ZONING ORDINANCE AMENDMENT ZONING ORDINANCE No. 2021-04

MT. HALEY TOWNSHIP, MIDLAND COUNTY

The Mt. Haley Township Board adopted an ordinance to amend the Mt. Haley Township Zoning Ordinance to define and regulate the land use Primary Caregiver Operation and to address marihuana activities within the Township for the public health, safety and general welfare. This ordinance was adopted by the Mt. Haley Township Board at a meeting held on September 13, 2021 at 7:00pm at the Mt. Haley Township Hall.

Mt. Haley Township ordains: Section 1: Amendment of Chapter 2, Section 202 - Definitions. The Mt. Haley Township Zoning Ordinance, Section 202 is hereby amended to add the following definitions: 1. Reasonably Available Odor Control Technology ("RAOCT"). 2. Primary Caregiver Operation. Section 2: Amendment of Chapter 4, General Requirements. The Mt. Haley Township Zoning Ordinance, Chapter 4, General Requirements is hereby amended to add Section 409 - Generally Applicable Marihuana Regulations. Section 3: Amendment of Chapter 3, District Regulations. Section 4: Amendment of Chapter 6, Special Use Permit Requirements. Section 622 - Primary Caregiver Operation. Section 5: Severability. Section 6: Repeal. Section 7: Effective Date. This ordinance shall take effect seven days after publication of a notice of adoption of this Ordinance, unless referendum procedures are initiated under MCL 125.3402. If referendum procedures are initiated, this ordinance will take effect in accordance with MCL 1215.3402.

A copy of this ordinance may be obtained or inspected by appointment at the Township Hall located at 3012 South Homer Road, Merrill, MI 48637.
