If alarm sounds and YOU have no fire, get out of the building: USE FIRE EXITS.To control a grease fire in oven or other electrical appliances: SHUT OFF THE ELECTRICAL CIRCUIT BREAKERS, then smother fire.TO ALL UNIT OWNERS, LESSEES AND GUESTSThe attached Rules and Regulations are hereby adopted by the Naples Continental Club, Inc., a private residential condominium, and will become effective immediately.Please be aware that it is our intention to strictly enforce these Rules and Regulations.It is our urgent hope that these Rules and Regulations will be received in the spirit of respect of all owners rights and enjoyment and that there will be no need for disciplinary action. NO EXCEPTIONS, please.In case of an emergency it could be helpful if the following information was on file in the Managers office:The resident’s doctorThe person or relative to be notified in the event of any emergencyThe owner’s insurance agent, address and telephone numberSubmission of such information is optional and will be strictly confidential in the owner’s file in a locked cabinet in the office. It will be used only to be helpful in case of an emergency.“A” Box - Each owner will furnish the Manager with a duplicate key to his or her unit. These keys will be kept in a locked cabinet in the manager’s office. Only he/she or a member of the security staff will have keys to the cabinet. These duplicate keys are to be used only to make essential maintenance inspections or repair common elements or to prevent damage to other units. They are not to be used for admission of relatives, guest or tradesmen nor to deliver packages, mail, furniture or any other material for your private residence. “B” Box - A second locked key cabinet is available at the security desk for the convenience of owners who wish to have duplicate keys available. These keys are the responsibility of the owner, not the Naples Continental Club, and will be given to persons who present some evidence that such is the owner’s wish. Authorization must be in writing and given to security prior to arrival to allow vendors/guests access to “B Box” keys. Owners, not the Manager, are expected to check for their return and their continued availability. Each owner shall at all times have a completed NCC-1 Long Term Authorization Form on file in the Club office.Whenever a unit is to be occupied by guest in the absence of the owner, Form NCC-2b must be sent beforehand to the Manager, listing names and length of stay. Limit 6 persons (including babies) in a 2 bedroom unit. Limit 8 persons (including babies) in a 3 bedroom unit. They are also to be provided with any essential .. building or unit entry keys by the owner. B Box key will be provided for entry only and must be returned to security after checkin.No unit owner or occupant shall place or store or maintain objects of any kind in the hallways, stairways, walkways, grounds or other common elements. Unit entrance may be decorated (with Board Approval) in such a manner that no safety hazard is created.Occupants are not permitted to run or play in stairways, halls, balconies, lobbies, elevators, parking areas or other common elements.Disorderly or rowdy conduct of any kind is prohibited and is grounds for ejection by authorized personnel.Persons in public areas must be properly attired. This means footwear and proper covering in the lobby, hallways, elevators-in fact, in all common areas of the building.No food or beverage shall be consumed in the Game Room, hallways, lobbies, elevators or other common areas of the building, except in designated courtyard areas of the pool, International Room and Continental Room.Outdoor cooking is permitted only on the gas grills in the pool courtyard area. Clean after use.Fireworks are prohibited on the premises.Luggage racks and grocery carts are available in the Game Room. They must be returned promptly after use.Registered mail addressed to individual owners, lessees or guests WILL NOT BE ACCEPTED by the Continental Club or its employees.Under no circumstances shall electrical repairs or alterations be undertaken in common areas other than by persons authorized by the manager.All matters regarding the holding or forwarding of mail must be taken up with the United States Post Office.Small and medium sized parcels will be accepted at the security desk and will be stored in the mail room. No responsibility will be accepted on behalf of the Club or its employees.No “For Sale”, “Rent”, “Lease”, “Open House” signs may be posted on condominium units or the property, including cars. Any media listings for sale or rental of Naples Continental Club units will state “By Appointment Only”.The Florida clean Indoor Air Act prohibits smoking in enclosed common areas in a condominium. Common areas mean any hallway, lobby, restrooms, stairwell, entryway, conference rooms or Party room.PARKING AND AUTOMOBILESAn assigned parking space is for the exclusive use of owner to whom it is assigned and may not be occupied or used by others except with the permission of the owner to whom it is assigned.Each tenant shall park in the space belonging to the unit owner.Cars must be parked heading in, centered between the painted stripes and against the numbered