this purpose of an agent under a company, fir or individual engaged in trading, commercial, industrial, financial or professional business, and includes also a Directorship of such company and partnership of such firm. The term commercial employment inter-alia also means setting up practice, either independently or as a partner of a firm, as adviser or consultant in matters in respect of which the Service Officer:

(i) has no professional qualifications and the matter in respect of which the practice is to be set up or is carried on are relatable to his official knowledge or experience; or

(ii) has professional qualifications but the matters in respect of which such practice is to be set up are such as are likely to give his clients an unfair advantage by reasons of his previous official position.

(b) Employment in Civil Post under the Central or State Government or an Administration of Union Territory or in a Post under a Body Corporate Owned or Controlled by the Government. If an officer has been allowed to retire prematurely at his own request, he is required to obtain Govt. approval. Such permission is, however, not required if he retires from naval service in normal course or completion of the standard service prescribed for his rank or if he has been invalidated from naval service on grounds of ill health or physical disability.

1308. Applications for obtaining Government permission for accepting civil or commercial employment, are to be forwarded to the Chief of the Naval Staff, (DOP), giving full particulars of the employment in question. A specimen application form in respect of commercial employment is at Appendix ‘V’.

1309. Penalties for Non-Compliance with Govt. Rules. No Service or Disability Pension or other recurring benefit is payable in case of acceptance of employment in contravention of the provisions of articles 1307 and 1308, for the period of employment or such longer period as the Government of India may direct. Gratuity, where due, not already paid, is also liable to be forfeited in part or full as may be decided by the Govt. of India. If an officer has been permitted, before his naval service ceased, to take up particular employment of any of the types specified in article 1307 and 1308 above, he is not required to obtain subsequent permission for his continuance in the employment.

1310. Fixation of Pay in Govt/Public Sector Employment. The pay in the Government and the Public Sector Employment is fixed in such a way that the pay of the post plus pension should not exceed the last pay drawn while in service. In other words, the initial pay is fixed at a stage where the total pay of the new post plus the pension admissible, which continues to be drawn separately, adds up to the pay last drawn. This, however, does not apply to officers who, while still in service, proceed on deputation to Public Sector Enterprises and are later absorbed therein within a specific period.

C H A P T E R – XIV

SERVICE PRIVILEGES AND OBLIGATIONS

1401. Use of Naval Rank. Permanent Commissioned Officers who retire with pension or Service Gratuity are entitled to use the naval rank held at the time retirement suffixed by the word ‘Retired’. For this purpose, the higher acting paid rank may be used, if it has been held for a minimum period of 10 months at the time of retirement. In all other cases, only substantive rank is to be used.

1402. Entitlement to Wear Uniform. All regular officers who have retired from the Service may wear uniform with badges of appropriate rank on special occasions like attending ceremonial parades and entertainments of military nature, and on other occasions when the wearing of uniform would appear appropriate, such as:

a) Official parties at Rashtrapati Bhavan/Raj Bhavans.

b) When invited to any official function by any Embassy, Legation of High Commission.

c) At all Armed Forces functions including ex-servicemen’s rallies or reunions.

d) When attending a durbar or any other function in honour of the National Day.

e) When called upon in aid of civil power.

f) When visiting any military headquarters on duty.

g) When calling on or meeting Senior Service Officers and local heads of the civil administration of and above the rank of Collector/Deputy Commissioner.

h) When going to draw their pension.

j) When serving on the personal staff of a Governor.

k) When attending State or military funerals.

1403. Wearing of Badges of Rank. Badges of rank to be worn by those entitled to use military ranks, will be those of the last substantive rank, except where the higher acting rank has been held for a minimum period of 2 years at the time of retirement or where the use of the honorary military rank is specifically authorised.

1404. Wearing of Miniature Medals on civil clothes by Ex-Servicemen. The miniature medals will be worn on the following occasions:-

(a) While attending official and private functions such as Dinner, Cocktails, lunches, tea parties and receptions etc, during day and night.

(b) Functions held in the messes, institutions in connection with Service Day, Unit Anniversary, Re-Union functions.

(c) Functions in connection with Republic Day Parade, Independence Day Parade, Standard/Colour Presentation, Reception at the Service Chief’s residence on the Service Day, Reception on Passing Out Parades etc.

(d) When invited to any official function by any Embassy, Legation or High Commission.

(e) At all Armed Forces functions including ex-servicemen’s rallies or re-unions.

(f) Retired officers and Honorary Commissioned Officers may wear medals and decorations on their civilian clothing under the same conditions as for officers in uniform on the Active List.

1405. Personnel Forbidden to Wear Uniform and Places Where Uniform is Forbidden. None of the personnel mentioned above will wear uniform at meetings of a political nature. Personnel dismissed from service/discharged on disciplinary grounds are not entitled to wear uniform under any circumstances.

1406. Occasion for wearing of Medals on civil clothes by Ex-Servicemen. Personnel dismissed from service or discharged on disciplinary grounds will not wear medals on any occasion. Full medals/miniature medals may be worn by ex servicemen on all functions in the manner as authorized for serving officers/personnel. However, medals will not be worn at meetings of political nature. The various occasions on which wearing of full medals/miniature medals by Ex-servicemen is enumerated below:-

(a) Republic Day Parade

(b) Independence Day Function

(c) Service Day

(d) Vijay Diwas

(e) Wreath Laying on Memorial Day

(f) Reception at Rashtrapati Bhawan and Governor’s House

(g) Standard/Colour Presentation Parade/Functions passing out parade

(h) Anniversary/Re-union Functions

(j) When attending State or Military Funerals

(k) When invited to any official function by any Embassy, Legation or High Commission.

(l) At all Armed Forces functions including ex-servicemen’s rallies or re- unions.

(m) When called upon in aid to civil power

(n) When visiting any Military Headquarters on duty.

