Oil Companies Money at Work

Oil & Gas Companies Reported Lobbying for the years 1998-2004 was $343,896,623 for an average of over $49 million a year in contributions. I can imagine what 2005 report looks like! Figures based on Senate Office of Public Records filings last updated June 2005.

The top five contributors in the oil industry were for the 7 years; No.1 ExxonMobil ($59,672,742), No.2 ChevronTexaco ($32,803,755), No. 3 Marathon Oil Corp. ($29,190,000), No. 4 BP Amoco ($26,793,984) and No. 5 Shell Oil Co. ($26,608,088).

HB 101 was introduced by Irving “Irv” Slosberg District 90 Boca Raton in the Florida House of Representatives that would repeal the Motor Fuel Marketing Practices Act (Below Cost) and has been assigned to the Agriculture committee. Contact your elected state Senator and Representative and send mail, phone, fax, e mail or meet with your elected officials to oppose the repeal of the MFMPA.

Letters have been mailed to the Agriculture Committee Chair and members to oppose HB 101.

Crude Oil Prices

As crude oil prices rise, the Oil Companies increase their profits. The Oil Companies prefer a higher crude oil price that leads to windfall and record profits. They can find more excuses like rumors, innuendos, refinery maintenance, storms, refinery shutdowns with no backup or plans to compensate for shortages. There are not enough refineries to process the crude oil and there hasn’t been one built in 30 years.

The stranglehold on the public by the oil companies who are again increasing wholesale gasoline prices at an alarming rate will not stop until the public complains to their elected officials and cuts back on their driving. The consumer outcry isn’t loud enough. Conserving gasoline not only reduces the price of gasoline it also sends a message to congress for the overdue need for alternative fuels and conservation. As of 12-1-05 to 1-23-06, the wholesale gasoline prices have increased over 30 cents a gallon. Many independent gasoline retailers have absorbed some of the increases.

Supprise Supprise? One of a kind profit at ExxonMobil

Exxon Mobil Corp. posted record net profits for any U.S. company of $10.71 billion for the fourth quarter and $36.13 billion for the year 2005 from $25.3 billion in 2004 and the annual revenue grew to $371 billion for the year and just missed $300 billion in 2004 as the world's biggest publicly traded oil company benefited from high oil and gas prices and demand for refined products. The results exceeded Wall Street expectations.

ConocoPhillips Co., Surges on Oil Prices

The nation's third-largest integrated oil and gas company said its fourth-quarter profit ballooned as prices and refining margins remained strong versus a year ago.

Net profits increased to $3.68 billion, from $2.43 billion, a year ago. ConocoPhillips posted income from continuing operations of $3.78 billion, versus $2.48 billion.

Revenue surged to $50.2 billion from $40.1 billion in the year-earlier quarter.

Profit for the full year jumped to $13.53 billion, from $8.13 billion, in 2004. Full-year revenue increased to $183.4 billion from $136.9 billion in 2004.

ConocoPhillips is the third-largest integrated oil and gas company in the U.S., behind Chevron Corp. and Exxon Mobil Corp.

Maryland Looking at Price-Gouging Law

Baltimore -- State lawmakers in Maryland will decide whether to make price gouging during an emergency a crime in Maryland, an issue that hit home after gasoline prices spiked after Hurricane Katrina, reported the Baltimore Business Journal.

The exact details of the anticipated bill have yet to be determined.

That bill would have applied to sales of essential goods including food, emergency supplies, gasoline, medical supplies, heating oil and hotel rooms. It would have allowed price hikes of more than 10 percent only if a business could have proven the increase was the result of additional costs, according to the report.

New York AG Proposes Price-Gouging Threshold

Albany, N.Y.--New York State Attorney General Eliot Spitzer has submitted a bill to the Legislature that will establish a mark-up limit of 25 percent between what retailers were selling goods or services for and what they paid for them on the wholesale level, reported Albany’s The Business Review . He developed the bill while investigating suspected price gouging among service stations in New York State over the summer.

The attorney general said in the report the 25 percent mark-up threshold seemed like a reasonable one, based on his office's look at gas pricing trends and other suspected instances of price gouging.

"Spikes in prices for gasoline and home heating fuel following last year's hurricanes caused public outrage and tested the limits of the very laws enacted to protect the public from price gouging," Spitzer told the newspaper. "Abuse of the free market system by those who seek to exploit natural disasters and tragedies cannot be tolerated."

