The regular monthly meeting of the Board was called to order by the Chairman at 9:30 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

There being a quorum, the regular order of business began.

Mr. Vic Weston, Vice Chairman, led the members and audience in the Pledge of Allegiance.
Mr. Lloyd “Chip” Badeaux, new Commercial Board Member, was sworn in by Judge Darrell White.
Judge Darrell White gave the invocation and asked for a moment of silent prayer in memory of longtime AGC Executive Preston Eggers. Judge Darrell White then introduced himself, and advised those present of his duties.
A MOTION was made by Mr. Lambert and seconded by Mr. Clouatre to accept the Minutes of the December 16, 2010 regular meeting. The Motion passed.

◙ Judgment Hearing(s):
STEWART BROTHERS INDEPENDENT CONTRACTORS (CL #36270)
Administrative Hearing – Consider an alleged violation by Stewart Brothers Independent Contractors of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief that both Christopher E. Stewart and Kevin T. Stewart d/b/a Stewart Brothers Construction, and you Christopher, being a Partner, and Kevin, being a Partner and only qualifying party, for Stewart Brothers Independent Contractors, holder of commercial contractor’s license number 36270, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by both of you of the above statutes.
This alleged violation is based on the fact that you have a judgment which was rendered by the 21st Judicial District Court, No. 2005-0002349, Division “F”, Parish of Tangipahoa, State of Louisiana, on the 11th day of March, 2009, in which both Christopher E. Stewart and Kevin T. Stewart d/b/a Stewart Brothers Construction, an unlicensed contractor, were ordered to “pay in the amount of ONE HUNDRED
THIRTY FOUR THOUSAND ONE HUNDRED THIRTY TWO DOLLARS & 72/100, ($134,132.72), together with legal interest from July 11, 2005 until paid, together with attorneys fees in the amount of $5,000.00, and for all costs incurred in this proceeding in favor of Jill E. Firmin and Craig R. Firmin. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that petitioners’ rights against the remaining defendants, FRED HOLLIDAY AND ALTERNATIVE SOURCE, INC. be and the same are hereby reserved.” The order was signed in Amite, Louisiana, on the 11th day of March, 2009. The Motion for New Trial filed by Christopher E. Stewart and Kevin T. Stewart was denied by the same court as stated above. The order was signed in Amite, Louisiana, on the 24th day of May, 2010. On November 18, 2010, the Twenty-First Judicial Court, Parish of Tangipahoa, State of Louisiana, ordered that the Preliminary Injunction signed by the Court on August 3, 2009, enjoining the State Licensing Board for Contractors from taking any action on or pursuant to the Judgment of the Court dated March 11, 2009 pending further order of the Court be dissolved. This Order was signed on November 18, 2010 in Amite, Louisiana.
Ms. Kris Fitch read the allegations against STEWART BROTHERS INDEPENDENT CONTRACTORS and asked if a representative was present. Attorney Frank DiVillorio was present representing STEWART BROTHERS INDEPENDENT CONTRACTORS. Mr. Chris Stewart and Mr. Kevin Stewart were present, came to the stand, and were sworn in. Mr. Craig Firmin, Complainant, was also sworn in.
Attorney DiVillorio requested a sixty (60) day extension to address this matter further with the District Court. Attorney DiVillorio then entered the outstanding judgment and attachments in to the record. Ms. Laborde had no objections to these documents. Mr. Firmin objected to the records being entered into the record, then gave his statement.
A MOTION was made by Mr. Meredith and seconded by Mr. Gallo and Mr. Clouatre to give STEWART BROTHERS INDEPENDENT CONTRACTORS sixty (60) days to resolve the outstanding judgment with Jill and Craig Firmin. If the outstanding judgment is not resolved within sixty (60) days, Commercial License Number 36270 held STEWART BROTHERS INDEPENDENT CONTRACTORS will be immediately revoked. The Motion passed.

