In accordance with C.R.S. ?12-43.3-601(7) following is a report of fines issued to Medical Marijuana Business Licensees and Applications for calendar year 2011. As current statute does not require local authorities to have a Medical Marijuana Licensing Authority in place until July, 1, 2012, information from Local Medical Marijuana Licensing Authorities are not included in this report; the Division anticipates including this information in the 2012 report.

As of December 31, 2011, the Department of Revenue Medical Marijuana Enforcement Division has entered into 53 Stipulated Agreements with businesses that failed to meet the September 1, 2010, statutory deadline (C.R.S.?12-43.3-103(2 )(b)) requiring them to certify that the business was cultivating seventy percent of the Medical Marijuana necessary for its operation These agreements mandate that the business owner pay a fine for failing to meet this requirement at the time they purchase their MMED Business License. Of those 53 businesses that entered into such agreements: seven have been deemed ineligible for licensure and their business license application has been denied; six applications have been withdrawn; four of the businesses are located in Fort Collins and are under conditional or temporary withdrawal; four have been licensed and paid the fine; and 32 license applications are still pending.

No additional fines were levied against MMED business licensees or applicants in 2011, nor were any MMED Business Licenses suspended or revoked.
