PUBLIC NOTICE

The public is hereby noticed that the Nevada Department of Education reserves the right to take agenda items out of posted order (except that public hearings will not begin earlier than posted times); items may be pulled or removed from the agenda at any time; and items may be combined for consideration. A time for public comment is provided at the beginning and at the conclusion of the meeting. A time limit of three minutes will be imposed by the Deputy Superintendent for public comments in order to afford all members of the public who wish to comment an opportunity to do so within the timeframe available to the Board. If you are unable to attend but would like to provide a written statement for public comment, please submit your statement to acthibault@doe. by 5:00 PM the day prior to the Workshop. The Deputy Superintendent reserves the right to call on individuals from the audience or to allow for testimony at any time. All individuals providing testimony must fill out a visitor card. Reasonable efforts will be made for members of the public who have disabilities and require special accommodations or assistance at the meeting. This public notice has been posted at the offices of the Department of Education (NDE) in Carson City and Las Vegas; in the main public library in each county; in the central office of each school district; and with the State Library and Archives. AGENDA

The purpose of these workshops and public hearing is to solicit comments from interested persons on the following general topics that may be addressed in the proposed regulations. The workshops and public hearing will be conducted in accordance with the Open Meeting Law (NRS 241.020). Comments by the general public will be taken following a description of the proposed regulation changes. Public comment may be limited to 3 minutes per person at the discretion of the staff member conducting the workshops and public hearing. Members of the State Board of Education may participate.

I, Jhone Ebert, being the duly appointed Superintendent of Public Instruction of the Nevada Department of Education, do hereby certify, to the best of my knowledge or belief:

1. The proposed regulations to carry out the Read by Grade 3 Act are not likely to (a) impose a direct or significant economic burden upon a small business, or (b) directly restrict the formation, operation or expansion of a small business.

2. A concerted effort was made to determine any economic burden.

3. All relevant materials were reviewed and the Department considered its history with implementing similar regulations; the proposed changes are within the scope of the Department's activities and present no significant cost of enforcement.

4. Comment has not been solicited from small businesses, and no summary of their response is provided, because small businesses are not impacted by this regulation and thus no burden or adverse economic impact can be assessed.

The Nevada Department of Education is proposing regulation language pertaining to the Nevada Administrative Code. Workshop to Solicit Comments on Proposed Amendments to NAC Chapter 391.571 -Performance Evaluation of School-level and Probationary Administrators; and NAC Chapter 391.574 -Performance Evaluation of Teachers: Required Domains, which pertain to Regulations to Carry out the provisions of SB 475 (2019).

Proposed amendments are pursuant to the passage of SB475 during the 2019 Legislative session and are in accordance with changes made to NRS 391.465 State Board to establish statewide performance evaluation system and prescribe tools to be used by schools to measure performance; school district authorized to apply to use different performance evaluation system and tools; prohibition against evaluating certain administrators using statewide performance evaluation system.

Section 4 of SB475 revised the Student Outcomes Domain weight within the Nevada Educator Performance Framework (NEPF) from 40% to 15%. Subsequent changes to the Educational Practice Domain have been recommended by the Teachers and Leaders Council and approved by the State Board of Education.