State of Emergency ends this month

The State of Emergency ends February 16th which lasted 6 ½ months. The gasoline retailers should be complemented for their unselfishness and loyal response to the public in the emergencies. I hope they will be recognized by the consumer that they appreciated their sacrifice and help during last season’s hurricanes (a BIG thank you).

Illinois Gas Stations Considering Closing in a Disaster

William Fleischli of the Illinois Petroleum Marketers Association says that way; the stations won't be accused of price gouging.

He says the stations did not benefit unduly from any price run-up that followed last summer's hurricanes Katrina and Rita.

Attorney General Lisa Madigan's office investigated allegations of gouging after both of those weather events, then accused 18 stations of price gouging. Madigan said she would not bring legal action against the stations if they each donate one-thousand dollars to the Red Cross and agreed not to gouge in the future. The stations signed the deal last week but maintain they did nothing wrong.

Why isn’t the major oil companies included in the investigation and have them donate to the Red Cross? In Florida, some oil companies raised their wholesale gasoline prices, at the Taft terminal Orlando, Citgo unbranded 97 cents and Murphy Oil Co. 84 cents in the first 2 days during hurricane Katrina.

If any of those Illinois gasoline stations challenged the investigation, attorneys’ fees would be over 10 times more to defend themselves than their donation to the Red Cross. Again it’s the little guy who can not defend themselves and being unfairly accused. Attorney General Lisa Madigan is being Judge and Jury. I think it’s cheaper to close than try to be loyal and responsible than be accused of price gouging while the oil companies increase their record breaking profits while the independent gasoline retailer is struggling. The gasoline increases were the result of the oil companies raising their wholesale gasoline prices and taking advantage of the hurricanes.

Many investigations into the retail gasoline stations

There are many state investigations by elected officials why gasoline prices are high gave the impression that the retail gasoline station was responsible. There isn’t any investigation of the major oil companies. The chief executives from the nation's five largest oil companies declined the Wisconsin governor's demand to appear at a similar hearing of U.S. Senate from Chevron, ExxonMobil, ConocoPhillips, BP America and Shell Oil about oil company high gas prices and fat profits, they sent their subordinates.

The mother of all booms

By just about any measure, the past three years have produced one of the biggest cash gushers in the oil industry’s history. Since January of 2002, the price of crude has tripled, leaving oil producers awash in profits. During that period, the top 10 major public oil companies have sold some $1.5 trillion worth of crude, pocketing more than $125 billion net profit.

“This is the mother of all booms,” said Oppenheimer & Co. oil analyst Fadel Gheit. “They have so much profit; it’s almost an embarrassment of riches. They don’t know what to do with it.

The reason for the boom is simple. Much of the investment in finding that oil and developing the wells and pipelines needed to produce it has already been made. So an oil field that was profitable with oil selling for $20 a barrel is much more profitable with oil trading around $60.

That’s left the industry with a happy problem what to do with enough cash to fill a supertanker.

BP Aims to Be Franchise Player

Warrenville, Ill. -- BP is launching a franchise offer for BP Connect and Wild Bean Café convenience store brands in U.S. retail markets east of the Rocky Mountains.

"The BP Connect and Wild Bean Café takes convenience retailing to the next level, offering great food, coffees and Amoco Ultimate premium fuel," said Polly Flinn, president of BP’s U.S. convenience retail operations.

"BP is already a successful franchisor on the West Coast," Flinn said. "As we launch our new BP Connect franchise offer that includes our Wild Bean Café, we are applying experience from our successful am/pm convenience store business, which includes nearly 1,000 locations in the western United States."

According to Flinn, the BP Connect franchise offer will first be launched in south Florida. The company also has plans for expanding the franchise program into other east of Rockies markets that will be announced at a later date.

In early February, BP will also launch , where information on the franchising program will be available.

"Our goal is to build and recruit a franchise network east of the Rockies that complements our already distinctive BP brand," said Ben Amante, BP’s vice president of franchising in the United States. "We also see an opportunity to reflect the diverse communities where we operate by finding minority business people looking to franchise in the community. We look forward to building a strong network of franchisees who will help us grow our business, delivering our products and services to more consumers."

This will be great as long as BP corporate owned and operated gasoline retail outlets do not undercut their franchise outlets by selling gasoline to the public below franchisees wholesale gasoline price and do away with zone pricing. Also a minimum 3 year franchise agreement and not a 1 year trial lease should be reflected in the contract and be sure to hire an attorney who understands the gasoline industry (Luis Konski our association attorney 305-262-4433).