1407. Retired Officer’s Identity Cards. Retired Officer’s Identity Cards are issued only to facilitate identification on ceremonial occasions, Service functions and also while drawing pensions, canteen goods, etc. These Identity Cards are under no circumstances to be used for entry into Defence Units/Installations. Officers will be permitted entry into Defence Units/Installations only on the basis of passes issued by the concerned reception officers.

1408. Indian Armed Forces Identity Card. (IAFZ 2015) issued to officers while in service will be withdrawn from them prior to their proceeding on retirement/release/leave. If retiring with pensionary benefits, officers will be issued, free of charge, a Retired Officer’s Identity Card (IAFZ 2015A) by the Commanding Officer INS Kunjali on receipt of specific request from such officers, Retiring officers desirous of obtaining a retired officer’s identity card may request for the same through their CO’s immediately on receipt of information regarding date of their retirement giving the following information and undertaking:

(a) Rank and personal No.

(b) Full Name

(c) Ship/Establishment in which the officer last served.

(d) Whether in receipt of pension

(e) Present address

(f) Permanent address

Three copies of the photographs in plain clothes together with negative, one with board showing rank, name and number print size 5 cm x 5 cm and another without board, print size 4.7 cm x 3.3 cm should accompany the application. Retired officers’ identity cards are not laminated.

1409. Loss of Identity Card. It is the responsibility of the officers to ensure safety and security of the Identity Card issued to them. In the event of loss of identity card, retired officer must report the loss to the nearest police station, local naval authority and CO INS Kunjali, explaining in detail circumstances under which the loss occurred and attaching a copy of the FIR. He must make a specific request for re-issue of identity card if he so desires. Another Identity Card will be issued by the CO INS Kunjali subject to approval of Naval HQ. On receipt of Naval HQ approval, CO INS Kunjali will advise the officer to deposit a sum of Rs.1000/- for the first loss, and Rs.2,500/- for the 2nd loss with the Reserve Bank of India/State Bank of India on Military Receivable Order (MRO in favour of the CDA(N) Mumbai. A duplicate copy of the MRO must be sent to CO INS Kunjali. No Identity card will be issued after the third loss.

1410. Retired Officers Re-employed. If an officer is re-employed in Navy at a later date, the retired officer’s Identity card issued to him must be surrendered on joining the appointment where upon an Armed Forces Identity Card will be issued for the duration of his re-employment. If the officer is re-employed immediately after his retirement, he will continue to hold his Armed Forces Identity card for the duration of such re-employment. Information to this effect is required to be sent by ship/establishment where the officer is borne to CO INS Kunjali under intimation to Naval HQ indicating additional period of retention of identity card quoting relevant NHQ letter of re-employment.

1411. Personal Weapons. Serving Service Officers are permitted to hold one privately owned pistol or revolver without licence as part of their personal equipment, in addition to the service pistol/revolver issued to them. However, on retirement/release obtaining licence for the privately owned weapon is necessary irrespective of the fact whether the weapon is of prohibited or non-prohibited bore.

1412. Non Claiming of Private Arms Deposited in Armouries. Officers are advised to claim private arms deposited with ship/establishment before proceeding on retirement/release. In case any private arms are left unclaimed on board, the particulars of such weapons are promulgated throughout the Service in an endeavour to trace the owner. Should there be no claimant, within a period of 60 days of promulgation, the weapons are handed over to the local police authority for disposal.

1413. Exemption from Licence Fee. Payment of licence fee for the above weapon is exempted in respect of retired/released officers provided the application for grant/renewal of the licence is made within one month of the date on which licence should have been taken/renewed.

1414. Right to Enter Politics After Retirement. There is no bar on military pensioners participating in lawful political activities, including contesting elections. However, pension is liable to be forfeited if found guilty of grave misconduct, of a political or other nature.

1415. Residential Telephone on Priority Basis. If an officer has continuously drawn a basic pay of Rs. 4000/- per month or more for a minimum period of one year prior to retirement, he may ask for a residential telephone connection on a priority basis from the P&T Department at his selected place of residence under ‘SS’ Category. Application form can be had from local P&T authorities and will be submitted to them through local Military Headquarters who will verify officer’s eligibility for a telephone under the ‘SS’ category. If an officer is registered under ‘SS’ category he is given precedence over applicants under general category. Certificate of pay required for this purpose is obtainable from Naval Pay Office.

1416. Eligibility for Recall. If on the Retired or Emergency List an officer is liable to be recalled for service upto the age of 55 years in the event of wars or an emergency. He is required to give his post retirement address to DESA & DMPR and intimate subsequent changes.

1417. Disclosure of Classified Information. It is an offence against Indian Official Secrets Act (XIX 1923) for a person whether still belonging to the Naval Service or not, to divulge any classified information or any information acquired by him as a member of the naval Service unless authorised by the Chief of the Naval Staff to do so.

1418. If an officer wishes to publish any information acquired by him as a member of the Naval Service, as a book or newspaper article or otherwise he should, in his own interest, obtain the prior permission of the Chief of the Naval Staff (DNI).

1419 Immunity from Attachment. In accordance with the provision of Section 11 of Pensions Act, 1971 and Code of Civil Procedure 1908 Section-60 provision 187 No Pension granted or continued and no money due to or to become due on account of any such Pension or allowance shall be liable to seizure, attachment or sequestration by process of any Court, at the instance of a creditor, for any demand against the Pensioner or in satisfaction of a decree or order of any such court. This provision will apply to DSOP Fund amount, Pensions and other compulsory deposits till these reach the hands of the Pensioner. Therefore, attachment is possible and lawful any time after such amounts are received by the Pensioner.

1420. Exemption from the Levy of Estate Duty. Section 33(I) (n) of the Estate Duty Act of 1953 provides that ‘No Estate Duty’ shall be payable in respect of property belonging to the deceased who was killed in action during operation against an enemy’.

