Terms and Conditions

TERMS AND CONDITIONS OF ENTRY FOR NATIONAL GEOGRAPHIC PARTNERS (Promoter) "The Experience Canada Photo Contest" (Prize Promotion)

By entering the Prize Promotion, all entrants are deemed to have accepted and agreed to the below terms and conditions.

Entrants

1. Entrants must be natural persons over the age of 18 and be resident or domiciled in the United Kingdom or a legal resident of one of the fifty (50) United States and the District of Columbia (entries submitted via third party agents, proxies, facilitators or under assumed names will not be eligible and will be disqualified).

2. Employees of the Promoter or any of their wholly-owned subsidiaries or any suppliers connected with the Prize Promotion or any members of those employees' families are not eligible to enter.

3. Entrants can enter the Prize Promotion only as specified in these terms and conditions.

4. The winner entrant may be required to provide the Promoter with proof of identity, in a form requested by Promoter in its sole discretion, before receipt of any prize. Failure to produce sufficient evidence as to identity may result in disqualification.

5. Failure to comply with any of these terms and conditions (including instructions) will disqualify any entrant from taking part in the Prize Promotion and the entry will be invalid. The Promoter retains sole discretion to refuse entrants the right to enter if it feels that these terms and conditions are not being complied with or for any valid and justifiable reason.

6. The Promoter reserves the right to amend these terms and conditions at any time in its absolute discretion.

Entries

7. To enter, entrants must have an Instagram account set to permit public viewing in order for the Prize Promoter to view/see the entrants' Submissions.

8. Entrants must upload their best, original images of Canada (the "Submission") to the entrants' Instagram account with the #ExperienceCanadaContest (the "Hashtag") during the Prize Promotion period. Only Submissions containing the Hashtag will be eligible for the Prize Draw.

9. Entrants agrees and acknowledges that by using the Hashtag in connection with your Instagram Submission the Prize Promoter has the right to stream the submission through the Instagram API or otherwise use the Submission as set forth in its Terms of Use located at

All entries must be received during the term of the Prize Promotion commencing at 12:00 pm EST /5:00 pm BST on 3 October 2016 and ending at 11:59 pm EST / 4:49 am BST on 31 October 2016 (Closing Date). Only one entry is allowed per natural person per Instagram account. The Promoter does not accept any responsibility for network, computer hardware or software failures of any kind that may restrict the sending or receipt of an entry. Any entry received after the Closing Date will be invalid.

11. Entrants represents and warrants that the Submission:

(a) is an original, previously unpublished work and does not feature or focus on any material owned or controlled by third parties (including without limitation, any third party copyrighted material);

(b) has all appropriate clearances, permissions and releases for the Submission to be entered and the aforementioned to be provided to the Prize Promoter upon request;

(c) is not (and does not include/contain any) obscene, pornographic, libellous or otherwise objectionable images/references; and

(d) does not and will not violate any applicable laws.

11. The entrants hereby agree to indemnify and hold the Promoter or any associate or group company harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.

Prize Promotion

12. No purchase is necessary for entry in the Prize Promotion.

13. Any entry made using another person's Instagram account or through other dishonest information will be disqualified.

14. The Winner will be announced through the Prize Promoter's NatGeoCreativeTeam Instagram account promptly once the selection process has been completed.

Prize Draw

15. One (1) winner (Winner) will be chosen from those entrants who have submitted a Submission in accordance with the Prize Promotion terms and conditions stated herein and the Winner will be determined through the application of the Selection Criteria.

16. The Prize Promoter will use the following selection criteria to determine the Winner: (i) execution of theme (e.g., demonstrating the concept) (40%), creativity & originality (30%); and photographic quality (30%). .

17. The Promoter's decision in this Prize Promotion is final and legally binding and no correspondence will be entered into.

Prizes

18. The Winner will receive the following prize package (Prize):

(i) 2 return scheduled economy flights from the nearest major international commercial airport to the Winner's primary residence to St. John's International Airport in Canada, departing and returning dates to be confirmed with an approximate value of US$3,000. The Prize is scheduled to be taken by the Winner in date in September 2016 but is subject to change in the Prize Promoter's sole discretion;

(ii) A booking for 2 on The Canadian Maritimes and Newfoundland (category 2) expedition with an approximate value of US$17,300 see details here: ();

(iii) All meals covered are as described here:

(iv) Car transfers to and from St. John's International Airport to the ship; and

For the avoidance of doubt it's the Winner's responsibility to ensure that the Winner, and those accompanying the Winner, have the required travel documentation i.e. passport and visa (where applicable) to enable the Winner and those accompanying him/her to take up the Prize as stated above. The winner's companions must be 18 years or over in order to accompany the Winner on the Prize.

19. The Promoter reserves the right to substitute all or any part of the Prize for one of an equivalent or greater value if necessary for reasons beyond its control, and any change will be final and binding upon every person who enters the Prize Promotion.

20. The Prize for this Prize Promotion will be given to the Winner as set out in these terms and conditions. The Winner must accept the Prize in that form. Under no circumstances will cash be given as an alternative. The Prize is non-transferable, non-negotiable and cannot be substituted for any other prize or cash value.

