RE: PRESERVATION BUYER RFQ
Dear Ms. LaBotz:
This letter is being submitted in connection with my application (“Application”) submitted in response to the Preservation Buyer Request for Qualifications (“RFQ”) issued by the Department of Housing Preservation and Development (“HPD”) of the City of New York (“City”).
I understand that selection as a Qualified Preservation Buyer and placement on the Qualified List under the RFQ will mean only that HPD may refer prospective sellers of property, community based organizations, and others as deemed appropriate to the Qualified List when seeking a Qualified Preservation Buyer who will purchase the property and extend any underlying affordability restrictions. I understand that Qualified Preservation Buyers appearing on the Qualified List are not guaranteed an opportunity to purchase a property.
I recognize that in becoming a Qualified Preservation Buyer my organization does not automatically qualify for the NYC Acquisition Loan Fund or the technical or financial assistance provided through the Neighborhood Pillars program. If the organization I represent is a intends to use the NYC Acquisition Loan Fund or the technical or financial assistance provided through the Neighborhood Pillars program, I will submit the necessary documentation to the appropriate organization.
I further recognize that in order to receive financing from HPD to acquire and rehabilitate a property, I must first apply to HPD and receive a soft commitment letter prior to acquiring the property.
I also confirm that:
1. HPD makes no representations whether the City will finance, or whether City funds are available or will be available to finance the rehabilitation of any buildings. In the event a Qualified Developer participates in an HPD Loan Program to finance redevelopment of a Property, any cash equity requirements of the relevant loan program will apply.
2. The City is not obligated to pay, nor will it in fact pay, any costs or losses incurred by the Qualified Preservation Buyer at any time, including, but not limited to, the cost incurred by the Qualified Preservation Buyer in acquiring property or actions to comply with requirements of HPD, the City, or any applicable laws.