1421. Restoration of Houses/Agricultural Land. Special provisions have been made by a large number of States/Union Territories in their Rent/Land Tenancy Act, for service/ex-service personnel to enable them to get possession of their Houses/Agricultural Land on priority basis from the tenants for their bonafide use. The States/Union Territories which have these provisions are – Gujrat, Haryana, J&K, Kerala, Karnataka, U.P., West Bengal, Rajasthan, Chandigarh, Goa, Daman and Diu, Pondichery, and Delhi. Only partial provision exists in the States of Himachal Pradesh. Orissa and Tamil Nadu. For detailed procedure for restoration, the Acts of concerned States/Union Territories are to be consulted.

1422. Display of Star Plates by Former Service Chiefs .Star plates by former Service Chiefs may be displayed on the following occasions in Delhi and State Capitals:-

(a) Republic and Independence Day ceremony.

(b) Beating Retreat Ceremony.

(c) Service Day functions.

(d) Republic and Independence day functions at Rashtrapati Bhavan/Raj Bhavans.

(e) Banquets for visiting Heads of state at Rashtrapati Bhavan/Raj Bhavans.

(f) Investiture ceremonies at Rashtrapati Bhavan.

CH A P T E R – XV

PENSIONARY BENEFITS TO

THE NEXT OF KIN/DEPENDENTS

1501. In the unfortunate event of death. wife/children/parents/brother/sisters of the deceased officer, as applicable, are eligible for various pensionary awards. These are as follows:-

(a) Pensions.

i) Ordinary Family Pension (OFP). Admissible where death is not attributable to/aggravated by the Service.

ii) Special Family Pension (SFP). Admissible where death is attributable to/aggravated by the Service.

iii) Liberalised Special Family Pension (LSFP). Admissible in the case of battle casualties and such other cases a specified by the Govt.

(iv) Dependent’s Pension. Admissible to dependent parents/brothers/sisters of a bachelor/widower without children.

(b) Gratuity

i) Death Gratuity Admissible in all cases where death occurs whilst in Service

(ii) Family Gratuity Admissible where death occurs in special circumstances on duty (Please see para 1702).

1502. Reckonable Emoluments. The Reckonable Emoluments for the purpose of pensionary benefits are Pay plus Non-Practicing Allowance, Rank Pay and Stagnation Pay, if any, last drawn by the deceased officer. 1502

1503. Admissibility of Dearness Relief. It is admissible on Ordinary Family Pension/Special Family Pension/Dependent’s Pension in accordance with the rules promulgated by the Government from time to time.

1504. Effect of Voluntary Retirement/Resignation. In case the individual has voluntarily retired or resigned, and subsequently dies after leaving the Service, NO SPECIAL FAMILY PENSION will be admissible to the Next of Kin. However, only in case of death after Voluntary Retirement, the NOK may be granted Ordinary Family Pension provided the laid down minimum Qualifying Service for pension had been rendered by the deceased.

1505. Effect of Re-marriage. In case the re-marriage is with a PERSON OTHER THAN THE REAL BROTHER of the deceased:-

(a) The widow forfeits the right to Ordinary and Special Family Pension and these are transferred in the name of Child/Children of the deceased.,

(b) The award of Liberalised Special Family Pension is, however, not totally forfeited buy converted to Ordinary Family Pension.

C H A P T E R – XVI

FAMILY PENSION

1601. Ordinary Family Pension. The ordinary family pension to the widow/children of the deceased officer where death is neither attributable to nor aggravated by Naval Service is admissible at uniform rate of 30% of reckonable emoluments subjects to minimum of Rs.1275/- per month and maximum of Rs.10,000/-, that is 30% of the highest pay in the Government (Rs.30,000/-)

1602. If individual dies after rendering 7 years of qualifying service, the family is entitled to family pension at double the rates of ordinary family pension or half the pay last drawn whichever is less, for the first seven years or until, the date the deceased would have attained the age of 65 years, whichever is earlier. On completion of the above period the ordinary rate only is payable.

1603. Eligibility of Children. If the deceased is survived by child/children only the Family Pension is payable to the eligible child in order of seniority subject to the condition that he/she is below 25 years of age and not earning his/her livelihood. In the case of daughter there is yet another condition that she should be unmarried.

1604. Grant of Family Pension for life to handicapped children. In the event of death/disqualification of the widow, the son/daughter who is suffering from a physical/mental infirmity so as to render him/her incapable of earning a livelihood even after crossing the prescribed maximum age of Family Pension, shall be granted Family Pension for life. The payment shall however be subject to the following conditions:-

(a) The disability should have manifested itself before the retirement or death of the officer while in service.

(b) Such a daughter shall become in-eligible from the date she gets married.

(c) Such a son/daughter shall be in-eligible once he/she starts earning his/her livelihood.

d) The guardian shall be required to furnish a certificate to the effect that the child in question has not started earning the livelihood and in addition case of a female child, that she has not yet got married.

1605. Family Pension in case of missing Pensioners. In the case of pensioners missing for over a year, payment of family pension shall commence on expiry of one year from the date of missing subject to the following conditions:-

(a) Lodging of a report with the police authorities and their certifying that the individual is un-traced despite all efforts.

(b) Rendering of an indemnity bond with two solvent sureties to the effect that in case the pensioner reappears at a subsequent date the amount of Family Pension paid would be recovered from the retiring pension that would become due.

1606. Special Family Pension. In case of death of an Armed Forces personnel under the circumstances mentioned in Category ‘B’ or ‘C’ of Para 0501(a) above, Special Family Pension shall continue to be admissible to the families of such personnel under the same conditions as in force hithertofore. There shall be no condition of minimum service on the date of death for grant of Special Family Pension.

