Ethics Statement & Welcome

President Stan Haywood read the Ethics Statement regarding any conflicts of interest and/or appearances of conflicts of interest of any Board member. There were no conflicts noted by any Member.

President Haywood welcomed all visitors.

Minutes of July 2008 meeting

The members received the July 2008 meeting minutes prior to this meeting for review. It was moved by Mr. Chesson and seconded by Mr. Nelson to accept the Minutes as submitted. The motion passed with no dissenting votes.

Disciplinary Hearing – William Hicks RPh . License #06199

William Hicks, license #06199, accompanied by his wife Leanna Hicks, appeared before the Board to request reinstatement of his license, which the Board summarily suspended in February 2007. Abby Soles, Board counsel, proceeded with the case and stated that Mr. Hicks was referred by Pharmacist Recovery Network (PRN) to the Center for Professional Excellence (CPE) for treatment of alcohol abuse in June 2006. While at CPE, Mr. Hicks signed a PRN contract. He was discharged from CPE in August 2006. In early 2007, PRN advised the Board that Mr. Hicks was no longer complying with his PRN contract or cooperating with PRN. The Board temporarily suspended Mr. Hicks’ license in February 2007. The summary suspension ordered Mr. Hicks to report to PRN and comply with treatment instructed by PRN. Mr. Hicks did not report to PRN as ordered. A Prehearing conference was held in March 2007, presided over by Mr. McLaughlin, where there was no resolution.

After presentation of evidence and testimony from Paul Peterson, Executive Director of PRN and William Hicks, the Board moved into closed session, on a motion from Dr. Chesson and seconded by Mr. Nelson, to deliberate the matter. When the public session resumed, President Haywood

stated that on a motion from Dr. Chesson, seconded by Mr. Nelson with no dissenting votes, the Board would deny Mr. Hicks request for reinstatement and permanently revoke his license.

Consideration of Technician Application – Tiffany Hauser

Ms. Tiffany Hauser appeared before the Board in consideration of her technician application. Mr. Campbell stated that Ms. Hauser was honest on her application and admitted to a conviction for DWI in 1999 and 2001. Ms. Hauser spoke about her conviction and how it was a mistake of her youth. It was the consensus of the Board to allow Ms. Hauser to proceed with the technician application process.

Consideration of Technician Application – Lawrence Vaughn

Mr. Lawrence Vaughn, accompanied by his wife Geter Vaughn, appeared before the Board in consideration of his technician application. Mr. Campbell stated that Mr. Vaughn was honest on his application and admitted to a charge and conviction of possession of LSD in 1980. Mr. Vaughn spoke about his conviction and how he had since turn his life around. It was the consensus of the Board to allow Mr. Vaughn to proceed with the technician application process.

Request for Modification of Disciplinary Order – Theresa Lynn Ferguson

Ms. Theresa Lynn Ferguson, license #8729, appeared before the Board to request modification of her reinstatement order to allow her to work as pharmacist manager for Rite Aid pharmacy. Paul Peterson stated that PRN supports Ms. Ferguson request for modification. Helen Mahairas, Rite Aid District Manager, spoke before the Board on behalf of Ms. Ferguson request and felt she was able and prepared to fill the position of pharmacist manager. After testimony from Ms. Ferguson, Ms. Chater moved, seconded by Dr. Dennis, to grant the request for modification. The motion carried with no dissenting votes.

David R. Work, Executive Director Emeritus, Portrait presentation

The Board presented a portrait of David R. Work, Executive Director Emeritus, to Mr. Work, his family and guests. Stan Haywood, Jay Campbell and guests spoke about Mr. Work’s dedication and 30 years of service to the Board. Mr. Work thanked the Board and staff. The portrait will reside in the NCBOP Board room.

The Board adjourned for lunch at 12:00 a.m. and returned to open session at 1:30pm.

Petition to add Tracolimus (marketed as Prograf) to the NC NTI list

The Board considered the addition of tacrolimus (marketed as Prograf) to the North Carolina Narrow Therapeutic Index (NTI) list. Steve Mitchell, Astellas; Matt Harris, Duke University; Erin Fisher, registered nurse; Bob Dupais, Astellas; and David R. Work spoke to the Board on behalf of

adding Prograf to the NTI list. Andy Ellen, NACD; Dr. Arthur Straughn and Jerry Moore spoke in opposition to adding Prograf to the NTI list.

It was the consensus of the Board to take this matter under advisement and meet separately for discussion before readdressing at the November 2008 Board meeting. It was also decided that Dr. Betty Dennis and Wallace Nelson would work together for suggestions to the Board on the matter.

Reinstatement Request – Scott Savage – RPh. License #16486

Scott Savage appeared before the Board to request reinstatement of his pharmacist license. Mr. Campbell proceeded with the case and stated the Mr. Savage had surrendered his license in February 2008. Mr. Savage entered into a PRN program and completed a program at CPE. Paul Peterson, PRN, spoke on behalf of Mr. Savage and recommended the reinstatement of his license. Mr. Savage spoke before the Board on his recovery process and his desire to return to the pharmacy profession.

On a motion from Mr. Nelson, seconded by Mrs. Chater, the Board moved into closed session to deliberate the matter. When open session resumed, Mr. Haywood stated that on a motion from Mr. Nelson, seconded by Dr. Chesson with no dissenting votes, the Board would reinstate Mr. Savage’s license with conditions.

Financial Update/2009 Budget Proposal

Financial and Administrative Services Director Gail Brantley presented the financial statistics for August 2008 and the 2009 Budget Proposal. The Board approved the 2009 Budget Proposal.

Election Rule Amendment

Mr. Campbell stated that a Public Hearing was held on September 15, 2008 in consideration of proposed rule amendment to allow electronic voting for Board elections. A letter from RPh. Jimmy Jackson and a letter from the National Association of Chain Drugs in opposition to the proposed rule change were read at the Public Hearing.

On a motion from Dr. Chesson, seconded by Mr. Nelson with no dissenting votes, the Board moved to accept the changes to rule .2107 and send it forward to the Rules Review Commission.

2009 Leaders’ Forum

It was the consensus of the Board to hold the 2009 Pharmacy Leaders’ Forum on February 6, 2009 at the Proximity Hotel, Greensboro, NC with a dinner on February 5, 2008.

Investigative Statistics

Karen Matthew, Director of Investigations, presented the August and September Investigative statistics to the Board.

Citizen Advocacy Center Annual Meeting, Asheville, October 27th – 29th 2009

Mr. Campbell stated the Citizen Advocacy Center (CAC) Annual Meeting is being held in Asheville, October 27 _ 29, 2008. CAC is devoted to training public members of Boards on issues governing health care.

Consent Agenda

Following a review of the consent agenda, it was moved by Mr. Nelson, seconded by Dr. Dennis, to approve the consent agenda as presented. The motion carried with no dissenting votes. The following items were approved.

Consent Order

Mohsen Khordehforosh – RPh. License # 14518 – was subject of a prehearing conference held June 16, 2008, heard by Joey McLaughlin, regarding allegations that RPh. Khorodehforosh dispensed Fluconazole 50mg/5 ml with incorrect directions for dosage. As a result the patient received five times the prescribed amount of medication each day. Recommendation: Active 10 day suspension.
