Disposition Policy

06. Disposition Policy

Upon consent from various departments within the city, the city has the authorization to dispose of equipment, land, property, etc., in the following manner:

1) Any property that is valuated under $1,000 according to NADA or Blue Book, will be disposed upon recommendation of the city manager and authorization of the mayor.

2) The city will place two consecutive Class II legal advertisements in the Hurricane Breeze notifying the public of the date, time, and place of the auction. Also, contact information will be provided to request information about the items to be auctioned.

3) The city will place estimated values on the items determined by NADA, Blue Book, or WV surplus property. These values will be released upon contacting the city for information on the items for sale.

4) Bidding will occur on each item presented by the city. The highest, acceptable bid will be received by the city. Once payment is received by the city, this is a binding contract between the city and the buyer. For vehicles, titles will be provided to the buyer at the time of the purchase. All sales are final upon completing the purchase transaction(s).

5) Once the auction has closed and there are remaining items not purchased, the city has the option to initiate another auction at a future date, submit the item(s) to WV Surplus Property for sale, or dispose of the item to the local trash collection agency or salvage yard.

6) All sales are not final until the purchaser has been verified to not owing any restitution to the city for various fees such as water, sewer, stormwater, police citations, municipal court fees, or other fees.

7) Payment will be received in the form of cash, money order, and/or cashier’s check.