The Special Family Pension shall be calculated at the uniform rate of 60% of reckonable emoluments subject to a minimum of Rs. 2,550/- irrespective of whether widow has child(ren) or not. There shall be no maximum ceiling on Special Family pension.

In case the children become the beneficiary, the Special Family Pension at the same rate (i.e. 60% of the reckonable emoluments) shall be admissible to the senior most eligible child till he/she attains the age of 25 years or upto the date of his/her marriage whichever is earlier. Thereafter, Special Family Pension shall pass on to next eligible child.

Widowed/divorced daughters upto the age of 25 years or marriage whichever is earlier shall also be included in the definition of family for the purpose of Special Family Pension. In case the eligible child is physically or mentally handicapped and unable to earn a livelihood, the Special Family Pension would be admissible for life to such a child subject to same conditions as in force hithertofore.

Special Family Pension on Re-marriage of Widow. Special Family Pension on re-marriage of widow, shall be regulated as follows :-

(a) If she has child(ren) :-

(i) If she continues to support Full Special Family Pension to

children after re-marriage continue to widow.

(ii) If she does not support Ordinary Family Pension

children after re-marriage equal to 30% of emoluments

last drawn to the re-married

widow;

50% of the Special Family

Pension to the eligible children.

(b) If widow has no children Full Special Family Pension to

continue to widow.

1607. Liberalised Family Pension. In case of death of an Armed Forces Officer under the circumstances mentioned in Category ‘D’ and ‘E’ of Para 0502, the eligible member of the family shall be entitled to Liberalised Family Pension equal to reckonable emoluments last drawn. Liberalised Family Pension at this rate shall be admissible to the widow until death or disqualification.

1608. If the Officer is not survived by widow but is survived by child/children only, all children together shall be eligible for Liberalised Family Pension at the rate equal to 60% reckonable emoluments. Liberalised Family Pension shall be shall be payable to the child/children for the period during which they would have been eligible as in the case of Special Family Pension. The Liberalised Family Pension shall be paid to the senior most eligible child at a time. On his/her death/disqualification it will pass on to next eligible child.

In view of the rationalization of Liberalised Family Pension and provisions on re-marriage of widow, Children Allowance will not be payable in addition to Liberalised Family Pension.

1609. Dependant Pension. Dependant Pension shall be admissible to the parents (s)/eligible brothers and sisters (in the absence of parents) of the deceased officers, who die as a bachelor or widower without children, at a rate equal to 50% of notional Special Family Pension that would have been admissible. Conditions regarding age limit and marriage shall equally apply to dependant brothers/sisters for grant of dependant pension which shall be paid to the senior most eligible brother/sister at a time.

Dependant Pension (Liberalised). Where an officer dies as a bachelor or as a widower without children under the circumstances mentioned in Category ‘D’ and ‘E’ at Para 0502 above, Dependant Pension (Liberalised) shall be admissible to parents without reference to their pecuniary circumstances at the rate of 75% of Liberalised Family Pension for both parents and at the rate of 60% of Liberalised Family Pension for single parent. On the death of one parent, Dependant Pension at the latter rate shall be admissible to the surviving parent. In the absence of parents, Dependant Pension shall be admissible to dependant brother(s)/sister(s) if otherwise, eligible at the rate of 60% of Liberalised Family Pension.

Liberalised Family Pension on re-marriage of widow

Liberalised Family Pension on re-marriage of widow shall be regulated as follows :-

(a) If she has children :-

(i) If she continues to support Full Liberalised Family Pension to

children after re-marriage continue to widow.

(ii) If she does not support Ordinary Family Pension at 30% to

children after re-marriage widow.

Special Family Pension at 60% to

eligible children.

(b) If widow has no children Full Liberalised Family Pension

to continue to widow.

Procedure for Sanction of Family Pensionary Awards.

1610. If Death Occurs Whilst in Service Integrated Headquarters, Ministry of Defence(Navy) . (Dte of Pay & Allowances) will forward blank application forms for claiming family pension to the widow or any other Next of Kin (as applicable) for completion and onward transmission to the Controller of Defence Accounts (Navy) Pension Cell, Mumbai. On receipt of pension claims, the CDA(Navy) will notify Ordinary Family Pension in favour of the widow. Simultaneously, NHQ will take up a case with the Ministry of Defence on receipt of medical documents for a decision on the attributability of death to Service. As and when the Government letter conveying the decision on attributability of the case is received by CDA(Navy), corrigendum Pension Payment Order (if admissible) notifying Special Family Pension is issued by that office to Pension Disbursing Authority under instruction to Integrated Headquarters, Ministry of Defence(Navy) and the widow.

1611. Post Retirement Marriage. Government have decided to extend the benefit of Family Pension Scheme 1964 to post retirement spouses/children born after retirement of pensioners. Arrears of family pension are payable w.e.f. 22 Sep 77. Life time arrears wherever admissible would also be payable to their family members/heirs where spouses eligible for family pension were alive on the date of eligibility and who died subsequently for the period from the date of eligibility to the date of death. Application for Life Time Arrears should be supported by death certificate and proof of relationship.

1612. Pensioners who marry after retirement should apply for endorsement of Ordinary Family Pension entitlements in their PPO’s to Directorate of Pay and Allowances, NHQ on a prescribed form available from them. Registration details of the marriage will be required along with the application. In case the marriage is not registered an affidavit sworn before a Ist class magistrate may be submitted.

1613 Liberalised Special Family Pension. On receipt of application forms from the widow/other eligible Next of Kin, Pension Payment Order notifying Liberalised Special Family Pension will be issued by the CDA(N) for authorisation of payment through the Bankers/Pension Disbursing Authority, as desired by the widow/next of kin.

