BOARD OF BARBERS MINUTES December 8, 2008

A meeting of the State Board of Barbers was held on Monday, December 8, 2008 in the 2nd floor conference room, the Shillman building, 500 N. Calvert Street, Baltimore, MD 21202. The following were in attendance:

Meeting Called to Order

The meeting was called to order by the Board’s President at 9:46 a.m.

Minutes

A motion was made by Mr. Crossney, and seconded by Mr. Avara, to approve the minutes from September 15, 2008 as written. The Board voted unanimously to approve.

Informal Conferences – Convictions

An informal conference was held for Mr. Dion Randall in regard to his disclosure of a previous criminal conviction on his Barber license renewal application. The Board and Senior Assistant Attorney General Bruce Spizler questioned Mr. Randall as to the events which led to the conviction and the consequences which resulted thereafter. In addition to hearing Mr. Randall's explanation of the conviction, the Board considered other factors such as the history of his other convictions and the effect of the conviction on the public and the barber industry; whereupon, the Board voted unanimously to approve the application of Mr. Randall’s Barber license renewal application.

An informal conference was held for Mr. Anthony Richardson, who submitted an application for registration as a Barber Apprentice. Mr. Richardson, who had not completed his previous 2 apprenticeships, disclosed having a criminal conviction on the application. After Mr. Richardson explained his conviction to the Board’s satisfaction, the Board voted (2 for and 2 against) on the approval of Mr. Richardson’s application to restart a new apprenticeship program. Therefore without a majority vote, the application was not approved.

Informal Conferences- Apprenticeships

An informal conference was held for Mr. Christopher Fowlkes, who submitted an application to restart the Barber Apprentice program. Mr. Fowlkes explained that his previous Master Barber never submitted the monthly reports in a timely matter; however, he did hold a Barber license in the State of New York. The Board and Senior Assistant Attorney General Bruce Spizler advised Mr. Fowlkes that, if he can provide a certification from New York’s State Board and verification of 2 years of work experience, he would qualify for the waiver of the examination requirement. The Board voted unanimously to approve Mr. Fowlkes to restart the Apprenticeship program in May if he is unsuccessful in obtaining his certification information from the State of New York.

An informal conference was held for Mr. Clarence Dixon, an Apprentice Barber who is requesting the Board to give him credit for the months in which the Master Barber who was training him failed to remit the reports to the Board staff. After Mr. Dixon supplied documentation of his recorded hours and provided a letter of explanation from the Master Barber, the Board voted unanimously to approve Mr. Dixon’s hours of training and granted him approval to take the examination.

Informal Conference- Family and Friends Barbershop

An informal conference was held for Mr. Keith Norman, owner of Family and Friends, Inc., Barbershop. Mr. Norman was directed to come before the Board as a result of an inspection by a Board inspector in which the owner was cited for sanitation violations and having a Barber working for compensation without a license posted. After a lengthy discussion, the Board counseled Mr. Norman on proper sanitation and that licenses are posted at all stations at all times.

Informal Conference – Lacey Smith

Although not originally scheduled to appear before the Board and not listed as an item on the agenda, Ms. Lacey Smith, a candidate applying to take the Barber Board exam requested an appearance before the Board, together with her father, Ed Smith. Board member Lawrence Avara recused himself from considering this matter as Ms. Smith had been a student at the barber school operated by Mr. Avara. In light of an unspecified disability, Ms. Smith is requesting special accommodations in trying to pass the theory portion of the exam. Ms. Smith advised that she has taken the theory exam 9 times but has been unable to get a passing score. Mr. Smith provided documentation regarding certain difficulties. Board counsel Bruce Spizler advised that the Board has statutory ability to authorize an applicant with a reading impairment to utilize a “reader” during the Theory exam (BOP Ant., §4-304 (f)) as well allowing the applicant additional time and taking the exam in a private room. Ms. Smith acknowledged that she has requested in the past the additional time, but has never requested a reader. The Board unanimously decided to authorize Ms. Smith the additional time, as well as a reader, for the theory portion of the exam. The Board further advised that, in the event Ms. Smith is still unable to get a passing score, it would be willing to work with all involved to seek other recourses.

Formal Hearing – BARB090015 – Deno Kanaras

The Board conducted a formal hearing regarding an applicant who marked “yes” on his application regarding a felony conviction. The applicant appeared without legal counsel and expressly waived his right to have counsel present. Eric London, Assistant Attorney General, presented the case. After taking testimony and evidence, and conducting deliberations, the Board approved granting a barber license to the individual.

There being no further business the meeting adjourned at 1:00 p.m.
