County Extradition Practices

Summary 2012

This summary provides an overview of county extradition practices and based on responses to the questions below. Special thanks to Atlantic, Camden, Mercer, Monmouth, Somerset, and Passaic counties for responding to Hudson County’s survey request.

1. Does your county maintain a policy for the extradition of persons from another state? If yes, please forward the policy. If no, please answer the remaining questions.

▪ Atlantic – The Sheriff Department or County Prosecutors’ Office maintains an extradition policy that the County plans to share shortly.

▪ Camden - Uses a private company to perform extradition services and noted that it has saved a significant amount of money. The County to provide an analysis of the cost savings in 2013.

▪ Mercer - Uses a private company to perform extradition services.

▪ Monmouth - Uses certain guidelines or practices, but does not maintain a formal policy.

▪ Somerset - Does not maintain a written policy.

▪ Passaic - Maintains an extradition policy for 1st and 2nd degree cases (excluding violations of N.J.S.A. 2C:35-7) where the County permits nationwide extradition.  For 3rd degree cases, the County authorizes extradition from the surrounding states.  For 4th degree cases, extradition from New Jersey and  New York City.  For violations of probation, the County permits extradition from New Jersey and New York City. 

2. Which office or department in your county handles extraction matters?

▪ Atlantic – The Sheriff’s Office is vested with picking up persons outside the County’s jurisdiction in conjunction with the Prosecutor’s Office. Depending on the distance, the Sherriff’s Office may use an outside service selected through the bidding process.

▪ Camden – Sherriff’s Office

▪ Mercer – Sheriff’s Office

▪ Monmouth – The Fugitive Unit in the Prosecutors’ Office, which works in conjunction with the Sheriff’s Office.

▪ Somerset – The Prosecutor’s Office

▪ Passaic – The Prosecutor’s Office

3. Does your county use a travel agency to book air fair? If yes, how does your county select the agency and establish fees?

▪ Atlantic – Purchasing schedules air fare and works with a local department store since the airlines will not take our purchase orders. The County is considering the use of a “P” Card or limited use of a credit card

▪ Mercer – Uses Prison Transportation Services (PTS), a private vendor. The County bids for extradition services every three years. The Mercer County Purchasing Agent maintains bid specifications and is willing to share them with any county.

▪ Monmouth – Uses a competitive bidding process to select a travel agency.

▪ Somerset – Uses McLachlan Travel in Somerville. It is considered an extraordinary un-specifiable service and is approved by the Somerset County Purchasing Agent. 

▪ Passaic – Uses a travel agency that the New Jersey Department of Corrections has utilized for over 10 years.  The name of the agency is Vista Travel and the agency establishes the fees for the travel costs.  We also have utilized and will continue to utilize a private company to conduct fugitive transport.  The name of this company is U.S. Prisoner Transport.  This company will provide a price quote in advance of the transport. 

4. How does your county reimburse travel related expenses for the officer in charge of the extradition? 

▪ Atlantic County - Any costs associated with extraditions are handled through the Sheriff’s operational budget travel line item.

▪ Mercer – On a cost per mile basis.

▪ Monmouth - Transportation is usually handled during normal business hours - if personnel incur out-of-pocket expenses, a voucher is submitted for reimbursement.

▪ Somerset County - Prior to departure, the officer in charge of the extradition will provide a memorandum to our Administration Division outlining anticipated expenses and requesting authorization for confidential funds.  A check is provided to the officer who then cashes same and uses the money for expenses incurred on the extradition trip.  Upon the officer’s return, expenditures are documented with receipts and any excess monies are deposited in the confidential fund account.  If there is a shortfall of money, the officer uses his/her own funds and requests reimbursement through confidential funds upon return from the trip. 

▪ Passaic – As noted above, the County uses U.S. Prisoner Transport.  This company will provide a price quote in advance of the transport.  If one of our detectives does go out on an extradition, he or she can submit any receipts incurred during the extradition to be reimbursed from petty cash.
