A consumercomplaint was filed with the Board on January3, 2006. The complaintwas

investigatedand it was determinedthat Dr. Kempf hadviolatedthe provisionsof Chapter

638 in that the Licensee'sconductviolated NAC 638.045(2), negligence, a departure

from the standardof practiceof veterinarymedicine,in that the Licenseefailed to usean

appropriatetechniqueof ligation during a c-sectionand ovariohysterectomy.The Board Order stated that: 1) The Licensee shall pay investigative costs to the Board in the

amount of $250.00; and 2) Take an additional three hours of continuing educationin

reproduction which must include surgery and two hours of continuing education in

critical care.

investigatedand it was determinedthat Dr. Hittenmiller had violated the provisions of

Chapter638 in that the Licensee'sconduct violated NAC 638.053,in that the Licensee

allowed unlicensedpersonnelwho were ownersof the animalto administera controlled

substanceandcloseda woundwith staples.The Board Order statedthat: 1) TheLicensee

shallpay investigativecoststo the Board in the amountof 5250.00;2) The Licenseeshall

take and passthe Nevada State Jurisprudenceexamination;3) The veterinary facility

shall be subjectto randominspectionsat stafI"s discretionand the Licensee'sexpense;

and 4) Will not allow any of his employeesto perfonn animal health tasks for which

licensureis requiredasa veterinarytechnician.