21. If any selected Winner is unreachable, ineligible, disqualified or fails to claim the Prize within seven (7) days of notification, that Winner automatically forfeits the Prize and a new Winner will be selected.

22. The Winner will be liable for any taxes or surcharges that may be levied on the Prize and for any expenses not expressly specified in the above description of the Prize.

23. The Promoter will not be held liable for the Prize if it does not reach the Winner for reasons beyond its reasonable control.

24. The Winner uses the Prize at their own risk. Should the Winner have any consumer queries or concerns regarding the Prize they should contact the applicable provider of that particular element of the Prize directly or a warranty provider as appropriate.

25. The Winners may be required to execute and return a completed affidavit of eligibility, liability/publicity release within seven (7) days following the notification that the entrant's submission was selected as the winning Submission. By accepting a Prize, the Winner agrees that Sponsor may, without any limitation or further compensation, use his or her name, screen name, voice and/or likeness in any and all media for the purpose of advertising and promoting the Website, the Contest, the Program or any other promotion, contest or Contest sponsored by the Promotion Entities.

26. The Promoter shall not be liable in any way for any failure, liability or breach by any third party in connection with this Prize Promotion or Prize and accepts no responsibility for any loss, property damage or personal injury suffered by the Winner relating to this Prize Promotion or the Prize, except in the case of death or personal injury caused by Promoter's negligence or fraudulent misrepresentation and, so far as permitted by law, the Promoter its associated companies and agents exclude responsibility and all liabilities arising for reasons beyond its control including any act or default of any third party supplier.

Publicity and Personal Data

27. In order to administer and manage the Prize Promotion, National Geographic Partners ("NGC", "our", "us" or "we"), the data controller, must ask you to provide us with information about yourself. By consenting to, and agreeing the terms of the Prize Promotion you expressly consent and agree to us processing your data in the manner set out herein. The personal data as describe herein is the information we collect and clearly states how we use that information. NGC takes the processing of your information very seriously and will use your information only in accordance with the terms set out herein.

28. We will not sell or rent your information to third parties for their marketing purposes without your explicit consent. However, in order for us to administer the Prize Promotion we will, in limited circumstances, share some of your information with third parties under strict restrictions, as described in more detail herein.

29. We collect the following types of personal information in order to run the Prize Promotion:

? #ExperienceCanadaContest necessary to take part in the Prize Promotion and any related content;

? Your public information on Instagram. This is the information that you have made publicly available on Instagram.

? Your information on Instagram to which you explicitly grant us access to. This includes your first and last name, your profile picture, your email address and Instagram ID.

? The number of likes, comments and shares of your Submission

30. Instagram determines in accordance with its privacy policy, which parts of your data is always publicly available and for which parts you can control the access rights for via your Instagram privacy settings. You can find more information about your Instagram privacy settings through your account/Instagram terms of use.

31. When you access the Prize Promotion using any device (whether connected wirelessly or by a fixed line or otherwise), we may additionally collect and store device sign-on data (including but not limited to device ID) and geolocation data.

32. We collect, store and process your information on servers located in the United States and elsewhere in the world where our facilities are located. Our primary purpose in collecting your information is to provide you with a safe, smooth, efficient, and customised experience. You agree that we may use your personal information to:

? Administer the Prize Promotion;

? Resolve disputes and troubleshoot problems;

? Manage risk, or to detect, prevent, and/or remediate fraud or other potentially illegal or prohibited activities;

? Provide you with customer support services;

? Improve our services by customising your user experience;

? Measure the performance and improve content and layout.

33. NGC will not sell or rent any of your personal information to third parties for their marketing purposes without your explicit consent, and will only disclose this information in the limited circumstances and for the purposes described in this Privacy Policy. This includes transfers of data to non-EEA member states. NGC is committed to adequately protecting your information regardless of where the data resides and to providing appropriate protection for your information where such data is transferred outside of the EEA.

34. For the purposes of this Prize Promotion we are working with service providers. Our contracts with these service providers dictate that these service providers only use your information in connection with and for the purpose of the Prize Promotion, based on our instructions and do not use your personal information for their own benefit.

35. NGC is committed to handling your information with high standards of information security. We use computer safeguards such as firewalls and data encryption, we enforce physical access controls to our buildings and files, and we authorise access to personal information only for those employees who require it to fulfil their job responsibilities.

36. By entering into this Prize Promotion you consent to your personal data being passed outside the EU for the purposes of processing and storing on the Promoter's servers.

37. By entering this Prize Promotion, the entrant agrees to the use of their submitted image, name and/or likeness in conjunction with the Prize Promotion without compensation, for the Promoter's promotional and marketing purposes.

Miscellaneous

38. The entrant by entering this Prize Promotion agrees to indemnify the Promoter, its agents, employees, representatives, associates, affiliates, parent and subsidiary companies against any and all claim, losses, costs, damages, liability and expenses arising out of the entrant's breach of any of these terms and conditions.

39. The entrant by entering this Prize Promotion expressly releases the Promoter, its affiliates, agents, employees and directors from any claim, action or demand arising out of or in connection with the Prize Promotion or their Prize, if any.

40. The Prize Promotion is in no way sponsored, endorsed or administered by, or otherwise associated with Instagram, Inc.

41. The laws of England and Wales govern these terms and conditions.
