However, employees may be restricted from utilizing accrued sick leave until January 1, 2021.Amount of Sick Leave AvailableUnder the new sick leave provisions:employers with 4 or fewer employees and a net income of less than $1 million in the prior tax year must provide employees with up to 40 hours of unpaid sick leave.employers with between 5 and 99 employees and employers with?4 or fewer employees and a net income of greater than $1 million in the prior tax year must provide each employee with up to 40 hours of paid sick leave per year.employers with 100 or more employees will provide up to 56 hours of paid sick leave per year.Employees must accrue sick leave at a rate of at least 1 hour for every 30 hours worked (which is also the accrual rate set forth under the New York City Earned Safe and Sick Time Act and the Westchester County Earned Sick Leave Law).? Alternatively, employers may fulfill their obligation under the law by providing the full amount of sick leave in a lump sum at the beginning of each year.Unused sick leave carries over to the following year, though employers with fewer than 100 employees may limit the use of sick leave to 40 hours per year and employers with 100 or more employees may limit the use of sick leave to 56 hours per year.The permitted use of this leave is intended for:A mental or physical illness, injury, or health condition of, or diagnosis, care, preventive care, or treatment for, an employee or employee's family member, defined as child (including biological, adopted, foster, legal ward, or in loco parentis), spouse, domestic partner, parent (including biological, foster, step, or adoptive, legal guardian or in loco parentis), sibling, grandparent or grandchild, child or parent of spouse or domestic partner (with same definitions as child and parent).Specified reasons due to domestic violence, a family offense, sexual offense, stalking, or human trafficking regarding the employee or employee's family member.NYPSL Plan Examples(All highlighted information can be changed to fit business needs. This time can be used immediately after it has been dropped-in. Time off must be used in a minimum increment of 4 hours.The 40 hours will be dropped in every January 1st for employees to use.If the employee does not use all their sick days by year end all unused time will be carried over into the next year. Employees are limited to take a maximum of 40 hours of sick time per calendar year. Also, employees will not have additional time dropped in if they are already at the maximum number of hours. Time will be dropped in after the maximum time has started to be used.Any unused sick time will not be paid out upon a voluntary or involuntary separation of employment.Accrual Plan:EMPLOYER NAME provides all employees with 5 days (40 hours) of paid sick leave each calendar year. This time can be used immediately after it has been accrued.Time off must be used in a minimum increment of 4 hours.The 40 hours will start accruing September 30, 2020 and employees are eligible to begin using their paid sick leave benefit January, 1 2021.
