      Per our discussion this afternoon I )have attached both my initial contract which was submitted in October with payment (check 6333 and the letter from Patrick Lyons (dated February 16) in which he notes the submission of my contract and the remaining full payment in January.  Over the last five months each time I questioned why my checks had not been processed my emails were never answered but when I talked personally to Mr. Lyons, I was assured that there was no problem with my slip and that New York had the checks but had not processed them. In February after seeking explanation as to why the checks were still not cashed I was told that the accounting office had informed Mr. Lyons that they had deposited the checks but that the  bank had "misplaced them".  I found that incredible and suggested that I stop payment on the checks and provide a credit card for payment. Mr. Lyons took my credit card information and stated that he could not process it but would forward it to the accounting office and it would be processed within a week. A month has passed and on the new statement I find the credit card account has not been charged.

     Today (March 26) in seeking explanation I am told Mr. Lyon's is no longer employed and that it is difficult to check records with the option to check back next week as no one is in the main office and will not  be for a week. Attached please find a copy of my initial contract with first payment check number noted for the summer of 2010. You will additionally find a copy of the letter provided by Mr. Lyons noting my contract submission and payments as well as the new charges to the credit card. I have been a patron of Shipyard for twenty years and have had paid for the full 60 feet  of my present slip for seven years for the past seven years period.

     In spite on monthly assurance that I had been assigned my slip and that paperwork and payments had been forwarded it now appears clear that the checks and credit card information was never provided my Mr. Lyon's to the Main office.  I wish to resolve this matter promptly.

Subject: Slip charges have not been processed

In reference to discussions regarding the marina accounting

office failure to process my payments. While it was odd that the

accounting office noted receipt of and stated to have deposited my two

payments they were never cashed at the bank. It is even more peculiar

that I provided credit card information for payment a month ago and

that has not been processed. Please contact me on Monday at 617 470

            When I came by the office in January you confirmed that I had been assigned the slip noted in my summer contract, which is the slip I have had for fifteen years, and that all the administrative processes had been taken care assigning the slip(s) again to me. At that time I mentioned that I was concerned that my initial deposit still had not been cashed. You will recall that I had initially brought this to the marina’s attention previously in the late fall. At that time you had confirmed that it was received and forwarded. You were going to check on this for me but I have not heard back regarding the situation. I continue to see that my initial deposit is still not cashed and that my final payment, what was submitted in January, also has not been cashed.

            I would appreciate your checking into this for me again as I find it odd that checks would not be deposited by an accounting office. I would appreciate it if you would please acknowledge (1) receipt of both payments and (2) to avoid any unnecessary confusion as the season approaches confirm the specific assignment of my slip(s).

            I plan to bring my new boat up from Maryland, where she was purchased, in May and am looking forward to the summer.