1614. When Death Occurs After Retirement. In the unfortunate event of death after retirement, the widow is advised to immediately inform Integrated Headquarters/DESA. A copy of the death certificate may also be forwarded. Action for sanction of Ordinary Family Pension be initiated as under:-

a) Officers who have Retired on or after Jan 77. The Ordinary Family Pension admissible to the widow is notified in the Pension Payment Orders sanctioning the officer’s retiring pension. In such cases, the widow may immediately, contact the Pension Disbursing Authority through whom the officer was drawing his retiring pension. She will be permitted to draw the family pension on production of the death certificate and submitted the application in the form given at Appendix ‘W’.

b) Officers Retired Prior to 1976. Provisions have been made for notification of family pension during the life time of the pensioner. In this regard, application as per Appendix ‘X’ is to be completed and forwarded to Controller of Defence Accounts (Pensions), Allahabad through Pension Disbursing Authority for notification of the family pension. If this action has already been completed, in that case, the procedure given at para 1609(a) above will be applicable.

c) In case of pre 76 retirees where action as explained at (b) above, could not be completed, the widow is advised to write to NHQ/DPA indicating the date of death and enclosing the death certificate. On receipt of the above information, NHQ will forward the application forms to widow for completion and submission to CDA(Pension), Allahabad who was the Pension Sanctioning Authority prior to 01 Nov 85, under intimation Integrated Headquarters, Ministry of Defence(Navy) . If feasible the widow may avail help and guidance from the nearest Naval Establishment in this regard. A specimen application form for family pension si given at Appendix ‘Y’.

1615. For your convenience illustrations showing detailed working out of the Ordinary Family Pension, Special Family Pension and Liberalised Special Family Pension are given at Appendices ‘Z’ ‘AA’ and ‘AB’ respectively.

C H A P T E R – XVII

DEATH/FAMILY GRATUITY AND EX-GRATIA GRANT

1701. Death Gratuity.

When death takes place whilst in service, the Death gratuity will be admissible as follows:-

Length of qualifying Service Rate of Death Gratuity

(i) Less than one year : 2 times

(ii) One year or more but : 6 times of reckonable emoluments

less than 5 years

(iii) Five years or more but : 12 times

less than 20 years

(iv) 20 years or more : Equal to half of reckonable emoluments for each completed six monthly period of qualifying service, subject to a minimum of 12 times and maximum of 33 times pay provided that the amount shall in no case exceed to Rs.3.5 lakhs.

1702. Family Gratuity. In addition to Death Gratuity Family Gratuity is also admissible when death takes place in the following special circumstances:-

(a) If killed in action or dies from wounds sustained in action.

(b) If killed otherwise than through his own serious negligence or misconduct whilst on flying duty or parachute jumping duties in an aircraft or while being carried on duty in an aircraft under proper authority, or dies of injuries sustained in such circumstances.

(c) Dies otherwise than through his own serious negligence or misconduct, of a cause attributable to circumstances which in the opinion of the local administrative authorities are similar to those encountered in field service or in operation for officers employed on the work of disposal or demolition, burning, burial, breakdown or dumping of serviceable stocks of explosive is deemed to be in field or operational service for the purpose.

(d) Suffers a violent death while employed in aid of civil power.

(e) Suffers death on diving duty.

(f) Dies whilst on duty in submarine.

(g) Dies whilst laying or clearing land or sea mines.

Ex-Gratia Grant

1704. Flying Accident to a Service Aircraft. Families of individuals who die while on flying duty or when they are carried on duty in service aircraft or travel in it as passengers in the course of performance of their official duties (excluding those who travel on leave), are given an ex-gratia payment at the uniform rate of Rs.1 lakh, in addition to other special family pensionery wards. The made of payment of ex-gratia award is as under:-

(a) Where the Deceased is survived Either by Widow/Children or Parents.

Cash Payment In Fixed Deposit in Any

Nationalised Bank for 63 months.

(*This amount will normally be kept in fixed deposit unless specially authorised to be paid in cash).

1705. Procedure for Payment of Gratuity. The procedure is same as for Retirement Gratuity. Please see Article 0406. Deposit Linked Insurance Scheme of DSOP Fund.

1706. In the event of death after five years’ service the next of kin eligible to receive the credit balance in DSOP fund will be sanctioned an additional amount equal to the average balance in the Fund account during last three years preceding the death subject to:-

(a) A maximum ceiling of Rs.30000/- and;

(b) Provided the balance in the Fund account has not fallen below Rs.12000/- at any time during these three years.

CHAPTER XVIII

Financial Benefits to Next of Kin

1801. Keeping in view the socio -economic needs of the day and to alleviate distress amongst the widow/next of kin or other dependents, we have various welfare funds from which a financial assistance is automatically given or could be sought when needed. The funds are as follows-

a) Indian Naval Benevolent Association Fund.

b) Naval Group Insurance Fund.

c) Bengal Masonic Inter Services Charitable Trust.

d) Special Amalgamated Fund.

e) Naval Wives Welfare Association.

The extent of assistance available and the procedures for seeking this assistance is high lighted in the succeeding paragraphs.

1802. Indian Naval Benevolent Association(INBA). The details of major assistance available from INBA have been discussed in article 1005 to 1009 in chapter X. In addition, the event of unfortunate demise of an officer, the NOK are entitled for the following grant-in-aid:-

(a) Death whilst in Service

i) If married Rs 15,000/-

ii) If unmarried Rs 10,000/-

(b) Death as a Pensioner Rs.10,000/-

1803. Assistance for Economic Self Reliance. The resources of the Association being limited, it is not feasible to render perpetual financial assistance. The Association prefers one time financial help to the extent possible upto Rs 5000/- for starting some small economic venture to enable the officer to become economically self reliant. Pensioners are required to furnish the following particulars to the Secretary, IN Benevolent Association through the nearest Secretary/ Zilla Sainik Welfare Officer of the District for considering their proposal.

Naval Group Insurance Fund (NGIF).

