In the space below, write a summary statement of what is contained within that clause.The clause you have just read is known as the Necessary and Proper Clause. It is nicknamed the Elastic Clause. It allows Congress to enact legislation that is necessary to carry out all of its other powers. For example, Congress clearly was given the power to tax. Does that then mean that Congress can create an Internal Revenue Service to collect taxes from the people? Does that allow Congress to create the United States Tax Court to punish those American who try to avoid paying their taxes? The federal courts have clearly established that Congress does have those powers that are necessary in allowing them to carry out the powers enumerated in the Constitution.