The wholesale gasoline price should be the same wholesale price from the same terminal to all of the same branded gasoline stations it delivers to. (Example BP to all BP gas-stations, Shell to all Shell gas-stations and so on.)

My personal experiences with major oil companies referring to a franchise with over 34 years in the gasoline station business that the oil company leases are not negotiable with a take it or leave It policy. Every oil company has a personal guarantee from yourself and your spouse if married. Also you could not leave your business to your family because the lease has a termination clause if the franchisee died.

This is only the tip of the iceberg and there are many questions and confusing sections that have to be answered and that is why you need an experienced attorney before you invest your money.

Florida’s Proposal is for gas stations to share generators

Sharing of generators by gas stations, faster building of power plants and more use of mass transit are among several suggestions for how Florida can ensure a reliable and adequate supply of energy in the future, a state agency said Jan. 17, according to the Daytona Beach News-Journal.

While the report's focus is on ensuring a continuous, reliable energy supply, the comprehensive study of what should be done was prompted by two summers of hurricanes, which pointed out several vulnerabilities in how Florida gets fuel for its electric generation and gas for its cars, reported the Jan. 18 online edition of the News-Journal.

"The hurricanes really gave us a bit of a wake-up call when it came to our energy supply," said Colleen Castille, secretary of the Department of Environmental Protection.

Gasoline was hard to come by for several days after recent hurricanes, in some cases because of port closures that prevented supply from arriving. But in many cases there was gasoline but no power to pump it.

The DEP plan said gas stations should pool their resources and share generators based on need. That would be an alternative to more costly proposals under consideration in the Legislature requiring stations to have generators.

The panel suggested a goal of having 10 percent of Florida gas stations in such a network by June 1, and proposed trying to double that number by the beginning of the 2007 hurricane season.

Looking for a Home in Convenience Business

Atlanta -- The Home Depot, the world's largest home improvement retailer, will make a new home in the convenience store industry with four convenience store openings in the first half of 2006, with the possibility of 300 by 2010. The new initiative was announced at the company’s annual meeting with investors. Home Depot, will open the first of four gas convenience stores, called Home Depot Fuel, in the Nashville area next month, reported The Atlanta Journal-Constitution.

"Over the next five years, The Home Depot expects to maintain and grow its leadership position in home improvement retail worldwide," chairman, president and CEO Bob Nardelli proclaimed at the meeting. "At the same time, we expect to become the nation's largest diversified wholesale distributor, become number one in services and will dramatically increase our direct-to-consumer channels." The company did not respond to calls for comment.

"If Costco's doing it, and Wal-Mart's doing it, why not Home Depot?" Analyst Bill Sims with Smith Barney said. "I would think it would be a great traffic driver and more of a one-stop-shop."

OSHA DEADLINE

This is a reminder that effective on February 1, 2006 those of you who operate facilities with 10 or more employees will be required to comply with posting requirements issued by the U. S. Occupational Health and Safety Administration (OSHA). Businesses are required to post complete lists of work related injury and illness throughout the year, and that posting, must be verified by the employee with the highest rank at each individual workplace (i.e. manager, supervisor etc.). Forms and instructions for your compliance can be obtained by going to . When you get that screen click on “R” in the alphabet index at the top then click on “Record keeping”. The posting will require the proper industrial code for your type of business.

The most common codes for Convenience Food Stores and SIC code 5411 and 5541 for Convenience Food Stores with Gasoline. You could be exempt at a c-store/retail gasoline facility if your primary activity is the fuel segment. That primary activity is determined by gross receipts, so if you sell more in petroleum then in food you would be SIC code 5541 and would be exempt from the posting requirement. Your only obligation would be to report fatalities should they occur. All forms must be kept for five years. The one redeeming factor to all of this is that Florida workplace law matches the federal guidelines unlike 24 other states that have additional requirements on top of these.

Fuel dispenser is designed to deliver in-store conveniences

At the Microsoft booth at the 2006 International Consumer Electronics Show (CES) in Las Vegas, visitors can get a preview of a multi-purpose Dresser Wayne fuel dispenser.

Dan Harrell, Dresser Wayne’s senior director of marketing and product management said, “you’ll be able to stop for gas on your way to work and without ever leaving the pump buy a cup of coffee and a lottery ticket, download an MP3, and check up-to-the-minute traffic reports. The dispenser itself will be able to run a quick diagnostics report on your car, alert you when it’s time for an oil change, and even print out coupons for the lube shop down the street.”