1804. Death Benefits. These are payable automatically by the Secretary, NGIF, Integrated Headquarters, Ministry of Defence(Navy) on receipt of information after obtaining a pre-receipt from the nominee. If the amount is not received within 2 months, Secretary, NGIF should be informed. The benefits are as follows:-

(a) Whilst in Service

(i) Sum assured under the General Insurance Scheme 1985 - Rs 3.6 lakh – Term of cover enhanced to 25 years after retirement or upto attainment of 72 years of age whichever is earlier.

(ii) Accumulation of closed Scheme - Depends on period of participation and interest earned.

(iii) Sum assured under Addl Group Insurance

Scheme for Aviation and submarines,

if covered under any of these schemes. – Rs 2 lakhs in addition to the amount at (I) above

(b) After retirement. Members covered under Post Retirement Death Insurance Extension Scheme(PRDIES) are issued with Insurance certificate indicating period and amount of Insurance cover. In case of death during this period, sum assured is paid on submission of the following certificates to Secretary, NGIF

(i) Death Certificate

ii) Insurance Certificate

iii) Affidavit as per specimen supplied with Insurance certificate

iv) Pre-Receipt from the nominee

1805. Bengal Masonic Association Inter-Services Charitable Trust. The Bengal Masonic Association Inter-Services Charitable Trust was constituted on 25 Feb 72 with the approval of Ministry of Defence for giving educational grants to the sons and daughters of deceased/disabled officers/JCOs and OR’s who die whilst in service. The office of the Trust is located in South Block. C/o AG’s Branch. CW Dte, Army HQrs, New Delhi-110011. The Scholarships are awarded to the children for pursuing studies from class VI till graduation provided Guardians income from all sources does not exceed Rs.9000/- per annum. Then scholarship includes expenditures on tuition fee, boarding/lodging, cost of books/stationary and expenditure on uniform subject to a maximum of Rs.1800/- to a boarder and Rs.1,200/- to a day scholar. Payment is made direct to the principle of School/College. Applications on prescribed form (specimen at Appendix ‘AC’) duly recommended by Zila Sainik Board/Record Office are required to be forwarded to the Directorate of Ex-Servicemen Affairs, Integrated Headquarters, Ministry of Defence(Navy) , Sena Bhawan, New Delhi.110011 in case of officers’ children. These applications are then forwarded for consideration by a Board of Trustee which meets twice in June and December every year. Applications should be forwarded as early as possible.

1806. Amalgamated Special Fund. The fund is administered by Kendriya Sainik Board. The grants can be obtained for the following:-

(a) Education of Children.

(b) Training for rehabilitation.

(c) For prolonged hospitalisation in deserving cases.

(d) For purchase of plot or house or towards construction or repair of houses not financed from any other normal source or any other schemes of the Central or State Government.

(e) For payment of interest on a loan taken from Bank for construction of a house or for self employment by way of subside not exceeding 50% of the amount of interest actually paid. Application for grant is to be submitted through Zila Sainik Board.

1807. Assistance by Navy Wives Welfare Association (NWWA). Navy Wives Welfare Association also render financial assistance to retired Naval Personnel and their families. Some of their present schemes are as follows:-

(a) Educational scholarships are granted based on priority as under:

(i) Priority.

First - Children of widows

Second - Children of handicapped

Third - Children of retired naval personnel under exceptional circumstances (on need cum-merit basis)

(ii) Rates of the Scholarships:

KG to class VIII - 2,000/- per year

Class IX to XII - 3,000/- per year

Higher Education – 4,000/- per year

(iii) Applications form is at Appendix ‘AD’

(b) Financial Assistance to the Destitute Naval Families. Grants to alleviate the financial distress to the naval widow is also sanctioned on merit of each case subject to availability of funds. Applications form is at Appendix ‘AE’.

How to Apply.

1808. Applications on prescribed forms duly completed and verified/certified correct are to be forwarded to the President, NWWA Central Office, Room No.1B, ‘A’ Block Hutments , Integrated Headquarters, Ministry of Defence(Navy), DHQ PO, New Delhi-110011. Separate forms are to be used for children studying in different schools/institutions for Educational Scholarship.

1809. Additional Assistance by Local Branches. While the Naval Wives Welfare Association (Central) officers assistance, as stated above, there are local branches of NWWA in all Naval Stations which also offer monetary assistance or help in kind. For this purpose individuals are advised to contact the local NWWA office bearer.

C H A P T E R – XIX

EMPLOYMENT ASSISTANCE – NEXT-OF-KIN

Employment.

1901. Priority Employment by Govt. The Govt provides employment to one dependent of serving persons dying in harness or priority basis in Group C or D post. The application form at Appendix ‘AF’ is to be filled up and forwarded to Director Ex Servicemen Affairs, Integrated Headquarters, Ministry of Defence(Navy).

1902. Employment by Ministry of Labour . Upto two dependents of peace time deceased/severely disabled ex-servicemen with over 50% disability attributable to military service are eligible for employment assistance under Priority II(a). The form of application is at Appendix ‘AG’ The form is available with all the Rajya/Zilla Sainik Boards. The form duly completed and certified may be forwarded by Zilla Sainik Board to the Ex-Servicemen Cell of Ministry of Labour. The forms received direct from individuals are not accepted by the Cell.

1903. Employment in PSUs. Dependants of service personnel killed in action are also eligible for appointment against reserved group C and D posts in public sector undertakings and public sector banks vide Bureau of Public Enterprises OM No. 6(55)/79. DPE(GM-1) dated 13 Mar 80.

SELF EMPLOYMENT.

1904. Petroleum Product Agencies. 7.5% quota of agencies for LPG. Petrol Pumps (officers) have been reserved for disabled ex-service officers, widows of ex-service officers dying in harness or on military duty in peace time and death being attributable to military service and extremely deserving ex-service officers. The eligible candidates have to apply to the Oil Company when the Company advertises. The copy of application is to be endorsed to DGR for recommendation and certificates.

