Submission of the Grant Application & Budget Documents for Individuals with Disabilities Education Act - American Rescue Plan (IDEA-ARP) Part B Section 611 and Section 619 Federal Funding for the Education of Students with Disabilities.

Application materials and budget documents (FS-10 form) for IDEA-ARP section 611 and section 619 Grants. There is defined due date as materials will be accepted on a rolling basis. The IDEA Grant Application and corresponding forms are available online along with the budget forms.

In accordance with federal rules, local educational agencies (LEAs) may not obligate funds for a proposed federal grant project until the application form and budget documents have been received by SED in a substantially approvable form (see Page 1 for definition).

Frequently Asked Questions: Individual with Disabilities Education Act - American Rescue Plan (IDEA-ARP) Funds Supplemental Grant

Part B of the Individuals with Disabilities Education Act (IDEA) authorize assistance to State Education Agencies (SEAs) to support the provision of special education and related services to children with disabilities and the provision and coordination of early intervention services for infants and toddlers with disabilities and their families, respectively. Section 2014(a) of the American Rescue Plan (ARP) Act of 2021 provided more than $3 billion in supplemental funding for state Fiscal Year 2022 for the two IDEA formula grant programs.

1. What are these funds considered?

The additional IDEA funds that have been appropriated through ARP are considered IDEA federal grants. When budgeting these funds, LEAs must apply all the same requirements that are required when budgeting traditional IDEA funds.

2. Do the IDEA-ARP funds have both a 611(Ages 3-21) and a 619 (Ages 3-5) allocation? Yes. Eligible applicants will need to submit a separate budget for each award.

3. Where can I find my allocations and explanation of how these allocations were derived?

The allocations were figured using the same methodology as the regular IDEA Part B and Preschool funds.

4. How will LEAs apply for IDEA-ARP funds?

LEAs will submit a separate funding application for the additional IDEA-ARP funds. LEAs will operate separate but parallel budgets that have the same reporting and accountability requirements for both the traditional and IDEA-ARP allocations. Each LEA must ensure that it can account for and track the use of IDEA-ARP funds.

5. What is the due date to apply for the IDEA-ARP funds? There is no deadline date to apply for these funds. The period of availability of these funds is July 1, 2021 to September 30, 2023. To allow for sufficient time for activities it is recommended that districts don't apply any later than July 1, 2022.

6. What are the allowable uses of IDEA-ARP funds? IDEA-ARP funds may be used for all allowable purposes under Part B of IDEA and are subject to all requirements and provisions that apply to IDEA funds, including requirements and provisions under IDEA, EDGAR, and the OMB Uniform Guidance.

7. With the additional IDEA-ARP funds, what are the requirements for Comprehensive Coordinated Early Intervening Services (CCEIS) and Private School Proportionate Share? The determinations for these two requirements are the same as the regular 2021-22 IDEA Grant Program. If a LEA has been determined to be significantly disproportionate it must set aside the required 15 percent from the overall allocation to address the area(s) in which they are significantly disproportionate. In addition, private school proportionate share must be reserved to serve parentally-placed private school student(s).

8. What is the period of performance for the ARP IDEA funds? Funds are available for obligation for the period of 7/1/21 to 9/30/23. All grant funds must be liquidated by 1/28/24.

9. How do the additional funds impact an LEA's Maintenance of Effort (MOE)? Under section 613(a)(2)(A)(iii) of the IDEA, an LEA may not reduce the level of expenditures for the education of children with disabilities made by the LEA from local funds below the level of those expenditures for the preceding fiscal year. LEAs will be required to demonstrate they meet MOE in the 2021-22 IDEA Funding Application prior to the ARP IDEA funding application being approved.

10. What are some considerations LEAs should use for initial planning? These are one-time funds; LEAs should plan to utilize these funds for non-recurring expenditures or activities to avoid issues with sustainability when funds expire.

An original signed Application and three original signed FS-10 Budgets. New York State Education Department (NYSED) will accept application/budget submissions on a rolling basis.

Please note: The District may not obligate funds for a proposed federal grant until the Application and Budget (FS-10) have been received by the NYSED in a substantially approvable form.

Section I. - Maintenance of Effort (MOE). This is determined from regular 2021-22 IDEA application submission. No further information is needed for this application.

Section II. - LEA Certification for the Payment of Funding to Approved Special Education Providers (ASEPs) ? Please select ONE option.

Section III. ? Comprehensive Coordinated Early Intervening Services (CCEIS) and Voluntary Coordinated Early Intervening Services (CEIS) Calculation Worksheet.

This is necessary if the LEA is required to reserve 15% for Mandatory CCEIS or has opted to use up to 15 percent of funds for CEIS (Optional CEIS). Please note that the items and costs represented on these worksheets must be reconcilable to their corresponding grants. Additional technical assistance regarding CCEIS and CEIS can be found in the IDEA Grant Application Guidance

Section IV. ? Parentally Placed Students with Disabilities Calculation Worksheet.

This is necessary if the LEA must expend a proportionate amount of its IDEA, Part B funds on special education services to students with disabilities parentally placed in nonpublic elementary and/or secondary schools in their district. Please note that the items and costs represented on the Parentally Placed Worksheets must be reconcilable to their corresponding grants.
