20 "Departmentof Health": The Orderrequiredthat all operationof the x-ray machine(s)at
21 Respondent'sdentaloffices which arelocatedat 307 West Winnie Lane,#2, CarsonCity,

6. On August25,2006, at 9:30 a.m.,at a properlynoticedmeeting,pursuantto
25 Agenda Item #4(d) the Board issuedan Order summarily suspendingRespondentfrom
26 practicingdentistryat307WestWinnie Lane,#2,CarsonCity, Nevada,89703asauthorized
27 byN.R.S.? 233B.127(3).

7, On August 29,2006, the Board's Deputy ExecutiveDirector,DebraShaffer
2 receivedcorrespondencefrom theDepartmenot f HealthindicatingtheDepartmenot f Health
3 hadlifted the its ceaseoperationOrderissuedon July 26,2006 (seeExhibit 2).

8. Basedupon the admissionscontainedin Paragraph5, without admittingthe
5 fmdingsof theDisciplinary ScreeningOfficer containedin paragraph4, Respondenatgrees
6 to the following tenDSandconditions:

A. Pursuant to NRS 631.150(d)Respondent,s dental practice shall be
placed on probation for a period of one (1) year from the adoption of
8
this Stipulation. Durin~ the one (1) year probation~ period,
Respondent shall allow eIther the Executive Director of the Board
9
and/or the agent appointed by the Executive Director of the Board to
inspect Respondent's records during nonnal business hours to insure
10
compliance of this Stipulation.

B. Respondent acknowledges during the probationary period as set forth
in Paragt;aph?A should Executive Dir.ecto~receive and finds there is
12
substantial evIdence of a subsequentvIolation of an Order to ceasex-
ray machine operations issued by the Department of Health such a
13
violation shall be considered a willful violation of NRS 631.3485( I),
thereafter, the Executive Director shall, without any further hearing or
4
action by the Board, shall issue an Order suspending Respondent's
license to practice dentistrY in the State of Nevada. Thereafter,

Respondent may request in writing a hearing before the Board to
reinstate Respondent's license. However, prior to the full Board

hearing, Respondentwaives any right to seekjudicial review, including
injunctive relief from either the Nevada Federal District Court or the
17
Nevada State District Court to reinstate his privilege to practice
dentistry in the State of Nevada pending a final Board hearing.

Pursuant to NRS 631.3 50( 1)(e), this Sti~ulation shall be deemed a

public reprimand based upon Respondent s violation ofNRS 631.349.

D. Respondent, pursuant to NRS 631.3S0(1)(j), shall retake the
21
jurisprudence test as required by NRS 631.240(2) on the contents and
interpretation of NRS 631 and the regulations of the Board.

Respondentshall haveninety (90) days,commencing upon adoption of
this Stipulation, to co~lete the re-examination. The jurisprudence
23
examination is administered on the first Monday of each month at
10:00 a.m. and 2:00 p.m. at the Board's office. Respondent shall
24
contact the Board to schedule a time to submit to the re-examination.
In the event Respondent fails to successfully complete the re-
25
examination within ninety (90) days of adoption of thIS Stipulation,
Respondent agrees his license to practice oentistry in the State of
26
Nevada shall be automatically suspendedwithout any further action of
the Board other than issuance of an order by the Executive Director.

license to practice dentis~ in the StateofNevada will be automatically
reinstated, assuming all other provisions of this Stipulation are in
2
com~liance. Respondent agreesto waive any right to seek injunctive
relief from any Federalor Stateof Nevada District Court to prevent the
3
automatic suspensionof Respondent's license to practice dentis~ in
the State of Nevada due to Respondent's failure to comply with
4
Paragraph 8D. Respondent shall also be responsible for any costs or
attorney's fees incurred in the event the Board seeks injunctive relief
5
to prevent Re~ondent from practicing dentis~ during the period
Respondent's license is automatically suspended.

E. Pursuant to NRS 631.350(1)(c), Respondent shall pay a fme to the
7
Board in the amount of One Hundred Dollars ($100.00). This amount
shall be deposited with the Board upon execution of this Stipulation.

If the Board doesnot adoptthis Stipu1ationthe amount of One Hundred
Dollars will be returned m full to Respondent.

F.
Respondentagreesto reimburse the Board for costsof the investigation
10
and to monitor this Stipulation in the amount of One Thousand Five
Hundred ($1,500.00) Dollars. This amount shall be depositedwith the
11
Board upon execution of this Stipulation. If the Board does not adopt
this Stipulation the amount of One Hundred Dollars will be returned In
12
full to Respondent.

G. In the event Respondent fails to cure any default in payment within
forty-five (45) daysof the default, Respondentagreesthe amount may
14
be reduced to judgment.

9, Respondenthas read all of the provisions containedin this Stipulation and
"7 agrees with them in their entirety.

10. Respondentis awareby enteringinto this Stipulationhe is waiving certain
19 valuabledueprocessrights containedin, but not limited to, NRS 631,NAC 631,NRS2338
20 andNAC 233B

Respondentexpresslywaives any right to challengethe Board for bias in
22 decidingwhetheror not to adoptthis Stipulationin the eventthis matterwasto proceedto
23 a full Board hearing.

12. Respondenat ndthe Boardagreeany statementsand/ordocumentationmade
2S or consideredby the Boardduring anyproperlynotice openmeetingto detenninewhether
26 to adoptor reject this Stipulationareprivilegedsettlementnegotiationsandthereforesuch

9 affiliated with the NevadaStateBoardof Dental Examiners.

16. Respondenat cknowledgestheprovisionsin this Stipulationcontaintheentire
11 agreemenbt etweenRespondenat ndtheBoardandtheprovisionsof this Stipulationcanonly
12 be modified, in writing, with Boardapproval.

17. Respondenat greesin theeventtheBoardadoptsthisStipulationherebywaives
14 anyandall rights to seekjudicial review or otherwiseto challengeor contestthevalidity of
15 the provisionscontainedin the Stipulation.

8. Respondenat ndtheBoardagreethatneitherpartyshallbedeemedthedrafter
17 of this Stipulationand,in the eventthis Stipulationis construedby a courtof law or equity,
18 suchcourt shall not construethis Stipulationor anyprovisionhereofagainsteitherparty as 19 the drafter of the Stipulation. The parties hereby acknowledgethat both partieshave 20 contributedsubstantiallyandmateriallyto the preparationof this Stipulation. Theparties 21 acknowledgeand agreethis Stipulationis thejoint effort of eachof the partiesand in the 22 eventof anydisputeregardingtheconstructionof anytennsherein,it shallnot beconstrued
23 strictly in favor or againsteitherparty.

19. Respondentspecificallyacknowledgesby his signaturehereinandhis initials
25 at the bottom of eachpageof this Stipulation, he hasreadand understandsits tenDSand
26 acknowledgesthat he has signed and initialed of his own free will and without undue
27 influence,coercion,duress,or intimidation.