1905. SEMFEX-I. Under this scheme for self-employment of ex-servicemen, loan upto Rs.50000/- without promoter’s contribution is available for ex-servicemen and widows of ex-servicemen from Industrial Development Bank of India for self employment ventures of small scale industries, transports etc. The application form and details are available with Rajya/Zila Sainik Boards and is to be forwarded to DGR through them. Amount of loan is limited to Rs. 12 lakhs.

1906. SEMFEX-II. The Self-employment scheme for ex-servicemen, SEMFEX-II provides soft loan to ex-servicemen for development of cottage industries in farm and in non-farm sector (deserving cases only) in rural areas. No promoter’s and in non-farm sector (deserving cases only) in rural areas. No promoter’s contribution is required for loan upto Rs.30,000/-. There is no limit for loan for farm sector. Amount of l,oan is limited to Rs. 5 lakhs for non-farm sector. The application form is available with Zila Sainik Board and is to be forwarded through them.

1907. Jai Jawan Stalls and Milk Booths. Kiosks and Milk Booth are allotted on priority basis to widows of defence personnel and disabled ex-servicemen. The allotment is looked after by Rajya Sainik Boards.

1908. Transport Permits. Some of the States allot road permits for transport to widows and ex-servicemen on ‘Priority Basis’.

C H A PT E R – XX

TRAVEL ENTITLEMENTS – NEXT-OF-KIN

Eligibility.

2001. Families of those officers. who die in harness are entitled to conveyance to home town/selected place of residence as per the permanent transfer entitlement of the deceased by TRAIN ONLY. These entitlements include:-

(a) Railway Fare by entitled class

(b) Daily Allowance for the journey

(c) Transfer Grant

(d) Transportation of baggage (Married – 6000 Kg. & Unmarried 2000Kg)

(e) Packing Allowance

2002. The family would include the widow, children and dependent parents/brothers/sisters of the deceased.

Traveling to a Place Other Than Home Station.

2003. To Selected Place of Residence (SPR). When the family wishes to settle down permanently at a place other than the normal place of residence i.e. permanent home station of the deceased, travel expenses may be allowed by the shortest route from the last duty station to such selected place of residence.

2004. To a Place Other than SPR. When the family wishes to proceed from the last duty station to a place other than SPR, the Traveling Expenses Claims will be LIMITED to those admissible for travel from the last duty station to SPR as in article 2003 above.

2005. To SPR from Place Other than the Last duty Station. The entitlement remains same as in article 2004.

2006. Submission of Claims. All claims concerning the above moves are to be preferred on the Performa placed at Appendix ‘AH’ and forwarded to the last Commanding Officer of the Ship/Establishment or the NHQ(DPA) for countersignatures and onward transmission to CDA(N) Mumbai for authorisation of payment. The payment will be made through bankers, and it is therefore advised that full address of the bank and account number be clearly indicated on the claim form.

C H A P T E R – XXI

CONCESSIONS – NEXT-OF-KIN

Education.

2101. Children of Battle Casualties. The children of battle casualties/disabled during 1962, 1965, 1971 war; and IPKF/ Meghdoot Operations is Sri Lanka and Siachin are given following concessions by Central Government:-

(a) Complete exemption from tuition and other fees levied b y the educational institutions concerned (including charges levied for the4 school bus maintain by the school and actual fares paid from railway pass for students or bus fares certified by the Head of Institution):

(b) Grants to meet hostel charges in full for those studying in boarding schools and colleges;

(c) Full cost of books and stationery; and

(d) Full cost of uniform, where this is compulsory

2102. Min of Def. Scholarships for Children of Officers Killed or Disabled in Action or in Aid of Civil Power. A number of scholarships are sanctioned by the Ministry of Defence for Study at Lawrence/Military/ Sainik and other recognised public schools and provide for :-

(a) Complete exemption from tuition, boarding and other fees levied by the institution concerned.

(b) Full cost of books and stationary; and

(c) Full cost of uniform, where this is compulsory

2103. Reservation in Medical College by Central Government. 28 seats in MBBS and one seat in BDS and 2 seats in Engineering college at Annamalai university are reserved for wives/widows/wards of deceased/disabled/serving and ex-service personnel in Medical and Dental Colleges. They get admission as Govt of India nominees. The application is to be forwarded to Kendriya Sainik Board, on a prescribed form which can be obtained at any time after 15 April every year from the respective Rajya/Zila Sainik Boards. The form has to reach Kendriya Sainik Board by 30 June unless otherwise notified. Two seats in all six IITs are reserved for children of Defence personnel killed or permanently disabled in action subject to qualifying in JEE.

2104. Concession by State Govt /Union Territories. Education being state subject each state has its own rules in respect of ex-service3men and their wards. Some of the concessions are as follows:-

(a) Exemption from Payment of Tuition Fees. Payment of Scholarship depends on the income of the family.

(b) Reservation of Seats. Each state has its own rule in respect of educational concession. For detailed information Zila Sainik Board/Rajya Sainik Board concerned is to be contacted. The reservation is generally in the following institutions:-

(i) Medical and Dental College.

(ii) Engineering and Polytechnic Colleges

(iii) ITIs

(iv) B.Ed. Training Colleges

(v) Veterinary and Agricultural Colleges

TRAVEL CONCESSION.

2105. Concession by Railways. The Railways have granted 75% concession in rail fare by Second Class for war widows with effect from 01 Apr 87.

2106. Concession by Indian Airlines. Fifty percent concession in fare is permitted by Air Lines for war widows.

HOUSING.

2108. Air Force Naval Housing Board (AFNHB). Widows can join AFNHB schemes subject to the following eligibility criteria:

(a) Widow of a personnel who dies in service should have applied for registration in any of AFNHB schemes within 5 years of her becoming widow or one year of launching of schemes in her or her husband’s state.