bumper. They should not protrude beyond the spaces in such manner as to block the ingress and egress of others. Under special written approval, cars may be backed into parking spaces.There shall be NO parking at any time underneath the canopy in front of the building, or in front of the two side entrances. These areas are reserved for purposes of loading and unloading and discharging and picking up passengers.Posted stop signs and speed limits of 10 miles per hour in the driveways are to be observed. Yellow traffic directional arrows are to be observed.Excessive noise, loud talking, slamming of car doors, racing of engines and use of horns should be avoided in the parking areas.Any infraction of parking rules should be reported to the Manager. If such violation continues after notice, appropriate action will be taken.Parking of motor homes, trailers, buses, boats and company commercial trucks/cars with lettering in the condominium parking lot is prohibited overnight.ELEVATORSState law prohibits smoking in the elevators, as well in all covered common areas.The lobby elevator is not to be used for moving or transporting large items.Elevator #3 is used for moving in or out and must be properly padded. See MOVING, Section XVII, item 1.BALCONY AREASChanging paint color on the walls and ceilings of balconies/lanais will not be approved.Installation of storm shutters, storm windows, screening, lattice-work and the like must be approved by the Board of Directors.No rugs, garments or other objects shall be dusted, shaken or hung from the balconies or cleaned by beating or sweeping in any hallways or exterior part of the building.Nothing shall be hung from the balcony railings. Such prohibition shall include, but not be limited to, bathing suits, towels, beach mats and mops.NOTHING shall be thrown or dropped from balconies.Watering of plants, sweeping and mopping of balconies shall be done so as not to bother persons residing in lower or adjacent units or common areas.Waterproof containers shall be placed under all flower pots.Hosing balconies screens is prohibited.Inflated rafts, cushions, sailing gear, etc. are to be stored inside units or other approved storage areas-not on balconies.REFUSE DISPOSALThe trash chutes should not be used before 8am or after 9pm .All trash or refuse shall be securely wrapped and placed in a plastic bag before putting in the trash chute.All bottles or breakable items are to be hand carried to the dumpster room on the ground floor. This is necessary for your safety.All other waste material and refuse not disposable in the individual units shall be paper wrapped in small bundles or put in plastic bags before placement in the trash chutes or dumpsters.No highly flammable material shall be kept in any storage area, nor lighted smoking materials be thrown down the chutes along the hallways, or put in the dumpster.LOCKERS AND STORAGENothing of volatile or odorous nature shall be placed in or stored in any lockers or storage rooms, or put in the dumpster.Lockers and other storage areas and the safeguard thereof are the full responsibility of the owner. The Club will not be responsible for loss or damage to any property therein due to theft, wind, flood, fire, mysterious disappearance or any other cause whatsoever.Any storage lockers obscuring an electrical breaker panel are to be reported to the Manager immediately and a key provided to the Manager for entry to that area.SECURITY – Telephone 239-261-3805Security guards are on duty 7 days a week. They report only to the Manager and keep an hourly log of surveillance and safety.The security guards prevent unauthorized persons from entering the building or grounds and remind occupants if they are violating house Rules and Regulations.The security guard should be notified immediately of any emergency.Security guards are for security and are not permitted to perform personal services for occupants. They are NOT doormen. They WILL be away from the lobby desk, making their patrols as required by the Manager, at designated intervals for your safety.All trades people and the like are to sign the Vendor’s registration book at the desk upon entering and leaving the building.Residents, owners and realtors shall not give building entry keys to trades people, day workers or other persons seeking casual or occasional entry.THE OWNER OR OCCUPANT RESPONSIBLE FOR VIOLATING THIS RULE SHALL BE CHARGED FOR THE COST OF INSTALLING NEW TUMBLERS IN THE LOCKS OF ENTRY DOORS AND MAKING OF NEW KEYS FOR ALL BUILDING OWNERS.Each occupant is responsible for locking all doors which should be locked and for observing security regulations.Law enforcement or emergency medical service personnel shall be directed to the Manager by the security guards, or to a member of the Board of Directors if the Manager is not available.No unlisted telephone numbers are to be given out by anyone.Anyone of a suspicious nature is to be reported to the manager or security guards immediately.Occupants must agree to observe the established security system or the entire premises will be endangered with some unfortunate owner paying the penalty. Entry is by KEY ONLY.QUIET HOURSIn respect for neighbors and other occupants, residents