C&N ENTERPRISES, INC. (CL #32391)
Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 32391 held by C&N Enterprises, Inc. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against C&N ENTERPRISES, INC. and asked if a representative was present. There was no response.
A MOTION was made by Mr. Stuart and seconded by Mr. Clouatre to immediately revoke Commercial License Number 32391 held by C&N ENTERPRISES, INC. for not having a current qualifying party in place. The Motion passed.
COMARK BUILDING SYSTEMS, INC. (CL #39334)
Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 39334 held by Comark Building Systems, Inc. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against COMARK BUILDING SYSTEMS, INC. and asked if a representative was present. There was no response.
A MOTION was made by Mr. Stuart and seconded by Mr. Clouatre to immediately revoke Commercial License Number 39334 held by COMARK BUILDING SYSTEMS, INC. for not having a current qualifying party in place. The Motion passed.
Llano Utility Services, Inc. (CL #51333)
Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 51333 held by Llano Utility Services, Inc. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against Llano Utility Services, INC. and asked if a representative was present. There was no response.
A MOTION was made by Mr. Stuart and seconded by Mr. Dupuy and Mr. Clouatre to immediately revoke Commercial License Number 51333 held by Llano Utility Services, Inc. for not having a current qualifying party in place. The Motion passed.
◙ Continuance - Compliance Hearing(s):
SBL Construction, LLC (Unlicensed)
Administrative Hearing – Consider an alleged violation by SBL Construction, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, SBL Construction, LLC, acted as a contractor to perform work on the Bulkhead Project in Cut Off, Louisiana in an amount in excess of $50,000 without possessing a Louisiana State contractor’s license.
Ms. Bobbie Hughes read the allegations against SBL CONSTRUCTION, LLC then asked if a representative was present. Attorney Christopher Riviere representing SBL CONSTRUCTION, LLC was present then entered a plea of Guilty. Mr. Frank Boura, SBL Construction, was present, came to the stand and was sworn in.
Mr. Riviere reported to the Board that Mr. Boura had previously applied to the Board for a license, but became ill and was unable to complete the examination requirements. He reported that SBL did perform the work, however it was under the assumption that, as a subcontractor, he could do so under the license of OMC Construction. Mr. Boura is now aware of the regulations of the Board, and has again applied for a license. Mr. Riviere requested that this matter be deferred pending the outcome Mr. Boura’s examination, and further, upon successful attainment of his license, that this matter be dismissed.
A MOTION was made by Mr. Weston and seconded by Mr. Jones to accept the Guilty plea of SBL CONSTRUCTION, LLC. The Motion passed.
A MOTION was made by Mr. Weston and seconded by Mr. Clouatre to assess SBL CONSTRUCTION, LLC a fine of $1,000.00 plus Administrative Fees related to these proceedings. The Motion passed.
Aqua Pool Renovations, L.L.C. (Unlicensed)
Administrative Hearing – Consider an alleged violation by Aqua Pool Renovations, L.L.C. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Aqua Pool Renovations, L.L.C., acted as a contractor to perform work on the Meridian Pool Renovation project in Baton Rouge, Louisiana in an amount in excess of $50,000 without possessing a Louisiana State contractor’s license.
Ms. Bobbie Hughes read the allegations against AQUA POOL RENOVATIONS, L.L.C. then asked if a representative was present. Mr. Terry Lonatro was present, came to the stand, was sworn in, and entered a Not Guilty plea. Ms. Bobbie Hughes gave a synopsis of the allegations, stating this was the second time Aqua Pool Renovations has appeared before this Board.
Mr. Lonatro testified that the original cost of the project was below the $50,000 threshold, but because of work change orders, the cost eventually exceeded $50,000. Mr. Lonatro reported that the first appearance before this Board was in the person of Johnny Daniels, prior owner of Aqua Pool Renovators. Mr. Lonatro reported that he was not aware of an existing fine assessed to Aqua Pool Renovators, and stated that he has full intent to apply for a Louisiana State Contractor’s License, but is waiting on a financial statement from his accountant.
Ms. Laborde called Compliance Investigator, Todd Brady to the stand and he was sworn in. Ms. Laborde reviewed the exhibit packet with Mr. Brady and requested that the exhibit packet be entered in the record. Judge White accepted the exhibit packet into the record.
A MOTION was made by Mr. Meredith and seconded by Mr. Stuart to find AQUA POOL RENOVATIONS, L.L.C. Guilty. The Motion passed.
A MOTION was made by Mr. Meredith and seconded by Mr. Jones to assess AQUA POOL RENOVATIONS, L.L.C. a fine of 10% of $53,625.00 plus Administrative Fees, and a cease and desist on any advertising claiming to be a Louisiana State Contractor. The Motion passed.
Mr. Talbot requested that Mr. McDuff contact the Attorney General’s office regarding this contractor because this is Aqua Pool’s second appearance before this Board, and because of recurring citation of pool companies by this Board. With no objection, this motion passed.
THE Associated BuilderS (Unlicensed)
Administrative Hearing – Consider an alleged violation by The Associated Builders of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, The Associates Builders, acted as a contractor to perform work on the Beacon Light Baptist Church project in Houma, Louisiana in an amount in excess of $50,000 without possessing a Louisiana State contractor’s license.
Ms. Bobbie Hughes read the allegations against THE ASSOCIATED BUILDERS and asked if a representative was present. Mr. David Ashleigh was present, came to the stand, was sworn in, and entered a No Contest plea. Mr. Ashleigh reported that Associated Builders was contracted to act as a consultant on this project. He acknowledged that Associated Builders has a Mississippi License, but not a Louisiana License. Because Mississippi does not require a license for consulting, and because Louisiana has a reciprocal agreement with Mississippi, there was a mistaken assumption that a license for consulting was not required in Louisiana. Associated Builders had applied for a Louisiana License and submitted a financial statement, but because of a prior tax issue, time elapsed before a license was obtained.
Mr. Charlie Pellegrin, LSLBC Compliance Investigator came to the stand, was sworn in, and reported his findings to the Board.
A MOTION was made by Mr. Meredith and seconded by Mr. Clouatre to accept the No Contest plea of THE ASSOCIATED BUILDERS. The Motion passed.
A MOTION was made by Mr. Graham and seconded by Mr. Weston to assess THE ASSOCIATED BUILDERS a fine of 3% of $225,000.00 plus Administrative Fees related to these proceedings. The Motion passed.