A standard offering in the Ovation iX dispenser is iX Media, designed to allow consumers to watch full-motion, site-specific video commercials right on a dispenser-integrated 10.4-inch color display, with built-in speaker. Fuel customers can print customized coupons at the dispenser for in-store specials and other retail promotions.

E85 making entry into Q-C economy

Geneseo Illinois-- Kathy Williams remembers a bumper sticker on the back of her dad's old station wagon years ago that read, "My cornfield is your oil well."

Ms. Williams drives a flexible fuel 2000 Ford Ranger meaning it can run on regular unleaded gasoline or gasoline blends that are up to 85 percent ethanol. She usually heads to the Hometown Express on U.S. 6 in Geneseo to fill up with E85, a fuel that's 85 percent ethanol and 15 percent gasoline.

"My feeling is, we have the corn here, let's do something with it," she said. "It helps the local economy, and we're less dependent on foreign oil."

Proponents say awareness of the fuel is building slowly, but steadily.

Michelle Kautz, director of communications for the National Ethanol Vehicle Coalition of Jefferson City, Mo., said there is a major problem among consumers regarding awareness of flex-fuel vehicles.

"The problem is the education isn't out there on these flexibile-fuel vehicles," Ms. Kautz said. "Many people don't know they have them.

E85 average price is $1.74 per gallon in the Quad City area that compares to $2.29 per gallon for regular unleaded gas.

Ms. Williams said she gets about 14 miles per gallon on her Ranger with E85, compared to the 19 or 20 miles per gallon on unleaded gasoline. It takes about a 30 to 35 cents difference in price per gallon between unleaded and E85 to break even. Is your car E85 compatible? Death of Common Sense

Every once in a while I reprint this story!

Today we mourn the passing of an old friend, by the name of Common Sense. Common Sense lived a long life but died recently in the United States. No one really knows how old he was, since his birth records were long ago lost in bureaucratic red tape. He selflessly devoted his life to service in schools, hospitals, homes, factories helping folks get jobs done without fanfare and foolishness. For decades, petty rules, silly laws, and frivolous lawsuits held no power over Common Sense. He was credited with cultivating such valued lessons as to know when to come in out of the rain, why the early bird gets the worm, and that life isn't always fair.

Common Sense lived by simple, sound financial policies (don't spend more than you earn), reliable parenting strategies (the adults are in charge, not the kids), and its okay to come in second. A veteran of the Industrial Revolution, the Great Depression, and the Technological Revolution, Common Sense survived cultural and educational trends including body piercing, whole language, and "new math." But his health declined when he became infected with the "If-it-only-helps- one-person-it's-worth-it" virus.

In recent decades his waning strength proved no match for the ravages of well intentioned but overbearing regulations. He watched in pain as good people became ruled by self-seeking lawyers. His health rapidly deteriorated when schools endlessly implemented zero tolerance policies.

Reports of a six-year-old boy charged with sexual harassment for kissing a classmate, a teen suspended for taking a swig of mouthwash after lunch, and a teacher fired for reprimanding an unruly student only worsened his condition. It declined even further when schools had to get parental consent to administer aspirin to a student but could not inform the parent when a female student was pregnant or wanted an abortion.

Finally, Common Sense lost his will to live as the Ten Commandments became contraband, churches became businesses, criminals received better treatment than victims, and federal judges stuck their noses in everything from the Boy Scouts to professional sports.

Finally, when people, too stupid to realize that a steaming cup of coffee was hot, were awarded a huge settlement, Common Sense threw in the towel.

As the end neared, Common Sense drifted in and out of logic but was kept informed of developments regarding questionable regulations such as those for low flow toilets, rocking chairs, and stepladders.

Common Sense was preceded in death by his parents, Truth and Trust; his wife, Discretion; his daughter, Responsibility; and his son, Reason.

He is survived by two stepbrothers: My Rights, and Ima Whiner. Not many attended his funeral because so few realized he was gone.

Residents trying to hang onto their homes in a working-class neighborhood of New London, Conn., are waging a battle in the Supreme Court over their city government's attempt to seize property for private economic development. Susette Kelo and several other homeowners filed a lawsuit after city officials announced plans to bulldoze their residences to clear the way for a riverfront hotel, health club and offices. The residents refused to move, arguing it was an unconstitutional taking of their property.