should refrain from making noise audible outside the unit or in the common areas before 8 A.M. and after 10 P.M. Residents should exercise care at all times when making noise that may disturb other occupants. This applies especially to the use of musical instruments, radios, televisions and amplifiers.Occupants should notify the security guard of noise disturbances.EXERCISE ROOM AND SHUFFLEBOARD COURTSExercise Room & Shuffleboard Court users must register at the security desk and check out upon leaving. Ping Pong paddles, balls, pool cues, shuffleboard sticks and pucks are available at the security desk and are to be returned immediately after use.Children under sixteen (16) years of age are NOT permitted to use Exercise equipment. Children under twelve (12) years of age are NOT permitted to use the Game Room or Shuffleboard Courts without a parent or adult household member present.Players are to observe quiet hours on the Shuffleboard Courts from sundown to 9 A.M. dailyDamage to any recreational equipment will be charged to the offending unit owner.No food or beverage is allowed in the Game Room or on the Shuffleboard Courts.CONTINENTAL ROOM, INTERNATIONAL ROOM AND CHICKEEUse of the Continental Room, International Room and Chickee is for owners, lessees and guest only.The International Room is to be used for Club purposes only.Owners, lessees and guests must reserve the Chickee for private use by registering with the Manager twenty four (24) hours in advance.The Continental Room may be reserved by owners and lessees for a private party only by registration with the manager or office.Owners and lessees are required to post a deposit of $50 before using the Continental Room for any private party attended by a large number of outside guests. The cost of any damage repair or cleaning will be paid from this deposit and the balance, if any, will be refunded. In the event of extensive damage, the Manager will immediately bill the owner of the registered unit for the amount due to restore the room to its original condition.The same restrictions pertaining to Quiet Hours shall be observed in the use of these facilities.Reservation of the Continental Room may not be made more than sixty (60) days in advance. Any owner or lessee receiving permission will be responsible to see that ALL guests comply with ALL Rules & Regulations of the Naples Continental Club in ALL areas of the Club property.Owner and guest may use the Continental room to read, use computers, etc. Sign in and out at the front desk.COURTYARD AND POOL AREASPool hours are from 9 A.M. to DUSK. Persons with communicable diseases are prohibited from using the pool or saunas.Florida State Law REQUIRES THAT ALL PERSONS MUST SHOWER AT THE POOL SHOWER BEFORE ENTERING THE POOL. Incontinent persons must wear approved swim diapers.Children under 12 years of age are not permitted to use the pool or saunas at any time without a parent or adult household member being present.The Club will not be responsible for any accidents occurring in or near the pool area. Persons using the pool do so at their own risk.In the event of a storm or electrical disturbance the entire pool area is to be evacuated.NO running or shouting is allowed in the courtyard.Persons using oils or suntan lotions must use a towel when lying on a lounge. They must remove oil or lotion by a soap shower before entering the pool. Shoulder length or longer hair must be securely confined when using the pool.Food and beverages may be consumed only in the Chickee and at the tables in the patio section of the pool area.NO GLASS OR CHINA shall be brought into the courtyard or chickee. Use paper or plastic items.No surfboards, boogie boards, inflatable, pool toys, Frisbees, balls or scuba equipment are permitted in the courtyard or pool areas. No objects are to be thrown into the pool. No jumping or diving. Pool Noodles and baby floats/rings are permitted.Toys, bicycles, mobile toys or similar extraneous equipment are NOT permitted in the courtyard, parking lot or area walkways. Essential safety equipment or carriages may be used.Pets are NOT permitted in the courtyard at any time.Persons entering the building and elevators must be dry, free of sand, and be wearing bathing suit cover-ups and footwear. NO BARE FEET. ALL personal belongings must be removed from the chickee and courtyard areas.No pool area equipment or furniture may be reserved or removed from the pool area, nor placed on the grass or beach.During periods of high occupancy, non-resident and resident guests shall limit their use of pool lounge chairs to a maximum of 6 chairs for a 2 bedroom unit and a maximum of 8 chairs for a 3 bedroom unit.Residents wishing to entertain more than 8 guests in the pool, courtyard and Chickee areas must register such request with the Manager at least 24 hours in advance.No radios without ear phones are to be used in the courtyard.Persons using the stairs from the beach to the courtyard area are to hose the sand from their persons and other objects to prevent contaminating the area.All refuse must be placed in the plastic trash container located in the Chickee.Disorderly conduct of any kind in the courtyard is prohibited and is grounds for ejection from