(b) Widow of a retired personnel who dies within five years of his retirement and is in receipt of pension will also be eligible to register her name. This eligibility will be valid for a maximum period of one year after death of her husband or one year from the date of launching of any scheme whichever is earlier.

Priority is given to widows for allotment of flats. Further details may be obtained from Director General, Air Force Naval Housing Board, Air Force Station Race Course, New Delhi-110003.

2109. State Govt/Union Territories. Certain percentage of residential plots and houses are reserved for ex-servicemen/next of kin. The detail may be obtained from Rajya/Zilla Sainik Board.

CHAPTER – XXII

TAX-SAVING CUM INVESTMENT PLANNING

2201. This chapter attempts to guide the retiring officers/their Next of Kin on how to invest large sums of money received by them and consequently reduce the Income Tax Liabilities.

The Basic Principles.

2202. Prior to making any investment the following aspects need consideration :-

a) Security of the Investment. Safety of the investment is the most important aspect of the investment keeping in view the fact that in most cases the amounts received at the time of retirement would form a major part of one’s saving.

b) Good Returns. Good rate of interest and its liability in Income Tax should be considered to ensure that the investment derives good returns.

c) Easy Liquidity. It is extremely important to consider one’s family/other commitments like children education, their marriages etc before committing on any investments, as during the lock-in period of their investment any pre-mature withdrawals may not fetch the same returns.

d) Nomination. It is advisable that the investment, as far as possible should always be made in the joint name where nomination is not permitted to avoid unnecessary legal disputes in the event of unfortunate demise of the investor.

Schemes of Investment.

2203. Considering the above basic principles the various schemes promoted by the Government or Government run agencies appear to be the safest. A variety of such schemes are floated from time to time and given wide publicity in the media. It is advisable to collect information on schemes in vogue at a particular time and then carefully plan out an investment to ensure security, liquidity and reasonable return according to individual preferences.

(i) Impressions for dentures will not be taken within a period of three months from the date of the final extraction and in no case will they be taken, even though three months may have elapsed until the dental officer is satisfied that absorption is sufficiently complete for permanent dentures to be supplied.

(ii) All necessary adjustments or alterations of dentures (except breakages)

within six months after completion will be made by a Dental Centre without additional charges.

(iii) No charges will be made for placing a third molar (wisdom tooth) on any denture.

(iv) The charges for denture will be based on the number of tooth actually and necessarily supplied on the denture.

Examples Showing Calculation of Entitlement of Family Pension

Ordinary Family Pension

Mrs Sapna Singh W/O Late Lt Cdr Bahadur Singh

1. Lt Cdr Bahadur Singh died due to heart failure on 24 Sep 87, while on leave. His death was considerd as neither attributable to not aggravated by Naval Service by the Ministry of Defence. His widow was then entitled to ordinary family pension only, which has been sanctioned by the CDA(N) Pension Cell, Mumbai as per rates given at Para 3 below.

2. Service Particulars of the Late Officer are as follows:-

4. Basis of sanction of Ordinary Family Pension: Ordinary family pension of Rs.645/- has been worked out on the basis of 15% of reckonable emoluments of Rs.4300/- as shown at Para 2 above. However, since the Officer had served more than 7 years of qualifying service, his widow is entitled to enhanced ordinary family pension of Rs.1290/- p.m. i.e. twice the normal rate of ordinary pension, for a period of 7 years from 25.9.87. (The date following the death of the officer) or up to the date on which the deceased would have attained the age of 65 years, had he been alive or up to the date of widow re-marriage or death, whichever is earlier. The amount of enhanced ordinary family pension for this period is the lowest of the following amounts.

(a) Rs.2460/- per month i.e. 60% of reckonable emolument of Rs 4100/- (please see para 1(e) from 03 Aug 86 to 23.10.2010 i.e. children attain the age of 25 years and,

(b) Rs.1230/- per month i.e. 30% of reckonable emolument from 24.10.2010 till death or re-marriage whichever is earlier.

4. In case the widow dies or re-marries the children will be entitled to Special Family Pension at the rates given at para 3(b) above during the time they are eligible, i.e. up to the age of 25 years in the case of sons and un-married daughters, provided that the eligibility could cease from the date of marriage of the daughter or if the son or daughter starts earning his or her livelihood before attaining the age of 25 years. However, physically or mentally handicapped child who is unable to earn a livelihood could be sanctioned the family pension for life.

EXAMPLE OF ENTITLEMENT OF LIBERALISED SPECIAL

FAMILY PENSION

4. Duration of Eligibility until death or disqualification.

5. If the officer had not been survived by widow but survived by children : All children together shall be eligible for family pension at the following rates, which is payable to the senior most child at a time :- Rs. 1260/- p.m. ie. 30% of Rs. 4200/-.

6. Children allowance: In addition to the special family pension, children allowance @ Rs 150/- p.m. per child will be admissible.

Entitlement of the Widow on Re-marriage.

7. On re-marriage with the real brother of her deceased husband. Same as given at para 3 above, if the widow’s re-marriage takes place with the real brother of her deceased husband and she co tinues to live a communal life with and/or contributes to the support of okther living eligible heirs.

8. If married to anyn other than the real brother of her dfeceased husband. She will forfeit her right to the Liberalised Special Family Pension, but will be given Ordinary Family Pension of Rs. 630/- p.m. i.e. 15% Rs 4200/- given at para 2 above.

1. In case of Peace time deceased/serverely disabled solder, this certificate should be given only after Part F of the form has been certified by Record oOffice and dependant is found eligible for employment assistance under priority II(a).

2. Upto two dependants are only eligible for emplooyment asistance under priority II(a).

3. Dependants of only thos disabled ex-servicemen are eligible for employment assistance under priority II(a) who were severely disabled with over 50% disability attributable to military service and declar3ed unfit for civil employment by the medical board.