Amped Electrical of Louisiana, L.L.C. (Unlicensed)
Administrative Hearing – Consider an alleged violation by Amped Electrical of Louisiana, L.L.C. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1) and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, your firm acted as a contractor to perform work at 2401 Cumberland Court in New Orleans, Louisiana, in an amount in excess of $10,000.00 without possessing a Louisiana State contractor’s license.
Ms. Bobbie Hughes read the allegations against AMPED ELECTRICAL OF LOUISIANA, L.L.C. and asked if a representative was present. There was no response. Ms. Hughes gave a brief synopsis of the allegations.
Ms. Laborde called Compliance Director, Brent Templet to the stand and he was sworn in. Ms. Laborde reviewed the exhibit packet with Mr. Templet and requested that the exhibit packet be received into the record. Judge White accepted the exhibit packet into the record.
A MOTION was made by Mr. Weston and seconded by Mr. Meredith to find AMPED ELECTRICAL OF LOUISIANA, L.L.C. Guilty. The Motion passed.
A MOTION was made by Mr. Weston and seconded by Mr. Fenet and Mr. Meredith to assess AMPED ELECTRICAL OF LOUISIANA, L.L.C. a fine of 10% of $26,705.00 plus Administrative Fees related to these proceedings. The Motion passed.
Mr. Talbot had additional questions regarding the project. Ms. Laborde reported that the home owners’ complaint indicated that they paid $19,000 and have received nothing but a slab. Mr. Talbot requested that Mr. McDuff turn this matter over to the Attorney General’s Office. With no objection, this motion passed.
Chance Construction Co. (CL #25821)
Administrative Hearing – Consider an alleged violation by Chance Construction Co. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4) and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Chance Construction Co., entered into contracts with multiple unlicensed contractors to perform work on the Wal-Mart Remodel project in Baker, Louisiana in an amount in excess of $50,000.00.
Ms. Bobbie Hughes read the allegations against CHANCE CONSTRUCTION CO. then asked if a representative was present. There was no response. Ms. Hughes gave a brief synopsis then stated that a Settlement Offer of $1000 plus Administrative Fees has been submitted by CHANCE CONSTRUCTION CO.

This hearing is being called for reason that on information and belief, your firm, acted as a contractor to perform work on the Wal-Mart Remodel project in Baker, Louisiana, in an amount in excess of $50,000 without possessing a Louisiana State contractor’s license.

COMMITTEE REPORTS:
Staff Report
Ms. Judy Dupuy stated she is working on a 2010 Annual Report, and that she is planning to have a draft for the Board to review in February.
Building Committee
No report.
Classification and Testing Committee
Mr. Weston stated Mr. Dupuy would give the Classification and Testing Committee report later in the meeting.
Legislative/Rules and Regulations Committee
This Committee has had several meetings. Ms. Kris Fitch passed out the proposed changes to the Board Rules and Regulations, then Ms. Laborde reviewed the corrections and additions with the Board Members.
A Motion was made by Mr. Lambert and seconded by Mr. Fenet, Mr. Clouatre, Mr. Weston and Mr. Stuart to thank Mr. Gallo for his work over the past fourteen (14) months on these rules changes and additions. The Motion passed.
Act 725 Committee
No report, just rule changes.
FINANCE COMMITTEE
A MOTION was made by Mr. Dupuy and seconded by Mr. Clouatre to accept the Board’s operating budget, as typed, for the month ending 12/31/2010. The Motion passed.
RESIDENTIAL BUILDING COMMITTEE
A MOTION was made by Mr. Jones and seconded by Mr. Weston to accept the actions of and approve the minutes of the January 5, 2011 meeting of the Residential Building Committee – excluding the Continuing Education matter. The Motion passed. Mr. Talbot thanked Mr. Jones for his service as Chairman of the Residential Committee. Mr. Talbot announced that, effective February, Mr. Vic Weston will serve as Chairman and Mr. Chip Badeaux will serve as Vice Chairman of the Residential Committee.
Mr. Weston took a moment to recognize the contribution of Mr. Preston Eggers to the construction industry. Mr. Eggers served 40 years as Director of the Louisiana Associated General Contractors. Through sponsoring and promotion of legislation in 1956, Mr. Eggers was instrumental in the creation and founding of this Board. Mr. Eggers was recognized for his efforts in 2006 at the celebration of the Board’s 50 year anniversary.

Paddison, Jr. to be listed as qualifying party and the application be approved pending all requirements being met. Mr. Paddison, Jr. was previously waived for the Residential Building Contractor exam and has taken as passed Business and Law and Building Construction examinations.