the area by authorized personnel.The Security Guards are instructed to strictly enforce the Rules and Regulations that apply to the courtyard area. For the safety and benefit of all, please cooperate with them.Safety Rope may not be removed, even for the purpose of doing laps. Required by County/State Law.BICYCLES, ROLLER AND BLADE SKATES AND SKATE BOARDSBicycles shall be parked or stored only in the areas designated for such purposes – never on balconies, hallways, foyers or fire lanes.The use of roller skates, roller blades or skate boards on the premises is prohibited except to access the street.PETSDogs and cats shall be carried or leashed at all times when on the premises. They are not permitted in the courtyard area, nor on the lawn or garden areas or in the lobby. They shall be walked in the street area. The exit for pets is by the side doors only.Lessees and house guests may NOT have pets.ROOF AREASRoof areas are off-limits to all owners, lessees, guests and visitors. Only the Manager and authorized service and maintenance personnel are permitted on the roof areas.SALEUnit owner (seller) shall notify the Board of Directors of a proposed sale by filling in and delivering Form NCC-6, or a copy of the sales contract, to the Board, along with payment of the Transfer Fee of $100. Such written notice shall be given to the Board at least 30 days prior to the scheduled transfer date. Notify NCC office of sale of unit and provide the $100 transfer fee and application.Seller shall ensure that form NCC-4 is filled in, requirements therein met, and the form returned by the purchasers to the Board of Directors for review and preparation of scheduling of a personal interview with the purchasers for membership approval pursuant to the guidelines set forth in the Declaration of Condominium.The Board of Directors shall have 20 days after receipt of all required transfer information and the interview of purchasers to approve or disapprove a membership applicant. Upon approval a Certificate of Approval will be issued and the seller shall provide the purchasers with his copies of all the condominium documents.Any application for sale of a carport must be presented, in writing, to the Board of Directors for approval. Such transfer may be only to the owner of a Naples Continental Club unit.LEASE OR GUEST OCCUPANCYNotice – Prior to the effective date of a lease or occupancy by owner’s guest when owner is not in residence, unit owner (Lessor) shall complete Form NCC-2A and return it to the Club office. Registration – Owner shall ensure that Form NCC-3B shall be completed by Lessees/Guests and returned to Club office.Rules – Owner shall provide a copy of the House Rules and Regulations of the club to Lessees/Guests.Pets - Lessees and guests are not permitted to have pets on the premises.Leasing term – No unit may be leased for a term of less than 30 days nor more than one year. No option for the lessee to extend or renew the lease for any additional period shall be permitted without the express written approval of the Board of Directors. No sub-leasing or assignment of lease rights is permitted. Guest occupancy Terms Owner in Residence – No restriction as to length of stay.Owner Absent – guests are permitted to occupy the unit in the absence of the owner. No restriction as to length of stay. The total number of occupants is limited to six (6) persons in a 2 bedroom unit, including babies, and eight (8) persons in a 3 bedroom unit, including babies.Guests shall have the same occupancy and use of rights as the owner of the unit.MOVINGThe lobby elevator may not be used for moving.Occupants must notify the Manager before moving furniture or household effects in or out of the building. The Manager will see that the elevator is properly padded, that the elevator is not unduly tied up, that cartons and rubbish are removed from the property and that moving vans are parked in such a manner so as to permit free access to parking spaces in that area.EMPLOYEESOccupants shall refrain from interrupting or in any way interfering with employees (Security Guards or Maintenance employees) during the performance of their duties. Report any violations in writing to the Manager.LAUNDRY ROOM FACILITIESLaundry room hours are from 8 A.M. to 10 P.M.Use cold water whenever possible.Dryer lint traps MUST be cleaned after each use.Please time your use of the machines so that they are available for your neighbor. Remove items promptly after use.Use machines at your own risk. NCC is not responsible for the damage to articles placed in machines or loss or theft of such articles.MAINTENANCE FEEMaintenance Fees are due and payable WITHOUT notice on January 1st, April 1st, July 1st and October 1st. Fees not paid 10 days after the due date will be subject to an 18% interest charge. Provide signed form with name of contractor and dates of work prior to work starting to authorize entry and access to B-box key if required. Permits need to be pulled for any renovation.Major renovations with considerable noise and disruption are restricted to May 1 – December 31, excepting Thanksgiving and Christmas holiday. Quiet work such as carpet and paint and emergency repair are allowed anytime. ................
