31. Special instructions:

a) The work(s) of the lot(s) may be dropped, decreased or increased as per field condition/design/budget allocation for which no claim shall be entertained.

b) Work order will be issued only after approval from the competent authority.

c) Volume of item(s) of work may be increased or decreased or any item(s) may be omitted or added during execution of the work and the payment will be made as per actual executed item(s)/quantities of work at the accepted rate(s). In such case, no extra claim will be entertained.

d) Tender Security (Earnest money) to be submitted in the form of Demand Draft (DD) or Pay Order (PO) from any schedule bank payable at Kushtia town branch in favour of Deputy Director, Regional Accounting Centre (DD, RAC), BWDB, Kushtia or an irrevocable bank guarantee issued by a scheduled Bank of Bangladesh in favour of Executive Engineer, Amla W.D. Division, BWDB, Amla, Kushtia (In case of Pay Order it must be issued from Kushtia).

e) If any confusion arises due to printing mistake in STD (PW2/ PW3) then “The Public Procurement Regulations 2008” will be govern.

f) The procuring entity reserves the right to shift the location of work(s) as per field condition.

g) Payment will be made as per availability of fund. No clam in this regard will be entertained.

h) If the tenderer submits any false /incorrect or fraud certificate, the tender will be outright rejected and action as per PPR-2008 will be initiated

i) The Procuring Entity will issue Notification of Award (NOA) to the successful Tenderer after assurances of Budget allocation.

j) Copies of the certificates and other requisite papers (VAT, TIN certificate and Affidavit certificate for Corporate Joint Venture firm, in addition each in separate) attested by any 1st class officer of Govt./Semi-Govt. organization / Autonomous bodies or by a Notary public would be acceptable subject to verification with the original ones. For attestation, seal with name of the attesting officer is to be stamped below the signature.

k) The contractor will have to arrange the land at his own cost for stacking the materials including all other temporary works.

l) All certificates and other relevant papers submitted with the Tender document(s) must be marked by serial numbers.

m) Tender to be submitted in two copies (Original & Duplicate) and 2 (two) additional sets of BOQ need to be submitted.

n) Item wise tender modification can be done as per Board’s Circular no: CPC-51/04 dated 06/07/2010.

o) Other agency/agencies of the Govt. will have the authority to supervise the work for both quality and quantity in addition to BWDB officials.

p) Due to unavoidable circumstances if the tender cannot be received in the schedule date, the tender will be received and opened on the next working day in due time.

q) The procurement entity reserves the right to accept or reject any or all the tenders without assigning any reason.
